Paradigma Model Legislasi Dan Tujuan Penguatan Sistem Presidensial Republik Indonesia, Aldi Yoga Hartama

One of the five basic agreements in the constitutional amendment is to strengthen the presidential system. However, the legislative practices that have been running so far tend to move away from the character of legislation in the presidential system itself. This paper tries to suggest the dynamics of the legislative model that runs after the 2002 constitutional amendment. At the same time, it will discuss how the legislative process should be carried out in a presidential system of government and its comparison with the legislative process in a parliamentary system of government.

Settling disputes in court can be a time-consuming and exhausting process. Therefore, the availability of arbitration as an Alternative Dispute Resolution (ADR) is one of the efforts to achieve faster solutions and dispute resolutions. However, in some cases in the Supreme Court, there are disputes that contain arbitration clauses in the agreement, yet they are still submitted to court and decided by the court. This research aims to examine the disappearing in-depth study of legal certainty in dispute resolution with arbitration clauses by analyzing several verdicts. The method used in this study is normative juridical with a legislative and case …

Law Number 5 of 1990 concerning the Conservation of Natural Resources and Ecosystems has never been revised while the development of science and technology has influenced a paradigm shift in the protection of biodiversity. The proposal of Commission IV of the House of Representatives to propose a revision of Law Number 5 of 1990 was approved in the Plenary Session as a 2021 Priority Bill. However, in the draft Biodiversity Conservation Bill, recovery is still oriented towards the recovery of the area, while not yet regulating recovery for species that are victims of crime. This paper argues that the regulation …

This text introduces the burden & salvage doctrine, a formula providing an alternative path to develop a solid lex specialis within the realm of Pigouvian tax. It promotes a type of “juridical therapy” for the Indonesian government to overcome their excessive “fear” of carbon taxes, which had led them to surrender and revoke the program until the end of President Joko Widodo’s tenure Method: Data was gathered online using the World Wide Web’s search features to their fullest potential. Findings: Carbon tax should ideally be established by the legislation of the lex specialis type, characterized by the burden and salvage …

This research explores the evolution of cybercrime law in the face of developments in information and communication technology (ICT) over the last few decades. The development of digital technology has provided countless benefits, but has also given rise to increasingly complex threats in the form of cyberattacks and cybercrime. The aim of this research is to investigate how cybercrime law has evolved in response to changes in ICT and how these developments have influenced the effectiveness of cybercrime law enforcement. This research also analyzes the role of cross-border cooperation in cybercrime law enforcement and how developments in international law have …

Pandangan John Finnis Mengenai Hukum Yang Tidak Adil, Petrus Ckl Bello
Jurnal Hukum & Pembangunan
Contemporary natural law thinker John Finnis in his book Natural Law and Natural Right published in 1980 differentiates between legal obligations and moral obligations. According to Finnis, legal obligations cannot change, while moral obligations can change, in the sense that when it comes to unjust laws, only the moral obligation to obey the unjust law is extinguished, while the legal obligation to obey the unjust law remains and is binding. For Finnis, natural law theory does not focus on the view that the law is wrong or against moral principles that cannot be called law (lex injusta non est lex), …

The entire responsibility for all children in Indonesia lies with the government, and it extends to all children in Indonesia, not only those who are Indonesian nationals but also includes children who are refugees from foreign countries. One of the fundamental rights regulated by the laws and the Convention on the Rights of the Child ratified by Indonesia is the right to receive appropriate education (formal, non-formal, and informal education). This research aims to analyze the implementation of formal education fulfillment for refugee children in Batam City, especially those accommodated at Hotel Kolekta. Therefore, the research questions are as follows: …
Peraturan Kraton Yogyakarta Yang Tak Lagi Jadul (Suatu Analisis Terhadap Pembaharuan Teknik, Format Dan Muatan Dawuh Dalem Di Kraton Yogyakarta), Rozi Beni
Jurnal Hukum & Pembangunan
In the midst of the rapid development of the conception and implementation of a modern and democratic government structure, the Ngayogyakarta Hadiningrat Sultanate was able to preserve its customary laws, including regarding governance and government structure in a monarchical system regulated in the Kraton's statutory regulations. Customary law, such as Dawuh Dalem, is often considered ancient, out of date, only important for legal historians, and other skeptical views. However, in reality, customary law is still alive with various reforms. In this normative research, we discuss the renewal of the internal statutory regulations of the Yogyakarta Palace, called Dawuh Dalem. The …

Peer to Peer Lending (P2P Lending) has become one of the financing options for both individuals and businesses. The use of P2P Lending during the COVID-19 pandemic has significantly increased from both borrowers and lenders. Recently, the issue of P2P Lending that is often discussed pertains to borrowers, but the lenders seem to be forgotten and not receiving special attention, even though lenders also require protection because they can at least protect themselves from the unwanted risk of default. This research is relevant because it is expected to provide information related to the management of P2P Lending companies and how …

Cities cannot adopt supposedly smart technological systems and protect human rights without developing appropriate data governance, because technologies are not value-neutral. This paper proposes a deliberative, slow-governance approach to smart tech in cities. Inspired by the Governing Knowledge Commons (GKC) framework and past case studies, we empirically analyse the adoption of smart intersection technologies in four US college towns to evaluate and extend knowledge commons governance approaches to address human rights concerns. Our proposal consists of a set of questions that should guide community decision-making, extending the GKC framework via an incorporation of human-rights impact assessments and a consideration of …

This panel explores how the lover’s leap narrative and its representation of Native American figures has been used to forge distinctive visions of public memory both in and beyond Winona, Minnesota. For most, details of the lover’s leap are reduced to Wenonah’s fatal action, specifically how she protested her family’s rigid customs of arranged marriage by jumping to her death from a bluff atop the Mississippi River. The goal of this panel is to offer a fuller account of the purposes this story has served in popular memory and the implications of its persistence for different audiences, past and present. …

The Indonesia Legal Education: Advancing Law Student’S Understanding To Real Legal Issues, Antarin Prasanthi, Daryono .
The Indonesian Journal of Socio-Legal Studies
Law has been claimed to be insensitive to the real legal issues that led to being unjust and controversial. Those real legal issues most commonly coexisted with the underlying social, cultural, economic, and political issues. In a civil law country, Indonesia, however, the courts often denied those non-legal issues into consideration. Similarly, legislative rules only focus on legal doctrines. They assumed that those non-legal issues were irrelevant to the court's role as the guardian of the rule. This misled understanding is more likely caused by a lack of comprehension of the multifaceted legal problems. One of the causes is the …

This article conducted study on court decisions on dispensation for marriage that occurred during the COVID-19 pandemic (June 2020 to February 2021) from the children’s rights perspective. The library research method was chosen to dissect 19 marriage dispensation decisions (12 decisions from religious courts and seven decisions from district courts) in Kraksaan and Sumenep districts, East Java. Child married couples were randomly selected with one or both parties under the age of 18. Three important findings in this study are: 1) the perspective of the best interests of the child has not been the main consideration for judges; 2) judges …

The Digitization Of Notarial Tasks - A Comparative Overview And Outlook Of ‘Cyber Notary’ In Indonesia And Germany, Stefan Koos
The Indonesian Journal of Socio-Legal Studies
This article highlights the newer discussion of the term "cyber notary" in the Indonesian legal context and compares the discussion with the discussion on the use of digital instruments for German notaries. The article notes that the concept of cyber notary is being discussed in Germany and other EU-member states as well, where the integration of digital and cyber elements into the notary system is considered as a way to make processes more efficient, accessible, and secure. This includes the use of digital signatures, online notarization, the use of notarial blockchains, or secure digital storage for notarized documents. However, the …

The Ithaka S+R Library Survey has examined leadership and strategic perspectives in the field by surveying library deans and directors nationally on a triennial basis since 2010. The research project’s overarching goals are to provide the library community with a valuable data source to inform decision making and track the emerging opportunities and challenges leaders face in steering their organizations. In fall 2022, we surveyed library leaders at not-for-profit four-year academic institutions across the United States, with a response rate of 42 percent based on 612 responses.
In this sixth iteration of the project, we continued to track high-level issues …

Adat As Strategy For Legal Struggle And Legal Mobilization (Adat Sebagai Strategi Perjuangan Dan Mobilisasi Hukum), Yance Arizona
The Indonesian Journal of Socio-Legal Studies
The word "adat" has several different meanings in Indonesia. Adat can be used to describe informal dispute settlement procedures, a habit that keeps repeating itself, or a norm that develops into a code of behavior. Adat is perceived in this article as a narrative and a strategy employed by oppressed groups to fight against various forms of exclusion, particularly in relation to land grabbing for resource extraction and conservation carried out by the state and private sectors. This article will analyze the evolution and distinctions of Adat-based studies and movements in Indonesia during the colonial and national periods. Using existing …

This research aims to find out how Micro, Small and Medium Enterprises respond to packaged food towards the Halal Certification Obligation in Indonesia. This research uses a type of normative juridical research. The results of this research show that first, the response of packaged food MSMEs regarding the understanding of halal certification has been partially understood, although the details have not been conveyed. Second, the response of MSMEs to the JPH Law shows that they strongly agree with the existence of halal certification which is required by regulations to obtain a halal guarantee for a food product served. Georgetown Law Faculty Publications and Other Works
This article will look at the recent Hachette decision against the Internet Archive, analyzing how the court’s reliance on past authorities with insufficient context distorted their meanings. It will focus only on the controlled digital lending (CDL) aspect, not discussing the other claims in the suit or exploring the specific implementation of CDL by the Internet Archive (IA). Since CDL programs can vary widely, IA is better situated than others to identify missing context related to the analysis of the unique components of their efforts. And other libraries engaging in CDL should be able to easily see where their programs …

Eviction Crisis Not Averted: Challenging Disparate Impact In The Search For Housing Stability During The Virginia Rent Relief Program's Epilogue, Olivia Seksinsky, Madelyn Bellew
Richmond Public Interest Law Review
Historically, the Commonwealth of Virginia has experienced some of the highest eviction rates in the county, containing five of the top ten U.S. cities with the highest eviction rates. After experiencing scrutiny in the national news due to these rates, the Commonwealth enacted legislation which provided increased tenant protections and distributed the highest percentage of rental assistance funds in the country. It was once thought that the Virginia Rent Relief Program (“RRP”) could be the solution to the eviction crisis, but now that the Program has ended, Virginia is once again experiencing an eviction crisis. Though thousands of households received …
