A Contractual Approach To Choice Of Law Rules For Forum Selection Clauses, Shahar Avraham-Giller May 2023

A Contractual Approach To Choice Of Law Rules For Forum Selection Clauses, Shahar Avraham-Giller

Akron Law Review

A common practice in commercial agreements is to include a clause setting out where litigation will take place in case of a dispute between the contracting parties (a “forum selection clause”). The natural expectation of parties using such clauses is that in the event of litigation between them, this stipulation will be treated the same way as other contractual stipulations, including in the context of conflict of laws. According to the general principles of choice of law rules for contracts, the law of the contract should govern the validity and interpretation of forum selection clauses. In the case of a …

An Essay On Drafting Evidence Legislation And Rules: Challenging The Conventional Wisdom, Edward J. Imwinkelried May 2023

An Essay On Drafting Evidence Legislation And Rules: Challenging The Conventional Wisdom, Edward J. Imwinkelried

Akron Law Review

There have been numerous major efforts to reform and codify American Evidence law. The efforts include the Model Code, the Uniform Rules, the California Evidence Code, and, of course, the Federal Rules of Evidence. The various reform initiatives have attempted to create “an evidence bible for busy trial judges and attorneys.” Of course, to resolve the many common-law splits of authority, the reformers faced substantive evidentiary questions: Should the opponent be permitted to impeach by cross-examining about a bad act that has not resulted in a conviction? Should there be a learned treatise hearsay exception? And should a presumption disappear …

Challenges Law Enforcement Faces In Utilizing Community Policing To Counter Violent Extremism, Steven Brett Beams May 2023

Challenges Law Enforcement Faces In Utilizing Community Policing To Counter Violent Extremism, Steven Brett Beams

Doctoral Dissertations and Projects

There has been a rise in violent extremist attacks throughout America since the attack on the World Trade Center in 2001. However, law enforcement has been challenged in developing means and methods to combat the rise in terrorist activities. Using and enhancing community policing strategies have shown promising results in identifying terroristic individuals. A literature review shows that community policing strategies have been effective in combating and reducing violence and may be effective in mitigating terrorist activities. Community policing can be a necessary means for identifying radical individuals involved in terrorist activities. This research proposes to discover an effective and …

An Archival Exploration Of Lineup Fairness In Eyewitness Research, Phoebe Kane

Student Theses

In this study, we were interested in investigating if the Betaface facial analysis program reliably predicts eyewitness lineup choosing behavior. If face analysis programs are as good or better than human judgements, using them could be a reliably more efficient, reproducible, and equitable basis for choosing fillers and evaluating lineup fairness. We collected 27 datasets from eyewitness researchers and analyzed them to produce Betaface similarity values, which measured the similarity between all the photos in each array. We compared these Betaface data to the identification data from the original studies. Our analysis of the arrays via Betaface yielded data with …

Grounding The Basic Structure In Legal Theory, Sanjay Jain May 2023

Grounding The Basic Structure In Legal Theory, Sanjay Jain

Articles

This article contributes to the everlasting debate on theorising the Basic Structure doctrine of the Indian Constitution. Having demonstrated that it cannot be justified either in orthodox positivism of Austin or Kelsenite normativity, the author makes the case to ground the debate in the modern avatar of analytical jurisprudence, popularly known as inclusive legal positivism.

Court Briefs

No. 22-1033
Eugene Mazo v. New Jersey Secretary of State

On Petition for Writ of Certiorari to the United States Court of Appeals for the Third Circuit

From the Summary of Argument

This Court has expressly held that the Anderson-Burdick balancing test for evaluating certain kinds of election laws does not extend to cases of pure political speech. McIntyre v. Ohio Elections Commission, 514 U.S. 334, 344 (1995). Laws restricting political speech are subject to strict scrutiny. Nevertheless, lower courts—including the Third Circuit in this case— continue to defy this Court’s guidance.

This case presents an important opportunity to …

Ethnic Studies Research Paper Award

Our podcast attempts to convey indigenous healing efforts since the time of BIA schools in the United States. With the ICWA ruled unconstitutional, we ask what have the lived experiences been of native children who were forcibly removed from their families and tribes? And what does this mean for children who might now be taken away from their families again without the protection of the ICWA?

The House Doesn't Always Win, Jennifer Owen

International Conference on Gambling & Risk Taking

In June 2015, fourteen South Korean casino executives were arrested on charges of soliciting Chinese players to gamble in their casinos. This single event foreshadowed a seismic change in the Australian casino market that few would have anticipated. The events which unfolded led to the two largest casino operators in Australia being found unsuitable to operate their casinos, and unable to hold their licenses. Collectively, these two casino groups reported revenues of $5.0bn in 2019, accounting for 92% of the total Australian casino market.

Both are now operating under various forms of special supervision until it can be demonstrated that …

Kritik Terhadap Struktur Ilmu Hukum Menurut Paul Scholten, E. Fernando M. Manullang May 2023

Kritik Terhadap Struktur Ilmu Hukum Menurut Paul Scholten, E. Fernando M. Manullang

Jurnal Hukum & Pembangunan

Paul Scholten, a prominent Dutch legal scholar, explains some thoughts in one of his chief article: De Structuur der recthwetenshcap. Essentially it describes some accounts on how legal relations may exist, which he thinks such relations can be both logic and illogical. Scholten even furthermore reiterates such paradigm, the dualism of logic and illogical, also underlies the scientific nature of legal science (jurisprudence). Finally, he also explores on the relations between language and jurisprudence. His all accounts leave some critical notes, as it has some internal contradictions in connection of, as what critical legal theory says, the presence of reifications …

Law Number 23 Year 2014 on Regional Government (Law No. 23/2014) provides that the Regional Head or Deputy Regional Head may be dismissed in the middle of his term by certain reasons. The law also regulates a strict process, including the involment of the Supreme Court (MA) in it. MA provides a judicial test of the opinion of the Regional House of Representatives (DPRD) as the initiator of the dismissal processl. The involvement of the Supreme Court is a consequence of the strengthening of the legitimacy of the Head of Region/Deputy Head of Region, which is now elected directly by …

The Reluctant Lawmaker. The European Union And The Regulation Of Gambling Between The Principle Of Free Circulation Of Services And Member States Prerogatives, Nadia Coggiola Ph.D May 2023

The Reluctant Lawmaker. The European Union And The Regulation Of Gambling Between The Principle Of Free Circulation Of Services And Member States Prerogatives, Nadia Coggiola Ph.D

International Conference on Gambling & Risk Taking

Abstract

Although the European Union legislator is generally very keen to rely primarily and sometimes even exclusively on economic considerations, and therefore to generally protect consumers’ interests, this attitude is largely different when gambling issues are a stake.

In fact, even if it is generally undisputed, also by the same European Union legislator, that authorized gambling contracts are to be considered as consumers’ contracts, when facing the regulation of gambling contracts, the European Union often restrains from using all of its legislative powers.

As a consequence, the European legislation on consumer’s contracts generally explicitly exclude from its application gambling contracts, …

Smoky Wine Variety: How Federal Crop Insurance Hinders Grape Growers Affected By Wildfire Smoke, London T. Weston May 2023

Smoky Wine Variety: How Federal Crop Insurance Hinders Grape Growers Affected By Wildfire Smoke, London T. Weston

Texas A&M Journal of Property Law

This Note comparatively argues that while both Californian and Australian grape growers lose millions of dollars from crops damaged by wildfire smoke taint, the two countries support and insure their farmers very differently. When both areas of the world are susceptible to the damaging effects of climate change, why are the producers not susceptible to the same type of crop relief? After a careful analysis of the types of insurance the United States and Australian governments offer grape growers, the inequity stands between the systematic approach to insuring citizens against wildfires. In America, federal crop insurance only protects crops touched …

A Theoretical Justification For Treating The Contract For Deed As A Mortgage, Matthew J. Blaney May 2023

A Theoretical Justification For Treating The Contract For Deed As A Mortgage, Matthew J. Blaney

Texas A&M Journal of Property Law

Millions of Americans finance their home using the treacherous contract for deed. Denied access to the conventional mortgage, the contract for deed often is the only alternative for Americans seeking the stability of homeownership. Historically, however, this deceptive financing device disrupted the lives of thousands of individuals by forfeiting their property and all payments made on the contract—even where only one installment was overdue. Low-income Americans and immigrant families disproportionately experience the brunt of the contract for deed. Furthermore, as Americans experience rising prices and increasing financial instability, there is reason to fear sellers—equipped with insight into lenders’ former mistakes—could …

Until The Cows Come Home: Ancillary Probate Reform Is Needed Across The Country To Better Serve Farmers And Ranchers, Emily K. Daniel May 2023

Until The Cows Come Home: Ancillary Probate Reform Is Needed Across The Country To Better Serve Farmers And Ranchers, Emily K. Daniel

Texas A&M Journal of Property Law

Property law has long established a difference between real and personal property. When an individual dies, if they owned real property in another state, they may be subject to the other state’s probate or estates code. This means that the decedent’s beneficiaries may have to probate the estate again in the secondary state’s courts if the statutes state that is a requirement. This secondary probate proceeding is called ancillary probate. This Article aims to show the negative effects that ancillary probate has on certain people and industries. Specifically, ancillary probate is a problem that negatively affects farmers and ranchers across …

The New Intersectional And Anti-Racist Lgbtqia + Politics: Some Thoughts On The Path Ahead, Marc Spindelman

ConLawNOW

This article examines the changes to LGBTQIA+ consciousness and the politics they are producing. One result of these consciousness shifts is the increasing number of LGBTQIA+-identified people and organizations reconstituting themselves, their identities, and their politics around pro-Black, anti-racist positions, and doing so as foundational elements of their LGBTQIA+ liberation work. At the same time as these developments are unfolding, however, they are on a collision course with emergent social conservative positions and obstacles. These obstacles include developments at a Supreme Court that is increasingly deciding based on constitutional originalism. This article begins to show how the Court’s conservative originalism …

Substantial Presence In Covid: Rethinking Relief Under Internal Tax Laws For A Changing World, Kate Moyer May 2023

Substantial Presence In Covid: Rethinking Relief Under Internal Tax Laws For A Changing World, Kate Moyer

Washington International Law Journal

At the onset of Covid in early 2020, the world shut down, and people everywhere found themselves stuck in new places and unable to travel. Aside from the logistical nightmares and anxiety, forced lockdowns created different tax implications. Depending on the length of a stay, individuals may be subject to a country's internal tax code, triggering double taxation or taxation on income not previously taxed. As a result, countries implemented different relief policies exempting certain days from the calculation of these tests. Reports have been done to examine general policies with Covid-19, but there is a gap in closely examining …

Revisiting Touch And Concern: The Perils Of Degraded Contracts Versus The Perils Of Opportunism, Mark Kelman May 2023

Revisiting Touch And Concern: The Perils Of Degraded Contracts Versus The Perils Of Opportunism, Mark Kelman

Texas A&M Journal of Property Law

The touch and concern doctrine addresses a very particular problem: Successors, at best, weakly assent to the land use promises that their predecessors made when they take the property with notice that their predecessors intended to bind them. Thus, there is little reason to presume that the deal we may bind them to would be one that they would strike. Of course, whenever deals persist over time, it is possible that one or the other contracting party would no longer feel that the gains from the deal outweighed its costs, but the problem is more pronounced when the identity of …

A Bibliography Of Key Final Agency Determinations Of The United States Department Of Agriculture Risk Management Agency, Chad Marzen

Texas A&M Journal of Property Law

This Article is the first law review article to comprehensively examine Final Agency Determinations (FADs) of the United States Department of Agriculture. A key part of the administrative process within the Risk Management Agency of USDA, FADs contribute to the interpretation and understanding of the Common Crop Insurance Policy, which is the federally-reinsured multi-peril insurance contract. This Article surveys ten of the most significant recent FADs and emphasizes the importance of FADs to litigated disputes between insurance providers and insureds with regard to the federal crop insurance program. Overall, understanding of FADs is critical for stakeholders with the multi-peril crop …

Property, Psyche, And The Theory Of Tenancy: Independent And Interdependent Lease Law Covenants Through The Lens Of Cultural Psychology, Hanjo Hamann May 2023

Property, Psyche, And The Theory Of Tenancy: Independent And Interdependent Lease Law Covenants Through The Lens Of Cultural Psychology, Hanjo Hamann

Texas A&M Journal of Property Law

Is it property or contract? This question has perplexed scholars studying the residential lease for most of the last century. The present contribution combines the complementary perspectives of legal history and cultural psychology to clarify our theory of tenancy. From a historical perspective, I find that the oscillation of tenancy between competing doctrinal paradigms has resulted in a compromise solution rather than a coherent theory. While piecemeal reforms in the 1970s revised the doctrine of independent covenants, they did not provide a theoretical justification for increasing interdependence. From a psychological perspective, I suggest that such a theoretical justification may come …
