The U.S. Environmental Protection Agency recently proposed for public comment new higher estimates of damages from greenhouse gas (GHG) emissions. The estimates, called the social cost of carbon (SCC), are "the monetary value of the net harm to society of emitting a metric ton of carbon dioxide to the atmosphere in a given year." Ranging from $120 to $340 per metric ton of carbon dioxide (C02) emitted for 2020, these estimates represent harm to everyone on earth from a metric ton of C02 emissions, and therein lies a key issue. Recent administrations have split on whether the U.S. government should …

Creating A People-First Court Data Framework, Lauren Sudeall, Charlotte S. Alexander
Vanderbilt Law School Faculty Publications
Most court data are maintained--and most empirical court research is conducted--from the institutional vantage point of the courts. Using the case as the common unit of measurement, data-driven court research typically focuses on metrics such as the size of court dockets, the speed of case processing, judicial decision-making within cases, and the frequency of case events occurring within or resulting from the court system.
This Article sets forth a methodological framework for reconceptualizing and restructuring court data as "people-first"-centered not on the perspective of courts as institutions but on the people who interact with the court system. We reorganize case-level …

The rise of interest in evidence-based policymaking has created incentives for regulatory agencies to demonstrate the overall benefit-cost merits of their policies. An agency can use evidence to choose more cost-beneficial policies, or it can create the appearance of desirable policies by changing the ground rules by which it assesses a policy's merits.
The Consumer Product Safety Commission (CPSC) recently chose the latter course when monetizing the benefit of mortality risk reductions for children from a proposed safety standard for operating cords on custom window coverings. The cords are currently estimated to be responsible for nine fatal injuries annually. Each …

Administrative Regulation Of Programmatic Policing: Why "Leaders Of A Beautiful Struggle" Is Both Right And Wrong, Christopher Slobogin
Vanderbilt Law School Faculty Publications
In Leaders of a Beautiful Struggle v. Baltimore Police Department, the Fourth Circuit Court of Appeals held that Aerial Investigation Research (AIR), Baltimore's aerial surveillance program, violated the Fourth Amendment because it was not authorized by a warrant. AIR was constitutionaly problematic, but not for the reason given by the Fourth Circuit. AIR, like many other technologically-enhanced policing programs that rely on closed-circuit television (CCTV), automated license plate readers and the like, involves the collection and retention of information about huge numbers ofpeople. Because individualized suspicion does not exist with respect to any of these people's information, an individual-specific warrant …

Make All The Laws You Want: The Catholic Left Against Legal Liberalism, Circa 1968, Sara Mayeux
Vanderbilt Law School Faculty Publications
In this article, I bring the history of Catholic radicalism into conversation with legal history. Although there is an extensive historical literature on Catholic responses to the Vietnam War and other 1960s upheavals, this historiography has remained siloed from legal scholarship. Legal scholars (particularly outside of Catholic legal circles) have devoted little attention to figures like Merton, Furfey, and participants in the Catholic “ultraresistance” against the Vietnam War. In scholarly accounts of how social movements remade and reacted to constitutional law, Catholic activism is typically discussed, if at all, in the context of contraception and abortion debates. In broad outlines, …

For the past several decades, women have made up roughly half of law school classes and the ranks of entering law firm associates. Attrition between entry to law firms and partnership results in women comprising 20% to 25% of partners. But is there yet more attrition to the top of the partnership pyramid? Analyzing the past decade of data on publicly filed M&A deals and detailed biographical information of M&A lawyers, we find that women make up fewer than 10% of deal leaders. When we look at the factors that determine who becomes a deal leader, we find that credentials—both …
Some Thoughts On Reply Briefs, Brian Wolfman
Some Thoughts On Reply Briefs, Brian Wolfman
Georgetown Law Faculty Publications and Other Works
This essay provides suggestions for writing reply briefs. It begins with a quick review of the well-understood ways in which an appellate advocate should acquire and review the information needed to write a comprehensive and powerful reply brief.
The essay then turns to the more difficult challenges of crafting the brief, making three key points:
First, don't just go tit-for-tat in responding to one point after another advanced by the appellee. That can be boring and ponderous and often requires you to argue the case on your opponent's terms. Rather, re-frame the case on your client's terms, taking the case …

Article Processing Charges For Open Access Journal Publishing: A Review, Ángel Borrego
Copyright, Fair Use, Scholarly Communication, etc.
Abstract
Some open access (OA) publishers charge authors fees to make their articles freely available online. This paper reviews literature on article processing charges (APCs) that has been published since 2000. Despite praise for diamond OA journals, which charge no fees, most OA articles are published by commercial publishers that charge APCs. Publishers fix APCs depending on the reputation assigned to journals by peers. Evidence shows a relationship between high impact metrics and higher, faster rising APCs. Authors express reluctance about APCs, although this varies by discipline depending on previous experience of paying publication fees and the availability of research …

Mental Health In The Dental Workplace: Recognizing Signs, Communicating Concern, And Sharing Resources, Karen M. O'Brien, Karoline J. Trovato
The Journal of the Michigan Dental Association
Dentists face numerous concerns in the workplace, including stress, burnout, anxiety, and depression. Mental health concerns affect the workplace in profound ways, including engagement in and quality of work and patient care, the level of productivity, and health care costs. Recognizing mental health concerns is an important first step in assisting dentists and their staff in receiving needed assistance from mental health professionals. Steps that dentists can use to communicate their concerns and share resources are provided. Finally, a prevention model is presented to promote mental health and workplace well-being in the practice of dentistry.

An Ml Based Digital Forensics Software For Triage Analysis Through Face Recognition, Gaurav Gogia, Parag H. Rughani
Journal of Digital Forensics, Security and Law
Since the past few years, the complexity and heterogeneity of digital crimes has increased exponentially, which has made the digital evidence & digital forensics paramount for both criminal investigation and civil litigation cases. Some of the routine digital forensic analysis tasks are cumbersome and can increase the number of pending cases especially when there is a shortage of domain experts. While the work is not very complex, the sheer scale can be taxing. With the current scenarios and future predictions, crimes are only going to become more complex and the precedent of collecting and examining digital evidence is only going …

It advocates for reforms, including legislative changes and judicial discretion, to address the systemic inequities.
A Court Of Chaos And Whimsy: On The Self-Destructive Nature Of Legal Positivism, Joshua J. Schroeder
A Court Of Chaos And Whimsy: On The Self-Destructive Nature Of Legal Positivism, Joshua J. Schroeder
Cardozo Journal of Equal Rights & Social Justice
Each of the four arguably most famous dictators in modern Western history, Adolf Hitler, Porfirio Diaz, Napoleon Bonaparte, and Oliver Cromwell, were legal positivists. This is to say that they rejected both the common law and natural law conceptions ofhuman rights. They furthermore rejected the judiciary's equitable power to enforce human rights independently ofpolitics by characterizing the old Chancery of England as a court of chaos and whimsy, adopting John Selden's religious rejection of equity as a "roguish thing."
As Bertrand Russell recounted in his History of Western Philosophy, the philosophical avatars of German, French, and English despotism, Hegel, Rousseau, …

People Over Profits: Why A Private Right Of Action In The Occupational Safety And Health Act Is Necessary During The Covid-19 Pandemic, Olivia Nevola
Cardozo Journal of Equal Rights & Social Justice
The Occupational Safety and Health Act (OSHA) lacks a private right of action, leaving employees without direct legal recourse against employers for violations, despite the critical need for such protections, especially highlighted by the COVID-19 pandemic. The note argues that amending the Act to include an explicit private right of action would enhance enforcement, hold employers accountable, and provide necessary remedies for workers, supplementing the insufficient administrative process and workers' compensation laws.

Slouching Toward Regulation: Assessing Bill 88 As A Solution For Workplace Surveillance Harms, Danielle E. Thompson, Adam Molnar
Canadian Journal of Law and Technology
Employee monitoring applications (‘‘EMAs”) are proliferating in Canada and provide employers with sophisticated surveillance tools for the monitoring of workers (e.g., on-device video surveillance, browser activity, and email monitoring). In response to concerns about these increasingly invasive surveillance practices, the Government of Ontario passed Bill 88, the Working for Workers Act, 2022, which requires all employers with 25 or more workers to have a written policy stating whether and how they electronically monitor their employees. Bill 88 marks a more explict attempt to regulate workplace surveillance in a modern digital context in Canada; however; however, an analysis of the Bill’s …

When Your Boss Is An Algorithm: Preserving Canadian Employment Standards In The Digital Economy, Fife Ogunde
Canadian Journal of Law and Technology
The platform or ‘‘gig” economy is a rapidly growing economy in Canada. Between 2005 and 2016, the share of gig workers among all workers in Canada rose from 5.5% to 8.2%. These include independent contractors, select freelancers and platform workers. In 2018, 28% of Canadians aged 18 and older reported making money through online platforms. Research by Payments Canada in 2021 showed gig workers as representing more than one in 10 Canadian adults with more than one in three Canadian businesses employing gig workers. As the share of platform workers in the economy has grown, so has the discussion regarding …

In 2018, NASA’s Jet Propulsion Laboratory was the subject of a data breach where over 500 megabytes of data from a major mission system was stolen by hackers. This attack affected NASA’s Deep Space Network, prompting the United States Johnson Space Center to disconnect the International Space Station from the affected gateway due to fears that mission systems could become compromised. NASA has acknowledged that its vast online presence, which includes thousands of publicly accessible datasets, offers a large potential target for cybercriminals. The 2018 incident was one of many, with NASA experiencing more than 6000 cyberattacks from 2017-2021 alone. …

Dentistry And The Law: Did I Commit Fraud?, Dan Schulte Jd
Dentistry And The Law: Did I Commit Fraud?, Dan Schulte Jd
The Journal of the Michigan Dental Association
The dentist is under audit by a dental plan due to issues with claims, but inattention or mistakes do not necessarily constitute fraud. For fraud to be established, specific conditions must be proven, including knowledge, intent, and damage to the dental plan. The burden of proof is high for criminal fraud, making it unlikely in this situation. The dentist's main concern should be a breach of their participation agreement and the need for better billing practices.

An automated driving system (ADS), as the brain of an autonomous vehicle (AV), should be tested thoroughly ahead of deployment. ADS must satisfy a complex set of rules to ensure road safety, e.g., the existing traffic laws and possibly future laws that are dedicated to AVs. To comprehensively test an ADS, we would like to systematically discover diverse scenarios in which certain traffic law is violated. The challenge is that (1) there are many traffic laws (e.g., 13 testable articles in Chinese traffic laws and 16 testable articles in Singapore traffic laws, with 81 and 43 violation situations respectively); and …
