Interpreting The Administrative Procedure Act: A Literature Review, Christopher J. Walker, Scott Macguidwin
Law & Economics Working Papers
The modern administrative state has changed substantially since Congress enacted the Administrative Procedure Act (APA) in 1946. Yet Congress has done little to modernize the APA in those intervening seventy-seven years. That does not mean the APA has remained unchanged. Federal courts have substantially refashioned the APA’s requirements for administrative procedure and judicial review of agency action. Perhaps unsurprisingly, calls to return to either the statutory text or the original meaning (or both) have intensified in recent years. “APA originalism” projects abound.
As part of the Notre Dame Law Review’s Symposium on the History of the Ad- ministrative Procedure Act …

Women have encountered many obstacles in their quest to gain leadership in law enforcement. While research has studied how well women officers strive to achieve higher-level positions within police departments, the challenges women face when they gain top leadership roles remain largely unexplored. This research paper will discuss the unique challenges faced by women police chiefs, drawing from first-hand experiences of women police chiefs and existing literature. The study finds that women police chiefs encounter challenges in communication, transferring to a new department, overtasking, introvertedness, and general police chief stress. The study also finds that women police chiefs implement ways …

Year after year, the Commission on Teacher Credentialing receives a significant number of applicants from those who want to teach in the State of California. Focusing on one of the critical concerns of low student performance and academic achievement begins with identifying potential problems within the education system, such as a lack of quality or best-fit educators in California. Becoming a teacher in the State of California has demonstrated many areas where the credentialing criterion may contain the answers to achieving higher standards and expectations from our youths in California. Incorporating subject-matter exams onto the list of teacher credentialing criteria …

ICSID Convention Article 54 requires the United States to enforce Appellees’ final ICSID awards in fulfillment of treaty obligations owed to every other Contracting State to the ICSID Convention. That the courts of the United States must enforce ICSID awards without the extensive review that Appellant demands is at the heart of the ICSID Convention’s multilateral framework for investor-state …

Book Review: Derviš M. Korkut: A Biography—Rescuer Of The Sarajevo Haggadah, Ehlimana Memišević
Genocide Studies and Prevention: An International Journal
At the beginning of 2020, the Sarajevo-based publishing house El-Kalem, released a biography of Derviš M. Korkut, a Bosniak hero, to whom Yad Vashem posthumously awarded Righteous among the Nations on December 14, 1994.
Winston Churchill's words, with which the author begins the biography—that the Balkans produce more history than they can handle—best describe the difficult times in which Korkut lived. For Korkut and his fellow Bosnians, these difficult times lasted from the beginning of the 20th century to its very end.
The book is based on exhaustive archival research and reconstructs Korkut’s life very precisely, while the concise overview …

Are The Imposed Principles Standard? A Review Of Imposing Standards: The North-South Dimension To Global Tax Politics By Martin Hearson, Opeyemi Bello
Dalhousie Law Journal
The publication of Martin Hearson’s book, Imposing Standards: The North-South Dimension to Global Tax Politics, coincided with heated international discussions of the most substantial policy proposals in the field of international taxation in the last century.1 Hearson’s work provides insights on how the developed countries exerted control over the negotiations of the double taxation agreement (DTA) regime, which is the basis of the current international taxation framework. It explains how the negotiations resulted in a framework that works well for the developed countries, but does not substantially address the tax revenue needs of the developing countries. The publication of the …

The research problem lies in the excessive use of images in ways that may have been randomly put without taking into consideration certain factors such as allocation, processing, design construction or some expressive and psychological aspects. Experts have defined some technical problems related to image-choice and the extent of its future impact …

Minimally, a research data repository exists to make a collection of data assets available to potential users. If a dataset cannot be discovered and found, it cannot be reused (Garnett et al. 2017). Harvestable metadata catalogues are a key strategy for achieving greater global findability of data assets, as they create a surveyable access point to discover data products within large data collections. Such catalogues can be especially effective if they are tailored for interoperability with feature-rich infrastructures (e.g. meta-catalogues, see Kapiszewski & Karcher 2020; CRFCB 2014) that are highly visible and widely used, and also themselves integrated within the …

Neutralizing Secularism: Religious Antiliberalism And The Twentieth-Century Global Ecumenical Project, Rabiat Akande
Neutralizing Secularism: Religious Antiliberalism And The Twentieth-Century Global Ecumenical Project, Rabiat Akande
Articles & Book Chapters
A marked feature of the contemporary U.S. constitutional landscape is the campaign by an Evangelical- Catholic coalition against the idea of secularism, understood by this alliance to mean the exclusion of religion from the state and its progressive marginalization from social life. Departing from the tendency to treat this project as a national phenomenon, this article places it within a longer global genealogy of an earlier international Christian ecumenical effort to combat secularism. The triumph of that campaign culminated in the making of Article 18 of the Universal Declaration of Human Rights, now considered the paradigmatic international legal provision on …
Recidivism Among Rehabilitated Offenders With Mental Illness: A Quantitative Study, Robert Olando Walker
Recidivism Among Rehabilitated Offenders With Mental Illness: A Quantitative Study, Robert Olando Walker
Doctoral Dissertations and Projects
Offenders with severe mental illness (SMI) found a place within the criminal justice system (CJS) with its most crucial objectives including the reduction of recidivism among discharged offenders and their safe reintegration into a free community as rehabilitated offenders. Beyond the monetary costs of recidivism, the continued potential for criminality among offenders with mental illness (OMI) added enormous costs to all law-abiding citizens and their respective communities. However, no study was found in the literature that attempted to investigate the relationship between recidivism and the successful rehabilitation of patients with mental illness. Those found involved offenders without mental illness and …
