Drug Courts: The Risk Of An Increased Number Of Drug-Related Arrests And Long Jail Sentences, Wayne A. Comstock Oct 2023

Drug Courts: The Risk Of An Increased Number Of Drug-Related Arrests And Long Jail Sentences, Wayne A. Comstock

University of Miami Race & Social Justice Law Review

In June 1971, President Richard Nixon declared a War on Drugs. As the War on Drugs continued throughout the 1980s, drug-related convictions increased, leading to overcrowding in prisons across the United States. Drug courts operate as an alternative to incarceration in which criminal defendants enter court mandated drug treatment programs. Judges monitor the progress of drug court participants through scheduled status hearings. However, contrary to their purpose, drug courts may contribute to incarceration by presenting the risk of an increased number of drug-related arrests in those jurisdictions that have implemented drug courts and long jail sentences imposed as sanctions for …

Police Brutality & Unions: Collective Bargaining Is The Problem, Not Law Enforcement, Falco Anthony Muscante Ii Oct 2023

Police Brutality & Unions: Collective Bargaining Is The Problem, Not Law Enforcement, Falco Anthony Muscante Ii

University of Miami Race & Social Justice Law Review

When Derek Chauvin knelt on George Floyd’s neck for more than nine minutes, and when Jason Van Dyke fired sixteen rounds at Laquan McDonald who was walking away from the responding officers, were Chauvin and Van Dyke acting exclusively of their own volition, or were their actions indicative of a deeper, systemic issue? Nearly 60% of law enforcement officers enjoy collective bargaining protections from their police unions, but these protections create a lack of accountability.

Police unions can bargain collectively with police departments because of state legislation, which typically allow for negotiation over matters affecting wages, hours, and terms and …

The New Over-The-Counter Oral Contraceptive Pill—Assessing Financial Barriers To Access, Christopher Robertson, Anna Braman Oct 2023

The New Over-The-Counter Oral Contraceptive Pill—Assessing Financial Barriers To Access, Christopher Robertson, Anna Braman

Faculty Scholarship

In July 2023, the Food and Drug Administration (FDA) approved Opill (norgestrel), the first over-the-counter (OTC) daily oral contraceptive pill in the United States, a move that could dramatically improve practical access to family planning. Opill’s price, however, hasn’t been made public and may not be revealed until the drug enters the market in early 2024. Although contraceptive pills generally cost between $10 and $50 per month without insurance, there’s no indication that Opill’s price will fall within this range. In addition, although the manufacturer (Perrigo) has expressed interest in a consumer-assistance program, it hasn’t released details regarding eligibility for …

Privacy Harm And Non-Compliance From A Legal Perspective, Suvineetha Herath, Haywood Gelman, Lisa Mckee Oct 2023

Privacy Harm And Non-Compliance From A Legal Perspective, Suvineetha Herath, Haywood Gelman, Lisa Mckee

Journal of Cybersecurity Education, Research and Practice

In today's data-sharing paradigm, personal data has become a valuable resource that intensifies the risk of unauthorized access and data breach. Increased data mining techniques used to analyze big data have posed significant risks to data security and privacy. Consequently, data breaches are a significant threat to individual privacy. Privacy is a multifaceted concept covering many areas, including the right to access, erasure, and rectify personal data. This paper explores the legal aspects of privacy harm and how they transform into legal action. Privacy harm is the negative impact to an individual as a result of the unauthorized release, gathering, …

Adoption Of Cybersecurity Policies By Local Governments 2020, Donald F. Norris Phd, Laura K. Mateczun Jd Oct 2023

Adoption Of Cybersecurity Policies By Local Governments 2020, Donald F. Norris Phd, Laura K. Mateczun Jd

Journal of Cybersecurity Education, Research and Practice

This paper should be of interest to the readers of this journal because it addresses a subject that has received little scholarly attention; namely, local government cybersecurity. The U.S. has over 90,000 units of local government, of which almost 39,000 are “general purpose” units (i.e., municipalities, counties, towns and townships). On average, these governments do not practice cybersecurity effectively (Norris, et al., 2019 and 2020). One possible reason is that they do not adopt and/or implement highly recommended cybersecurity policies. In this paper, we examine local government adoption or lack of adoption of cybersecurity policies using data from three surveys. …

Implementation Of A Federated Information System By Means Of Reuse Of Research Data Archived In Research Data Repositories, Sylvia Melzer, Stefan Thiemann, Simon Schiff, Ralf Möller Oct 2023

Implementation Of A Federated Information System By Means Of Reuse Of Research Data Archived In Research Data Repositories, Sylvia Melzer, Stefan Thiemann, Simon Schiff, Ralf Möller

Copyright, Fair Use, Scholarly Communication, etc.

At universities, research data is increasingly stored in research data repositories according to a data management plan (DMP) and thus made available for further use. The challenge of reusing hundreds, thousands, or millions of data sets is to obtain an overview of the data in a short period of time and to search through all the data. The high variability of the formats used to store research data requires a new approach to data reusability that focuses on the visualisation and searchability of archived research data, which can also be combined with each other. In this article, we present a …

The 80/20 Rule For Legal Research, Olivia Smith Schlinck Oct 2023

The 80/20 Rule For Legal Research, Olivia Smith Schlinck

Library Staff Online Writings

A few semesters ago I was discussing the value of secondary sources with a student when they paused to think, then described secondary sources as “kind of like the 80/20 Rule, but different.” I’d never heard of the 80/20 Rule, but I jotted it down onto a Post-It note to look into later. Fast-forward to today and I now introduce my students to what I’ve dubbed “the 80/20 Rule for Legal Research” in all classes about secondary sources.

Mpp Covid-19 Antiviral Medicines Licenses – Licensed Territories, Supply Options For Excluded Territories, And Supply Barriers Arising From Trade-Secret Transfer, Brook K. Baker Oct 2023

Mpp Covid-19 Antiviral Medicines Licenses – Licensed Territories, Supply Options For Excluded Territories, And Supply Barriers Arising From Trade-Secret Transfer, Brook K. Baker

Joint PIJIP/TLS Research Paper Series

This is a paper that analyzes Medicine Patent Pool licenses for three COVID-19 antivirals, including licensed territories, patent landscapes, supply options, regulatory status, and supply barriers arising from licensee acceptance of trade-secret information from the originator licensor. It concludes that at present there is no existing WHO prequalified licensee that can supply nirmatrelvir + ritonavir outside the Pfizer licensed territory, whereas there are potential molnupiravir licensees that can supply outside licensed territories where there is no blocking patent exists or a compulsory license has been issued in the country of import or use. The paper concludes with an assessment that …

Beauty Is Only Skin Deep: An Examination Of Physical Attractiveness, Attractive Personality, And Personal Grooming On Criminal Justice Outcomes, Krystal N. Knox, Michael F. Teneyck Oct 2023

Beauty Is Only Skin Deep: An Examination Of Physical Attractiveness, Attractive Personality, And Personal Grooming On Criminal Justice Outcomes, Krystal N. Knox, Michael F. Teneyck

Open Initiatives Grant Funded Publications-Archive

Research has found that physical attractiveness is related to a host of benefits across life outcomes. Within the field of criminal justice, physical attractiveness appears to afford individuals leniency at various decision points. This research, however, often fails to include measures of personal presentation beyond simply measuring physical attractiveness. The current study extends this line of research by investigating how physical attractiveness, personality attractiveness, and grooming are related to criminal justice processing decisions. Results from negative binomial and logistic regression analyses indicate that when assessed alone, physical attractiveness significantly decreased the odds of criminal behavior by 18 percent, arrest by …
