Second Amendment Exceptionalism: Public Expression And Public Carry, Timothy Zick
Second Amendment Exceptionalism: Public Expression And Public Carry, Timothy Zick
Faculty Publications
In New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court recognized a right to carry firearms in public places. The scope of that right will depend on where, why, and how governments regulated public carry during the eighteenth and perhaps nineteenth centuries. The Court claimed that its turn to history for determining the scope of Second Amendment rights “accords with” and “comports with” how the Court has interpreted First Amendment rights. This Article examines and rejects that claim, both in general and specifically as it applies to the public exercise of Second Amendment rights. Although Bruen …
The Diffuse Executive, Anya Bernstein, Cristina Rodriguez
The Diffuse Executive, Anya Bernstein, Cristina Rodriguez
Fordham Law Review
A unitary executive is an exacting ideal. It asks that all power in an administration be gathered in the person of the President, who should have full authority to determine the actions of officials and employees. Even if the President does not directly control every executive action (how could he?), when officials fail to implement presidential preferences, the unitary theory dictates that the President must have the power to remove them. The model posits a tightly organized hierarchy—every rung implementing the substantive decisions of the rung above, with orders flowing from the top: a command-and-control structure for government action. And, …
The Collateral Fallout From The Quest For A Unitary Executive, Harold J. Krent
The Collateral Fallout From The Quest For A Unitary Executive, Harold J. Krent
Fordham Law Review
To bolster a strong “Unitary Executive,” the Roberts Court has held that Congress can neither shield a single head of an administrative agency nor an inferior officer in an independent agency from removal at will. With respect to appointments, the Roberts Court has held that adjudicative officers in many executive agencies must now be appointed either by the President or a superior officer under the President’s supervision. As a result, dissenting Justices and academics have accused the Roberts Court of expanding Article II beyond both the constitutional text—which seemingly grants Congress the discretion to structure administrative agencies as it deems …
To Mint Or Not To Mint: Non-Fungible Tokens And The Right Of Publicity, Hannah Bobek
To Mint Or Not To Mint: Non-Fungible Tokens And The Right Of Publicity, Hannah Bobek
Fordham Law Review
Non-fungible tokens (NFTs) allow for authentication and ownership of digital assets, which are notable features in the virtual world given the infiniteness of internet content. The emergence of this novel technology, however, has raised challenges, especially regarding enforcement of the right of publicity. This Note addresses how litigators have approached right of publicity violations arising from NFTs and how courts might respond to future violations that this technology is capable of facilitating. Legal scholars and commentators argue that certain features of NFTs pose pronounced threats to the right of publicity, namely the technology’s novelty, democratized nature, anonymization of creators, transferability …
Police Officers, Policy, And Personnel Files: Prosecutorial Disclosure Obligations Above And Beyond Brady, Lauren Giles
Police Officers, Policy, And Personnel Files: Prosecutorial Disclosure Obligations Above And Beyond Brady, Lauren Giles
Fordham Law Review
Police officers play a significant role in the criminal trial process and are unlike any other witness who will take the stand. They are trained to testify, and jurors find them more credible than other witnesses, even though officers may have more incentive to lie than the ordinary witness. Despite the role of police officers in criminal proceedings, state statutes say virtually nothing about evidence used to impeach police officers, often contained in the officer’s personnel file. Worse still, the standard for disclosing information in an officer’s personnel file varies among and within states, resulting in inconsistent Brady disclosures. This …
Due Process Protections For Charter School Students In Long-Term Exclusionary Discipline Proceedings, Leah E. Soloff
Due Process Protections For Charter School Students In Long-Term Exclusionary Discipline Proceedings, Leah E. Soloff
Fordham Law Review
Charter schools—public schools that are subject to minimal state regulation—often employ high levels of exclusionary discipline. Because charter schools in many states are exempt from state laws regulating school discipline, the U.S. Constitution provides charter school students their only source of protections during such disciplinary proceedings. However, the constitutional due process protections afforded to public school students in disciplinary proceedings remain a source of significant disagreement among courts. Although the U.S. Supreme Court has established that public school students must be afforded due process protections in exclusionary discipline proceedings, the Court has yet to determine what process is actually due …

The Legal Future Of Telemedicine Technology
Over the past few years, the field of information and communication technologies (ICT) has experienced remarkable advancements that have brought about significant revolutions in various aspects of public life. One notable area that has been greatly influenced by these advancements is telemedicine. Telemedicine has had a profound impact on interpersonal relationships and the supply of medical services in both developed areas and remote. What sets telemedicine apart from traditional hospital healthcare is its ability to bridge the gap between doctors and patients without the need for physical proximity. However, the implementation of telemedicine …

The Public Prosecutions Role in Closing Criminal Cases without Litigation “A Study of the Federal Criminal Procedures Law and Special Criminal Laws”
The dissertation highlights the role of the public prosecution in solving criminal lawsuits without a judicial ruling, by the procedures it takes either by dismissal of action at the evidence collection stage or by issuing a criminal case dismissal order at the initial investigation stage. This can also be done through a penal order in some crimes. Though this latter option gives the public prosecution the jurisdiction to adjudicate on some criminal cases, though this …

Legal Regulation of Insurance Mortgage for The Vehicles in UAE Law
The mortgage that applies to vehicles is the insurance mortgage, because of the special nature movables have the property of self-identification, which leads to apply the registration rule on the ownership deed. The insurance mortgage is concluded between the mortgagee, who is the creditor, and the mortgager, who is either the debtor himself or someone else (the in-kind guarantor). In order for this contract to be validly concluded, it must fulfill all its elements and conditions. The objective conditions stipulated in the general rules for concluding contracts must …

Affect Theory, The Perceived Impact Of Judicial Diversity, And The Gender Pay Gap In The Irish Legal Profession, Caoimhe Kiernan
Books/Book Chapters
This chapter investigates how affect theory can be used as a framework when examining judicial diversity, along with how affect theory can be used to help explore the impact of increasing gender diversity on the Irish bench. This chapter will first examine the current gender pay gap in the Irish legal profession, the status of women in Ireland throughout the 20th Century, recount the women’s movement of the 1960’s and 1970’s and discuss the appointment of the first women judges to Irish courts. Affect theory will then be explored, including how affect theory can be applied as a framework when …
Combatting A Crisis Of Global Food Protectionism Sparked By The War In Ukraine, Daniel C.K. Chow, Ian M. Sheldon
Combatting A Crisis Of Global Food Protectionism Sparked By The War In Ukraine, Daniel C.K. Chow, Ian M. Sheldon
Vanderbilt Journal of Transnational Law
The world is currently gripped in a food crisis of historic proportions that is threatening tens of millions of people in the poorest countries of the world with famine and starvation. Sparked by the war in Ukraine, this crisis is being made worse by nations imposing export restrictions on food in a misguided attempt to curb soaring domestic food prices. Export restrictions are "beggar-thy-neighbor" policies that prevent increases in domestic food prices but at the expense of raising world prices, exacerbating the crisis. Although nations have turned to the World Trade Organization (WTO) for help in removing these export restrictions, …

China's National Security Review Of Foreign Investment: A Comparison With The United States, Robin Hui Huang
China's National Security Review Of Foreign Investment: A Comparison With The United States, Robin Hui Huang
Vanderbilt Journal of Transnational Law
This paper critically examines China's national security review regime of foreign investment and compares it with that of the United States. Over the years, China has gradually established a comprehensive legal framework for national security review of foreign investment. Recent efforts were made to refine the public enforcement mechanism of the review in tandem with a new "pre-establishment national treatment plus negative list" system under the 2020 Foreign Investment Law. The United States also enacted the Foreign Investment Risk Review Modernization Act of 2018 to enhance its national security review regime. By analyzing the law and practices of China and …
The Identifiability Problem In Transnational Privacy Regulation, Xiaowei Yu
The Identifiability Problem In Transnational Privacy Regulation, Xiaowei Yu
Vanderbilt Journal of Transnational Law
Commercial surveillance pervasively compromises data privacy by tracking consumers without meaningful consent or knowledge, yet there is no consensus on when data privacy laws should intervene. The crux lies in the standard of identifiability, which functions as the threshold trigger for when regulation is permissible. Ascertaining the identifiability of information is therefore critical to consumers, companies, and regulators, who must understand, comply with, and implement data privacy laws. As this Article shows, the world's key privacy jurisdictions the European Union, United States, and China-continue to struggle in similar ways with inadequately defining and inconsistently applying the concept of identifiability. This …
The Enforceability Of Private Property And Contract Rights Against A Successor State In International Law, Daniel Costelloe
The Enforceability Of Private Property And Contract Rights Against A Successor State In International Law, Daniel Costelloe
Vanderbilt Journal of Transnational Law
When one state replaces another in sovereignty over territory, several legal issues arise. One pressing issue that has fallen into neglect in scholarship concerns the enforceability of certain private rights, specifically property and contract rights, against the successor state. These include, for example, state contracts, concessions, or land grants by the government. This article examines the conceptual bases that have been invoked to explain the survival of such rights against a successor state. Even if such rights survive as a matter of customary international law, none of these theories acquired rights, subrogation, the continuity of the predecessor state's legal system …
Establishing Control Order Regimes: The International Human Rights Law Implications For Pre-Conviction And Post-Release Control Orders, Natalie Garcia
Establishing Control Order Regimes: The International Human Rights Law Implications For Pre-Conviction And Post-Release Control Orders, Natalie Garcia
Vanderbilt Journal of Transnational Law
Control orders are restrictive measures placed on individuals that pose an identified threat to public safety as a component of domestic counterterrorism policy. Control orders and their compliance with International Human Rights Law have been the subject of extensive litigation within the European Court of Human Rights and domestic states courts. Controlling provisions are applied in either the pre- conviction or the post-release stage of a state's criminal procedure. Pre- conviction control orders face significant criticism for the potential conflicts with due process protections of the right to a fair trial and the broader right of liberty. This Note describes …
A New Green Wave: Lessons From Argentina's Marea Verde For Legalizing Abortion Over Religious Opposition In The United States, Morgan Peck
Vanderbilt Journal of Transnational Law
This Note examines the role Christianity, particularly Roman Catholicism, played in influencing abortion laws in the United States and Argentina and offers a solution for new federal protections of abortion rights in the United States. Part II discusses the evolution of abortion rights in both countries, from their foundations to their recent reversals. Part III scrutinizes the ways in which religious ideology factored into the different logical frameworks utilized by the different parties involved in the fight for abortion access, the relevant tactics employed, and the subsequent outcomes. Considering the impact in Argentina of US jurisprudence regarding abortion rights, the …

Misconduct On Public Transit: An Exploratory Analysis Using The Comments Formerly Known As Tweets, Egbe Etu Etu, Asha Weinstein Agrawal, Imokhai Tenebe, Jordan Larot, Dang Minh Nhu Nguyen
Mineta Transportation Institute
This project developed a simple methodology for using Twitter data to explore public perceptions about misconduct on public transit in California. The methodology allows future researchers to analyze tweets to answer questions such as: How frequent are tweets related to assault, abuse, or other misconduct on public transit? What concerns arise most frequently? What are the types of behaviors discussed? We collected and analyzed data from Twitter posts in California about various types of public transit misconduct from January 2020 to March 2023 to identify the nature and frequency of reported misconduct. Our findings reveal that harassment, uncivil behavior, and …

Mothers In Law: A Critical Discourse Analysis Of Mothers In Law School, Sarah M. Jordon
Electronic Theses and Dissertations
Mothers are an increasing student population in higher education but an extensively under-researched population. While research examining motherhood is limited, the dearth of studies examining motherhood in higher education is especially limited, with even less available in the legal field and the institutions that provide legal education. This study examined how mothers in law school made meaning of their experiences utilizing a postmodernist epistemological framework, postmodernism and performance as a theoretical framework, and critical discourse analysis as a methodology. Data collection took place over the 2022-2023 academic year. Eight mothers participated in this qualitative study representing a range of ability …
The Relationship Between Constitutional Equality And Substantive Review, Wei Yao, Kenny Chng
The Relationship Between Constitutional Equality And Substantive Review, Wei Yao, Kenny Chng
Research Collection Yong Pung How School Of Law
General equality rights in written constitutions – rights stating the ideal of equality without specifying categories of impermissible differentiation – have often been effected through the idea of equality as rationality. Equality as rationality demands that differentiations between like entities have to be rationally justifiable. Such equality rights are applicable to legislation and executive action. This presents a prima facie overlap with substantive review in common law administrative law, since substantive review is also concerned about the rational justifiability of executive action. This raises three questions: (1) Are both sets of legal principles indeed similar? (2) Have courts managed to …

Originalism After Dobbs, Bruen, And Kennedy: The Role Of History And Tradition, Randy E. Barnett, Lawrence B. Solum
Georgetown Law Faculty Publications and Other Works
In three recent cases, the constitutional concepts of history and tradition have played important roles in the reasoning of the Supreme Court. Dobbs v. Jackson Women’s Health Organization relied on history and tradition to overrule Roe v. Wade. New York State Rifle & Pistol Ass’n v. Bruen articulated a history and tradition test for the validity of laws regulating the right to bear arms recognized by the Second Amendment. Kennedy v. Bremerton School District looked to history and tradition in formulating the test for the consistency of state action with the Establishment Clause.
These cases raise important questions about …
Convergence By Design: Who Contracts And The Plural Purposes Of Contract Law, Gregory Klass
Convergence By Design: Who Contracts And The Plural Purposes Of Contract Law, Gregory Klass
Georgetown Law Faculty Publications and Other Works
A theory is robustly pluralist if it maintains that law is justified by multiple independent nonordered principles. Some have argued that robustly pluralist theories are deficient because they can provide no practical guidance when those principles conflict. The objection is misplaced when applied to pluralist theories of contract law.
This article demonstrates the possibility of a robustly pluralist and practically relevant theory of contract law by modeling a multipurpose law of contract. Five simple models are constructed to illustrate several purposes a contract law might serve, depending on preferences of the populace (self-interested utility maximizers, a preference for sharing, a …

Making The World Safer And Fairer In Pandemics, Lawrence O. Gostin, Kevin A. Klock, Alexandra Finch
Georgetown Law Faculty Publications and Other Works
Global health has long been characterized by injustice, with certain populations marginalized and made vulnerable by social, economic, and health disparities within and among countries. The pandemic only amplified inequalities. In response to it, the World Health Organization and the United Nations have embarked on transformative normative and financial reforms that could reimagine pandemic prevention, preparedness, and response (PPPR). These reforms include a new strategy to sustainably finance the WHO, a UN political declaration on PPPR, a fundamental revision to the International Health Regulations, and negotiation of a new, legally binding pandemic agreement (popularly called the “Pandemic Treaty”). We revisit …
Breaking The Fourth's Wall: The Implications Of Remote Education For Students' Fourth Amendment Rights, Sallie Hatfield
Breaking The Fourth's Wall: The Implications Of Remote Education For Students' Fourth Amendment Rights, Sallie Hatfield
Vanderbilt Journal of Entertainment & Technology Law
As the COVID-19 pandemic forced both public K-12 and higher education institutions to transition to exclusively provide remote education, students’ homes and personal lives were exposed to the government like never before. Zoom classes and remote proctoring were suddenly the norm. Students and their families scrambled to create appropriate offices and classroom spaces in their homes, and many awkward and invasive scenarios soon followed. While many may have been harmlessly captured on camera, like classes that witness a student’s family eating lunch in the background or a dog on the couch, even these harmless instances have insidious implications for the …
The End Of An Era: The Uncertain Future Of Section 230 Immunity For Social Media Platforms, Lillian H. Rucker
The End Of An Era: The Uncertain Future Of Section 230 Immunity For Social Media Platforms, Lillian H. Rucker
Vanderbilt Journal of Entertainment & Technology Law
Major social media platforms (SMPs), such as Facebook, Instagram, and TikTok, have become the primary means of communication for billions of people worldwide. They are the largest modern news distributors and the primary curators of online public discourse. However, the expanding influence of SMPs has led many to publicly scrutinize the content moderation decisions of such platforms, as SMPs regularly remove, block, censor, and ban user-generated content (UGC), including third-party written messages, photos, and videos, at their discretion. Because SMPs exercise immense power and are largely self-regulated, there has been growing public sentiment that SMP content moderation violates Users’ free …

Risk, Responsibility, Resilience, Respect: Covid-19 And The Protection Of Health Care Workers, William M. Sage, Victoria L. Tiase
Faculty Scholarship
Medicine and nursing have long professional traditions of altruism and self-sacrifice, including undertaking not only extreme stress but also personal risk in service of patient care. With exceptions for natural disasters, humanitarian missions, and military service, however, recent concerns about professional “burnout” often have had more to do with mismanagement, exploitation, and generational or technological change than with core clinical circumstances. The COVID-19 pandemic changed that – bringing front and center the close connections between the well-being of health care workers and the well-being of the patients they serve. This chapter begins with the COVID-19 experience of health care workers …
