Assessing The Performance Of Place-Based Economic Development Incentives: What’S The Word On The Street?, Matthew Rossman

Although politically popular, place-based economic development incentives have had limited success and proven difficult to evaluate. Unlike most legal scholarship on this topic, this article takes a qualitative approach in examining them. It studies the performance of four distinct types of development incentives intended to alleviate economic distress, using insight gathered from interviews with business owners, development professionals, and community members in six adjoining neighborhoods, where past efforts at revitalization have failed despite locational advantages.
The challenges faced by economically distressed places are typically varied and complex. The qualitative sampling techniques employed in this article’s research generated nuanced, ‘on the …

International Cultural Property Protection And Law: Ukraine And Beyond, Susanna Helms

This project examines the ongoing destruction and theft of Ukrainian cultural heritage by Russian forces since February 2022 in tandem with international cultural property law, and theory, and case studies. By studying relevant cultural property laws and gathering information from associated theories of cultural property nationalism and internationalism, this project examines how these laws and theories apply to modern Ukraine. This thesis utilizes a qualitative approach to analyze theories surrounding cultural property and heritage and explores how these theories influence international law. On June 24, 2022, the Supreme Court of the United States handed down its decision in Dobbs v. Jackson Women’s Health Organization. Beyond the obvious devastation this opinion wreaked on abortion rights nationwide, it also unleashed a fear in communities that have gained substantive rights through the Court’s decisions based on similar reasoning. News organizations and LGBTQ+ advocacy groups quickly published stories discussing the fate of same-sex marriage in a post-Dobbs society. If the Supreme Court were to overturn Obergefell v. Hodges, it would be a crushing loss to the LGBTQ+ community. Not only would it signal the lack of …

The Commonwealth of Virginia markets itself as “The Largest Data Center Market in the World.” In 2019, the Northern Virginia market alone was the largest in the United States by inventory, with room to grow. In 2021, data centers in Northern Virginia required an estimated 1,686 megawatts of power; that number is expected to increase by 200 megawatts in the near future, reflecting data centers currently under development. For reference, in 2022, it was estimated that more than 100 homes could be powered by one megawatt of solar power in Virginia. Historically, data centers have been located in the Commonwealth …

Venture capital (“VC”) is repeatedly described as one of the “crown jewels” of the U.S. economy for its role in financing startups and innovation. However, recent corporate scandals, including fraud, have exposed a darker side of the VC industry and the startups in which venture capitalists (“VCs”) invest. For example, Theranos received $686 million in VC funding yet proved to be nothing more than a “house of cards” once it came to light that Theranos falsified blood test results. Space resource utilization is coming. While some legal impediments exist, they are not insurmountable. The ban on the appropriation of resources found in Article II of the Outer Space Treaty (“OST”) does not apply to extracted resources, according to the most reasonable interpretation of Article II and the view held by almost all countries and the overwhelming majority of scholars. The Moon Agreement is not a barrier to space resource utilization because it has not been adopted by many countries (and none of the major space-faring ones). Al Qaeda’s terror attacks against the United States on September 11, 2001, introduced heretofore unseen issues under International Humanitarian Law. After Al-Qaeda’s attacks, the Bush administration began its Global War on Terror by invading Afghanistan in order to find those responsible for the attacks on September 11, 20001. This invasion caused Al-Qaeda to flee into Pakistan’s Tribal Areas in order to evade American forces. The Bush administration began employing drone strikes in Pakistan’s Tribal Areas to degrade Al-Qaeda’s ability to conduct operations against the United States. How did criminal bail work in the Founding era? This question has become pressing as bail, and bail reform, have attracted increasing attention, in part because history is thought to bear on the meaning of bail-related constitutional provisions. To date, however, there has been no thorough account of bail at the Founding. This Article begins to correct the deficit in our collective memory by describing bail law and practice in the Founding era, from approximately 1790 to 1810.
