Delayed Emergency Care: How Professional Liability Insurance Affects Doctors’ Decisions After Dobbs And What Needs To Change, Erin Stuart Jan 2024

Delayed Emergency Care: How Professional Liability Insurance Affects Doctors’ Decisions After Dobbs And What Needs To Change, Erin Stuart

Marquette Law Review

In 2022, the U.S. Supreme Court overruled Roe v. Wade, ushering in a new era for abortion regulation. In some states, like Wisconsin, abortion was instantly re-criminalized. In rare but serious instances, health care providers faced the dilemma of deciding whether to delay care for emergency abortion services to save the life of a mother, for fear of criminal prosecution. As a result, some providers wondered if their professional liability insurance plan would provide a legal defense in the event of a criminal charge of illegally performing an abortion, though the facts may show it was to save the life …

SchröDinger’S Dissent: The Hybrid Authority Of A Dissenting Opinion, Christina M. Frohock Jan 2024

SchröDinger’S Dissent: The Hybrid Authority Of A Dissenting Opinion, Christina M. Frohock

Marquette Law Review

A dissenting opinion is the Schrödinger’s cat of authorities: both the law and not the law simultaneously. Courts and scholars often clarify that a dissenting opinion is not binding. Outside the universe of precedent, that authority defies easy description. Emerging from the pen of a judge wearing a black robe and acting in an official capacity, a dissenting opinion exhibits the form of the law. Yet, beneath that lofty sheen, a dissent exhibits the substance of commentary. A dissenting judge writes to undercut the law, providing a case law coda. This Article describes the traditional categories of authority, primary and …

Water Law Transitions In The Era Of Climate Change, Luis Inaraja Vera Jan 2024

Water Law Transitions In The Era Of Climate Change, Luis Inaraja Vera

Law Faculty Scholarship

Legal transitions--that is, changes in legislation, regulations, or judicial decisions are necessary to improve any legal system. This process, however, is fraught with obstacles and hard decisions mainly because, while society may gain, some individuals suffer under a new rule. This raises a number of questions. Is the reform unfair to those who lose as a result of it? If so, should the new rule incorporate any form of transition relief to alleviate these concerns, such as compensation? Legal transitions can be particularly difficult when a new rule affects vested property rights. This Article uses water law reform as a …

Beyond The Reach Of Legal Process – Lessons From United States V Rafiekian, Vivian M. Williams

Publications and Research

The influence of foreign agents on the domestic affairs of countries is now a major issue in global affairs. This issue gained significance after foreign influence was blamed for a massive protest demanding fair election, rocked Moscow in 2011. It has been amplified after Russian involvement was cited for Donald Trump’s surprised election as President of the United States in 2016. There is now great anxiety among nations that foreign actors could influence electoral outcomes. Consequently, the past decade has seen a proliferation of laws regulating the operation of foreign agents within a country. Aggressive enforcement of Foreign Agents laws …

Beyond Social Media Analogues, Gregory M. Dickinson Jan 2024

Beyond Social Media Analogues, Gregory M. Dickinson

Faculty Articles

The steady flow of social-media cases toward the Supreme Court shows a nation reworking its fundamental relationship with technology. The cases raise a host of questions ranging from difficult to impossible: how to nurture a vibrant public square when a few tech giants dominate the flow of information, how social media can be at the same time free from conformist groupthink and also protected against harmful disinformation campaigns, and how government and industry can cooperate on such problems without devolving toward censorship.

To such profound questions, this Essay offers a comparatively modest contribution—what not to do. Always the lawyer’s instinct …

Superpowers With Villainous Objectives: How The Executive Branch’S Immigration Enforcement “Powers” Utilize Technology To Violate Noncitizens’ Privacy, Nina-Simone Edwards

Library Scholarship

The United States border, for noncitizens, has a unique quality to it. Each time a noncitizen crosses that border, they are no longer private individuals. They can no longer choose to give up their information–instead, there is a forced exchange: data for entry. Who they are, what they are, and everything that connects them to the world is given up in exchange for a new life in a new land. Once the border is crossed, noncitizens no longer have the privacy that they may have known before. This Note first builds on scholarship theorizing that noncitizens do have a right …

Exploring "Coopetition" In The Electric Vehicle Energy Market: An Analysis Of The Ev Battery Competition Between China And South Korea, Alvin Hoi-Chun Hung Jan 2024

Exploring "Coopetition" In The Electric Vehicle Energy Market: An Analysis Of The Ev Battery Competition Between China And South Korea, Alvin Hoi-Chun Hung

South Carolina Journal of International Law and Business

This article employs a techno-econo-legal approach to analyze the potential “coopetition” (i.e., cooperation between competitors) between China and South Korea in the electric vehicle (EV) energy market. The investigation assesses a wide range of techno-econo-legal factors, including battery capacity, energy density, innovation, production capacity, and legal considerations. These legal considerations encompass intellectual property rights, trade practices, and environmental regulations. The central argument of this analysis posits that while South Korea holds an advantage in technological innovation, China’s superior production capacity and governmental support present significant challenges. The relative success in this domain relies not only on technological proficiency and resource …

R.I.P. R2p - And Yet It Moves: It Is Premature To Declare The Responsibility To Protect Dead - No, It Needs Cpr In The Dark Ages Of The 2020s!, Lily Katinka Svanberg

South Carolina Journal of International Law and Business

This work is about R2P and the responsibility to protect. Currently, the R2P doctrine is under serious pressure. The world climate has changed rapidly since the days of the launch of the R2P principle in 2001, and its most frequent references in 2011-2014, culminating in "responsibility not to veto" (RNVT) proposals in 2015. Recent grave violations of international law in the 2020s, resulting in alleged mass atrocities, have resulted in pessimism about the feasibility of R2P, and the declaration of its death. This article evaluates the 2000s decline in UNSC-mandated military action taken under Chapter VII from the perspective of …

Fair Cross Section And Tribal Jury Composition: Vawa 2022 Tribal Criminal Jurisdiction Series, Paula Hannaford-Agor, Steve Aycock

Faculty Publications

The Violence Against Women Reauthorization Act of 2013 (VAWA 2013) amended the Indian Civil Rights Act (ICRA) to ensure that non-Indian criminal defendants in Tribal courts have the right to a trial by an impartial jury that is drawn from sources that 1) “reflect a fair cross section of the community” and 2) “do not systematically exclude any distinctive group in the community, including non-Indians.” This requirement applies when a non-Indian who is criminally prosecuted in Tribal court faces possible imprisonment.

The implementation of these jury provisions has been a topic of discussion among the Inter-Tribal Working Group on Special …

A New Hope: Perez V. Sturgis Public Schools Opens The Doors To Children With Disabilities, Richard D. Marsico Jan 2024

A New Hope: Perez V. Sturgis Public Schools Opens The Doors To Children With Disabilities, Richard D. Marsico

Articles & Chapters

In Perez v. Sturgis Public Schools, the United States Supreme Court ruled that parents of children with disabilities who allege that their child’s school discriminated against them because of their disabilities can seek compensatory monetary damages pursuant to federal laws that prohibit such discrimination without exhausting the administrative process of the Individuals with Disabilities Education Act. This seemingly innocuous decision, based on two obscure procedural provisions of the IDEA, overturned decades of circuit court decisions that ruled otherwise.

Perez has already had a profound effect, opening the courthouse doors for children with disabilities. In all twenty-five post-Perez decisions in which …

The Intersection Of Special Education And Family Law: Thoughts For Family Law Attorneys In Divorce And Custody Cases, Richard D. Marsico Jan 2024

The Intersection Of Special Education And Family Law: Thoughts For Family Law Attorneys In Divorce And Custody Cases, Richard D. Marsico

Articles & Chapters

The Individuals with Disabilities Education Act (IDEA) requires participating states to provide a free appropriate public education (FAPE) to children with disabilities. The IDEA gives parents of children with disabilities significant rights and major responsibilities in developing and maintaining their child’s education. Getting the most out of the IDEA for their children requires parents to commit substantial time and financial resources that are difficult to provide in the best circumstances. When parents are having marital difficulties, separated, undergoing a divorce, or negotiating child custody, these difficulties can be exacerbated as parents navigate the intersection of the federal IDEA and state …

Their Futures, So Full Of Dread: How Barefoot's Contamination Of The Death Penalty Trial Process Continues, Michael L. Perlin, Talia Roitberg Harmon, Maren Geiger, Moana Houde-Camirand

Articles & Chapters

Forty years ago, in its most roundly-criticized criminal procedure decision in modern history, the Supreme Court, in Barefoot v. Estelle (463 U.S. 880 (1983)), a decision premised on testimony by the responses to a hypothetical of a witness who had never directly evaluated the defendant, ruled that such testimony as to future dangerousness – testimony that had concluded there was a “100% chance” the defendant would commit more crimes if released into society -- was permissible. Over a stinging dissent by Justice Blackmun, the Supreme Court had ruled in Barefoot that it was not constitutional error for psychiatrists to testify …

The Puzzle Of Floating Forum Selection Clauses, John F. Coyle, Robin J. Effron Jan 2024

The Puzzle Of Floating Forum Selection Clauses, John F. Coyle, Robin J. Effron

Faculty Publications

This essay examines floating forum selection clauses—provisions linking the litigation forum to a post-contractual fact such as a party’s future principal place of business, an assignee’s location, or a unilateral designation. Categorizing floating clauses into three types, the authors analyze divergent judicial approaches to enforceability and the underlying tension between waiver and submission as theories of consent. They argue that floating clauses expose conceptual inconsistencies in personal jurisdiction doctrine, especially regarding foreseeability and due process, and highlight how courts struggle to reconcile contract principles with constitutional limits.

Penalizing Compliance: The Case For Paying Chapter 13 Trustees In The Event Of Pre-Confirmation Dismissal, Hannah L. Fink Jan 2024

Penalizing Compliance: The Case For Paying Chapter 13 Trustees In The Event Of Pre-Confirmation Dismissal, Hannah L. Fink

Emory Bankruptcy Developments Journal

Standing trustees provide a critical function of fairness in chapter 13 bankruptcy, but a jurisdictional split regarding their fees means that trustees in multiple circuits are not paid for a large percentage of their work. Under Ninth and Tenth Circuit precedents, standing trustees may not collect the percentage fee when the debtor’s case is dismissed before confirmation. This creates a different result for standing trustees as opposed to single-case trustees, hurts debtors and creditors, creates adverse incentives, and even constitutional conundrums.

Permitting some debtors to enjoy the benefits of chapter 13 without paying their fair share creates a system where …

A License To Discriminate: The Risky Next Step Of Religious Charter Schools, Vania Blaiklock Jan 2024

A License To Discriminate: The Risky Next Step Of Religious Charter Schools, Vania Blaiklock

Scholarly Articles

From 2017 to 2022, the Supreme Court strengthened its First Amendment Free Exercise jurisprudence by deciding that states can provide aid to religious educational institutions through general benefit programs. Six months after the Court’s most recent religious aid case, Carson v. Makin, Oklahoma’s Attorney General stated that he would no longer enforce the nonsectarian provision of the state’s public charter statute because it was unconstitutional under Carson and its progeny. That opinion initiated the application and 2023 approval of the first religious charter school, St. Isidore of Seville Catholic Virtual School by Oklahoma’s Virtual Schoolboard. Immediately, state litigation ensued, …
