Women And Trade In Africa: A Case For Mainstreaming Gender In The Implementation Of The African Continental Free Trade Agreement (Afcfta), Tsotang Tsietsi
Women And Trade In Africa: A Case For Mainstreaming Gender In The Implementation Of The African Continental Free Trade Agreement (Afcfta), Tsotang Tsietsi
Indian Journal of International Economic Law
This article seeks to determine the extent to which the African Continental Free Trade Agreement (AfCFTA) and its protocols accord attention to the barriers and opportunities that African women face in intra-African trade. It discusses the considerable role of African women traders, for example, in agriculture, micro, small and medium enterprises, and in informal cross border trade. It questions whether, in support of their contributions in these sectors, gender has been adequately mainstreamed in the AfCFTA legal framework. Through its analysis of the contents of the instruments, it argues that there was little prioritization of women in the agreement and …

On February 24, 2022, war broke out between Russia and Ukraine, sparking concerns among government leaders, intergovernmental bodies and the public at large. A month later, the Russian government issued Decree 299, which reduced to zero the royalty rate for national security-based compulsory licenses to intellectual property rights held by individuals or entities originating from the United States or other "unfriendly" nations. Meanwhile, the United States and other members of the international community imposed sanctions on Russia, raising questions about whether those sanctions would prevent U.S. companies and individuals from engaging with Russian intellectual property agencies. Many multinational corporations also …
English Company Law: Legal Architecture For A Global Law Market, Andrew P. Morriss, Charlotte Ku
English Company Law: Legal Architecture For A Global Law Market, Andrew P. Morriss, Charlotte Ku
Faculty Scholarship
English-architecture company law describes the distinct and diverse group of company or corporate law used in more than 60 jurisdictions worldwide. English-architecture company law provides a robust platform for innovation and development due to its permissive structure, opportunity for choice of law in an entity’s internal governance, and scalability permitting variation for small and large entities. It is the dominant form among International Financial Centers (IFCs), many of which have legal systems with a British connection. This body of law responds to competition and maintains dynamism by engaging its practice community through “learning by doing” and “frictioneering.” An architecture approach …

What Mediation Romantics Can Learn From The Model T (Or Maybe The Chevrolet Trax), Nancy A. Welsh

When mediation was reintroduced to the U.S. in the 1970s, it was infused with a democracy-and-self-determination-enhancing, social justice ethos. As the process has been very successfully institutionalized, however, these ambitions have been scaled backalthough, at least arguably, certain "mediative elements" have actually been adopted (or coopted) by other procedural innovations. Perhaps it is time for those of us frustrated with the evolution of mediation to reconcile ourselves to the reality and value of a "basic" model of mediation designed for the sole purpose of getting parties from dispute to settlement-in much the same way that the basic model of a …

In Trump v. Anderson, 144 S. Ct. 662 (2024), the Supreme Court of the United States held that the Colorado Supreme Court erred in excluding President Donald J. Trump from the Republican Party's primary ballot in the state. The Court reasoned that the Constitution makes Congress, not the states, solely responsible for enforcing Section 3 of the Fourteenth Amendment. Scholars of Section 3 have demonstrated that Section 3 is self-executing, so the Court's rationale lacks a sound basis in the original or contemporary meaning of the text of the Civil War Amendments, the original intent of their drafters, or …
Juries And Tax: The Effect Of Income Taxation On Tort Damages, John E. Lopatka, Jeffrey H. Kahn
Juries And Tax: The Effect Of Income Taxation On Tort Damages, John E. Lopatka, Jeffrey H. Kahn
Faculty Scholarship
In some shape or form, most tort damages for personal injuries have been excluded from federal income taxation since 1919. Despite this rule having celebrated its 100th birthday, the tax policy justification for the exclusion eludes consensus. Whether the policy is justified or not, the exclusion raises two other issues: should compensatory damage awards reflect non-taxability, and should juries be informed about tax treatment when determining awards? Like the disagreement over policy justifications for the exclusion, states are not in accord on their damage rule or approach to jury instructions.
Proponents of a rule that awards should reflect taxation and …

Exploring The Factors That Influence Female Offending In The U.S. And Mexico, Dana Villasenor
Exploring The Factors That Influence Female Offending In The U.S. And Mexico, Dana Villasenor
CMC Senior Theses
Hollywood has painted a picture of the criminal woman as a sexy, sneaky, and often psychotic female fatale. This is because men run Hollywood. Much like movies, research on why women offend had historically focused on men as their stellar. However, towards the turn of the century and with the disproportionate rise in female incarceration, literature caught up to the fact that women and men do not experience the same socialization, standards, or reality and, therefore, have different reasons for and ways of offending. This research explores those reasons for women in the U.S. and Mexico and paints the picture …
The Unreasonableness Of The Reasonable Woman Standard: Evaluating And Reforming Sexual Harassment Jurisprudence, Richa Parikh
The Unreasonableness Of The Reasonable Woman Standard: Evaluating And Reforming Sexual Harassment Jurisprudence, Richa Parikh
CMC Senior Theses
The “Reasonable Woman Standard” was first used in the 1991 case of Ellison v. Brady and has been central in shaping legal responses to sexual harassment. However, as societal norms and understandings of gender dynamics continue to evolve, as we experienced with the #MeToo movement, this “Reasonable Woman” often fails to grow with the times. I argue that this “Reasonable Woman” fails to encapsulate the complexities of sexual harassment experiences across different genders and cultural backgrounds. In this thesis, I deconstruct the historical development of the “Reasonable Woman Standard,” analyzing its roots in the “Reasonable Person Standard.” Through a combination …
Reconceiving Tort Law And The Role Of Insurance: Achieving Mutual Accountability, Grace Hong
Reconceiving Tort Law And The Role Of Insurance: Achieving Mutual Accountability, Grace Hong
CMC Senior Theses
Despite insurance being a deciding factor in whether liability is found in tort cases, it is not always reflected in tort theories and court opinions. In this paper, I offer a framework for reconceiving the role of insurance in tort law. To achieve this, I outline where insurance falls into instrumental and non-instrumental theories and why non-instrumental theories are more persuasive. After establishing this, I move to Goldberg and Zipursky’s civil recourse theory and delineate how similarities between the right to vote and right of action indicate parallel problems with failures to comprehend lack of access to the political process …
The State Of Our Republic: State Constitutions’ Role In Creating A More Perfect Union, Caroline Bullock
The State Of Our Republic: State Constitutions’ Role In Creating A More Perfect Union, Caroline Bullock
CMC Senior Theses
This thesis situates state constitutionalism in the modern context of federal constitutional paralysis. By tracing patterns of state constitutional development, we find that states were always the fundamental setting of democracy, and there has always been critical action happening at state legislatures, in state courts, and through state constitutional change. State constitutions provide an active means to achieve progress and protect rights not federally enshrined (and thus, endangered by the political process). The use of state constitutions to prescribe ways of life, protect individual and specialized rights, and to limit local governments has always occurred, but with the current federal …

The Fallout Of Sffa V. Harvard And The Future Of Affirmative Action, Agosto Aliaga
CMC Senior Theses
When the Supreme Court ruled race-conscious admissions to be unconstitutional in SFFA v. Harvard, it sent the higher education world into shock. About 200 universities across the nation who featured admissions systems selective enough to where a student’s race impacted their admission probability were forced to restructure their admissions. As media outlets reports on the decision dominated the headlines, the man responsible for the Students for Fair Admissions’ victory, Edward Blum, quietly shifted his attention to his next target, the business world. Blum, a professional plaintiff with the goal of ridding America of race-conscious policies, understands better than anyone that …
For Richer Or Poorer: The Warren Court's Relationship To Socioeconomic Class, Nicole Jonassen
For Richer Or Poorer: The Warren Court's Relationship To Socioeconomic Class, Nicole Jonassen
CMC Senior Theses
The U.S. Constitution does not enshrine socioeconomic rights. Why does this matter? Many argue that socioeconomic rights have value in and of themselves because they secure certain minimum conditions of human dignity, but socioeconomic rights also have instrumental value because abject material deprivation often makes traditional political and civil rights meaningless. In this thesis, I explore the relationship between U.S. constitutional law and socioeconomic rights through an analysis of the Warren Court’s decisions regarding socioeconomic class. In Chapter 1, I present existing literature on socioeconomic rights, socioeconomic rights in the American context, and what many scholars see as the Warren …
Does The Constitution Follow The Flag? The Paradox Of Puerto Rican Identity And Citizenship, Laura Somoza Velez
Does The Constitution Follow The Flag? The Paradox Of Puerto Rican Identity And Citizenship, Laura Somoza Velez
CMC Senior Theses
How do identity and citizenship interact? Puerto Rico’s current political status is that of an unincorporated, organized territory of the United States, under the shiny title of ‘Commonwealth.’ Although they have US Citizenship, Puerto Rican residents aren’t protected by the US Constitution. This source of dual identification, American and Puerto Rican, creates a unique circumstance where questions of identity, and belonging naturally arise. In this thesis, I aim to answer how the citizenship condition created in Puerto Rico and how it is experienced measure up to current debates and scholarship surrounding citizenship. Achieved through a historical analysis of the formation …
China’S Strategic Calculus: A Comparative Analysis Of China’S Approaches Towards The Philippines And Vietnam In The South China Sea Dispute, Letian Wang
CMC Senior Theses
The South China Sea (SCS) dispute is a longstanding territorial conflict involving several surrounding states. In this paper, I analyze the differences in China’s policies towards the Philippines and Vietnam as China exerts its expansion into the SCS using relevant International Relations theories. The Philippines’ democratic values, alliance with the U.S., small-scale volume of trade with China, and active strategies against China all contradict China’s interests to be the regional hegemonic power. In contrast, Vietnam’s socialist regime, alliance with China, substantial trade with China, and passive strategies do not contradict China’s interests as much and even comply with them. Hence, …

Speaking To Maryland’S Eastern Shore: Lessons For Candidates Looking To Earn The Watermen Vote, Maryum Khwaja
CMC Senior Theses
One of the thirteen original states, Maryland is located on the East Coast. It consists of two main sections that are separated by the Chesapeake Bay: the Eastern Shore, which is east of the Chesapeake, and mainland Maryland, west of the Chesapeake. As a whole, Maryland is a blue state. The East Shore is different: it has Republican House member, Andy Harris, and holds different values from the rest of the state, and it votes differently, too. In the 2020 election, Biden won the statewide vote 65-32 percent – but Trump carried Harris’s district 56-42 percent.

Preservation Through Transformation: An Interpretive Analysis Of Title Vii’S Failure To Secure Remedy For The Wrongs Of Workplace Sexual Harassment, Halle Rudman
CMC Senior Theses
The establishment of Title VII of the Civil Rights Act of 1964 as federal law was a pivotal moment in the pursuit of workplace equality and eradication of discrimination. Unfortunately, the application of Title VII in sexual harassment cases has fallen short of the statute’s noble intentions. In this paper, I argue that the judicial treatment of Title VII has been disloyal to its original purpose, perpetuating systemic inequalities and hindering progress towards gender equality in the workplace. I first establish a framework for the reasonable construction of a statute, drawing on work from various legal theorists to establish three …
From The Barrel To The Border: Exploring The Roots And Ramifications Of Gun Trafficking From The United States To Mexico, Alexandra Punishill
From The Barrel To The Border: Exploring The Roots And Ramifications Of Gun Trafficking From The United States To Mexico, Alexandra Punishill
CMC Senior Theses
Nowhere is the discussion surrounding gun violence more prominent than in the United States, with the impacts of our gun-friendly culture being felt around the world. This thesis analyzes the dynamics of gun trafficking from the United States to Mexico and sheds light on its role in fueling the epidemic of gun violence south of the border. It is argued that the particular system of federalism adopted by the United States has led to a variety of state-level gun regulations that have shaped domestic gun policy and have had an international impact. Despite Mexico’s persistent efforts to combat the gun …
Righteous Fury: A Natural Rights Approach To The Individual Right To Bear Arms Under The Ninth And Fourteenth Amendments, Nikhil Agarwal
Righteous Fury: A Natural Rights Approach To The Individual Right To Bear Arms Under The Ninth And Fourteenth Amendments, Nikhil Agarwal
CMC Senior Theses
The individual right to bear arms for self-defence has been grounded by the modern Supreme Court in the Second Amendment and incorporated against the States by the Due Process Clause of the Fourteenth Amendment. However, a close examination of both the majority and dissenting opinions in each of the three landmark gun-rights cases decided by the Supreme Court this century- DC v. Heller, McDonald v. Chicago, and New York State Rifle & Pistol Association v. Bruen- reveal how difficult is to determine the original meaning of the Second Amendment, and expose weaknesses in the Court’s current substantive due process …
Creating A Just System Of Civil Recourse – Articulating The Controlled Instrumentalist Approach For Marginalized People, Rukmini Banerjee
Creating A Just System Of Civil Recourse – Articulating The Controlled Instrumentalist Approach For Marginalized People, Rukmini Banerjee
CMC Senior Theses
A system of civil recourse is a precondition for a just society. In this paper, I outline the ideal version of a system of civil recourse and analyze the accounts of various liberal philosophers to explain how a non-instrumental and mutual accountability theory of civil recourse best encapsulates its stated purpose. I analyze the American system of civil recourse, specifically tort law, and argue that it bypasses the threshold of tolerable injustice for marginalized people in the United States. Using Tommie Shelby’s framework in Dark Ghettos: Injustice, Dissent, and Reform, I argue that marginalized people are not obligated by …

The Efficacy Of Insider Trading Regulation: An Analysis Of The 1942 Introduction Of Sec Rule 10b-5, Kamila Melikova, Eric Hughson
CMC Senior Theses
Existing research has thoroughly examined the impact of insider trading regulations, finding mixed results regarding the effectiveness of new law introductions. Although this topic has received considerable attention, there is still a notable lack of research on the first regulation of insider trading: the 1942 introduction of Section 10(b), an amendment to the Securities Exchange Act of 1934. This paper uses a newly compiled dataset of earnings announcements from large public companies between 1937 and 1946, combined with event study methodology, to investigate the effectiveness of the very first ban on insider trading. Through the application of t-tests and regression …
Pathways For Recognition: Indigenous Land Rights In Panamá, Caruna Gillespie, William Ascher
Pathways For Recognition: Indigenous Land Rights In Panamá, Caruna Gillespie, William Ascher
CMC Senior Theses
Indigenous communities in Panamá face the same challenge that many Indigenous communities experience around the globe: a lack of recognition of their land rights. Over the last several decades, the Panamanian government has developed policies and ratified international agreements that recognize Indigenous rights. The comarcas that institutionalize these rights have had some success. However, despite a seemingly progressive framework for recognition, Indigenous communities across the country continuously have their rights violated by conservation projects and resource extraction efforts in the name of economic development. The Panamanian government crafts recognition policies using loopholes, exceptions, and ambiguous language that allow for them …

Aducanumab, Accelerated Approvals & The Agency: Why The Fda Needs Structural Reform, Matthew Herder
Articles, Book Chapters, & Popular Press
The US Food and Drug Administration’s controversial decision to grant accelerated approval to aducanumab (Aduhelm), a therapy for Alzheimer’s disease, has motivated multiple policy reforms. Drawing upon a case series of other drugs granted accelerated approval and interviews of senior FDA officials, I argue that reform should be informed but not defined by aducanumab. Rather, structural reforms are needed to reshape FDA’s core priorities and restore the regulatory system’s commitment to scientific rigor.
International Source Code Secrecy And The Characterization Of Intellectual Property As National Security, Anthony D. Rosborough
International Source Code Secrecy And The Characterization Of Intellectual Property As National Security, Anthony D. Rosborough
Articles, Book Chapters, & Popular Press
This chapter explores the emergence of source code secrecy rules in Free Trade Agreements (FTAs) and their implications for the future of intellectual property (IP). Rooted in geopolitical rivalry, these rules are framed as safeguards for national security and cybersecurity but carry significant potential social, economic, and environmental costs.
It traces the historical and geopolitical contexts that have shaped the rise of source code secrecy. Given that software-dependent technologies are now the dominant modality of innovation, the chapter highlights the impact of source code secrecy on domestic regulatory oversight, innovation, the right to repair, and equitable technology transfer to least-developed …

Inescapable Skills: Testing Legal Research Skills In An Escape Room, David H. Michels, Hannah Rosborough
Articles, Book Chapters, & Popular Press
This micro-ethnographic case study explores the effectiveness of an escape room format game to test legal research skill retention. Previous attempts to benchmark legal research and information literacy skills of Schulich Law students across the program have met with limited success in part because of the difficulty in recruiting participants. This study used a game format to gather data on student skill retention over the course of the program. Using an adaption of the popular escape room format, student teams in the first and second years of the JD program solved a series of research problems to “escape.” Observations of …
Using Social Media As A Tool To Inform Person-Centred Justice, Matthew Dylag
Using Social Media As A Tool To Inform Person-Centred Justice, Matthew Dylag
Articles, Book Chapters, & Popular Press
Many leading access to justice organizations recognize the importance of including the public’s perspective within programming and policy development. One key question underlying this approach is, how can organizations learn about the public’s experience with legal problems and the law? Noting that conversations about legal problems provide evidence of such experiences, this paper presents a study that examines conversations posted to the social media platform Reddit. It argues that social media can be leveraged to better understand the public’s experience with legal problems and the law and, in doing so, help to inform a person-centred perspective of justice.

Canadian Extradition Law: The Pressing Need For Reform, Robert J. Currie
Articles, Book Chapters, & Popular Press
Extradition—the formal legal surrender between states of individuals sought for criminal prosecution or to serve a sentence—is an essential tool in the worldwide fight against cross-border crime. In a time when the permeability of borders to criminal conduct has reached previously untold levels, the importance of effective international law enforcement cooperation has similarly intensified. Criminal investigation and enforcement powers can, for all practical purposes, only operate within national borders, but criminals themselves are not so constrained. Human trafficking, internet fraud, financial crime, wildlife trafficking—all are running rampant. All states, and their citizens, have a pressing interest in crime suppression, …

Speed And Judgment: The Effect Of Caseload On Florida’S District Courts Of Appeal, Isabella C. Johnston
Honors Undergraduate Theses
The Florida District Courts of Appeal have undergone many changes over the last three years, including the adoption of video conferencing due to the Covid-19 pandemic, and the creation of a brand-new district for the first time since 1979. Included in this series of changes was a new rule that moves most of the circuit court’s appellate jurisdiction into the jurisdiction the District Courts of Appeals (DCAs). This change has added to the systemic pressures of the Florida DCAs. While the creation of a new district is a step in the right direction to protect the effectiveness and perception of …
