Missing Middle Housing: Accelerating America’S Transition From Single-Family Zoning, Lena Zeebuyth, Mallory Moore
Missing Middle Housing: Accelerating America’S Transition From Single-Family Zoning, Lena Zeebuyth, Mallory Moore
Natural Resources Journal
As housing unaffordability and climate change impose increasingly greater costs on American cities and towns, there is a growing sense that single-family residential zoning ordinances are partly to blame for these challenges. Many Americans remain unwilling to address these difficulties by welcoming large apartment buildings into their neighborhoods. Fortunately, policies designed to promote “middle housing” development––visually attractive duplexes and townhome projects––tend to be more politically feasible than policies that drive apartment development. Further, such policies do much to improve the affordability and environmental sustainability of residential neighborhoods. This Article describes how promoting greater middle housing development in the United States …
Thinking About The Public Trust Doctrine In A Modern Context As Applied To Non-Fungible Tokens, Dustyn Sams
Thinking About The Public Trust Doctrine In A Modern Context As Applied To Non-Fungible Tokens, Dustyn Sams
Natural Resources Journal
This paper discusses two popular concepts in the legal world, the public trust doctrine and non-fungible tokens (NFTs). For the first time, it explores whether litigants could successfully use the doctrine to protect valuable NFTs. The public trust doctrine is the legal principle that the government holds and manages land under navigable water and closely associated natural resources in trust of the people. NFTs, on the other hand, are unique collections of cryptographical data that represent ownership of a digital artwork. This paper reconsiders the question of what exactly the scope of the public trust doctrine is and how its …
A Good Idea: Analyzing The Ineffective Enforcement Of Idea Due To Limitations On The Recovery Of Attorneys’ Fees, Anna Anderson
A Good Idea: Analyzing The Ineffective Enforcement Of Idea Due To Limitations On The Recovery Of Attorneys’ Fees, Anna Anderson
Nebraska Law Bulletin (Selected Issues)
Recovering attorneys’ fees must be limited to some degree, but excessive limitations make enforcing a child’s rights under IDEA more difficult and inaccessible. Where necessary, limitations should be sensible, consistent, and clear to parents and school districts. Further, limitations should encourage efficient resolution, not prolonging the conflict or discouraging alternate dispute resolution. Courts should interpret issues relating to attorneys’ fee recovery favorably to prevailing parties and remain mindful of the goals IDEA seeks to accomplish. Expanding the ability to recover attorneys’ fees will support parents when they advocate for their child’s right under IDEA and, therefore, best support the policy …

The Status Of The Icj Case Of Ukraine V. Russia, Anne Harper
Cardozo International & Comparative Law Review (CICLR) Blog
When Russia launched its full-scale invasion of eastern Ukraine on February 24, 2022, Russia claimed that the use of force in Ukraine was justified since Ukraine was committing genocide. Within a few days, Ukraine filed a petition with the International Court of Justice (ICJ). Ukraine evoked the ICJ’s jurisdiction under Article IX of the Genocide Convention, which provides the ICJ with jurisdiction to resolve “[d]isputes between the Contracting Parties relating to the interpretation, application or fulfillment of the present Convention, including those relating to the responsibility of a State for genocide or for any of the other acts enumerated in …

Restricting The Meanings According To The Hanafi Fundamentalists: Principles And Results, Abdeljalil Zuheir Damrah Prof.
UAEU Law Journal
This research aims to review the phenomenon of restricting interpretations among Hanafi fundamentalists, through an investigation of the historical stages and its most prominent symbols, in light of the clarification of the criteria that limit the sections of meanings, and the foundations on which the restriction was based.
To achieve this goal, the study followed the inductive approach that confines the history of Hanafi fundamentalist research on the subject of verbal meanings, while relying on the deductive analytical approach. It is based on tracing the fundamentalist tendencies that appeared among the late Hanafi scholars to clarify the nature of these …

analytical approach to address the nature of the problems accompanying the means of raising a topic for public discussion as a method of parliamentary control over government actions. jurisprudential rulings and effects of dissemination of wrong medical information on websites. The study follows the inductive and descriptive approach. Some of the most important findings of the study are as follows: Adapting the medical advice revolves around being a lease or royalty agreement, and adapting the unpaid dissemination of medical information is an act of righteousness. The doctor who publishes false information ignorantly is a guarantor. If a doctor who strives to publish information on a website, after verifying it, finds out later on that it is false information, he will be rewarded by Almighty Allah, but he has …

principles, are not mere agreements in which some clauses were inserted by the will of the parties, but rather are real common economic projects between the parties, these contracts are intended to achieve the common contractual interest of the parties by ensuring that their effects remain effective. Because these contracts are in a situation of constant interaction with reality, this requires preserving them from the risk of rescission and invalidity as much as possible, and by various legal means. Perhaps the most important and qualified way to preserve the international commercial contract (the common economic project) is to resort to …

Narrative Of Nationalism In Mise-En-Scene Of Biopic Soekarno: Indonesia Merdeka, Eric Gunawan, Bambang Wibawarta
International Review of Humanities Studies
This paper examines the national narrative presented in the biographical film Soekarno: Indonesia Merdeka (2014). The analysis employs a film studies approach to explore the interplay between visual and narrative strategies within the framework of Eisenstein's theoretical perspectives. Christian Metz's semiotic theory is utilized to decode the signs embedded throughout the film. The study focuses on the visual and narrative strategies employed in the biopic to elucidate the national narrative, particularly through the portrayal of the character Soekarno and his interactions with other key figures. Visual strategies, encompassing cinematography and mise-en-scene techniques, bring to light signs that are intricately linked …

The Global Corporate Minimum Tax And Mne Home Countries, Reuven S. Avi-Yonah
Other Publications
This Perspective explores the implications for the home countries of large MNEs of the agreement reached by over 140 countries in 2021 to enact a corporate minimum tax of 15%. It argues that the corporate minimum tax complements the trend to reduce the negative impact of unfettered globalization on labor, and it protects the ability of home countries to finance a robust social safety net. Home countries should adopt the corporate minimum tax, and that includes the US, which last year failed to adapt its Global Intangible Low-Taxed Income approach to the corporate minimum tax.

This White Paper proposes a criminal litigation pathway within a broader rule of law context for legally securing those assets, which Ukraine can then utilize to begin the rebuilding process without having to wait through more years of depredation and harsh winters. Doing so through a legal process such as that outlined in this White Paper is going to be key to Ukraine’s future as a democracy, as a candidate to join the European Union, as a candidate to join NATO, and as a rule of law society that is trusted and safe enough to attract substantial foreign direct investment.
Loper Bright And The Future Of Chevron Deference, Jack M. Beermann
Loper Bright And The Future Of Chevron Deference, Jack M. Beermann
William & Mary Law Review Online
This essay proposes that the Court overrule the Chevron two-step standard of review of agency statutory construction and replace it by reviving deference under the factors announced in the Skidmore case with a twist that preserves Chevron’s greatest virtue: agency freedom to alter its statutory interpretations so long as the agency remains within the zone of reasonable construction. This essay also proposes that the Court clarify the boundary between cases involving statutory construction and cases involving agency policy decisions that are reviewed under the arbitrary and capricious standard articulated in cases such as Motor Vehicles and Overton Park. …
Paradise Lost: The Effect Of Judicial Review On Congressional Debate, Laura E. Jenkins
Paradise Lost: The Effect Of Judicial Review On Congressional Debate, Laura E. Jenkins
Dissertations - ALL
How does judicial supremacy affect constitutional deliberation in Congress? Normative critics of judicial supremacy argue that judicial supremacy warps congressional debate by disincentivizing members of Congress from independently considering the moral and legal issues at stake in legislation. As this dissertation’s quantitative analysis, topic modeling, and qualitative textual analysis show, the Supreme Court’s decision in National Federation of Independent Business v. Sebelius (2012) disincentivized members of Congress from engaging in independent constitutional interpretation and normative argumentation. Before the Supreme Court’s decision in Sebelius, members of both parties debated the constitutionality of the Affordable Care Act’s individual mandate and used constitutional …

If Black Lives Really Matter, We Must End Traffic Stops!, Kenneth Williams
William & Mary Journal of Race, Gender, and Social Justice
This Article will argue that African Americans will continue to be fatally shot and killed by police disproportionately and in many cases unjustifiably as long as police are allowed to stop motorists for minor non-violent traffic infractions. These stops do little to combat crime and are not worth the lives they upend and the continued unconstitutional racial discrimination that motivates many of these stops. Although the standards for police use of force need to be reformed and police culture has to be changed, the other reform that is imperative in order to significantly reduce the disproportionate fatal police shootings of …

Arkansas Act 626 outlaws any gender-affirming medical treatment for persons under eighteen years of age. This Note focuses on the evolving litigation surrounding Arkansas Act 626, the potential repercussions of the issues facing transgender adolescents, and the legal protections that may be implemented whether or not Arkansas Act 626 is upheld as a constitutional piece of legislation. It begins by examining the standard bases for administering puberty blocker treatments and addressing many of the misconceptions in medical treatment that have influenced the shaping of legislation on transgender healthcare. The Note discusses the current legal barricades for adolescents trying to access …

The Color Of Money: How Our Broken Campaign Finance System Fuels Racial Inequality, Blair T. Page
William & Mary Journal of Race, Gender, and Social Justice
The laws upholding our campaign finance system are inadequate and under-enforced. These problems are felt disproportionately by African American voters. Election law experts agree that the structure and enforcement authority of the Federal Election Commission (FEC) severely limits the ability of the agency to achieve its goals. Several Supreme Court decisions have also limited the ability of Congress to control campaign contributions and expenditures. Tracking expenditures from corporations, groups, and individuals (to the extent possible), will show the link between favorable outcomes for these groups and their detrimental effects on African Americans. While closing racial disparities in wealth allows for …

Critical Race Theory Bans And The Changing Canon: Cultural Appropriation In Narrative, Susan Ayres
William & Mary Journal of Race, Gender, and Social Justice
Thirty-five states have enacted critical race theory (CRT) bans at the level of elementary and secondary public education, and eleven states have extended these to the university level. One way to resist these attempts to repress a healthy democracy by whitewashing history is through a pedagogy of anti-racism, including literary works. The question of what that would look like involves questions of cultural appropriation, which occurs when one takes from another culture, such as a writer creating a narrative about a character outside of the writer’s cultural identity. This Article considers the story of Ota Benga, brought from the Congo …
The Imperative Of Rejecting "Gender-Critical" Feminism In The Law, Henry F. Fradella
The Imperative Of Rejecting "Gender-Critical" Feminism In The Law, Henry F. Fradella
William & Mary Journal of Race, Gender, and Social Justice
Roughly a half-century ago at the height of the second-wave feminist movement, some feminist scholars and activists found themselves arguing with transgender people about who is a woman. While much of contemporary feminist thought has moved past biological essentialism’s outdated embrace of a sex binary to embrace trans-equality, a relatively small but vocal group of self-proclaimed “gender-critical feminists” (who are sometimes called trans-exclusionary radical feminists, or “TERFs” for short) eschew transgender legal rights that they perceive as potentially threatening to the rights of cisgender women. Most gender-critical arguments in that regard are fallacious; they are based on myths and false …
