Path To Progress: The Smarter Sentencing Act's Potential To Redefine U.S. Sentencing Norms, Emily K. Abrams
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
Over the past fifty years, the United States has witnessed a staggering increase in its prison population. Between 1973 and 2009, the nation’s prison populations increased seven-fold, at one point growing at a rate of eight percent annually. According to 2023 estimates, roughly 1.9 million individuals were incarcerated in the United States. This stark reality has fueled national discourse on the issue of mass incarceration and contributing policies such as sentencing practices. One such sentencing practice that impacts mass incarceration is statutory mandatory minimums.

Banning Trans Student-Athletes Won't "Save Women's Sports", Laura Tierney
Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog
In the past few years, a wave of anti-LGBTQ+ legislation has been passed in the House of Representatives and state legislatures. As of February 2024, twenty-five states have laws or regulations which ban “transgender students from participating in sports consistent with their gender identity.” With deceiving names like the “Save Women’s Sports Act” and the “Protection of Women and Girls in Sports Act of 2023,” these laws discriminate against trans student-athletes, purportedly in the name of fairness and women’s empowerment .The stark reality is that these bills do nothing to cultivate fairness and safety for student-athletes and do not further …
Communication With Public Officials In The Modern Age Of Social Media: Does It Violate The First Amendment When Public Officials Block Private Individuals From Their Social Media Pages?, Emily Cohen
Duke Journal of Constitutional Law & Public Policy Sidebar
In the modern world, social media dominates. It is considered an almost essential function of public officials, ranging from the President of the United States to local politicians, to maintain at least one social media page to keep the public updated on their policies and current events. As public officials shift toward social media to communicate with the public, these social media sites become the new spaces for public discourse, with members of the public often commenting on or responding to public officials' posts. As more public discourse occurs on these sites, and individuals begin to criticize their public officials …

Another Missed Opportunity To Adopt A Universally Accepted Maritime Treaty, Raul (Pete) Pedrozo
International Law Studies
In March 2023, an intergovernmental conference adopted the Agreement under the United Nations Convention on the Law of the Sea on the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction (BBNJ Agreement). Inspired by a resurgence of the New International Economic Order (NIEO), the BBNJ Agreement contains numerous provisions that will have the practical effect of making ratification of the agreement untenable for the industrialized nations. Similar provisions were included in the original Part XI of the United Nations Convention on the Law of Sea (UNCLOS). As a result, industrialized nations refused to sign or …

An Exegesis Of The Meaning Of Dobbs: Despotism, Servitude, & Forced Birth, Athena D. Mutua
Journal Articles
The Dobbs decision has been leaked. Gathered outside of New York City's St. Patrick's Old Cathedral, pro-choice protesters chant: "Not the church, not the state, the people must decide their fate."
A white man wearing a New York Fire Department sweatshirt and standing on the front steps responds: "l am the people, l am the people, l am the people, the people have decided, the court has decided, you lose . . . . You have no choice. Not your body, not your choice, your body is mine and you're having my baby."
Despicable but not unexpected,³ this man's comments …

Shaping The Sky Navigating The Future Of Urban Air Mobility Through Innovative Regulation, Ed Koellner
National Training Aircraft Symposium (NTAS)
This poster presents an in-depth analysis of the evolving regulatory landscape in Advanced Air Mobility (AAM), a field poised to revolutionize urban transportation. It emphasizes the need for developing regulatory frameworks that address the unique challenges and opportunities posed by rapidly advancing AAM technologies, focusing on balancing innovation with safety, public interest, and environmental sustainability.
The research provides an overview of current AAM technologies, including unmanned aerial vehicles and electric vertical takeoff and landing aircraft, and assesses the existing regulatory environment. It highlights the discrepancies and challenges these new technologies introduce to conventional aviation laws and standards.

High Times, Higher Stakes: Mental Health Impacts In New Recreational Marijuana Legal Landscape, Jason T. Lorenzon J.D., Chris Pezalla, Diana Semilia
National Training Aircraft Symposium (NTAS)
This presentation delves into the societal and mental health consequences arising from the increasing trend of legalizing recreational marijuana. Specifically, we will examine the potential normalization of unconventional behavior among aviation college students, who may grapple with substance use challenges due to stress, sleep difficulties, and the demands of college life. Given the rigorous nature of flight training, prioritizing the mental well-being of pilots becomes imperative.
With the recent legalization of recreational marijuana in Ohio, this presentation integrates insights from Diana Semilia's 2022 study on Kent State Flight Students Ages 19-26. The study's objective was to extract practical recommendations applicable …

National Training Aircraft Symposium (NTAS)
This proposal centers on the development of a Concept of Operations in Advanced Air Mobility (AAM). Kent State University's College of Aeronautics and Engineering is poised to pioneer the integration of drones and electric Vertical Takeoff and Landing (eVTOL) systems, bridging the gap between its campus and airport by transporting students and faculty the 3NM distance from campus to the airport and back by a UAV. Beyond a standard research initiative, this proposal signifies a groundbreaking effort to reshape the landscape of educational aeronautics and Advanced Air Mobility and Urban Air Mobility. Crypto And Arbitration: The Perfect Pair, Jared Bond
Cardozo Journal of Conflict Resolution (CJCR) Blog
While Cryptocurrency was once seen as the forefront of unique new investment opportunities, early 2022, known as the “Crypto Winter” saw a steep decline in cryptocurrency prices.[1] The fall of cryptocurrency led to an increase in crypto arbitration, with some cases just starting to reach the court system.[2] Due to the international nature of cryptocurrency and the unique challenges disputes present, many crypto businesses include arbitration clauses in their contracts.[3] While not yet clear how many of these issues will ultimately be resolved, there are clear benefits for crypto companies using arbitration as their chosen dispute resolution process, and certain …

The research aims to find out the problem of perception of the sign and symbol in the designs of logos and trademarks for the consumer, the role that the sign or symbol plays in the symbolic representation of the consumer, and the desires and motivations that the brand raises for the consumer in the purchasing process. The research community is limited …

This article analyzes a 2023 maritime incident in which the Chinese Navy Ship (CNS) Ningbo employed active sonar in the vicinity of His Majesty’s Australian Ship (HMAS) Toowoomba, while knowing that Toowoomba had divers in the water. The Chinese sonar caused injuries to the Australian divers. The article discusses the employment of acoustic devices to cause harm during peacetime and analyzes whether CNS Ningbo’s actions constituted a failure of "due regard" and other applicable legal regimes and norms. The article concludes that CNS Ningbo’s actions were an unlawful use of force and failed to demonstrate due regard, and that …

The Legal Realists On Law And Literature, Dan Priel
The Legal Realists On Law And Literature, Dan Priel
All Papers
This encyclopedia entry considers the legal realists’ neglected contribution to law and literature. Starting with Cardozo’s essay ‘law and literature’ on the importance of judicial style, it then considers the contributions of the legal realists to the topic, focusing especially on Karl Llewellyn and Jerome Frank. Cardozo and Frank—both judges who were interested in making sure they effectively conveyed their ideas—focused on the style a judge should adopt. By contrast, Llewellyn’s more sociological perspective was concerned with how different periods (as well as different jurisdictions) were dominated by different judicial styles. However, in both cases the question of judicial style …
