Academic Support Programs At Hbcu Law Schools, Marla L. Dickerson
LSU Doctoral Dissertations
This qualitative descriptive case study delves into the effectiveness of academic support programs (ASPs) for students at Historically Black Colleges and Universities (HBCU) law schools, focusing on enhancing academic performance and passing the bar exam. The underrepresentation of minority lawyers in the United States, which is attributed partly to standardized test disparities, underscores the need for tailored support mechanisms. Drawing from social cognitive theory (SCT), the study investigates how ASPs impact academic success, informed by participant interviews and thematic analysis.
Key findings reveal four prominent themes. Firstly, effective features of ASPs for promoting academic performance include personalized guidance from academic …

Our society’s continued addiction to fossil fuels poses an existential threat to our future. The scientific consensus clearly tells us that we must stop burning fossil fuels as fast as possible. This poses a huge political challenge, as many people make a lot of money from the fossil fuel industry, and they resist change. But an overlooked legal doctrine shows that we are not even going after the lowest hanging fruit. Oil and gas rights are often privately held in the United States. Some owners of those rights would be happy to leave their oil and gas safely in the …

In Martinez v. Cot’n Wash, Inc., the California Court of Appeal for the Second District applied a strict method of textual interpretation to decide that, absent any nexus to a physical location or storefront, a website by itself cannot constitute a place of public accommodation under Title III of the ADA. Going Cashless: Privacy Implications For Gun Control In A Digital Economy, Liza Goldenberg
Going Cashless: Privacy Implications For Gun Control In A Digital Economy, Liza Goldenberg
The Journal of Business, Entrepreneurship & the Law
This paper will examine how, given the United States’ shift toward a cashless economy, the country’s top credit-card companies’ potential decision to implement a new merchant code for firearm-related transactions as a method of gun control will backfire, jeopardizing consumer privacy and leading to unregulated transactions through cryptocurrencies. Since the majority of gun violence stems from firearm transactions not involving credit cards, credit-card companies should abandon the new merchant code that dissuades Americans from exercising their fundamental rights. The American economy should focus on slowing the shift toward a digital economy so that federal and state governments can implement legislation …

Applicability Of Discharge Exceptions To Corporate Debtors In Subchapter V: A “Death Blow” To Rescuing Small Businesses, Robert J. Landry Iii
The Journal of Business, Entrepreneurship & the Law
On August 23, 2019, the Small Business Reorganization Act of 2019 (SBRA) was signed into law, adding a new subchapter to Chapter 11 for small business debtors, i.e. “Subchapter V”. The underlying driver for SBRA was a concern that while most Chapters 11 cases are small business debtors, most small business debtors face difficulty successfully reorganizing under Chapter 11. SBRA is intended to streamline Chapter 11 reorganization for small business debtors by making the process quicker and cheaper. However, SBRA arguably curtailed the scope of discharge when a plan is confirmed without the consent of the creditors for corporate small …

International criminal justice as a legal concept cannot be reached unless international criminal responsibility for gross violations of human rights is recognized .In light of the obstacles that prevent the application of the substantive jurisdiction of the international criminal judiciary, whether represented by the International Criminal Court or the Special International Criminal Courts ,it becomes necessary to search for legal mechanisms through which international crimes can be revealed and the identification of those responsible for them to be held accountable. From this point of view ,
we discussed the legal framework under which international commissions of inquiry work to investigate …

Regarding the importance of the human rights and the need to ensure a worldwide respect and fulfilment, the international community has always attempted to find adequate measures to guarantee this protection as part of the United Nations’ member States commitment to the UN Charter. The international community has developed a new mechanism to hopefully replace the principle of intervention, that is the “Responsibility to Protect”. This new mechanism is still yet under controversies and doubts, but nevertheless it is a tool to put an end to human rights violations namely when it comes to the right of life. To ignore …

Enforcing Intentional Motherhood: The Harrowing Consequences Arising From The Inconsistency Of Statutes Regarding Surrogacy, And How The Enforcement Of Surrogacy Contracts Is The Answer, Meena Hatab
Global Business Law Review
This Note discusses how the practice of commercial surrogacy is treated across the United States. Most notably, how the courts treat surrogacy contracts from state to state. A summary of how Canada views the practice of surrogacy will provide a general view into how the view of the practice is different across borders. It will be discovered that, while there is a federal law governing surrogacy in Canada, there is no federal law in either country that enforce surrogacy contracts or treat surrogacy contracts as valid contract between two adult parties. This is due to the preconceived notions of what …

Catch Me If You Can Claim Copyright Infringement: How Copyright Law Unevenly Protects Novice Scriptwriters, Alexander Cole Dibucci
Global Business Law Review
In the realm of creative endeavors, novice scriptwriters often find themselves in a precarious position, highly susceptible to having their original work exploited for profit by formidable players in the industry, drawing a parallel to the timeless tale of David versus Goliath. In these all-too common scenarios, the multi-million-dollar film agencies that, reminiscent of Goliath, appropriate the creative fruits of amateurs striving to establish their names in the field. Regrettably, unlike the triumphant David from the biblical narrative, novice scriptwriters are frequently left without adequate protection within the legal landscape of the United States, where the scales tend to tip …
