(Un)Necessary Evils?: Ethical And Emotional Conflicts For Social Change Lawyers In Canada, Marina Francesca Mckenzie
(Un)Necessary Evils?: Ethical And Emotional Conflicts For Social Change Lawyers In Canada, Marina Francesca Mckenzie
LLM Theses
This thesis concerns an exploratory study about “social change” lawyers in Canada. Based on qualitative interviews, I aim to provide a modest but in-depth examination of the experiences and practical challenges these lawyers face in their work and how they navigate them. I find their approaches are divided between external and internal, both of which are affected by lawyers’ positionalities and experiences. “External approaches” concern how they reconcile conflicts in their values and responsibilities to different groups—namely individuals, communities and social movements—with each other, and with their obligations to the legal profession. Meanwhile, “internal approaches” concern how they navigate conflicting …

Fan Works And The Elusive Border Between Derivative And Transformative Uses, Aaron Schwabach
Fan Works And The Elusive Border Between Derivative And Transformative Uses, Aaron Schwabach
Faculty Scholarship
When Professor Schwabach began writing about fanfic and other fan works over a decade ago it was a niche topic, mostly of interest to fellow fans. It has since generated dozens of articles and a small but steadily increasing amount of litigation. In addition to several previous articles on the topic, Professor Schwabach has contributed a book (Fan Fiction and Copyright) and some book chapters to this ongoing discourse.
When this subject was new each article had to begin with a lengthy explanation of what fanfic is, why fictional characters are or are not protected by copyright, how parody and …
The Legal Realists On Political Economy, Dan Priel
The Legal Realists On Political Economy, Dan Priel
Articles & Book Chapters
Alongside the well-known jurisprudential ideas associated with legal realism, some scholars have highlighted the realists’ political-economic ideas. Best known among them has been Morton Horwitz, who has argued that the realists launched an “attack on the legitimacy of the market.” Other scholars challenged this view and argued that there was no significant connection between legal realism and political economic ideas. I offer a corrective to both views. I first consider the work of five legal realists (Karl Llewellyn, Adolf Berle, William O. Douglas, Jerome Frank, and Thurman Arnold) and show that all held views that were well within the political-economic …

The Hon. Denny Chin, a senior judge of the U.S. Court of Appeals for the Second Circuit, and his wife Kathy Hirata Chin, created the re-enactments and will preside with Hofstra Law students and faculty playing parts in the re-enactment. The U.N. Framework Tax Convention: Can It Bridge The North-South Divide?, Assaf Harpaz
Scholarly Works
The United Nations recently concluded the second session of negotiations on terms of reference for a framework convention on international tax cooperation. The framework convention presents an opportunity to multilaterally address pressing global tax issues. Its goal is to “strengthen international tax cooperation and make it fully inclusive and more effective.” The extensively negotiated terms of reference make several substantive commitments, including the fair allocation of taxing rights; tax evasion and avoidance by high-net worth individuals; sustainable development; mutual administrative assistance in tax matters; tax-related illicit financial flows; and prevention and resolution of tax disputes. The ongoing multilateral effort brings …

Mitt Romney famously said during his 2012 presidential campaign that “corporations are people.” Mindy Herzfeld’s column comparing the proposed 2 percent global wealth tax on billionaires with the corporate minimum tax (pillar 2) raises the opposite question: Are people like corporations for tax purposes? I would say no, for several reasons.

Robbing Peter To Pay Paul: In The Absence Of School Finance Equity, Texas School Districts Forced To Choose Between Funding Academics Or Safety Reform, Emily Mann
The Scholar: St. Mary's Law Review on Race and Social Justice
This comment addresses the intersection between two discussions frequenting the Texas legislative floor – school safety and school finance. Following the deadliest school shooting in Texas history, Texas public schools are under political pressure to “harden” campuses rapidly and at great expense. Unsurprising, however, the high costs accompanying safety investment, coupled with the lack of financial backing from the state, puts districts in a challenging position. Any discussion of investment in Texas public schools also triggers questions of equity.
Debate over lack of equity across Texas public schools is no stranger to the Texas Supreme Court. Nonetheless, inequity persists in …
