Crime, Corruption, And Construction: Exploring The Impact Of The “Construction Mafia” On Public Infrastructure Development, Sada Kalbach Oct 2024

Crime, Corruption, And Construction: Exploring The Impact Of The “Construction Mafia” On Public Infrastructure Development, Sada Kalbach

Independent Study Project (ISP) Collection

Recent government policies and a state-led focus on “radical economic transformation” have spawned a range of business forums, colloquially known as the “construction mafia,” seeking to capitalize on economic reform. However, competition for construction contracts have led to the widespread use of intimidation, violence, and government corruption within the eThekwini Municipality. This research seeks to understand how the construction mafia in eThekwini impacts the local government’s ability to develop public infrastructure, as well as the extent to which government responses enable or hinder organized criminal networks in the construction industry. Utilizing a qualitative method of semi-structured one-on-one interviews and notes …

Using Machine Learning To Predict State Compliance With International Legal Obligations For Registration Of Space Objects: Comparative Performance Of Logistic Regression And Dense Neural Network Models, Jonathan K. Sawmiller Oct 2024

Using Machine Learning To Predict State Compliance With International Legal Obligations For Registration Of Space Objects: Comparative Performance Of Logistic Regression And Dense Neural Network Models, Jonathan K. Sawmiller

Student Publications

Approximately 12% of satellites and other objects launched into outer space have not been registered with the United Nations (UN) as required by international law. To predict whether States will register a launched space object and understand what factors influence a registration decision, data from a UN online index of space objects was used to train and select the best machine learning model. After preparation, the dataset had 1938 datapoints with 11 features, with categorical features simplified and converted to binary.

Multiple variations of classical logistic regression models were compared to multiple variations of dense neural network models. The best …

Sturm College of Law: Faculty Scholarship

The Stockholm Resilience Centre has concluded that the number of "planetary boundaries" we are crossing has increased from three in 2009, when the Centre's researchers first introduced the concept, to six in 2023. Crossing these boundaries means humans are changing basic attributes of planetary systems to the point of risking the future of civilization. And the distinction between "safe" and "just" planetary boundaries raises questions regarding how to conceptualize the "good life." In this latest in a biannual series of essays, members of the Environmental Law Collaborative explore conceptions of the "good" as well as the various elements necessary to …

From Custom To Courtroom: The Informal And Formal Justice Systems In The Manang And Narphu Valleys, Clarissa Sayre Oct 2024

From Custom To Courtroom: The Informal And Formal Justice Systems In The Manang And Narphu Valleys, Clarissa Sayre

Nepal: Tibetan and Himalayan Peoples

This research paper aims to depict the structure and some of the current changes of the justice system in the Narphu and Manang Municipalities. The new Constitution of Nepal in 2015 mandated the establishment of one judicial committee in each municipality and rural municipality in the entire country. That’s 753 judicial committees. This is just one example of the recent and rapid change that the justice system in Nepal is currently undergoing. These new implementations of government bodies for justice aim to “mitigate the inefficiencies of the formal legal system and bridge the formal/informal justice divide. ” In both Narphu …

The Psychological Impacts Of Algorithmic And Ai-Driven Social Media On Teenagers: A Call To Action, Sunil Arora, Sahil Arora, John Hastings Oct 2024

The Psychological Impacts Of Algorithmic And Ai-Driven Social Media On Teenagers: A Call To Action, Sunil Arora, Sahil Arora, John Hastings

Research & Publications

This study investigates the meta-issues surrounding social media, which, while theoretically designed to enhance social interactions and improve our social lives by facilitating the sharing of personal experiences and life events, often results in adverse psychological impacts. Our investigation reveals a paradoxical outcome: rather than fostering closer relationships and improving social lives, the algorithms and structures that underlie social media platforms inadvertently contribute to a profound psychological impact on individuals, influencing them in unforeseen ways. This phenomenon is particularly pronounced among teenagers, who are disproportionately affected by curated online personas, peer pressure to present a perfect digital image, and the …

The Constitutional Right To Peremptory Challenges In Jury Selection, Richard Lorren Jolly Oct 2024

The Constitutional Right To Peremptory Challenges In Jury Selection, Richard Lorren Jolly

Vanderbilt Law Review

The peremptory challenge is one of the oldest and most well-established jury selection procedures. Its use dates back to the earliest days of English common law, and it was a firmly established and protected practice at the United States’ founding and into the early twentieth century. But while peremptory challenges are foundational, they remain perhaps the most controversial aspect of jury selection today. This is because they are regularly used by the government and private parties to advance racist, sexist, and bigoted ends. For this reason, over the last three decades, calls to abolish the practice have been regularly made …

Indigenous Copyright Concepts And Indigenous Data Sovereignty: How Libraries And Archives Can Support It, Rebecca Chapman, Rebecca Plevel Oct 2024

Indigenous Copyright Concepts And Indigenous Data Sovereignty: How Libraries And Archives Can Support It, Rebecca Chapman, Rebecca Plevel

Law Librarian Journal Articles

U.S. copyright law does not account for Indigenous knowledge. These items, such as stories, dances, songs, and oral teachings are data and works authored by a sovereign com- munity, not just individuals. Indigenous data sovereignty provides that data and cultural knowledge are subject to Tribal protections. Tribes have the right as a sovereign nation to govern the collection, ownership, and application of its own data and cultural knowledge. Assimilating Indigenous knowledge into non-Indigenous works is a copyright issue from an Indigenous perspective. Librarians can identify these Indigenous copyright issues to support local Indigenous Peoples and promote efforts toward achieving Indigenous …

Florida's Homeowners Insurance Problems, Peter Molk Oct 2024

Florida's Homeowners Insurance Problems, Peter Molk

Connecticut Insurance Law Journal

Floridians have seen dramatically rising homeowners insurance premium increases over the past several years, with year-over-year increases of forty percent or more over multiple years. The problem grew so severe that the State legislature convened a special session in 2022 to address the problem, ultimately passing several efforts designed to moderate rates. This Article reviews the evidence of Florida's experience to interrogate why the State has suffered disparately high homeowners insurance premium increases. In light of this interrogation, I critically assess the prospects for the recent legislative efforts and other suggestions to address the underlying problems. Reform efforts predominantly address …

Reaching wide and varied audiences for our academic work through book publishing served as the focus on this pipeline program panel. Through a dynamic conversation among leaders in book publishing from the academic and editorial sectors, we discussed the nuts and bolts of book publishing.

We are indebted, for this important dialogue, to American University Washington College of Law, NPOC, and all the conference’s co-sponsoring schools. We particularly want to thank Vice Dean Susan Carle of American University Washington College of Law, whose idea it was to host this panel. We were joined by the following expert book authors for …

Panel Discussion: Balancing Scholarship, Teaching And Service To Succeed On The Tenure Track – A Workshop For Pretenure Colleagues And Faculty Aspirants, Brenda Smith

Scholarly Articles in Law Reviews & Journals

In imagining the National People of Color Legal Scholarship Conference, the planning committee brainstormed about the theme of the conference and the scope of panels and opportunities that would capture the breadth and vibrancy of scholarship by faculty of color. An antecedent, however, to that scholarship is the entry, success, and thriving of faculty of color in the academy.
