Tort Liability For Failure To Age Gate: A Promising Regulatory Response To Digital Public Health Hazards, Matthew B. Lawrence, Brett Frischmann, Avi Sholkoff
Tort Liability For Failure To Age Gate: A Promising Regulatory Response To Digital Public Health Hazards, Matthew B. Lawrence, Brett Frischmann, Avi Sholkoff
Faculty Articles
Tort liability for failure to “age gate” is a promising legal response to the public health hazards of AI, social media, sports gambling, and other digital spaces. Tort liability for failure to “age gate” hinges liability for harms to minors on an app’s failure to take reasonable steps to prevent minors from gaining access or otherwise to apply appropriate governance rules, such as privacy-protective default settings or ensuring genuine parental consent. While no one legal response is a panacea, tort liability for failure to age gate carries several distinctive advantages that make it a particularly promising option at this stage …
Criminal Investors, Andrew K. Jennings
Criminal Investors, Andrew K. Jennings
Faculty Articles
This Article reassesses the culpability of those who invest in law-breaking firms. Prosecutors currently treat investors as victims of corporate wrongdoing rather than as actors who might bear responsibility for it. This Article observes, though, that investment can facilitate, and even cause, illicit corporate activity. When investors intentionally contribute to those effects, substantive criminal law imposes liability on them just the same as it does on accomplices, conspirators, or principals in other contexts. Despite this formal parity, however, investor criminal liability is more a theoretical proposition than a practical reality.
This Article questions that status quo by asking whether and …
Moral Panic Or Public Health Crisis? Lessons From Drugs And Gambling For “Addictive” Design, Matthew B. Lawrence, Haomin (Kevin) Yan
Moral Panic Or Public Health Crisis? Lessons From Drugs And Gambling For “Addictive” Design, Matthew B. Lawrence, Haomin (Kevin) Yan

In her important book, Unwired: Gaining Control Over Addictive Technologies, Gaia Bernstein illustrates the value of a comparative approach, drawing lessons from fights around the regulation of tobacco and ultra-processed food for the regulation of social media. Building on Bernstein’s work, this symposium contribution aims to draw additional insight from experience with drug and gambling regulation for the regulation of social media, video games, AI, and other potentially-addictive technologies.
Specifically, after introducing Bernstein’s book and the foundation it lays, we draw six lessons from the study of psychoactive drugs and gambling. As we elaborate below: Lesson one is that …
Constitutionalizing Climate Rights, Mark P. Nevitt
Constitutionalizing Climate Rights, Mark P. Nevitt
Faculty Articles
This Essay proceeds in three Parts. In Part I, I describe and analyze which states have climate and environmental amendments within their state constitutions. Here, I focus on three states (Hawaii, Montana, and Pennsylvania) that have comparably strong Green Amendments and have experienced litigation in recent years enforcing these constitutional provisions. I describe and analyze three cases: Navahine F. v. Hawaii Department of Transportation (Hawaii), Held v. Montana (Montana), and Robinson Township (Pennsylvania). I argue that these three decisions—all of which enjoyed varying degrees of success—will spur greater efforts to constitutionalize state environmental rights. Indeed, there are grassroot efforts within …
Extramural Absolutism, Deepa Das Acevedo
Extramural Absolutism, Deepa Das Acevedo
Faculty Articles
As battles over academia escalate, an area of intensifying concern is the speech faculty engage in outside their professional functions—what is often called “extramural” speech. Professors have been criticized, disciplined, pressured to resign, and even terminated for extramural speech that is deemed offensive by individuals inside and outside university communities. And yet, academics generally remain committed to a principle that this Article identifies as extramural absolutism.
The Article explains extramural absolutism’s unpopularity outside academia as a reasonable consequence of the way supporters have presented and justified it. Contrary to widespread scholarly portrayal, extramural absolutism is not a moderate concession justified …
Searching For A Big Score: Analyzing Drug Yield From Search Warrant Executions, Elizabeth Griffiths, Walter Campbell, Kay L. Levine, Joshua C. Hinkle
Searching For A Big Score: Analyzing Drug Yield From Search Warrant Executions, Elizabeth Griffiths, Walter Campbell, Kay L. Levine, Joshua C. Hinkle
Faculty Articles
In this study, we investigated the extent to which law enforcement efforts predicted drug and other kinds of illicit yield in search warrant executions. The data are drawn from one major metropolitan police department during 2005, 2009, and 2012. Using multilevel random intercept logistic regression models and multilevel random intercept multinomial logistic regression models, we regress high yields of various kinds of drugs and other illicit items seized during searches on the investigative activities that led to search warrant applications and the enlistment of teams of officers or other agencies in executing the search. Investments in high-effort search warrant work …

In March and April 2025, the Trump Administration issued a series of executive orders directed at various law firms that had represented clients or undertaken actions with which the President disagreed. Those executive orders imposed various sanctions capable of destroying the firms financially. The Administration also threatened numerous other law firms with similar types of executive orders.
Although a few law firms challenged the executive orders in court, the majority of firms targeted by the President entered into informal settlement agreements whereby the firms promised to provide between $40 million and $125 million worth of free “pro bono legal services” …
Chevron Stare Decisis In A Post-Loper Bright World, Jonathan R. Nash
Chevron Stare Decisis In A Post-Loper Bright World, Jonathan R. Nash
Faculty Articles
In its June 2024 decision in Loper Bright Enterprises v. Raimondo, the Supreme Court jettisoned the longstanding Chevron doctrine, which had directed courts to defer to agencies’ reasonable interpretations of ambiguous statutes. The Loper Bright Court attempted to minimize the substantial effect this change would have on administrative law and governance by declaring that “[t]he holdings” of cases that relied on the Chevron test to conclude “that specific agency actions are lawful...are still subject to statutory stare decisis despite our change in interpretive methodology.” But there are two problems with Chevron stare decisis. First, Chevron stare decisis is …
Defederalizing Opioid Addiction Care, Matthew B. Lawrence
Defederalizing Opioid Addiction Care, Matthew B. Lawrence
Faculty Articles
Lack of access to evidence-based care for drug addiction is an urgent problem amid a decades-long overdose crisis that kills tens of thousands of Americans a year. Opioid addiction is the primary driver of overdoses today, and medicines exist to treat such addiction that can dramatically improve quality of life while reducing the risk of deadly overdose by more than half. Yet fewer than one in four of the nine million Americans who need such evidence-based medical care for their addiction receive it. Chief among barriers to access are restrictive and burdensome federal requirements limiting the use of narcotic medications …
Cumulative Environmental Impacts In Thailand : A Legal Appraisal Of The Eia Regime Under Neqa, Leila Kenza Cherkaoui
Cumulative Environmental Impacts In Thailand : A Legal Appraisal Of The Eia Regime Under Neqa, Leila Kenza Cherkaoui
Chulalongkorn University Theses and Dissertations (Chula ETD)
This Research examines the limitations of Thailand’s Environmental Impact Assessment (EIA) framework under the Enhancement and conservation of National Environmental Quality Act B.e. 2535 (1992) (NEQA), with a focus on its failure to address cumulative environmental impacts in tourism-intensive regions such as Phuket, Koh Samui, and Chiang Mai. While EIA was originally introduced to ensure that environmental risks are considered before project approval, in practice Thailand’s system remains narrowly projectbased, overlooking the combined effects of multiple small and medium scale development that together exceed ecological carrying capacity. This has contributed to serious environmental degradation, including coral reef decline, freshwater depletion, …
Developing Data Handling Guidelines For Open-Source Llm Training In Compliance With Section 37 Under Thailand’S Pdpa And Related Legal Provisions, Nattakrit Kawejaiboon
Developing Data Handling Guidelines For Open-Source Llm Training In Compliance With Section 37 Under Thailand’S Pdpa And Related Legal Provisions, Nattakrit Kawejaiboon
Chulalongkorn University Theses and Dissertations (Chula ETD)
This study examines the application of Section 37 under Thailand’s PDPA to the fine-tuning of Open-weight Models in decentralized LLM development. Data controllers are defined as developers responsible for their specific stages including collection, storage, fine-tuning, and deployment, excluding the original base model liability. Utilizing doctrinal analysis, international frameworks, and semi-structured interviews with Thai practitioners, the research proposes a practical guideline for LLM data handling. Designed to assist small-scale developer groups who possess foundational knowledge of LLM data handling, the guidelines aim not to replace existing practices, but to guide and align current workflows towards legal compliance. This ensures that …

ปัญหามาตรการคุ้มครองชั่วคราวในชั้นอนุญาโตตุลาการ, วราลี โยธาวิจิตร
Chulalongkorn University Theses and Dissertations (Chula ETD)

Healing Communities With Police Divestment: Seeking Abolition Through Transformative Reform And Community-Government Collaboration, Jessica E. Gillson
Healing Communities With Police Divestment: Seeking Abolition Through Transformative Reform And Community-Government Collaboration, Jessica E. Gillson
Undergraduate Honors Theses
Concerns about the efficacy and sustainability of the U.S. carceral system have persisted throughout the country’s history, recently fueling renewed activism and bipartisan calls for reform. However, proposed solutions remain divisive. This thesis first defines the current status of our prison systems, then explores collaborative alternatives to incarceration and policing that support communities and break cycles of incarceration.
Focusing on partnerships among local governments, community organizations, justice-involved individuals, and law enforcement, this study examines holistic approaches to crime prevention, reentry, and reintegration. Using an interdisciplinary framework incorporating restorative justice, community resilience, and systems theory, it investigates how community-based strategies can …

Te Kaitiakitanga O Ngā Tūpuna: Restructuring Repatriation And Globalizing Decolonial Indigeneity, Kailee A. Hall
Undergraduate Honors Theses
Preserving cultural heritage through repatriation has admittedly worked against Indigenous communities because museums have maintained a system of control over their belongings and have fractured their trust in partnerships. Repatriation is the process by which Indigenous belongings, land, and people are returned, and must be decolonized into a system of support within museums’ institutional structures. The aim of this thesis is to analyze how the institutional mechanisms for repatriation are ineffective and offer a new framework to be globalized and accessible. While decolonial theories and methods act as a lens, Māori educationalist Graham Hingangaroa Smith’s Kaupapa Māori is a theoretical …

The American Bar Association’s Standards for Legal Education and Admissions to the Bar require law schools to provide students with “substantial opportunities” for “[t]he development of a professional identity.” The Standards do not require a particular curriculum or mode of instruction but offer two guideposts for legal educators: one, that “professional identity focuses on what it means to be a lawyer and the special obligations lawyers have to their clients and society,” and two, that professional formation “should involve an intentional exploration of the values, guiding principles, and well-being practices considered foundational to successful legal practice.” The guidance and concomitant …

Alternate Approaches: Beyond Problem-Solving Courts, Erin Collins

Problem-solving courts were born out of a well-meaning experimentalist spirit, a spirit that is very much in line with the vision of a recent symposium on the multidoor criminal courthouse. These courts, which include drug courts, mental health courts, veterans courts, and many other specialized criminal courts, were created as a way to close one door to the criminal courthouse — the so-called “revolving door” that appeared to bring some people accused of crimes back into court as soon as they exited. Problem-solving court judges sought to open a different door for some of those who entered their courtrooms, one …
Reputation Reconsidered, James Gibson
Reputation Reconsidered, James Gibson

Reputation has a great reputation. We know this because the law values, venerates, and subsidizes reputation in many ways. Contract law relies on it as a means of disciplining the market without the need for intrusive regulation. Defamation law lets individuals and businesses seek relief when their reputations are sullied. Trademark law grants exclusive rights in order to encourage rightsholders to invest in their reputations. In these fields and others, the law views reputation as an important, socially positive good.
This faith in the integrity and value of reputation is unwarranted. Our impression of any given business is subject to …

Qualified Immunity & Subjective Knowledge, John F. Preis

There is something weird going on within the doctrine of qualified immunity. The Supreme Court and lower courts routinely claim that officers who “knowingly violate the law” are not entitled to qualified immunity, but then—in almost the same breath—assert that an officer’s knowledge of the law is irrelevant to the qualified immunity analysis. What is even more strange is that these two opposing views can apparently be traced to the foundational case in the field: Harlow v. Fitzgerald.
This Article explores and proposes a resolution to this apparent contradiction. Beginning with Harlow itself, the Article explores the case using the …

Much like climate change, the clean energy transition presents a “super wicked” problem that is further complicated by prioritizing justice. History has taught us that government regulation, industry innovation, and community engagement are the catalysts of effective transitions. Similarly, the just energy transition requires the support of these interconnected networks. This Essay offers sustainable collaborative governance as a theoretical framework through which decision-makers may filter their assessments, industry can model its metrics, and community can develop language to articulate its needs. Sustainable collaborative governance is also a means of navigating the complexities of renewable energy siting and regulation while fostering …

This paper introduces a novel approach to measure a patent's economic value by examining whether the patent's disclosure leads to rejection of another pending US patent application. This approach considers the use of the patent by the US Patent and Trademark Office (USPTO) in office action rejections on the grounds of novelty or obviousness, as well as its citation as an X or Y reference in a European Patent Office (EPO) search report, which provides analogous information. Unlike conventional citation metrics widely employed by economists, the novel metric is arguably more closely tied to private value, as it is centered …

This article will outline the distinct special education and related service needs of children with autism and describe a new model for a medical-legal partnership tailored to address those needs and educate the professionals who work with children with autism. We will share results supporting the use of this model from a series of Interprofessional Education (“IPE”) case studies and consultations the authors conducted through interdisciplinary coursework shared among several graduate schools within Touro University. Part I explains the legal and client-centered framework within which the medical-legal partnership operates. Part II identifies the advantages of Applied Behavioral Analysis (ABA) and …

Web Of Exploitation: The Psychological Need For Comprehensive Federal Law To Combat Cyber Sexual Abuse, Sarah E. Bahrenburg
Journal of Race, Gender, and Ethnicity
Cyber sexual abuse inflicts deep and lasting psychological harm on victims, often exacerbating the trauma of traditional sexual abuse due to the permanence and reach of digital content. Survivors may experience depression, anxiety, PTSD, and suicidal ideation as intimate images, videos, or messages resurface indefinitely online. Despite the severity of its impact, current state and federal legal protections are limited and inconsistent, leaving many victims without adequate criminal or civil remedies. This article argues for the creation of comprehensive federal legislation specifically targeting cyber sexual abuse. Such laws would not only provide clearer paths to justice and accountability but also …
