The Need For The Enactment Of Prize Law Legislation In Indonesia, Pornomo Rovan Astri Yoga
Indonesian Journal of International Law
Indonesia is a peace-loving nation. However, maintaining independence is more precious than maintaining peace. Therefore, Indonesia will always be ready to maintain its independence at any cost, including war. Indonesia claims itself as a maritime nation. All of those facts disregard the point that Indonesia lacks legislation regarding the law of naval warfare. This is particularly true in the case of the prize law. There are no single laws, statutes, or even procedures that govern the prize law in times of armed conflict at sea. The practice of the prize law has also been lacking since Indonesia’s independence in 1945. …

The Paris Convention and Trademark Law Treaty (TLT) have emphasized the importance of distinctive characteristics of words as marks. The TRIPs have stated that trademarks are signs with distinguishing power and one of the elements are words. There are two doctrines related to the distinguishing power of words, namely the likelihood of confusion and dilution. There are also eight categories of words as trademarks with distinctive power that are recognized internationally. Indonesian trademark law has regulated distinctive characteristics of wordmarks in relation to words that cannot be registered as trademarks and words whose application for registration has been rejected. Despite the presented advantages associated with the effort, it is important to state that the agreement has raised concerns in Indonesia regarding its implications for maritime stability and …
Home Equity Theft: A Right Without A Just Remedy, Mitchell F. Crusto
Home Equity Theft: A Right Without A Just Remedy, Mitchell F. Crusto
William & Mary Law Review Online
Several local governments throughout the country have confiscated homeowners’ real property for overdue real property taxes, sold those properties to investors at a discount, and pocketed millions of dollars in profits from the sales. The victims of such “home equity theft” are disproportionately elderly, African American homeowners in gentrified urban communities. One such victim, Geraldine Tyler, a vulnerable ninety-four-year-old African American woman living in a nursing home, claimed that the government’s taking of her property’s value violated the U.S. Constitution. In response, both a federal district court and a federal appellate court denied her claim, declaring that she lacked a …

On the same basis, the countries calculate the date of their inception, the date of their independence, the date of the revolutions that changed their paths, the history of the wars in which they were victorious, the date of birth or death of their founders, and other important events. In view of the importance of time in determining the timings upon which many of the Shari’a rulings are based and to explain the signs …

Abstract
The principle of certainty of contract is considered one of the principles included in the unwritten English common law of customary origins and based upon judicial precedents of the English courts. It allows the court to intervene to give certainty to the contract, and save it from nullity; by completing it through construction and adding some phrases to its legal wording, and giving it an objectively clear meaning, that is consistent with the common intention of the contracting parties. This principle can also nullify the contract, despite the availability of its basic elements, if its subject matter and terms …

Understanding Public Domain Case Citations, Joshua Levine
Library Staff Online Writings
I first learned about public domain citations after law school, when I was working on a fifty-state survey. I was completely used to parentheticals that included the deciding court and the year of decision, so I couldn’t understand the examples I found from certain states. I thought that surely something was missing from these citations!

This Article examines the evolving interpretation of the Copyright Act's statute of limitations in light of RADesign, Inc. v. Michael Grecco Productions, Inc., a case pending before the Supreme Court. Following the Court's decision in Warner Chappell Music, Inc. v. Nealy (2024), which left open the question of whether copyright claims can be based on infringement occurring more than three years prior, the circuit courts remain split on whether the three-year statute of limitations runs from the time of infringement (the "injury rule") or from when the copyright holder discovers the infringement (the "discovery rule"). Through analysis of the Grecco …
