The 5BFTS Association gave donations to the NMA which provided a Grove of five trees (five for number 5) comprising two English Birch trees and three American Birch trees and a Plaque. This Article will analyze the comprehensive demographic jury data reforms adopted by the Nebraska Supreme Court through new Court Rules and a new Juror Qualification Form (“Questionnaire”) promulgated October 2024 (“January 2026 Reforms”) and effective January 1, 2026. The Court has embraced major reforms that are cause for optimism that the Court will continue the journey to reinvigorate the guarantee that juries be drawn from a fair cross-section of the community served by the trial court as required by the Sixth Amendment and the Nebraska Jury Selection Act of 1979 (“NJSA”).

In the 2008 case, District of Columbia v. Heller, the Supreme Court, for the first time, held that the Second Amendment protects an individual right to bear arms. Challenges to various federal gun control laws immediately followed, including challenges to 18 U.S.C. § 922(g)(5)(a), which prohibits possession by an undocumented immigrant. Between 2008 and 2022, courts faced with challenges to § 922(g)(5)(a) universally upheld it. Then the Court decided New York State Rifle and Pistol Association v. Four years ago, the Supreme Court revolutionized Second Amendment law in New York Rifle & Pistol Ass’n, Inc. v. Bruen by instituting a test concentrated on text, history, and tradition. To uphold a firearm regulation, the government must demonstrate a relevantly similar historical analogue. Shortly after, the Court affirmed but clarified its position in United States v. Rahimi by performing the Bruen analysis at a higher level of generality and rejecting a challenge to 18 U.S.C. 922(g)(8). “The friendly skies are not always so friendly.” This Note supports the Ninth Circuit’s en banc opinion in United States v. Lozoya, which determined that the landing district is the proper venue for prosecuting in-flight crime. The Ninth Circuit’s en banc ruling overturned the requirement to prosecute in-flight crimes in flyover districts, which created practical and evidentiary burdens for the prosecution and defense. The establishment of the landing district as the proper venue for in-flight crime prosecution promotes practical adjudication, justice for victims, constitutionally sound trials for defendants, uniformity for inflight prosecution, and encompasses Congress’s intent when enacting 18 U.S.C. …

“It is curious that the Legislature has chosen to give a presumption of probation for more serious felony offenses, but not for lesser misdemeanor offenses.” With those words, Judge Bishop concluded a heart-wrenching opinion in State v. Anderson, which upheld Courtney Anderson’s sentence of 240 days in jail. Despite being sentenced for a first offense Class I misdemeanor and nearly every sentencing factor counseling in favor of probation, the district court decided to separate Ms. Anderson from her two children, one of whom was a newborn. The Supreme Court’s recent embrace of “historical practices and understandings” in interpreting the Establishment Clause has emboldened states to challenge forty-five years of precedent prohibiting Ten Commandments displays in public schools. Yet, these states advance a version of history that mistakenly ignores European religious persecution that shaped how the Founders understood the establishment of religion. This Essay remedies that error through a novel historical analogy: sixteenth-century Catholic processions that forced Protestants to choose between betraying their conscience or marking themselves for persecution. The soil freezing characteristic curve (SFCC), which relates unfrozen water content to temperature, is a fundamental constitutive relationship in frost heave simulations. However, the influence of soil suction, another critical state variable, is often neglected. This study highlights how the SFCC is significantly affected by suction conditions, with unfrozen water content varying markedly between saturated (suction = 0) and completely dried (suction = ∞) conditions at the same subfreezing temperature. Recognizing this limitation, the concept of the soil freezing characteristic surface (SFCS) is proposed to incorporate the impacts of both temperature and suction on unfrozen water content. Blast-furnace slag, which contains high levels of CaO (and MgO), holds potential as a feedstock for CO2 capture and storage. This study investigates the phase transitions occurring during the wet carbonation of ground granulated blast-furnace slag (GGBFS), characterizes the physical and chemical properties of carbonated GGBFS (CS), evaluates its pozzolanic reactivity, and examines the microstructure and performance of cement pastes blended with GGBFS or CS. The findings reveal that aragonite and calcite, the primary carbonation products, precipitate on the surface of GGBFS, hindering its dissolution and thereby reducing both the pozzolanic reactivity and the early strength of cement pastes. …

In this paper, we present a rigorous optimal error analysis for a semi-discrete finite element method of the coupled Cahn-Hilliard-Navier-Stokes-Darcy model. The optimal convergence order for the phase variable in the L(0,T;H1) norm and the velocity in the L(0,T;L2) norm are proved with two key techniques. One key technique is establishing the discrete L2(0,T;H2)∩L2(0,T;L) boundedness of the numerical solution for the phase variable to handle the nonlinear regional coupling terms. In this paper, we propose Fourier pseudospectral methods to solve the variable-order space fractional wave equation and develop an accelerated matrix-free approach for its effective implementation. In constant-order cases, fast algorithms can be designed via the fast Fourier transforms (FFTs), and the computational cost at each time step is O(Nlog⁡N) with N the total number of spatial points. In variable-order cases, however, the spatial dependence in the power s(x) leads to the failure of inverse FFTs. While the direct matrix-vector multiplication approach becomes impractical due to excessive memory requirements. Conviction Integrity Units within prosecutors’ offices have doubled in number over the last 10 years. Leaders of the innocence movement initially praised these units, believing they were necessary for the future of innocence work given their unique access to discovery, and scholars hoped Conviction Integrity Units would lead prosecutors away from fighting against claims of innocence to sincere and open review of wrongful convictions. But, as Conviction Integrity Units proliferated, the question of whether prosecutors can fulfill the mandate of these offices and conduct thorough review of their colleagues’ work has received insufficient inquiry, particularly given that official misconduct continues …

We propose a topology-optimization framework for optimizing finite structures of arbitrary shape by combining density-based methods with level-set approaches. We first optimize regular polygonal structures to suppress the photonic density of states and find that the best performing polygon is consistent with a tiling of space with hexagonal unit cells. We next show that introducing cavities into hexagonal structures further suppresses the photonic density of states, particularly when the cavity is also hexagonal. Such a result would find application in the design of fiber-optic cables. We then describe an approach for optimizing arbitrary x-simple or y-simple designs that can recover …
