The watershed discarding of Roe v. Wade by the Supreme Court in Dobbs v. Jackson Women’s Health Organization1 predictably included a discussion of the role of stare decisis. After deciding that the Constitution does not protect the right to make decisions about abortion, the Court considered whether stare decisis counseled leaving Roe in place to protect the integrity of the legal process.2 In this discussion, the majority cited Payne v. Tennessee,3 a fairly obscure 1991 case regarding the admissibility of victim impact evidence in death penalty sentencing hearings.4 In Payne, the Court abandoned several recent precedents, concluding that “[s]tare decisis …

Snap removal, the “swift removal of a case before a forum defendant can be served,”1 is “the rare case in which it is as clear as anything ever can be that Congress did not mean what in strict letter it said.”2 There is no evidence that when the removal statutes were amended in 1948, Congress intended to allow forum defendants to remove a case before being served.3 Indeed, many courts have reached the opposite conclusion.4 Thus, allowing snap removal leads to absurd results.5 Some courts deem snap removal absurd.6 Three circuit courts, however, find this practice acceptable.7 Some scholars claim …

The role of time in constitutional precedent lies at the heart of judicial decision making. While there is a consensus on the importance of precedent, the modalities of its application remain a subject of intense debate within legal circles. At the core of this discourse lies a fundamental tension: the imperative to maintain fidelity to established precedent, thereby ensuring legal stability and predictability, versus the necessity to re-evaluate and potentially overturn precedent in response to evolving societal norms or innovative constitutional interpretations. The 2022 and 2023 Supreme Court terms were “blockbusters.”1 From the rousing dissents in Trump v. United States2 to the death knell of Chevron deference3 and the intense debates over the role of history in judicial decision-making encapsulated in Vidal v. Elster,4 the past several terms have provided both significant insight into decisionmaking processes at the Court and substantial change to previously settled law. Its impacts are already the subject of a slew of writing, both in legal journals and the popular press.5 Largely missing from the conversation is discussion of the high Court’s impacts on district courts. Judicial Sanewashing: The Roberts Court's New Canon Of Construction, Erin M. Carr

In late 2024, a new expression—“sanewashing”—began circulating in the lead-up to the presidential election. The term was used to describe the media’s coverage of Donald Trump, in which journalists, in their attempt to make his often incoherent campaign and media statements seem semi-intelligible, were accused of presenting his ideas as more sensible and cogent than they actually were. While finding its contemporary relevance primarily in politics, this Article argues that the sanewashing phenomenon is not limited to the political branches of government or the reporters who cover it. The Rule Of Law's Lack Of Rules, James Bernstein

This Article critiques the reliance on judge-made standards by the Supreme Court, arguing that such standards, while flexible and comprehensive, create significant challenges in application, particularly in lower courts. Standards, characterized by broad and adaptable language, grant judges considerable discretion, often resulting in inconsistent and unworkable outcomes. This phenomenon contributes to what Ran Hirschl terms “juristocracy,” where the judiciary exerts considerable influence over significant social, political, and economic issues, often due to implied deference from other branches of government. Baltic Journal of Health and Physical Activity
Background: Extensive research has identified muscles that are particularly susceptible to emotional stimuli, namely the facial muscles, trapezius, and diaphragm. These muscles can respond to emotional stimuli by affecting the viscoelastic properties of muscles, especially stiffness. This study attempts to identify suggestions in evidence-based physiotherapy (EBP) for treating muscles that are particularly susceptible to emotions. Materials and methods: In order to achieve the goals, studies available in PubMed, PEDro, and Elsevier and Springer databases were analyzed.
