Exploring Unpredictability In Augusta Read Thomas' Six Piano Etudes And Traces, Gianne Ge Zhu Dec 2021

Exploring Unpredictability In Augusta Read Thomas' Six Piano Etudes And Traces, Gianne Ge Zhu

Dissertations, 2020-current

Augusta Read Thomas (1964-) composes in many genres. Her music is often filled with subtle nuances of articulation and color, and contains many intentional "surprises." Thomas achieves these sound effects by applying three compositional principles: by providing a score with detailed instructions and additional information that result in the feeling of "spontaneity"; by using her "organic" language to transform the connections to the past or to living composers; and by considering all musical elements as one "gestalt" to form her music.

Six Piano Etudes (1996-2005) and Traces (2006) are filled with "surprises," in which the listener can discover elements of …

The Technologization Of Insurance: An Empirical Analysis Of Big Data And Artificial Intelligence’S Impact On Cybersecurity And Privacy, Shauhin A. Talesh, Bryan Cunningham Dec 2021

The Technologization Of Insurance: An Empirical Analysis Of Big Data And Artificial Intelligence’S Impact On Cybersecurity And Privacy, Shauhin A. Talesh, Bryan Cunningham

Utah Law Review

This Article engages one of the biggest issues debated among privacy and technology scholars by offering an empirical examination of how big data and emerging technologies influence society. Although scholars explore the ways that code, technology, and information regulate society, existing research primarily focuses on the theoretical and normative challenges of big data and emerging technologies. To our knowledge, there has been very little empirical analysis of precisely how big data and technology influence society. This is not due to a lack of interest but rather a lack of disclosure by data providers and corporations that collect and use these …

Uncovering The Legislative Histories Of The Early Mail Fraud Statutes: The Origin Of Federal Auxiliary Crimes Jurisdiction, Norman Abrams Dec 2021

Uncovering The Legislative Histories Of The Early Mail Fraud Statutes: The Origin Of Federal Auxiliary Crimes Jurisdiction, Norman Abrams

Utah Law Review

The federal crime of mail fraud is generally viewed as the original federal auxiliary jurisdiction crime, that is, a crime that does not protect direct federal interests against harm. Rather, it functions as an auxiliary to state crime enforcement. In the almost 150 years since Congress enacted the mail fraud statute, federal auxiliary crimes have proliferated and have become the most important part of federal criminal jurisdiction—so that, today, they largely duplicate state crimes. It is important to know how this form of federal criminal jurisdiction originated.

Mail fraud is a crime that scholars, judges, and lawyers have viewed as …

An Alternative Class Of Ratio-Regression-Type Estimator Under Two-Phase Sampling Scheme, Muhammad Isah, Zakari Yahaya, Audu Ahmed

CBN Journal of Applied Statistics (JAS)

In this study, a new exponential ratio-regression estimator is developed using an auxiliary variable for estimating the finite population mean under a two-phase sampling system. The Bias and Mean Square Error (MSE) of the proposed estimator are derived and compared with some of the estimators in extant literature. Thus, the conditions under which the proposed estimator is better than some existing estimators are provided. Empirically, using four real datasets and simulation study, the proposed estimator performs better than the classical ratio, classical regression, exponential ratio, and exponential regression cum ratio estimator when compared using the criteria of bias, mean square …

Monetary Policy Transmission And Bank Interest Rates In Nigeria, Eleam Victor E., Ekwom Chinyelu G., Ariolu Chibueze C., Umebali Chukwubuzo J., Balogun Adewale T.

CBN Journal of Applied Statistics (JAS)

The paper examines the adjustment of retail and money market interest rates to changes in discount corridor of the monetary policy in Nigeria. A vector error correction model was adopted for this study, using monthly data from 2007:06 to 2019:12. We further accounted for structural breaks in the dataset to improve its policy reliability. The adjustment parameters were found to be significant but with slow speed of adjustment. This finding provides evidence of the weakness of the discount corridor in monetary policy transmission in Nigeria. Furthermore, the results showed no asymmetric adjustment of retail rates to long run equilibria. Lastly, …

Inflations And Its Uncertainty In Some Ecowas Member States: Transfer Entropy Approach, Otoakhia Eric I. Dec 2021

CBN Journal of Applied Statistics (JAS)

This study examines the information flow between inflation and inflation uncertainty (IU) and intrastate inflationary trend among some ECOWAS member states. IU is measured using GARCH models and stochastic volatility model (SV). Transfer entropy was adopted to quantify the extent of information flow. The result showed information flow exists from inflation to the GARCH measure of IU. On the reverse flow from inflation uncertainty to inflation, there is no information flow except for Burkina Faso and Gambia which have asymmetric bidirectional flow between inflation and IU. Adopting SV measure for IU, there are no support for causality from inflation to …

Relationship Between Real Exchange Rate And Consumption In Nigeria: A Nonlinear Approach, Babangida Jamilu S., Sanusi Aliyu R., Yusuf Isah M. Dec 2021

Relationship Between Real Exchange Rate And Consumption In Nigeria: A Nonlinear Approach, Babangida Jamilu S., Sanusi Aliyu R., Yusuf Isah M.

CBN Journal of Applied Statistics (JAS)

This study analyses the relationship between real exchange rate and domestic consumption in Nigeria using the Smooth Transition Autoregressive (STAR) model from 1981Q1 to 2019Q4. Findings show that domestic consumption determines the regime shift in real exchange rate, suggesting a nonlinear linkage with clearly distinct regimes. The lagged exchange rate is shown to have a significant linear effect on the current exchange rate. On the other hand, current foreign consumption is positive but has no significant impact on the exchange rate in the linear part of the model. In the nonlinear part of the model, evidence of a significant negative …

The Temptation Of Cosmic Private Law Theory, Nathan B. Oman Dec 2021

The Temptation Of Cosmic Private Law Theory, Nathan B. Oman

Faculty Publications

It’s a heady time to be a theorist of private law. After decades of vague post-Realist functionalism or reductive economic theories, the latest generation of private law theorists have provided a proliferation of new philosophies of tort, contract, and property. The result has been a tremendous burst of intellectual creativity. While Kant and Hegel have been dragooned into debates over torts and contracts and even such supposedly wooly headed thinkers as Coke and Blackstone have been rehabilitated, there have been fewer efforts to generate natural law accounts of private law than one might expect, particularly in light of the revival …

Millennials' Strategic Decision Making Through The Lens Of Corporate Social Responsibility And Financial Management, Mark Reavis, Kuldeep Singh, Jack Tucci

Faculty Publications - The LeMoyne Smith School of Business

Corporate Social Responsibility (CSR) is the touchstone for millennials when looking at the means for making their world a better place. Higher education’s focus on CSR has allowed millennials to focus their decision-making using a CSR/stakeholder approach to financial management decisions. Millennials’ support for a CSR/stakeholder approach has grown as they have been completing college. The CSR/stakeholder approach has increased partly due to social awareness created by curricula that highlights areas of social and environmental inequality. This CSR/stakeholder approach has recently emerged as a bona fide strategic management option globally. This paper extends CSR research by evaluating millennial financial decisions …

Facing Injustice: How Face Recognition Technology May Increase The Incidence Of Misidentifications And Wrongful Convictions, Laura M. Moy Dec 2021

Facing Injustice: How Face Recognition Technology May Increase The Incidence Of Misidentifications And Wrongful Convictions, Laura M. Moy

Georgetown Law Faculty Publications and Other Works

Does law enforcement use of face recognition technology paired with eyewitness identifications increase the incidence of wrongful convictions in U.S. criminal law? This Article explores this critical question and posits that the answer may be yes. Facial recognition is frequently used by law enforcement agencies to help generate investigative leads that are then presented to eyewitnesses for positive identification. But erroneous eyewitness accounts are the number one cause of wrongful convictions, and the use of face recognition to generate investigative leads may create the conditions for erroneous eyewitness identifications to take place. This is because face recognition technology is designed …

Biofilm Viscoelasticity And Nutrient Source Location Control Biofilm Growth Rate, Migration Rate, And Morphology In Shear Flow, Hoa Nguyen, Abraham Ybarra, H. Başağaoğlu, Orrin Shindell Dec 2021

Biofilm Viscoelasticity And Nutrient Source Location Control Biofilm Growth Rate, Migration Rate, And Morphology In Shear Flow, Hoa Nguyen, Abraham Ybarra, H. Başağaoğlu, Orrin Shindell

Mathematics Faculty Research

We present a numerical model to simulate the growth and deformation of a viscoelastic biofilm in shear flow under different nutrient conditions. The mechanical interaction between the biofilm and the fluid is computed using the Immersed Boundary Method with viscoelastic parameters determined a priori from measurements reported in the literature. Biofilm growth occurs at the biofilm-fluid interface by a stochastic rule that depends on the local nutrient concentration. We compare the growth, migration, and morphology of viscoelastic biofilms with a common relaxation time of 18 min over the range of elastic moduli 10–1000 Pa in different nearby nutrient source configurations. …

Cross-State Differences In The Processes Generating Black–White Disparities In Neonatal Mortality, Benjamin Sosnaud Dec 2021

Cross-State Differences In The Processes Generating Black–White Disparities In Neonatal Mortality, Benjamin Sosnaud

Sociology & Anthropology Faculty Research

The U.S. Black neonatal mortality rate is more than twice the White rate. This dramatic disparity can be decomposed into two components: (1) disparities due to differences in the distribution of birth weights, and (2) disparities due to differences in birth weight–specific mortality. I utilize this distinction to explore how the social context into which infants are born contributes to gaps in mortality between Black and White neonates. I analyze variation in Black–White differences in neonatal mortality across 33 states using 1995–2010 data. For each state, I calculate the contribution of differences in birth weight distribution versus differences in birth …

The Charitable Continuum, Eric Kades Dec 2021

The Charitable Continuum, Eric Kades

Faculty Publications

There are powerful fairness and efficiency arguments for making charitable donations to soup kitchens 100% deductible. These arguments have no purchase for donations to fund opulent church organs, yet these too are 100% deductible under the current tax code. This stark dichotomy is only the tip of the iceberg. Looking at a wider sampling of charitable gifts reveals a charitable continuum. Based on sliding scales for efficiency, multiple theories of fairness, pluralism, institutional competence and social welfare dictate that charitable deductions should in most cases be fractions between zero and one. Moreover, the Central Limit Theorem strongly suggests that combining …
