Boom Or Bust: Ensuring The Georgia State-Wide Business Court Fulfills Its Constitutional Promise, Roya Naghepour Dec 2021

Boom Or Bust: Ensuring The Georgia State-Wide Business Court Fulfills Its Constitutional Promise, Roya Naghepour

Georgia Law Review

The United States judiciary includes specialized court systems within its baseline civil and criminal justice structure that provide more efficient and expert adjudication in a wide variety of areas. Since the creation of the Delaware Court of Chancery in 1792, many states have established specialized business courts with jurisdiction over commercial and corporate disputes. Today, many states have business court models, all choosing to employ some version of a specialized forum for corporate and commercial issues for the sake of judicial efficiency. The Georgia State-wide Business Court was established in 2019 with limited jurisdiction over narrow categories of commercial disputes. …

The Gig Economy’S Short Reach: An Analysis Of The Scope Of The Federal Arbitration Act’S “Transportation Worker” Exemption, Emina Sadic Herzberger Dec 2021

The Gig Economy’S Short Reach: An Analysis Of The Scope Of The Federal Arbitration Act’S “Transportation Worker” Exemption, Emina Sadic Herzberger

Georgia Law Review

The Federal Arbitration Act (FAA) governs arbitration agreements in the United States. Section 1 of the FAA provides an exemption from arbitration for “contracts of employment of seamen, railroad employees, or any other class of workers engaged in foreign or interstate commerce.” In a 2001 decision, Circuit City Stores, Inc. v. Adams, the U.S. Supreme Court held that the residual phrase “any other class of workers engaged in foreign or interstate commerce” includes transportation workers. But, such language is ambiguous, and the Supreme Court did not expound upon what it means to be a transportation worker or to be engaged …

Both the planning and public health literature have discussed proximity to greenspaces as predominantly beneficial to health, based on studies mostly conducted in high-income regions. Understanding the health risks of proximity to greenspace and nature—where pathogens and wildlife coexist—is important, as nature-based solutions are increasingly called for to address complex urban challenges. This exploratory pilot study bridges planning and epidemiology approaches to develop a new method to analyze habitat and environmental factors associated with the risk of vector-borne Chagas disease in a low-income region, South Texas. Chagas disease is endemic in Latin America, where it affects between seven to eight …

Background: Sleep-disordered breathing is a common disorder associated with significant morbidity. The genetic architecture of sleep-disordered breathing remains poorly understood. Through the NHLBI Trans-Omics for Precision Medicine (TOPMed) program, we performed the first whole-genome sequence analysis of sleep-disordered breathing. Methods: The study sample was comprised of 7988 individuals of diverse ancestry. Common-variant and pathway analyses included an additional 13,257 individuals. We examined five complementary traits describing different aspects of sleep-disordered breathing: the apnea-hypopnea index, average oxyhemoglobin desaturation per event, average and minimum oxyhemoglobin saturation across the sleep episode, and the percentage of sleep with oxyhemoglobin saturation < 90%. We adjusted for age, sex, BMI, study, and family structure using MMSKAT and EMMAX mixed linear model approaches. Additional bioinformatics analyses were performed with MetaXcan, GIGSEA, and ReMap. Results: We identified a multi-ethnic set-based rare-variant association (p = 3.48 × 10−8) on chromosome X with ARMCX3. Additional rare-variant associations include ARMCX3-AS1, MRPS33, and C16orf90. Novel common-variant loci were identified in the NRG1 and SLC45A2 regions, and previously associated loci in the IL18RAP and ATP2B4 regions were associated with novel phenotypes. Transcription factor binding site enrichment identified associations with genes implicated with respiratory and craniofacial traits. Additional analyses identified significantly associated pathways. Conclusions: We have identified the first gene-based rare-variant associations with objectively measured sleep-disordered breathing traits. Our results increase the understanding of the genetic architecture of sleep-disordered breathing and highlight associations in genes that modulate lung development, inflammation, respiratory rhythmogenesis, and HIF1A-mediated hypoxic response.

In genetics, aggregation of many loci with small effect sizes into a single score improved prediction. Nevertheless, studies applying easily replicable weighted scores to neuroimaging data are lacking. Our aim was to assess the reliability and validity of the Neuroimaging Association Score (NAS), which combines information from structural brain features previously linked to mental disorders. Participants were 726 youth (aged 6–14) from two cities in Brazil who underwent MRI and psychopathology assessment at baseline and 387 at 3-year follow-up. Results were replicated in two samples: IMAGEN (n = 1627) and the Healthy Brain Network (n = 843). NAS …

Several studies have established specific relationships between White Matter (WM) and behaviour. However, these studies have typically focussed on fractional anisotropy (FA), a neuroimaging metric that is sensitive to multiple tissue properties, making it difficult to identify what biological aspects of WM may drive such relationships. Here, we carry out a pre-registered assessment of WM-behaviour relationships in 50 healthy individuals across multiple behavioural and anatomical domains, and complementing FA with myelin-sensitive quantitative MR modalities (MT, R1, R2∗).

Surprisingly, we only find support for predicted relationships between FA and behaviour in one of three pre-registered tests. For one behavioural domain, …

Mechanisms And Applications Of Improved Protein Analysis By Desorption Electrospray Ionization Mass Spectrometry (Desi-Ms), Roshan Javanshad

Dissertations

Electrospray ionization mass spectrometry (ESI-MS) is a soft ionization technique that allows detection of macromolecules, such as intact proteins, by the formation of multiply charged ions from solutions. Desorption electrospray ionization mass spectrometry (DESI-MS) is an ambient ionization technique that directly samples analyte from a surface during ESI-MS analysis. Although DESI-MS is highly accomplished at the analyses of metabolites, lipids, and other small molecules, it is far more limited when it comes to protein analysis. While most of the field in ambient ionization MS has moved towards primarily applications, our approach has been to explore the use of DESI-MS and …

Parametric Characteristics Of The B6omsi-Re, Sarahelizabeth Janemarie Baguhn Dec 2021

Parametric Characteristics Of The B6omsi-Re, Sarahelizabeth Janemarie Baguhn

Dissertations

Orientation and mobility specialists for young children who are blind or visually impaired have relied on informal assessments or commercially available tools designed for sighted children to track developmental progress. When Bradley-Johnson (1994) literally wrote the book on assessment in blindness, the sharing and refinement of common tools led to professionals working in teams to sift and winnow the checklists, and move the best available tools into wider circulation. This has led to the evolution of the practitioner made tools becoming the published tools, although they have not yet had statistical evidence to support their efficacy. This three-paper dissertation aims …

Conditional Wasserstein Generative Adversarial Networks Applied To Acoustic Metamaterial Design, Peter Lai, Feruza Amirkulova, Peter Gerstoft

Faculty Research, Scholarly, and Creative Activity

This work presents a method for the reduction of the total scattering cross section (TSCS) for a planar configuration of cylinders by means of generative modeling and deep learning. Currently, the minimization of TSCS requires repeated forward modelling at considerable computer resources, whereas deep learning can do this more efficiently. The conditional Wasserstein generative adversarial networks (cWGANs) model is proposed for minimization of TSCS in two dimensions by combining Wasserstein generative adversarial networks with convolutional neural networks to simulate TSCS of configuration of rigid scatterers. The proposed cWGAN model is enhanced by adding to it a coordinate convolution (CoordConv) layer. …

Faculty Research, Scholarly, and Creative Activity

After years of advocacy and international negotiation, the General Assembly of the United Nations voted to officially recognize a stand-alone human right to water and sanitation on 28 July 2010. Since, academic scholarship has continued to grow in an effort to understand the implications of the codification of this human right. Yet, with this growth, it has become impractical if not impossible for scholars to keep up with the advancement of academic knowledge or to make sense of it in a systematic way. In short, to date, we know very little about the trends in the literature as they have …

Human error has been implicated as a causal factor in a large proportion of road accidents. Automated driving systems purport to mitigate this risk, but self-driving systems that allow a driver to entirely disengage from the driving task also require the driver to monitor the environment and take control when necessary. Given that sleep loss impairs monitoring performance and there is a high prevalence of sleep deficiency in modern society, we hypothesized that supervising a self-driving vehicle would unmask latent sleepiness compared to manually controlled driving among individuals following their typical sleep schedules. We found that participants felt sleepier, had …

Faculty Research, Scholarly, and Creative Activity

Background: Fire suppression in western North America increased and homogenized overstory cover in conifer forests, which likely affected understory plant communities. We sought to characterize understory plant communities and their drivers using plot-based observations from two contemporary reference sites in the Sierra Nevada, USA. These sites had long-established natural fire programs, which have resulted in restored natural fire regimes. In this study, we investigated how pyrodiversity—the diversity of fire size, severity, season, and frequency—and other environment factors influenced species composition and cover of forest understory plant communities. Results: Understory plant communities were influenced by a combination of environmental, plot-scale recent …

Faculty Research, Scholarly, and Creative Activity

Detecting when and where animals feed is key to understanding their ecophysiology, but our ability to collect these data in marine mammals remains limited. Here, we test a tag-based accelerometry method to detect prey capture in California sea lions. From synchronized underwater video and acceleration data of two trained sea lions, we isolated a combined acceleration and Jerk pattern that reliably indicated prey capture in training datasets. We observed a stereotyped feeding motion in underwater video that included (1) mouth opening while approaching prey; (2) head deceleration to allow initial suction or prey engulfment, and (3) jaw closure. This motion …
