Beyond Data Ownership, Ignacio Cofone

Cardozo Law Review

Proposals for data ownership are widely misunderstood, aim at the wrong goal, and would be self-defeating if implemented. This Article, first, shows that data ownership proposals do not argue for the bundle of ownership rights that exists over property at common law. Instead, these proposals focus on transferring rights over personal information solely through consent.

Second, this Article shows the flaws of a property approach to personal information. Such an approach magnifies well-known problems of consent in privacy law: asymmetric information, asymmetric bargaining power, and leaving out inferred data. This article outlines how strategic philanthropy can align its mission with the United Nations 2030 Agenda for Sustainable Development by describing the experience of the most important foundation of banking origin in Italy. Fondazione Compagnia di San Paolo marked a milestone in 2020 in aligning with the Agenda, applying the Sustainable Development Goals as a rigorous, internationally shared methodological framework and restructuring its operations to focus on three programmatic efforts — Planet, People, and Culture — aligned with those goals.

In the wake of the COVID-19 pandemic, Georgia Governor Brian Kemp and other state governors issued emergency executive orders authorizing the attestation and execution of wills, trusts, and other testamentary documents through the use of audio-video technology. Most states have traditionally required that such testamentary documents be signed in the physical presence of two or more witnesses to be valid. Georgia’s executive order permits these witnesses to instead observe the signing via video-conferencing software, alleviating the requirement that the witnesses be physically present with the testator. In September 2020, in response to the COVID-19 pandemic, the Centers for Disease Control and Prevention (CDC) and the Department of Health and Human Services issued a residential eviction moratorium to prevent the further spread of COVID- 19. One year later, the U.S. Supreme Court terminated the moratorium. Banteng (Bos javanicus), an endangered, wild ungulate, plays a major role in seed dispersal and as a prey animal in Thailand. The population of wild banteng is threatened by poaching and habitat losses. Captive breeding management of banteng has been established and reintroduction of banteng has been successful in some areas. This study investigated the genetic variation of wild and captive banteng, based on mitochondrial DNA (mtDNA) and the Y-chromosome. The mtDNA analysis revealed three novel maternal haplotypes. The Y-chromosome analysis showed two Y-chromosome haplotypes based on the SRY region in the Thai population. This region may be useful as …
