Regulating Mobility Limitations In The Franchise Relationship As Dependency In The Joint Employment Doctrine, Andrew Elmore

Franchisors often impose exhaustive operational standards on franchisees, and enforce those standards by restricting the mobility of their franchisees and their franchisees' employees. But courts often ignore mobility limits when applying joint employer doctrine. This Article argues that courts and agencies should be more likely to find, and presume, that franchisors and their franchisees are joint employers under federal and state employment law based on proof that a franchisor restricts the mobility of franchisees or their employees. Propositions for ideas such as Universal Basic Income (UBI) has reemerged into the mainstream conversation, with some lofty promises. What is the credibility of UBI as a welfare policy platform? Do the results of the studies on the effects of cash-transfers show the possibility of UBI as a new national program, or do they reveal issues that highlight major structural problems with UBI? There is considerable evidence that vestibular dysfunction and anxiety are correlated. Clinical and philosophical arguments suggest that a loss of sense of self, experienced through symptoms like derealization and depersonalization, might contribute to this relationship. The present study used a mixed methods approach, including Systematic Metaphor Analysis, to analyze written short answer and quantitative survey data from one hundred and thirteen participants with vestibular disorders. The Systematic Metaphor Analysis revealed several primary metaphor concepts which elucidated the connections between concrete experience and abstract concepts in vestibular dysfunction. Copper and silver pyrazolate complexes have numerous fascinating properties such as luminescence, catalytic ability, and complexation with small molecules. Using both more widely studied non-fluorinated pyrazolates and less common highly fluorinated pyrazolates as supporting ligands, we successfully synthesized and investigated several new coinage metal complexes. Synthetic details, structures, and properties i.e., luminescence and catalytic ability, have been studied. Chapter 2 of this research describes the synthesis of a new pyrazole with highly fluorinated aryl groups and corresponding trinuclear copper(I), silver(I), and gold(I) complexes. In this research, we have investigated several HFIP-induced biphasic systems of zwitterionic surfactants like CHAPS and DMMAPS and their mixed amphiphilic systems for the extraction, enrichment, and fractionation of mixture of standard proteins and complex sample mixture of yeast proteins. The biphasic systems of zwitterionic surfactants (CHAPS and DMMAPS) and their mixed amphiphiles with quaternary ammonium salts (QUATS= TBAB, TEAB) provide concomitant extraction of hydrophobic membrane proteins, enrichment of lower abundance proteins to one phase, and fractionation of complex sample mixture into two phases. Home care aides are a rapidly growing, non-standard workforce who face numerous health risks and stressors on the job. While research shows that aides receive limited support from their agency employers, few studies have explored the wider range of support that aides use when navigating work stress and considered the implications of these arrangements. To investigate this question, we conducted 47 in-depth interviews with 29 home care aides in New York City, focused specifically on aides’ use of support after client death. Guided by Nils Christie's (1986) Ideal Victim framework, the current study examines the effect that victim/offender relationship status (casual vs. serious), victim self-identity (as a "victim" or a "survivor"), and observer gender (woman vs. man) have on victim blame attributions. Data were collected from 329 adult students at a large public university in the Southwest United States using an online, experimental vignette design. Three separate one-way analysis of variances (ANOVAs) were conducted to test the study's three hypotheses. Results suggest that among the study sample, victim/offender relationship status (H1) and victim self-identity (H2) do not significantly affect victim blame attribution …

Physics graduate teaching assistants (GTA) often instruct student-centered lab and recitation sections at large universities, creating the opportunity to positively impact students. However, as STEM GTA professional development varies by institution and discipline, GTAs rarely receive feedback about their teaching. In K-12 teacher preparation, "microteaching", where a teacher teaches a lesson to peers acting as students, is used to provide feedback. Research has demonstrated benefits to microteaching in K-12 teacher and STEM GTA preparation, but practicing teachers find microteaching can lack authenticity. Recently, researchers have explored integrating technology, like simulation, in pedagogy training to provide a more authentic training experience. …

Personality can be explored hierarchically with higher- and lower-order factors. Recent research suggests the personality hierarchy is comprised of higher-order Big Five traits with two lower-order factors per Big Five trait, termed aspects. There is a lack of research examining the relationship between these lower-order aspects and social anxiety (SA) severity. To better understand these relationships, 443 university undergraduate students (72.2% female; mean age = 20.48, SD = 4.64) completed the Big Five Aspects Scale (BFAS) and the Social Phobia and Anxiety Inventory- 23 (SPAI-23), and were retained following exclusionary criteria. Furthermore, to democratize the process of text analytics, tools must be usable for those with a non-technical background and those who do not have the financial resources to outsource their data analysis needs. Background: COVID-19 has caused a worldwide pandemic, making the early detection of the virus crucial. We present an approach for the determination of COVID-19 infection based on breath analysis.

Introduction: Subjective feelings of loneliness and objective social isolation have been consistently connected with ill-health and mortality, though little work has empirically examined the mechanisms explaining the adverse effects. This study examines whether alcohol consumption explains the connection of loneliness and social isolation on mortality in different age and gender groups.

Methods: The sample comprised a representative 1994 Finnish sample (n = 8,650) matched with 22-year follow-up mortality data. A multigroup path analysis with discrete survival time analyses was conducted.
