Purpose. To explore outcomes of endolymphatic sac surgery for patients with Meniere’s disease with and without the comorbid condition of migraine. Materials and Methods. A retrospective chart review of adult patients undergoing endolymphatic sac surgery at a single tertiary care center from 1987 to 2019 was performed. All adult patients who failed medical therapy and underwent primary endolymphatic sac surgery were included. The main outcome measures were vertigo control and functional level scale (FLS) score. Patient characteristics, comorbidities, and audiometric outcomes were tracked as well. Results. Patients with Meniere’s disease and migraine had a stronger association with …

There is currently an unsolved problem in the legal literature regarding the role cost-benefit analysis should play in determinations of breach in negligence cases. Additionally, despite extensive writings, the relationship between duty and breach in negligence cases remains unclear. At the core of the problem lies the inadequacy of our understanding of breach, which, currently established through a number of independent constructs, lacks a fundamental conceptual base. Further complicating matters is the limited study afforded the nature of the negligence cause of action itself, which leaves the element of duty on unsound footing. This article fills those gaps. To Live More And Die Less: Challenging Tennessee's Anti-Trans Birth Certificate Policy, Guy E. Tustin Iii

This note analyzes Gore, et al., v. Lee, et al., a case challenging Tennessee's birth control policy which explicitly prohibits trans people born in Tennessee from correcting their gender marker to accurately reflect their gender identity. The note begins with a description of the issues the lawsuit hopes to address and continues with a description of the parties, history of anti-trans birth certificate jurisprudence, an analysis of lawyering strategies, and concludes with First Amendment strategies which may be used to fight state laws requiring trans citizens to complete gender confirming procedures in order to correct their birth certificate gender markers.

The first measurements of differential branching fractions of inclusive semileptonic B→Xuℓ+νℓ decays are performed using the full Belle data set of 711 fb-1 of integrated luminosity at the (4S) resonance and for ℓ=e, μ. With the availability of these measurements, new avenues for future shape-function model-independent determinations of the Cabibbo-Kobayashi-Maskawa matrix element |Vub| can be pursued to gain new insights in the existing tension with respect to exclusive determinations. The differential branching fractions are reported as a function of the lepton energy, the four-momentum-transfer squared, light-cone momenta, the hadronic mass, and the hadronic mass squared. Laying It On The Line: How Hernandez V. Mesa Nixed Bivens For A Transnational Homicide, Sean Davis

n Hernandez v. Mesa, the Supreme Court denied the petitioners the opportunity to seek a Bivens remedy for a constitutional violation by a federal official. The Court appears like it will soon remove Bivens remedies entirely. This article analyzes the case and argues that the Court correctly decided the issue. Current literature decries this decision as ignoring precedent but fails to analyze the framework for deciding Bivens cases fully. The article further adopts the stance of the concurrence to argue that Bivens remedies violate the separation of powers, have failed to achieve their stated purpose, and should be completely abolished. …

As long as the concept of monogamy has existed, humans have looked for ways to escape it. Children, a natural consequence of sexual activity, are often negatively affected by the lack of a supportive family structure in single-family households. To correct this, courts often order child support to be paid from one parent to another, usually through the State. This is why paternity determinations are an important court function. One aspect courts have neglected, however, is child support for expecting mothers during pregnancy. Disorderly Conduct: An Investigation Into Police And Prosecutor Practices, Michael Cicchini

Disorderly conduct is usually a misdemeanor statute that criminalizes a broad range of behavior. Law professors have recently called for the abolition of such statutes, arguing that the police are surveilling African American neighborhoods “for signs of disorder” and using the statute “as a means of social control against people of color.”This Article investigates this claim of racist policing by examining a sample of disorderly conduct cases. The sample confirms that African Americans are indeed charged at a disproportionately high rate relative to their percentage of the population. However, the disproportionate charging is not due to racist police surveillance. Rather, …

The suite of derived human traits, including enlarged brains, elevated fertility rates, and long developmental periods and life spans, imposes extraordinarily high energetic costs relative to other great apes. How do human subsistence strategies accommodate our expanded energy budgets? We found that relative to other great apes, human hunter-gatherers and subsistence farmers spend more energy but less time on subsistence, acquire substantially more energy per hour, and achieve similar energy efficiencies. These findings revise our understanding of human energetic evolution by indicating that humans afford expanded energy budgets primarily by increasing rates of energy acquisition, not through energy-saving adaptations such …

Objective: This study examined the impact of a dichotomous versus scaled response format on prevalence rates of sexual violence perpetration and victimization, thus conceptually replicating Hamby et al., 2006 and extending those findings to the context of sexual violence.
Methods: Two samples were recruited from Amazon Mechanical Turk and were randomly assigned to either a dichotomous or scaled response format of the same questionnaire. Sample 1 was used to examine perpetration and received a perpetration specific version of the Post-Refusal Sexual Persistence Scale (PRSPS). Sample 2 was used to examine victimization and received a victimization specific version of the PRSPS. …

As heat wave phenomena and thermal variance events increase in frequency and intensity, it is important to understand how the effect of exposure to constant elevated temperatures on fitness differs from the one of thermal fluctuations. This study aims to investigate how parental thermal environment affects maternal fitness measured as maternal investment and offspring performance. A wild population of the amphipod Gammarus chevreuxi was exposed to constant (15, 20 and 25 °C) or fluctuating (variable between 15 and 25 °C) thermal regimes and allowed to mate. The Syndromic Surveillance System Data report was obtained from Michigan's COVID-19 dashboard, from under the link "Coronavirus Symptoms": https://www.michigan.gov/coronavirus. Data was compiled by the Michigan Department of Health and Human Services (MDHHS). The information was updated three times a week on Mondays, Wednesdays and Fridays.
Syndromic Surveillance System data is obtained from approximately 216 facilities participating in syndromic surveillance (139 Emergency Departments (ED), 77 Urgent Care) across the State of Michigan. Traumatic brain injury (TBI) is highly prevalent in adults. TBI-related functional brain alterations have been linked with common post-TBI neurobehavioral sequelae, with unknown neural substrates. This study examined the systems-level functional brain alterations in white matter (WM) and gray matter (GM) for visual sustained-attention processing, and their interactions and contributions to post-TBI attention deficits. Task-based functional MRI data were collected from 42 adults with TBI and 43 group-matched normal controls (NCs), and analyzed using the graph theoretic technique. At 308 K, using a 9.37 GHz dielectric relaxation setup, dielectric studies of hydrogen bonded complexes of benzamide and acetamide with 4-fluorophenol, 4-bromophenol, 4-chlorophenol, and 4-iodophenol in benzene were performed. Various dielectric parameters (such as ?', ?'', ?0, ??) were tested. Additive manufacturing technology is becoming popular in the industry because it allows the manufacturer to fabricate cost-effective, strong, lightweight, and complex-shaped parts directly from 3D design data as compared with the conventional manufacturing method. Background: Hippocampal atrophy has been consistently reported in major depressive disorder with more recent focus on subfields. However, literature on hippocampal volume changes after antidepressant treatment has been limited. The first-line treatments for depression include antidepressant medication (ADM) or cognitive-behavior therapy (CBT). To understand the differential effects of CBT and ADM on the hippocampus, we investigated the volume alterations of hippocampal subfields with treatment, outcome, and chronicity in treatment-naïve depression patients. We establish the supercongruences for the fourteen rigid hypergeometric Calabi–Yau threefolds over Q conjectured by Rodriguez-Villegas in 2003. Our first method is based on Dwork's theory of p-adic unit roots and it allows us to establish the supercongruences between the truncated hypergeometric series and the corresponding unit roots for ordinary primes. The other method makes use of the theory of hypergeometric motives, in particular, adapts the techniques from the recent work of Beukers, Cohen and Mellit on finite hypergeometric sums over Q. Glioblastoma (GBM), the most aggressive brain tumor, is associated with a median survival at diagnosis of 16–20 months and limited treatment options. The key hallmark of GBM is altered tumor metabolism and marked increase in the rate of glycolysis. Aerobic glycolysis along with elevated glucose consumption and lactate production supports rapid cell proliferation and GBM growth. In this study, we examined the gene expression profile of metabolic targets in GBM samples from patients with lower grade glioma (LGG) and GBM. Salinity is the primary determinant of the Arctic Ocean’s density structure. Freshwater accumulation and distribution in the Arctic Ocean have varied significantly in recent decades and certainly in the Beaufort Gyre (BG). In this study, we analyze salinity variations in the BG region between 2012 and 2017. We use in situ salinity observations from the Seasonal Ice Zone Reconnaissance Surveys (SIZRS), CTD casts from the Beaufort Gyre Exploration Project (BGP), and the EN4 data to validate and compare with satellite observations from Soil Moisture Active Passive (SMAP), Soil Moisture and Ocean Salinity (SMOS), and Aquarius Optimally Interpolated Sea Surface Salinity …

The challenge in establishing an early-sown wheat crop in southern Australia is the need for consistently high seedling emergence when sowing deep in subsoil moisture ( > 10 cm) or into dry top-soil (4 cm). Understanding metabolic and immune regulation inherent to patient populations is key to improving the radiation response for our patients. To date, radiation therapy regimens are prescribed based on tumor type and stage. Patient populations who are noted to have a poor response to radiation such as those of African American descent, those who have obesity or metabolic syndrome, or senior adult oncology patients, should be considered for concurrent therapies with radiation that will improve response. BACKGROUND: Mood disorders (MDS) are a type of mental health illness that effects millions of people in the United States. Early prediction of MDS can give providers greater opportunity to treat these disorders. We hypothesized that longitudinal cardiovascular health (CVH) measurements would be informative for MDS prediction.
METHODS: To test this hypothesis, the American Heart Association's Guideline Advantage (TGA) dataset was used, which contained longitudinal EHR from 70 outpatient clinics. The statistical analysis and machine learning models were employed to identify the associations of the MDS and the longitudinal CVH metrics and other confounding factors.
