Winnowing The Wheat From The Chaff: The Continuing Controversy Over Article Iii Standing And The Certification Of Rule 23(B)(3) Damages Classes Containing "Uninjured" Members, William G. Beatty
William & Mary Business Law Review
The controversy surrounding the inclusion of uninjured class members in Rule 23(b)(3) damages classes has deeply divided the federal circuit courts of appeals and continues to do so. This Article explores the constitutional roots of the issue, beginning with the foundational element of Article III standing, and discusses the question of how many uninjured members, if any, Rule 23 permits in a class seeking certification before problems with commonality and predominance arise.

Pediatric out-of-hospital cardiac arrest (OHCA) remains a high-mortality event, with survival to discharge consistently below 10%. Although extracorporeal cardiopulmonary resuscitation (E-CPR) improves outcomes for in-hospital cardiac arrest, its application in the pre-hospital environment is not well defined for pediatrics. Identifying which pediatric patients might benefit from OHCA ECPR activation is essential for developing feasible pre hospital pediatric E-CPR systems. Preliminary analysis of applying criteria for adult OHCA ECPR activation can provide a crucial next step in establishing feasibility and applicability for the pediatric patient population.

Background
Recent publications describe severe disease in pediatric patients with TMP-SMX associated respiratory failure progressing to extracorporeal membrane oxygenation (ECMO), lung transplantation and/or death. ECMO characteristics in this patient population remain poorly defined.
Methods
This is a retrospective observational report from our institutional referral Redcap database reviewing ECMO characteristics for pediatric patients (age ≤ 18 years old) patients. This includes presumed TMPSMX associated severe respiratory failure, following 6 or more days of TMP-SMX exposure and lack of other diagnostic explanation.

Background: Proinflammatory cytokine production may be related to poor emotional adjustment in dementia spousal caregivers. People who display attachment insecurity may be at increased risk for adverse caregiving experiences and poor psychosocial outcomes.
Objective: This study aimed to understand whether proinflammatory cytokine production was associated with anticipatory grief, caregiver burden, and depressive symptoms and whether those relationships were stronger for caregivers higher on attachment anxiety or avoidance.
Method: A sample of 103 dementia spousal caregivers provided self-report data on demographics, health information, and psychosocial outcomes. Background: Current clinical practice guidelines support the long-term use of pharmacotherapy for obesity treatment. Historically, phentermine has been one of the most prescribed obesity medications (OMs), however, its long-term efficacy and safety have never been evaluated in a randomized trial as its market approval predates such requirements. Here we describe the design, rationale, and baseline characteristics for a 24-month, double-blind, randomized controlled trial evaluating the efficacy, cardiovascular risk, and safety of phentermine in adults with overweight or obesity.

The Importance Of International Exchange In A Time Of Worldwide Economic And Political Crisis And Change, David Anshen

This paper argues that international scholarly and cultural exchange has become especially vital in the context of intensifying global economic, political, ecological, and social crises. Drawing on Marxist theory, contemporary political realities in the United States and South Asia, and examples from world literature, the article examines how global capitalism both deepens human suffering and creates new possibilities for solidarity and resistance. Through reflections on immigration, political violence, ecological collapse, and the marginalization of the humanities, the paper highlights the role of international dialogue- facilitated by digital technologies and cross-cultural engagement- as a necessary counterforce to dehumanization and fragmentation. The world has become more complex and interconnected, with challenges that span countries and disciplines. To navigate these challenges, individuals are needed who are equipped with skills and competencies to lead in cross-cultural, cross-disciplinary environments. These leadership skills and competencies can be developed through participation in experiential learning programs. However, the impact of international research-based programs remains unexplored. This is a qualitative, phenomenological study within a bounded case that explored the lived experiences of students who participated in an international graduate student research program from a leadership development perspective.
