Fadgi On A Budget: Improving Digital Images For Library Staff And Faculty, Matthew J. Martin

Provenance, Journal of the Society of Georgia Archivists

This case study describes the photography equipment and setup of San Francisco State University’s Digital Scholarship Center, and the testing and manipulation of these elements to reach the 4-star tier of the Federal Agencies Digital Guidelines Initiative (FADGI) technical guidelines. It describes how, with a few tools like a color target and image analysis software, cultural heritage digitization units with limited photography skills can markedly increase the quality of their digital images with experimentation, creativity, and the photography equipment they already have.

The Takings Clause Confronts The Police Power: How The Constitution’S Well-Known Protection Failed To Protect Jobs, Businesses, And The Broader Economy In The Name Of Covid-19, Ryan E. Cox May 2022

The Takings Clause Confronts The Police Power: How The Constitution’S Well-Known Protection Failed To Protect Jobs, Businesses, And The Broader Economy In The Name Of Covid-19, Ryan E. Cox

Lincoln Memorial University Law Review Archive

“This note, completed in the midst of the COVID-19 Pandemic, recounts the emergency orders issued by various levels of government in Tennessee and explains how those orders interplay with the Takings Clause of the Fifth Amendment to the United States Constitution. As the note explains in great detail, the limitations imposed on government by way of the Takings Clause, a well-known rule that essentially requires the government to pay citizens for property it takes, are thwarted by state governments’ police powers. Analogizing the COVID-19 Pandemic to a disease that kills apple trees, the note explains how the government can take …

Still Standing: Does The Government Ever Waive A Right To Challenge Standing In Fourth Amendment Cases?, Stefanie M. Bowen

Lincoln Memorial University Law Review Archive

While "standing" in Fourth Amendment cases is not a preliminary inquiry, perhaps it should be. When the government fails to object to a defendant's standing to challenge a Fourth Amendment search, there may be an opportunity to renew the objection on appeal. Your outcome is jurisdiction-specific. This article explores the reasons that the Supreme Court should again visit the question of standing with respect to Fourth Amendment searches and eliminate the government's ability to challenge standing for the first time on appeal.

Statutory Adoption Of The Objective Test For Entrapment As A Solution To Dubious Tactics In Federal Terrorism Investigations, Philip M. Gibson May 2022

Statutory Adoption Of The Objective Test For Entrapment As A Solution To Dubious Tactics In Federal Terrorism Investigations, Philip M. Gibson

Lincoln Memorial University Law Review Archive

Federal investigators and their informants frequently utilize questionable tactics which resemble entrapment in terrorism investigations. Despite the use of such tactics, entrapment has universally failed as an affirmative defense in federal terrorism cases. This is largely as a result of the subjective test for entrapment employed in federal courts which does not allow for a finding of entrapment if the defendant is found to be predisposed to commit the particular offense. This is especially damning for defendants in terrorism cases as they are frequently proponents of fringe political and religious ideologies or mentally ill which easily establishes predisposition for a …

Under What Circumstances Is The Shield Against Self-Incrimination Lowered In A Civil Action?, Andrew Hemming May 2022

Under What Circumstances Is The Shield Against Self-Incrimination Lowered In A Civil Action?, Andrew Hemming

Lincoln Memorial University Law Review Archive

The case of Pennsylvania v Cosby has brought into sharp relief the question of what criteria apply in determining whether a defendant in a civil action can definitively rely on a District Attorney’s purported statement that no further criminal action will be taken regarding the complaint in question. It is settled law that a defendant in a civil action faces the possibility of perjury charges for not telling the truth once the shield of the constitutionally enshrined Fifth Amendment right against self-incrimination is lowered by virtue of termination of criminal prosecution on the same facts. This article considers how best …

Cross-Modal Perception Of Identity By Sound And Taste In Bottlenose Dolphins, Jason N. Bruck, Sam F. Walmsley, Vincent M. Janik May 2022

Cross-Modal Perception Of Identity By Sound And Taste In Bottlenose Dolphins, Jason N. Bruck, Sam F. Walmsley, Vincent M. Janik

Faculty Publications

While studies have demonstrated concept formation in animals, only humans are known to label concepts to use them in mental simulations or predictions. To investigate whether other animals use labels comparably, we studied cross-modal, individual recognition in bottlenose dolphins (Tursiops truncatus) that use signature whistles as labels for conspecifics in their own communication. First, we tested whether dolphins could use gustatory stimuli and found that they could distinguish between water and urine samples, as well as between urine from familiar and unfamiliar individuals. Then, we paired playbacks of signature whistles of known animals with urine samples from either the same …

Implementing A Presumption Against Imprisonment: How Scandinavian Sentencing Policies Could Be The Key To Ending Mass Incarceration In The United States, Cydney Carter

Lincoln Memorial University Law Review Archive

With the largest prison population in the world, the United States relies on incarceration more than most when it comes to sanctioning criminal offenders, but there must be another way. This paper will examine the sentencing policies and practices in the United States, Sweden, Finland, Denmark, and Norway. It will also compare these sentencing policies and their impact on incarceration rates suggest ways in which the Scandinavian sentencing practices could influence changes to the current Federal Sentencing Guidelines in order to combat mass incarceration in the United States.

The Status Of Utah Black Women, Tasha Toy, Marin Christensen, Susan R. Madsen May 2022

The Status Of Utah Black Women, Tasha Toy, Marin Christensen, Susan R. Madsen

Marketing and Strategy Faculty Publications

Utah is becoming increasingly diverse, and this has brought wide disparities between most minority groups and the White population in terms of education, housing, and health outcomes.1 Last year, the Kem C. Gardner Policy Institute at the University of Utah released a report on race, ethnicity, and sex that started the conversation more broadly, and now the Utah Women & Leadership Project (UWLP) is expanding and deepening this discussion by focusing a series of research snapshots on Utah women of color. As the UWLP focuses on strengthening the impact of all Utah girls and women, research that increases our …

Studi Komparatif Kebijakan Luar Negeri Indonesia Bebas-Aktif Dan Lebih Dekat Ke Salah Satu Blok, Mana Yang Lebih Menguntungkan Kepentingan Nasional Indonesia?, Syahdami Syahdami, Muhammad Syaroni Rofii Mr.

Jurnal Kajian Stratejik Ketahanan Nasional

Since independence, Indonesia's foreign policy has always changed. Although the doctrine of a free and active foreign policy that was first coined by the proclaimer Mohammad Hatta in 1948 has never changed, its practice depends on the approaches and interpretations taken by the ruling leaders. The old order leaned towards the eastern bloc, the new order tilted towards the western bloc, and the reform order was in a dilemma due to various domestic and international factors. Of the various political choices that have been made by the Indonesian authorities, which one is more beneficial to Indonesia's own national interests. This …
