A little over a decade ago, a state-of-the-art one-gigabyte disk drive cost nearly $1000. In November 2008, a Seagate 750 gigabyte drive could be purchased from an Internet retailer for around $140. Organizations have leveraged advances in storage technology to house enormous amounts of data which, in turn, provide a treasure trove of discoverable information to an adverse party. Whether the attorney is providing or requesting data during discovery, he may not sufficiently understand the technical architecture supporting the information central to the case. Engineers today face a diminished ability to reverse engineer, due to the Digital Millennium Copyright Act and developments in contract law. This Article will illustrate and explore the shift by comparing software lawsuits from the 1990s and 2000s.

In an effort to facilitate efficient research by practitioners, I have endeavored to separate my normative discussion from an objective overview of the legal landscape. Part II lays out this legal landscape, while Part IV provides commentary.

Defamation on the Internet is a serious problem with real world consequences for victims. The effects of online defamation are growing more severe as Google and other search engines become more effective at retrieving information about people. The problem is amplified because federal law immunizes Internet companies and website owners from liability for the defamatory content others post on their websites even when it is brought to their attention. Many academics have proposed solutions with little practical success. The Article examines how the courts have, and should, balance these potentially competing speech and property interests in the context of new communications technologies. First, the background of this Article explains the relevant facts of Bennett’s case and describes “blogs” in greater detail. Part I of the analysis examines the relevant First Amendment issues applicable to blogs, Part II considers the various intellectual property concerns, and Part III addresses the public policy concerns highlighted by Bennett’s case. In this Article, I analyze the emergence of LPO in India, as well as the ethical considerations raised for firms that offshore legal work. I chose to focus on India, where the industry has evolved most rapidly, for two reasons. First, as a result of British colonization, many Indian workers speak English fluently, thereby facilitating an East-West synergy more easily than other countries. Second, India utilizes a common law system similar to what is practiced in the United States and Britian (a result of British colonization).

The alteration centers around allowing journalists, and the companies they work for, to own 98% of the investigated and researched facts they uncover for twenty-four hours after the story is first published.
