Be Careful What You Wish For: Impeachment In The Trump Era, Gene Healy
Missouri Law Review
Having now gotten some distance and perspective on the head-spinning Trump presidency, what have we learned about the way presidential impeachments are likely to work in the future?
Impeachment And Trial After Officials Leave Office, Michael W. Mcconnell
Impeachment And Trial After Officials Leave Office, Michael W. Mcconnell
Missouri Law Review
The second impeachment of President Donald J. Trump raised an important and unresolved question: May Presidents and other federal officers be impeached or tried on impeachments after they have left office? Most Democrats argued that former officers can be both impeached and tried; most Republicans argued that former officers can neither be impeached nor tried. Trump himself was impeached while still in office and tried – and acquitted – after he left office. This is the sort of question that could easily arise again, in connection with presidents and other officers of either party, and it needs an answer that …

Ethanol Exposure Up-Regulates Pd-L1/Pd-1 Immune Checkpoint Pathway And Promotes Mammary Tumor Development, Wenhua Xu, Linqing Wu, Mei Xu, Jia Luo, Gang Chen
Pharmacology and Nutritional Sciences Faculty Publications
Alcohol consumption in women enhances breast cancer incidence and ethanol is the main causal factor. Compromised host immunity through immunosuppression facilitates the development of many types of cancer, including breast cancer. Immune cells in breast tissues, particularly tumor-infiltrating CD8 cytotoxic T cells, play a critical role in the host anti-tumor immunity against breast tumorigenesis. These cytotoxic T cells are the major immune cells to carry out anti-tumor immunity through their cytotoxic effector function, which can be regulated by immune checkpoint pathways. The PD-1/PD-L1 pathway (the interaction between programmed death-1, PD-1, and its ligand, programmed deathligand 1, PD-L1) is the best …

Utilization Of Lidar Technology — When To Use It And Why, Levy Mcintosh, Brad Rister
Kentucky Transportation Center Research Report
Lidar technologies can assist transportation agencies during the design, construction, and maintenance phases of transportation projects. While Lidar has numerous applications, successfully deploying Lidar technologies is only possible if agencies have a solid understanding of their use cases and potential limitations. This report offers guidance the Kentucky Transportation Cabinet (KYTC) can use when making decisions on how to employ Lidar technologies in highway contexts. In addition to reviewing Lidar platforms and comparing Lidar-driven surveying to traditional surveying methods, the report examines challenges related to processing and storing Lidar data and the safety benefits Lidar technologies confer in the field. Brief …

Developing A Data Acquisition System For Use In Cold Neutral Atom Traps, Jonathan E. Fuzaro Alencar
Physics
The rising interest in quantum computing has led to new quantum systems being developed and researched. Among these are trapped neutral atoms which have several desirable features and may be configured and operated on using lasers in an optical lattice. This work describes the development of a new data acquisition system for use in tuning lasers near the precise hyperfine transition frequencies of Rb 87 atoms, a crucial step in the functionality of a neutral atom trap. This improves on previous implementations that were deprecated and limited in laser frequency sweep range. Integration into the experiment was accomplished using an …

Missouri’S Hangover: Wine-Ing About Direct-To-Consumer Prohibition, Matthew D. Warren
Missouri Law Review
“[W]ine,” Thomas Jefferson once said, “[is] a necessary of life with me.” The French Ambassador turned president spent well over $365,000 in today’s currency on imported wines during his eight-year tenure as president of the United States. The intoxicating rights once afforded to Jefferson, as a drafter of the Constitution, have shifted throughout history with the passing of the Eighteenth and Twenty-First Amendments.

Symposium: The Two Impeachments Of Donald J. Trump Foreward: Requiem For Impeachment?, Frank O. Bowman Iii
Missouri Law Review
Impeachment was inserted into the Constitution of the United States as a tool of national self-preservation. Although its most common use has been as a quotidian house-cleaning device for dispensing with corrupt or egregiously unsuitable federal judges otherwise unfireable due to life tenure, the American framers conceived impeachment’s real and essential function to be the ejection and permanent electoral disqualification of any president who proved grievously unfit or exhibited a dangerous disposition to autocracy.

Second Keynote Address: The Two Impeachments Of Donald J. Trump, Senator Richard Durbin
Missouri Law Review
It was just two years ago this month that the Senate acquitted President Trump in the first impeachment trial, and one year ago this week, he was acquitted in the second trial for inciting an insurrection against the government of the United States. Now, in the first trial, Republican Senators voted to prohibit the trial managers, the actual prosecutors, from subpoenaing any witnesses or documents. They won because they were in the majority. Before both trials, enough Republican Senators, known as jurors, announced that they had already made up their minds to acquit the President—that the not-guilty verdicts were essentially …

“Ring…Ring…Ring…” It is one o’clock in the morning. The buzz of your phone wakes you from your sleep. You roll over and check to see who could be calling at this hour. You do not recognize the number, but you answer anyway. The words racing from the voice on the other end of the line are too horrific to be true, but they are. Your dreams suddenly turn into a real-life nightmare as you learn that your loved one waits in a hospital room, fighting for their life. You rush to their bedside. You are with them when they die. …

For Autumn Stultza, a single mother suffering from severe tonsil stones, Melinda Hille, a Type 1 Diabetic forced to choose between eating and paying for medication, Stephanie Doyle, a mother of three unable to afford her eczema medications, and approximately 275,000 other Missourians, August 10, 2021 was a good day. More than a decade after the enactment of the Affordable Care Act and just over a year since Missourians voted to expand Medicaid, Missourians ages 19 to 65 making under 138% of the federal poverty level became officially eligible for Medicaid coverage through the state’s MO HealthNet program. Their excitement, …

The Manhattan Project caused death and destruction in Hiroshima and Nagasaki and sparked a nuclear arms race around the world. The Project’s legacy is most closely associated with Los Alamos, New Mexico, the site of the primary research laboratory. But, the primary research site, smaller project sites, and disposal sites throughout the country have been plagued by environmental consequences. Its effects are still being felt today, even in the world of civil procedure. One landfill in St. Louis, in particular, holds significant amounts of nuclear waste from the program and has recently sparked major class-action litigation.
Boot-Strapping Trans-Discrimination Claims To Sex: Band-Aiding The Discrimination Of Transgender People, Zachary Walker
Boot-Strapping Trans-Discrimination Claims To Sex: Band-Aiding The Discrimination Of Transgender People, Zachary Walker
Missouri Law Review
R.M.A. was discriminated against merely because he identified as a male. He was denied use of basic school facilities that are available to all other boys his age. Under some federal and state laws, R.M.A. would be fully protected from such discrimination. In Missouri, however, transgender individuals are not expressly recognized as a protected class. Thus, until Missouri establishes safeguards for people who are discriminated against because of their transgender identity, R.M.A. and other transgender children must couch their claims as discrimination on the basis of “sex.”
How Impeachment Works, Michael J. Gerhardt
How Impeachment Works, Michael J. Gerhardt
Missouri Law Review
Presidential impeachments test nearly everyone. Whereas constitutional adjudication largely tests the limits and powers of governmental institutions, presidential impeachments do that and more. They test whether and how members of Congress may fulfill their oaths to do “impartial justice according to the laws and Constitution of the United States;” whether, or to what extent, presidents have abused their powers; how well the American public and media understand the stakes and issues involved in the impeachment process; and to what extent Article III courts refrain from reviewing any aspect of impeachment trials. A popular concern for most observers and commentators during …

Mmm, Mmm, No Good: Refocusing On The Article Of Manufacture Requirement For Obviousness Of Design Patents, Avery J. Welker
Missouri Law Review
While Campbell’s canned soup is appetizing to many, patent attorneys may not have an appetite for the law of obviousness. In the Inter Partes Review (“IPR”) process, a petitioner often attempts to invalidate patent claims using the sword of obviousness. When defending a patent in an IPR, a patent owner must apply evidence supporting patent validity to the invention itself. Why even have the requirement to link evidence to a patented invention in the first place? Campbell Soup Co. v. Gamon Plus, Inc. attempted to answer this question.

BACKGROUND: Predicting outcomes of patients with COVID-19 at an early stage is crucial for optimised clinical care and resource management, especially during a pandemic. Although multiple machine learning models have been proposed to address this issue, because of their requirements for extensive data preprocessing and feature engineering, they have not been validated or implemented outside of their original study site. Therefore, we aimed to develop accurate and transferrable predictive models of outcomes on hospital admission for patients with COVID-19.
METHODS: In this study, we developed recurrent neural network-based models (CovRNN) to predict the outcomes of patients with COVID-19 by use …

Hardware-Accelerated Ecg-Based True Random Number Generator, James Burrill, Sunjit Jayam
Electrical and Computer Engineering Senior Theses
Developing and proving the effectiveness of ECG-based TRNGs for use in cryptography applications related to implantable medical devices (IMDs) offers a novel approach to securing IMDs. Current ECG-based True Random Number Generators (TRNGs) are software orientated and computationally heavy with hardware implementations being suggested as one possible solution to make such TRNGs useful for the medical device industry. Hardware offers the opportunity to increase power efficiency through algorithmic optimization while maintaining device security. In this paper, we use Verilog design and FPGA simulation tools to demonstrate the potential for hardware-accelerated ECG-based TRNGs for use in low power cryptographic applications. This …
Bridging The Gap Between Research And Smallholder Farmers Through Community-Based Development Organizations, Nathan D. Fortner
Bridging The Gap Between Research And Smallholder Farmers Through Community-Based Development Organizations, Nathan D. Fortner
Doctor of Plant Health Program: Dissertations and Student Research
Food demand is expected to increase 30% to 62% by 2050 according to recent estimates. Yet, annual increases in agricultural productivity have slowed and plateaued since the green revolution increases of the 1960’s. Two strategies to help address future food demand are reducing post-harvest loss and consumer waste, and closing the yield gap between potential and farmer realized yields. Some of the largest yield gaps are those of smallholder farmers. While solutions may exist to close these gaps, delivering and integrating solutions into smallholder production systems is a complex process involving research, extension, cultural factors, government policy, NGOs, private industry, …
Balloons, Breadcrumbs, And Spoons: Emerging Adults’ Privacy Negotiation And Management Of The (Non)Disclosure Of Chronic Illness-Related Information With A Friend, Robert D. Hall
Department of Communication Studies: Dissertations, Theses, and Student Research
Emerging adults (EAs) experience many changes throughout this life-stage, characterized by self-focus, identity explorations, instability, in-betweenness, and possibilities of optimism (Arnett, 2014). As EAs transition from home of origin into independence, they may place more reliance on social networks apart from their family of origin (e.g., friends, Rawlins, 2009). Yet, chronically ill EAs may experience complications due to the biographical disruption, or interference of expectations in one’s life (Bury, 1982), particularly given that chronic illness is typically viewed as an elderly-related issue rather than occurring with youth (Kundrat & Nussbaum, 2003). Through transitions in the EA life-stage, EAs with chronic …

2020, Hong Kong Chinese opera’s year of mischance (for that matter, same to all performing arts and other arts fields). Since early 2020, COVID-19 quickly turned a global pandemic causing lockdowns of almost everything. A year back, 2019, Hong Kong Chinese opera enjoyed a blossoming year beginning with the January grand opening of the magnificent West Kowloon Cultural District Xiqu Centre. 2020, the industry was like being thrown into an apocalyptic dystopia of contagion. New productions, large scale shows, ritual drama performances, overseas and non-local troupes’ visits, educational and promotional activities were all drastically shrunk, rescheduled, relocated to virtual space, …

404 Provider Not Found: Contributions And Solutions To Inadequate Provider Networks For Behavioral Health Care, Travis Williams
Georgia State University Law Review
Despite the efforts of policymakers, access to in-network behavioral health care services has continued to lag relative to other types of health care. Many psychiatrists, for example, do not accept insurance, limiting access to their services to only those individuals who can afford to pay out of pocket. Several factors contribute to insurance networks’ paucity of behavioral health care providers, including low insurance reimbursement for behavioral health care services, inadequate regulation and enforcement, provider shortages, and a lack of access to telehealth services. To maximize the utility of existing regulatory structures, states should take an outcome-oriented enforcement approach that principally …
