The Power Of Vulnerability In Promoting A Sense Of Belonging: The Perspective Of A First-Generation American, Karin Mika Aug 2022

The Power Of Vulnerability In Promoting A Sense Of Belonging: The Perspective Of A First-Generation American, Karin Mika

Law Faculty Articles and Essays

It is my intention that students teach each other through really getting to know one another and finding commonality in each other’s experiences. Most of us live in a social bubble, partially because we feel vulnerable in worlds where we perceive that we do not belong. By sharing vulnerabilities, we are able to expand our world to not only understand our commonalities, but to get a new view of what we thought was inalterable. By sharing my own experience as an out-sider, I am better able to encourage students to consider more deeply the opinions of others and to learn …

Products Of Ideals And Golod Rings, Keller Vandebogert Aug 2022

Products Of Ideals And Golod Rings, Keller Vandebogert

Mathematics Faculty Publications

In this paper, we study conditions guaranteeing that a product of ideals defines a Golod ring. We show that for a 3-dimensional regular local ring (or 3-variable polynomial ring) (R, m), the ideal Im always defines a Golod ring for any proper ideal I ⊂ R. We also show that non-Golod products of ideals are ubiquitous; more precisely, we prove that for any proper ideal with grade ≥ 4, there exists an ideal J ⊆ I such that IJ is not Golod. We conclude by showing that if I is any proper ideal in a 3-dimensional regular local ring and …

Criminal Defamation And Freedom Of Speech In The Internet Age: A Study For Indonesian Democratic Values, Eka Nugraha Putra Aug 2022

Criminal Defamation And Freedom Of Speech In The Internet Age: A Study For Indonesian Democratic Values, Eka Nugraha Putra

Maurer Theses and Dissertations

For a country that has been declared a democratic nation since it gained independence, Indonesia still faces the real challenge of maintaining democratic values. Currently, Indonesian legal regulations do not provide a clear standard for when speech is protected and when it can be considered actionable defamation. The obscure scope of the law means that it can affect some kinds of speech, such as opinion or criticism, and render that speech punishable as a crime.

This study analyzes Indonesia’s criminal defamation laws by examining what is protected and unprotected speech. The study examines various laws, including Indonesian statutes and judicial …

Planning For Emerging Threats: Rethinking The Presidential Line Of Succession, Fordham Law School Rule Of Law Clinic, Gregory Ascher, Myrna Nakhla, Colin Shea

Rule of Law Clinic

From the COVID-19 pandemic to the Ukraine war, recent events have highlighted possible threats to the continuity of presidential leadership. The presidential line of succession in the Presidential Succession Act of 1947 has several flaws. Some of the successors it designates might be ill-suited to discharge the powers of the presidency. Others concerns include its constitutionality, inappropriate incentives it might create, and the democratic legitimacy of outcomes it might produce. This report proposes several reforms to the line of succession for pre- and post-inaugural succession contingencies.

Ensuring Continuity Of Congress, Fordham Law School Rule Of Law Clinic, Rachida Mecheri, Bryce Robins, Benjamin Roth

Rule of Law Clinic

Throughout its history, the U.S. Congress has had several brushes with catastrophe that threatened to prevent it from functioning or to change its balance of power. This report advances reforms to ensure that Congress can continue functioning if many of its members die or become incapacitated or if lawmakers' ability to meet at the Capitol is challenged. It recommends procedures for (1) rapidly replacing members of Congress in the event of mass death or incapacity; (2) declaring members of Congress incapacitated during an emergency; and (3) implementing emergency protocols.

Prosecuting White-Collar Financial Crime: The Contrasting Cases Of The Us, Spain, And Ireland In The Aftermath Of The 2008 Global Financial Crisis, Justin Rex, Adam Panas

Indiana Journal of Global Legal Studies

Why have no Wall Street executives been prosecuted or convicted for actions that contributed to the global financial crisis? Scholars have documented a variety of legal, bureaucratic, economic, and political reasons for a lack of prosecutions, but one missing piece from this scholarship is a comparative perspective; other countries similar also experienced the effects of the crisis but convicted more financial executives than did the US. This article examines the financial crises and post-crisis responses in Ireland and Spain to see why they put more bankers in jail. The comparative analysis highlights several legal, economic, and political variables that partially …

Voting By Proxy-Meddling In Foreign Elections And Public International Law, Patrick C. R. Terry Aug 2022

Voting By Proxy-Meddling In Foreign Elections And Public International Law, Patrick C. R. Terry

Indiana Journal of Global Legal Studies

Following the alleged Russian meddling in the 2016 US presidential election, there has been noticeable interest in the lawfulness of foreign interference in another state's elections under public international law. The obvious lack of previous research on the issue is surprising, given that election meddling in other states has been a widespread practice since at least the end of World War II. Indeed, according to Dov Levin, between 1946 and 2000, the United States and the Soviet Union (and Russia) alone were responsible for 117 partisan "electoral interventions" in other states. What is more, meddling in foreign elections is effective. …

This article discusses the challenges that the COVID-19 pandemic poses to the current concepts of globalization, universality of human rights, and the rules-based international order. This article discusses how Russia has used the COVID-19 pandemic to accelerate its move away from Western ideas and institutions so as to solidify the power of its executive branch. In particular, this article examines the Russian Constitutional Court in its dealings with both the 2020 Russian constitutional amendments and the government's lockdown measures. This article concludes that the Russian Constitutional Court which is supposed to serve as a key guarantor of fundamental rights of …

Science-Intensive Dispute Mechanism For Protection Of Atmosphere: Icj, Wto And Pca, Chhaya Bhardwaj, Anmol Agarwal Aug 2022

Science-Intensive Dispute Mechanism For Protection Of Atmosphere: Icj, Wto And Pca, Chhaya Bhardwaj, Anmol Agarwal

Indiana Journal of Global Legal Studies

The authors argue that protection of atmosphere related science intensive disputes should be submitted to the Permanent Court of Arbitration (PCA) because it has a better approach in comparison to the International Court of Justice (ICJ), and World Trade Organization (WTO). This comparative analysis highlights different approaches by the three dispute settlement institutions. The approach by the ICJ and WTO are discretionary and follow a case-by-case method to evaluate scientific evidence. The PCA has standardized its dispute settlement process under its codified protocols for science-intensive disputes. There is an increase in science-intensity of legal issues in the twenty-first century and …

"Just Ice" For Bourbon: The Need For Gis In International Protection Of America's Beloved Spirit, Haley Scott Aug 2022

"Just Ice" For Bourbon: The Need For Gis In International Protection Of America's Beloved Spirit, Haley Scott

Indiana Journal of Global Legal Studies

The term "bourbon" has become increasingly popular in markets all over the globe. The popularity of the bourbon trend has been exploited for both labelling liquors and describing nonalcoholic products. Bourbon has several separate definitions, usually differing on the issue of the geographical scope of the spirit's production. The bourbon liquor industry has experienced periods of significant downturn followed by periods of explosive revival, motivated mainly by foreign interest, from countries such as Japan, in the product In the 1970s, Japanese interest in whisky and US bourbon facilitated a resurgence of the then-struggling US bourbon industry. In 2018, production of …

Investigation Of The Stability Of Arsenoplatins In Saline Solution Using Reverse-Phase High-Performance Liquid Chromatography, Amber Rojas

University Honors Program Senior Projects

The pursuit of novel platinum(II)-based drugs has been driven by adverse side effects and resistance to current FDA-approved antineoplastic platinum drugs, such as cisplatin. The discovery of a synergistic effect between the FDA-approved anticancer drugs arsenic trioxide and cisplatin in vitro inspired the synthesis of complexes containing the moieties of both drugs. Arsenoplatins (APs) are novel and promising chemotherapeutic agents with an arsenous acid moiety attached to a platinum(II) center. Based on the NCI-60 (NCI = National Cancer Institute) screen, the first member of the family, arsenoplatin-1 (AP-1), has shown greater cytotoxicity than cisplatin or arsenic trioxide in various cancer …

The Effects And Costs Of Changes In River Flooding In New Jersey, Yousef Alagrabawi Aug 2022

The Effects And Costs Of Changes In River Flooding In New Jersey, Yousef Alagrabawi

Theses, Dissertations and Culminating Projects

The purpose of this research is to quantify the flood risks of rivers in various locations in New Jersey and how they have changed over time. This is important because the change is likely to continue over time as climate change continues. ArcGIS, HEC-SSP, and online sources such as Trulia (www.trulia.com) were used to understand where flooding is most likely to occur, which streets, and how many homes will be affected and estimate the cost of damages from a potential 100-year flood. I compiled information such as annual peak river discharge from the USGS river gages on the Delaware River …

The Susceptibility For Recreational Boating To Serve As A Vector For Harmful Algal Blooms, John Michael Thraen Aug 2022

The Susceptibility For Recreational Boating To Serve As A Vector For Harmful Algal Blooms, John Michael Thraen

Theses, Dissertations and Culminating Projects

To combat the spread of invasive and nuisance aquatic species, recreational boating has many recommendations and regulations in place for boaters to properly treat their boats in between uses in separate locations. While protection procedures are in place for preventing the spread of invasive mussel and plant species, there is no sufficient procedure in regard to the spread of cyanobacterial species. The objective of this study was to investigate whether common drying procedures employed in these treatment practices were capable of additionally preventing the spread of cyanobacterial species so as they may help prevent the spread of algal blooms throughout …

Learning In A Community : An Investigation Of Mentor Inquiry Into Formative Assessment Practices, Erin Riley-Lepo Aug 2022

Learning In A Community : An Investigation Of Mentor Inquiry Into Formative Assessment Practices, Erin Riley-Lepo

Theses, Dissertations and Culminating Projects

This qualitative, instrumental case study examined how a mentor inquiry community can serve as a space for mentors to articulate their knowledge and what about the inquiry community, its characteristics, might harm or help that development. Using Design-Based Research as the methodology, a mentor inquiry community, composed of three university-based mentors of preservice teachers and I engaged inquiry. Mentors showed their knowledge through their storytelling and problematizing each other’s work. The inquiry community was facilitated by shared symbolic language, and mentors’ off-task talk hindered the current work of the community but may have opened up new avenues of inquiry for …

Rape Myth Acceptance And Acknowledgment: Predictors Of Disclosing Sexual Assault And Service-Seeking Among College Students, Zerbrina Valdespino-Hayden Aug 2022

Rape Myth Acceptance And Acknowledgment: Predictors Of Disclosing Sexual Assault And Service-Seeking Among College Students, Zerbrina Valdespino-Hayden

Theses, Dissertations and Culminating Projects

Sexual assault is highly prevalent on college campuses in the United States (U.S.), such that college students are at high risk for sexual victimization. Furthermore, while the disclosure rates to informal sources are more prevalent, disclosure to formal sources (e.g., legal authorities and university staff) and mental health service use of college students who have experienced sexual assault are low. As such, understanding the factors that either facilitate or hinder disclosure and service-seeking is of critical importance. Research has identified rape myth acceptance (RMA) and acknowledgment of the victimization (i.e., whether the survivor labels their experience as sexual assault) as …

Using A Novel Experimental Paradigm To Investigate Whether Individuals With Trauma Exposure Are At An Increased Risk Of Pleading Guilty Falsely, Jennifer M. Bartlett Aug 2022

Using A Novel Experimental Paradigm To Investigate Whether Individuals With Trauma Exposure Are At An Increased Risk Of Pleading Guilty Falsely, Jennifer M. Bartlett

Theses, Dissertations and Culminating Projects

Individuals with trauma histories are overrepresented in the criminal justice system. However, little is known about how trauma-exposed individuals engage with the legal process. Over 90% of U.S. criminal convictions are resolved by guilty plea and in recent years it has become clear that guilty pleas are a leading cause of wrongful conviction. This dissertation used a newly developed, computerized interactive environment to explore the impact of trauma history on the likelihood that an innocent person will plead guilty to a crime they did not commit. Individuals with trauma histories are more likely to be risk averse when facing potential …

Parasite Variability In The Invasive Crayfish, Faxonius Rusticus, In Northern New Jersey, Nathan Martin Klunk

Theses, Dissertations and Culminating Projects

The Northeast United States has been thoroughly invaded by the well-known invasive crayfish species Faxonius rusticus (rusty crayfish). Similar to the exploration of man to new regions, the spread of invasive species can cause the introduction of new diseases and parasites while conversely the invader has to deal with the already existing diseases and parasites. For crayfish, the most notable of these is a fungal plague, which has a poorly understood distribution in the United States. In this study, I collected rusty crayfish in Northern New Jersey to better understand the locations where they exist in the state. I also …
