Territorial Paternalism, Anthony M. Ciolli Oct 2022

Territorial Paternalism, Anthony M. Ciolli

MC Law Review

This Article strives to deconstruct and dismantle the most prominent misconceptions and outright lies being used to justify the continued withholding of constitutional rights and liberties from American Samoa, Guam, the Northern Mariana Islands, Puerto Rico, and the U.S. Virgin Islands. Part II addresses the claim that territories are not self- governing or are otherwise effectively ruled from Washington, D.C., by a Congress that is completely unresponsive to any of their concerns. Part III examines the portrayal of the territories as geographically isolated, crumbling, lacking safe drinking water, and otherwise substantially underdeveloped compared to the mainland United States. Finally, Part …

The Clean Water Act: Wading Back Into Muddy Interpretations, Kord Wilkerson Oct 2022

The Clean Water Act: Wading Back Into Muddy Interpretations, Kord Wilkerson

MC Law Review

“Fresh water: everything that lives on land, animal or plant, depends upon it.” A necessity to our very livelihood, our nation’s waters must be protected. As concern grows over Earth’s stability, and environmental issues in particular, clean water has been at the forefront of this Gordian knot. To mitigate our nation’s impact on water cleanliness, state organizations, environmental activists, and the Environmental Protection Agency have joined forces in an effort to create and enforce environmental protection.

These water quality efforts, however, have not come without struggle. The creation, enforcement, and efficiency of legislation to mitigate water pollution in certain water …

The Intersection Of The U.S. Immigration System And Human Trafficking: A Legalized Labor Of Injustice, Stephanie Durr Oct 2022

The Intersection Of The U.S. Immigration System And Human Trafficking: A Legalized Labor Of Injustice, Stephanie Durr

MC Law Review

In order to provide a critical analysis of the structural barriers to justice faced by trafficking victims, this Comment will explore the legal framework of trafficking in the United States since 2000, discuss how that framework perpetuates trafficking, review the existing remedies available to trafficking survivors, and analyze whether the existing remedies accomplish their purported goals. Part II of this Comment details the legal framework of human trafficking, including the Trafficking Victims Protection Act and its progeny, as well as relevant case law interpreting the Act’s statutory language. Part III analytically explores how trafficking is perpetrated through temporary work visas. …

More Than Fifty Years After The Enactment Of Federal Laws Forbidding Discrimination In Pay, The Wage Disparity Based On Sex Continues: Focusing On The Circuit Courts’ Differing Interpretations Of “Factors Other Than Sex”, Audrey K. Hurt Oct 2022

Hurt

MC Law Review

The broad scope of this fourth affirmative defense available to employers under the EPA and Title VII allows for inconsistency in its interpretation and is responsible, at least in part, for the continued existence of wage discrimination. Without a prescribed means of application— specifically, a stricter means of application—employers are more readily absolved from liability under the FOTS defense. The best solution to this problem is for Congress to adopt a more stringent approach to the FOTS defense under the Equal Pay Act of 1963—an approach which would apply to Title VII, as well. However, with little headway being made …

Get Your Head In The Game: Gamifying The Bar Examination, Donald E. Campbell Oct 2022

Get Your Head In The Game: Gamifying The Bar Examination, Donald E. Campbell

MC Law Review

During a recent administration of the bar examination, I observed the following: a student who had a child ten days before the exam passed; a student on law review failed; a student whose predictors indicated he should fail the bar exam passed; two students who were in the library every day studying failed. Even though these folks were all taking the same exam, their outcomes varied dramatically, and there did not seem to be a common variable that predicted whether they would pass or fail. My first inclination was to throw up my hands in frustration and chalk it up …

Editing Out-Of-Domain Gan Inversion Via Differential Activations, Haorui Song, Yong Du, Tianyi Xiang, Junyu Dong, Jing Qin, Shengfeng He Oct 2022

Editing Out-Of-Domain Gan Inversion Via Differential Activations, Haorui Song, Yong Du, Tianyi Xiang, Junyu Dong, Jing Qin, Shengfeng He

Research Collection School Of Computing and Information Systems

Despite the demonstrated editing capacity in the latent space of a pretrained GAN model, inverting real-world images is stuck in a dilemma that the reconstruction cannot be faithful to the original input. The main reason for this is that the distributions between training and real-world data are misaligned, and because of that, it is unstable of GAN inversion for real image editing. In this paper, we propose a novel GAN prior based editing framework to tackle the out-of-domain inversion problem with a composition-decomposition paradigm. In particular, during the phase of composition, we introduce a differential activation module for detecting semantic …

Postdigital Ecopedagogies: Genealogies, Contradictions, And Possible Futures, Petar Jandrić, Derek R. Ford Oct 2022

Postdigital Ecopedagogies: Genealogies, Contradictions, And Possible Futures, Petar Jandrić, Derek R. Ford

Education Studies Faculty publications

This paper charts some genealogies, challenges, and directions for experimenting with the utopic postdigital ecopedagogies demanded by our present (post)pandemic reality. These are messianic—rather than prophetic—utopias that exist not as proclamations or programmes for a distant future but as potentialities immanent in the irreducible excess of the present. While their roots most clearly emanate from the Freirean-inspired ecopedagogy movement, we conceptualize ecopedagogies instead as educational forms that emerge from, negotiate, debate, produce, resist, and/or overcome the shifting and expansive postdigital ecosystems from and to which we write and think. These are expansive ecosystems of humans, postdigital machines, nonhuman animals, minerals, …

Exploring The Impact Of Gender Bias Mitigation Approaches On A Downstream Classification Task, Nasim Sobhani, Sarah Jane Delany Oct 2022

Exploring The Impact Of Gender Bias Mitigation Approaches On A Downstream Classification Task, Nasim Sobhani, Sarah Jane Delany

Conference Papers

Natural language models and systems have been shown to reflect gender bias existing in training data. This bias can impact on the downstream task that machine learning models, built on this training data, are to accomplish. A variety of techniques have been proposed to mitigate gender bias in training data. In this paper we compare different gender bias mitigation approaches on a classification task. We consider mitigation techniques that manipulate the training data itself, including data scrubbing, gender swapping and counterfactual data augmentation approaches. We also look at using de-biased word embeddings in the representation of the training data. We …

System-Level Leaders’ Local Control Of Teacher Supervision And Evaluation Under Every Student Succeeds Act, Douglas Wieczorek, Israel Aguilar, Ian M. Mette Oct 2022

System-Level Leaders’ Local Control Of Teacher Supervision And Evaluation Under Every Student Succeeds Act, Douglas Wieczorek, Israel Aguilar, Ian M. Mette

Organization and School Leadership Faculty Publications

This article investigates school system leaders’ influence and control over local teacher supervision and evaluation systems (TSES) guided by the United States’ (U.S.) Every Student Succeeds Act (ESSA). Using qualitative, textual document analysis methods, we analyzed 50 states’ ESSA policies to determine the extent to which local education agencies have flexible TSES authority granted by state and federal guidelines. The study findings indicate that a majority of U.S. state-level policies mandate standardized TSES tools and processes at the local district level. In order to optimally meet students’ and teachers’ needs, we recommend that systems-level leaders prioritize community driven visions for …
