Gravity And Grace: Foreign Investments And Cultural Heritage In International Investment Law, Valentina Vadi
Gravity And Grace: Foreign Investments And Cultural Heritage In International Investment Law, Valentina Vadi
Vanderbilt Journal of Transnational Law
Globalization and international economic governance have promoted dialogue and interaction among nations, potentially increasing cultural diversity and providing the funds to recover and preserve cultural heritage. However, these phenomena can also jeopardize cultural diversity. Foreign direct investments in the extraction of natural resources have the potential to change cultural landscapes, destroy monuments, and erase memories. In parallel, international investment law constitutes a legally binding and highly effective regime that demands that states promote and facilitate foreign direct investment. Does the existing legal framework adequately protect cultural heritage vis-a-vis the economic interests of foreign investors? To address this question, this Article …

Money Grab: How The G20/Oecd Inclusive Framework For Taxation Could Unnecessarily Disrupt Corporate Incentives And Misallocate Taxing Rights, William T. Anderson
Vanderbilt Journal of Transnational Law
The Organisation of Economic Co-operation and Development (OECD) is proposing a dramatic shift to international corporate taxation that both sets a floor for corporate tax rates across the globe and transforms how countries obtain taxing rights over large multinational corporations. This Note focuses on the proposed framework for re-allocating taxing rights over corporations away from the traditional requirement of a physical presence in a country to mere revenues in a country. This Note identifies problems with the proposal as it relates to artificially altering corporate incentives and structures, as well as the proposal's incompatibility with theories of taxation- including Adam …
A Regulatory Scheme For The Dawn Of Space Tourism, Molly M. Mccue
A Regulatory Scheme For The Dawn Of Space Tourism, Molly M. Mccue
Vanderbilt Journal of Transnational Law
Today, companies like Blue Origin and Virgin Galactic have successfully launched paying customers into space, forging the future of the space tourism industry. While a growing space tourism industry promotes scientific advancement and opens an activity once reserved for trained astronauts to the public, the industry generates new issues and reveals the vulnerabilities of international space law. This Note explores the history of commercial spaceflight and the international agreements that comprise the current legal regime. It argues that space tourism presents a need for a new international agreement to address three vulnerabilities in the current international regime: environmental protections, protections …

Toward A Transdisciplinary Model Of Social Justice In Academic Librarianship: Promoting Critical Awareness Within Advocates And Privileged Allies, Judith L. Brink Drescher
Theses & Dissertations
Academic libraries are largely comprised of White, middle-aged females, and as part of the overall diversity crisis within higher education, grapple with issues of racism, sexism, heterosexism, classism, and ableism. This mixed-methods study uses an original theoretical framework of critical transcendence, based on the philosophies of Carl Jung and Paulo Freire, to examine what triggers and/or preconditions lead some academic librarians to reflect upon and interrogate their worldview to become actively engaged as advocates and social justice allies (SJAs). An online survey was conducted that obtained data from a sample of 113 academic librarians regarding their interest and commitment toward …
Nutrition Facts Label Use Among U.S. Adolescents, Jennifer Beth Mandelbaum
Nutrition Facts Label Use Among U.S. Adolescents, Jennifer Beth Mandelbaum
Theses and Dissertations
Despite the promise of Nutrition Facts label (NFL) use as a population-level intervention with broad reach, few studies have examined determinants of adolescents’ NFL use, and how this label use may be associated with nutrition behaviors. This study used data from the International Food Policy Study, an online cross-sectional survey of trends in dietary patterns and policy-relevant behaviors in the U.S. and five other countries. First, this study examined 1) whether NFL use was associated with healthy eating efforts and 2) whether there were sociodemographic differences in NFL use among U.S. adolescents. Results demonstrated that NFL use was positively associated …
Achieving Sustainability In Urban Transit And High-Occupancy Vehicle Systems Through Emerging Technologies And Operations, Ruixiao Sun
Theses and Dissertations
It is critical to reduce road transportation emissions, as it is the major source contributing to greenhouse gas emissions (GHGs) and air pollution. However, the increasing travel demand due to the rise of population and economy makes the task challenging. Mathematically, road transportation emissions can be minimized in the manner of reducing total vehicle miles traveled (VMT) and lowering vehicle emission rate. Many strategies have been proven viable for achieving transportation sustainability. For example, the total VMT can be reduced by switching low-occupancy transportation modes (i.e., driving alone) to high-occupancy transportation modes (i.e., public transit, ridesharing). The development of alternative-fuel …
Applications Of Laser Liftoff Technique For Wide Bandgap Power And Flexible Electronics, Md Didarul Alam
Applications Of Laser Liftoff Technique For Wide Bandgap Power And Flexible Electronics, Md Didarul Alam
Theses and Dissertations
Wide bandgap (WBG) AlGaN/GaN and ultrawide bandgap (UWBG) AlGaN/AlGaN III-nitride high electron mobility transistors (HEMTs) have come a long way since their initial demonstration and are desired for a multitude of applications in deep-scaled high-frequency, high-voltage, high-current, and high-temperature power electronics. Although AlGaN/GaN HEMTs have recently become state-of-the-art in consumer electronics chargers and amplifiers, the performance of the devices is limited by severe self-heating which significantly reduce their efficacy in demanding applications that require high-current density. One strategy to reduce this self-heating effect in GaN HEMTs is to use high thermal conductivity SiC or bulk AlN substrates. While this approach …

Medical Image Recognition Method For Respiratory System Viruses Diagnosis Based On A Proposed Combined Neural Network System, Mazhar B. Tayel, Ahmed M. Fahmy
Mansoura Engineering Journal
Respiratory viral detection is a confusing and time-consuming task of constantly looking at clinical pictures of patients. So, there is a need to develop and improve the respiratory case prediction model as soon as possible to control the spread of Respiratory viruses. Today advanced machine learning methods diagnose viruses such as Corona viruses that can be effectively classified. This paper proposes a scanning model based on using a combination of CNN (Convolutional Neural Network) and PNN (Probabilistic Neural Network) to classify images of Corona viruses. The proposed combined network, (PCN) system. The images used are resized, and the light was …

Towards Sustainable Architectural Education In Egyptian Universities According To International Accreditation Standards For Facing Environmental Crises (Covid 19 Pandemic): A Case Study Of The Architecture Programs At Mansoura University And Tanta University, Alaa Abdelhamid Elmanzlawi, Neveen Youssef Azmy
Mansoura Engineering Journal
COVID-19 is highly contagious. It caused a global health crisis that in turn affected many aspects of life, especially in architectural education, which faced challenges due to these crises. This makes us tend to change learning methods in a way that turns students from passive listeners to active learners, and from consumers of knowledge to producers of it, in a way that enables them to be able to face problems in architectural and urban design. This research aims to enable students to obtain the necessary knowledge to enter the profession and support its sustainability and preservation, by obtaining accreditation from …

Pyrus calleryana is one of the most problematic invasive species in the eastern United States. The mechanisms that enable Py. calleryana to establish and outcompete native plants are not fully understood but likely include a profile of advantageous traits. Extended leaf phenology is a characteristic noted in many woody invasive plants. Leaf phenology of Py. calleryana and two native woody species, Populus deltoides and Platanus occidentalis, was observed in natural areas near Dayton, OH from December 2019 to November 2020. A frost event in May also gave us the serendipitous opportunity to assess frost tolerance of these species. We …

Research outputs 2022 to 2026
Hadal trenches are considered to act as depocenters for organic material, although pathways for the material transport and deposition rates are poorly constrained. Here we assess focusing, deposition and accumulation of material and organic carbon in four hadal trench systems underlying different surface ocean productivities; the eutrophic Atacama and Kuril-Kamchatka trenches, the mesotrophic Kermadec trench and the oligotrophic Mariana Trench. The study is based on the distributions of naturally occurring 210Pbex, 137Cs and total organic carbon from recovered sediment cores and by applying previously quantified benthic mineralization rates. Periods of steady deposition and discreet mass-wasting deposits were …

The Museum As Object Of Display: Experiencing The Ashmolean, Jack Z. Chen
Armstrong Undergraduate Journal of History
Conventionally, museums are most often considered as a series of objects displayed, but I argue that the museum itself should be seen, first and foremost, as the object on display. The Ashmolean Museum in Oxford, built at the high tide of British Imperialism, is a very interesting case study. Interested in its engagement with its own past, I do not seek to investigate the actions it takes as an institution, for instance, as regards to the politics of repatriation. Instead, I want to explore the whole experience it facilitates as an object in its own right.
This experience begins with …

Special Purpose Acquisition Companies (Spacs) And The Sec, Neal Newman, Lawrence J. Trautman
Faculty Scholarship
Special Purpose Acquisition Companies (SPACs) are simply enterprises that raise money from the public with the intention of purchasing an existing business and becoming publicly traded in the securities markets. If the SPAC is successful in raising money and the acquisition takes place, the target company takes the SPAC’s place on a stock exchange in a transaction that resembles a public offering. Also known as “blank-check” or “reverse merger” companies, this process avoids many of the pitfalls of a traditional initial public offering.
During late 2020 and 2021 an unprecedented surge in the popularity and issuance of Special Purpose Acquisition …

Constant cyber threats result in: intellectual property loss; data disruption; ransomware attacks; theft of valuable company intellectual property and sensitive customer information. During March 2022, The Securities and Exchange Commission (SEC) issued a proposed rule addressing Cybersecurity Risk Management, Strategy, Governance, and Incident Disclosure, which requires: 1. Current reporting about material cybersecurity incidents; 2. Periodic disclosures about a registrant’s policies and procedures to identify and manage cybersecurity risks; 3. Management’s role in implementing cybersecurity policies and procedures; 4. Board of directors’ cybersecurity expertise, if any, and its oversight of cybersecurity risk; 5. Registrants to provide updates about previously reported cybersecurity …
Content Moderation As Surveillance, Hannah Bloch-Wehba
Content Moderation As Surveillance, Hannah Bloch-Wehba
Faculty Scholarship
Technology platforms are the new governments, and content moderation is the new law, or so goes a common refrain. As platforms increasingly turn toward new, automated mechanisms of enforcing their rules, the apparent power of the private sector seems only to grow. Yet beneath the surface lies a web of complex relationships between public and private authorities that call into question whether platforms truly possess such unilateral power. Law enforcement and police are exerting influence over platform content rules, giving governments a louder voice in supposedly “private” decisions. At the same time, law enforcement avails itself of the affordances of …
The Administrative Agon: A Democratic Theory For A Conflictual Regulatory State, Daniel E. Walters
The Administrative Agon: A Democratic Theory For A Conflictual Regulatory State, Daniel E. Walters
Faculty Scholarship
A perennial challenge for the administrative state is to answer the “democracy question”: how can the bureaucracy be squared with the idea of self-government of, by, and for a sovereign people with few direct means of holding agencies accountable? Scholars have long argued that this challenge can be met by bringing sophisticated thinking about democracy to bear on the operation of the administrative state. These scholars have invoked various theories of democracy—in particular, pluralist, civic republican, deliberative, and minimalist theories—to explain how allowing agencies to make policy decisions is consistent with core ideas about what democracy is.

In the past decade, streaming has become one of the most popular formats of “consuming” entertainment and other content—from music to videos, and concerts, sports, conferences, and other events. In the United States, the majority of consumers subscribe to one or more streaming services today. Popular streaming services include famous platforms such as Spotify, Netflix, Apple Music, or Apple TV, Pandora, YouTube, and more. Beside subscription-based services, several of these platforms offer “freemium,” or ad-paid version of their services, which allow users to access content with advertisements for free. As elaborated in several industry reports and other publications, the rise …

The Environmental, Social, Governance (Esg) Debate Emerges From The Soil Of Climate Denial, Lawrence J. Trautman, Neal Newman
Faculty Scholarship
It has been almost six decades since Rachel Carson’s ominous warning of pending environmental disaster. During 2019 the United Nations requested urgent action from world leaders, given that “just over a decade is all that remains to stop irreversible damage from climate change.” With every passing year, damage resulting from destructive climate change causes increased pain, suffering, death and massive property loss. During 2020 and 2021 alone, severe weather events have included: destructive fires in California; record breaking freeze, power outage, and threat to the electrical grid in Texas; continuation of disruptive drought in U.S. Western states; and record-breaking high …

Conversational Agents (CAs) powered with deep language models (DLMs) have shown tremendous promise in the domain of mental health. Prominently, the CAs have been used to provide informational or therapeutic services (e.g., cognitive behavioral therapy) to patients. However, the utility of CAs to assist in mental health triaging has not been explored in the existing work as it requires a controlled generation of follow-up questions (FQs), which are often initiated and guided by the mental health professionals (MHPs) in clinical settings. In the context of `depression', our experiments show that DLMs coupled with process knowledge in a mental health questionnaire …
