Sentencing After Stash Houses: Addressing Manipulation Of The Federal Sentencing Guidelines, Elizabeth Foy Gudgel Oct 2022

Sentencing After Stash Houses: Addressing Manipulation Of The Federal Sentencing Guidelines, Elizabeth Foy Gudgel

Fordham Law Review

In the realm of undercover work, law enforcement has broad discretion to define the contours of a criminal offense. Due to quantity-based provisions in the Federal Sentencing Guidelines, federal agents or their informants may coerce an individual into a higher sentencing range by escalating their behavior to align with mandatory minimums or quantifiable offense levels. Because this type of offense is police-initiated, law enforcement has discretion to select the individuals subject to these tactics and influence their eventual sentences. The defenses of sentencing entrapment and sentencing manipulation are meant to combat this discretion. However, these defenses are rarely invoked successfully …

International Gaming Institute Faculty Research

Diversity, Equity, and Inclusion (DEI) metrics enable organizations to set concrete goals and self-monitor their performance. In 2021, Nevada’s legislature passed Senate Bill No. 267 (SB267), authorizing the University Nevada, Las Vegas (UNLV) to study DEI benchmarks in the State. The study is designed to produce actionable results capable of informing policy and employer best practices in Nevada. This study was piloted in 2021, with study participation taking place between January 3-April 30, 2022.

The questions in the study were crafted based on DEI public policy considerations as well as metrics for gauging the scope of offerings available to women …

Don't Let The Past Sink Your Future, Timothy Meyer Oct 2022

Don't Let The Past Sink Your Future, Timothy Meyer

Cornhusker Economics

Decision scientists have many algorithms for making decisions. These algorithms can be qualitative and subjective, such as following a 7-step process, to highly quantitative procedures like minimax regret, or linear programming. These techniques are very different from each other, but in one way they are very similar; they never, ever suggest the manager become emotional and use past decisions to guide the future.

Past decisions and events should guide decision-making. They help managers assign probabilities as well assessing performance. Viewing these events and situations as permanent paths is where sunk costs become problematic.

Includes discussions of four scenarios.

American Becoming : Poetics, Space, And Race In The Travel Narratives Of Herman Melville And Jack Kerouac, Yun Song Oct 2022

American Becoming : Poetics, Space, And Race In The Travel Narratives Of Herman Melville And Jack Kerouac, Yun Song

Lingnan Theses (MPhil & PhD)

This dissertation examines the travel narratives of Herman Melville and Jack Kerouac arguing that these works epitomize a literary ”becoming” in American history. Being a crucial component of Gilles Deleuze’s positive ontology, this ”becoming” mirrors a multiple and constant transformation toward the minor, the marginal, and the non-white and resonates rigorously with the literature of Melville and Kerouac. The representative works by these two canonical American authors, namely, Typee: A Peep at Polynesian Life (1846) and On the Road (1957), construct aesthetic spaces in which readers are called upon to appreciate the American life of becoming-Pacific and becoming-beat. The geographical …

Gender Differences In College Drinkers: The Role Of Masculine Norms, Jared A. Davis Oct 2022

Gender Differences In College Drinkers: The Role Of Masculine Norms, Jared A. Davis

USF Tampa Graduate Theses and Dissertations

Drinking among college students has remained a prominent problem within the United States, with more than 50% of college students drinking alcohol, 30% considered binge drinkers, and 9% considered heavy drinkers (SAMHSA, 2018). Evidence also shows that males are more likely to partake in risky drinking behaviors (e.g., binge drinking or drinking to intoxication) and are at higher risk to be diagnosed with a alcohol use disorder when compared to women (Iwamoto et al. 2014; Grant et al., 2004). Recent findings suggest that adherence to particular masculine norms as a risk factor for problematic alcohol use among men (Mahalik, 2000; …

The Communicative Function Of Gender In Italian, Joseph C. M. Davis Oct 2022

The Communicative Function Of Gender In Italian, Joseph C. M. Davis

Publications and Research

An analysis of gender in modern literary Italian based on attested examples from various genres. The evidence-based hypothesis, thoroughly noncanonical, proposes a system of morphologically signaled meanings, and these are not the traditional categories "feminine" and "masculine." Even the familiar and misleading term "gender" is replaced. The analysis concerns primarily what is typically called "grammatical gender, although it stands to inform too the use of Italian in communication having to do with human cultural gender. The analysis concerns primarily what might be called "variable gender" (essentially adjectives) although it stands to inform too the problem of "invariable gender" (essentially, nouns).

Identification Of Minimum Essential Therapeutic Mixtures From Cannabis Plant Extracts By Screening In Cell And Animal Models Of Parkinson’S Disease, Michael G Morash, Jessica Nixon, Lori M N Shimoda, Helen Turner, Alexander J Stokes, Andrea L Small-Howard, Lee D Ellis

Faculty, Staff and Student Publications

Medicinal cannabis has shown promise for the symptomatic treatment of Parkinson's disease (PD), but patient exposure to whole plant mixtures may be undesirable due to concerns around safety, consistency, regulatory issues, and psychoactivity. Identification of a subset of components responsible for the potential therapeutic effects within cannabis represents a direct path forward for the generation of anti-PD drugs. Using an

Peripheral Blood Monocytes As A Therapeutic Target For Marrow Stromal Cells In Stroke Patients, Nikunj Satani, Kaushik Parsha, Courtney Davis, Adrian Gee, Scott D Olson, Jaroslaw Aronowski, Sean I Savitz

Faculty, Staff and Student Publications

BACKGROUND: Systemic administration of marrow stromal cells

METHODS: Peripheral blood from stroke patients was collected at 5-7 days (

RESULTS: Our results show that there is a higher release of IFN-γ and IL-10 from monocytes isolated from peripheral blood at day 5-7 after stroke compared with monocytes from healthy controls. In trans-well co-cultures of MSCs and monocytes isolated from stroke patients, we found statistically significant increased levels of IL-4 and MCP-1, and decreased levels of IL-6, IL-1β, and TNF-α. Addition of MSCs to monocytes increased the secretions of Fractalkine, IL-6, and MCP-1, while the secretions of TNF-α decreased, as compared …

Small-cell lung cancer (SCLC) is the most aggressive and lethal subtype of lung cancer, for which, better understandings of its biology are urgently needed. Single-cell sequencing technologies provide an opportunity to profile individual cells within the tumor microenvironment (TME) and investigate their roles in tumorigenic processes. Here, we performed high-precision single-cell transcriptomic analysis of ~5000 individual cells from primary tumors (PTs) and matched normal adjacent tissues (NATs) from 11 SCLC patients, including one patient with both PT and relapsed tumor (RT). The comparison revealed an immunosuppressive landscape of human SCLC. Malignant cells in SCLC tumors exhibited diverse states mainly related …

Building A Sustainable Social Feedback Loop: A Machine Intelligence Approach For Twitter Opinion Mining, Ahmed Abdelhafeez, Alber Aziz, Nariman Khalil

Sustainable Machine Intelligence Journal

This paper presents a sustainable machine intelligence approach for Twitter opinion mining, focusing on building a socially responsible feedback loop. We propose a methodology that combines advanced machine learning algorithms with eco-conscious practices to extract sentiment-related insights from Twitter data while minimizing environmental impact. The preprocessing steps involve removing special characters, tokenization, stop word removal, handling user handles and URLs, and lemmatization or stemming. Sentiment classification is performed using the Extra Tree Classifier, an ensemble learning algorithm that incorporates random feature selection and bagging techniques. Experimental results demonstrate the effectiveness of our approach in accurately classifying tweets into positive, negative, …

Women-Owned Businesses In Utah: Status, Challenges, And Opportunities, Susan R. Madsen, April Townsend

Marketing and Strategy Faculty Publications

Twenty-five years ago, in 1997, Utah’s Women’s Business Center, in partnership with the Utah Technology Finance Corporation and Small Business Administration, sponsored a comprehensive survey of Utah women business owners.1 The purpose of the study was to better understand the specific roles women-owned businesses play in Utah’s economy. It was hoped that the research would stimulate a rich dialogue within the business community regarding the nature of women-owned businesses and better anticipate future needs, and this is indeed what happened. The 1997 report addressed four questions:

  1. What is the economic power of women business owners in Utah?
  2. What are …

This study aimed to uncover the presence of different metabolites and to investigate the biological properties of the leaves of Mangifera indica during summer and winter seasons. The extract of M. indica leaves for summer and winter using different solvent extracts (hexane, chloroform, and methanol) showed the presence of phenols, flavonoids, tannins, terpenoids, alkaloids, phytosterol, saponins, steroids, and carbohydrates. Antibacterial activity of the methanolic leaf extracts for summer and winter were evaluated against the bacterial species Staphylococcus aureus (ATCC 43300) and Escherichia coli (ATCC 25922). …

Self-Calibrated Through-Time Spiral Grappa For Real-Time, Free-Breathing Evaluation Of Left Ventricular Function, Dominique Franson, James Ahad Oct 2022

Self-Calibrated Through-Time Spiral Grappa For Real-Time, Free-Breathing Evaluation Of Left Ventricular Function, Dominique Franson, James Ahad

Faculty Scholarship

Purpose: Through-time spiral GRAPPA is a real-time imaging technique that enables ungated, free-breathing evaluation of the left ventricle. However, it requires a separate fully-sampled calibration scan to calculate GRAPPA weights. A self-calibrated through-time spiral GRAPPA method is proposed that uses a specially designed spiral trajectory with interleaved arm ordering such that consecutive undersampled frames can be merged to form calibration data, eliminating the separate fully-sampled acquisition. Theory and Methods: The proposed method considers the time needed to acquire data at all points in a GRAPPA calibration kernel when using interleaved arm ordering. Using this metric, simulations were performed to design …
