Reflections On Hans Micklitz’ Plea For A ‘Movable System’ (Of Consumer Law): Something To Learn From The Experiences Of Indian Consumer Law, H.C Norbert Reich Emeritus Professor Oct 2022

Reflections On Hans Micklitz’ Plea For A ‘Movable System’ (Of Consumer Law): Something To Learn From The Experiences Of Indian Consumer Law, H.C Norbert Reich Emeritus Professor

International Journal on Consumer Law and Practice

The topic of the paper is based on a study done for GIZ, the German developmental agency concerning the improvement of consumer protection in India by the combined use of preventive and remedial justice which is possible under the Indian Consumer Protection Act (CPA) but not adequately implemented. The paper takes as a starting point Hans Micklitz’ concept of a “movable system of consumer law”, developed in the EU context whereby remedies under unfair commercial practices and unfair contract terms legislation should be applied in combination and not be separated into different “legal boxes” each following its own logic. The …

Consumer’S Rights As A Special Category Of Human Rights, Ewelina Cała Wacinkiewicz Assistant Professor Oct 2022

Consumer’S Rights As A Special Category Of Human Rights, Ewelina Cała Wacinkiewicz Assistant Professor

International Journal on Consumer Law and Practice

The main objective of this paper is to show the protection of consumer rights against the international concept of human rights protection, which entails the obligation to demonstrate their common roots, as well as the delineation of the relationship. In principle, therefore, the author abstracts from a detailed description of consumer protection and its essence, which is competent in individual countries and international organizations, among which the European Union leads. The main weight of consideration is placed on the subjective and objective development of human rights, so as to prove against it the research hypothesis on the need for the …

Effect Of Bridges On Low Order Stream Fish Assemblages, South Georgia, Usa, David L. Bechler Dr. Oct 2022

Effect Of Bridges On Low Order Stream Fish Assemblages, South Georgia, Usa, David L. Bechler Dr.

Georgia Journal of Science

Anthropogenic impacts such as bridge sites can greatly alter established streambed morphology, associated ecology and flora and fauna. At bridge sites, streams are often channelized approaching the site and deep pools are created at the bridge site causing ecological alterations of faunal assemblages. However, restoring channels and reducing negative construction practices allows the return of natural habitats that are likely to include more sensitive species. Recent conservation studies have suggested that anthropogenic sites may serve as potential habitats for reestablishment of populations following a drought event. This study examined the impact of bridges on fish assemblages at first through fourth …

A Test Of Predator Avoidance By Larvae Of The Blue Ridge Two-Lined Salamander (Eurycea Wilderae) In Appalachian Streams, Taylor Hopkins, Emmeline Lombard, Carlos D. Camp Oct 2022

A Test Of Predator Avoidance By Larvae Of The Blue Ridge Two-Lined Salamander (Eurycea Wilderae) In Appalachian Streams, Taylor Hopkins, Emmeline Lombard, Carlos D. Camp

Georgia Journal of Science

Larval Blue Ridge Two-lined Salamanders (Eurycea wilderae) are significant components of Appalachian streams, reaching densities up to 100/m2. Not surprisingly, these salamanders fall prey to many types of predator. In order to test the hypothesis that larval E. wilderae actively avoid predators, we paired them against a variety of predators of this species. Predators included Banded Sculpins (Cottus carolinae), Chattahoochee Crayfish (Cambarus howardi), and Spring Salamanders (Gyrinophilus porphyriticus), both adult and larval. We placed larvae in a 1-m metal trough filled with water with a predator placed in a cage …

A Proposal For Developing The Role Of Educational Platforms To Face Cyberbullying In The Light Of Global Expertise, H. M. Alhothali

Information Sciences Letters

The paper aims to determine the reality of cyberbullying on the Madrasti (my school) platform from the point of view of students and teachers. It identifies the requirements and challenges of developing the platform to face cyberbullying. It makes a proposal for developing the platform’s role to face cyberbullying. It covered a randomly selected sample of (126) female students and (420) female teachers. The result indicated that (25.4%) of the sample were bullied, and (42.9%) of them believed that verbal bullying is the most common among students on the Madrasti platform. Moreover, (54.8%) of them were aware of what to …

On The Negative Binomial-Discrete Erlang-Truncated Exponential Mixture, A. R. El-Alosey, H. Eledum Oct 2022

On The Negative Binomial-Discrete Erlang-Truncated Exponential Mixture, A. R. El-Alosey, H. Eledum

Information Sciences Letters

This paper introduces a new two parameters discrete distribution by mixing the negative binomial with the discrete Erlang-truncated exponential distribution; the proposed distribution is called the negative binomial-discrete Erlang-truncated exponential (NBDETE) distribution. The quantile function, moments, moment generating function, Renyi entropy, order statistics, stress-strength reliability, and simulating the random sample are some of the statistical features of the NBDETE that are investigated. The method of maximum likelihood procedure is adopted for estimating the model parameters. A Monte Carlo simulation is performed to assess the performance of the accuracy of point estimates for NBDETE. Finally, an application of the new distribution …

Analysis Of Two Generalized Exponential Populations Under Joint Type-I Progressive Hybrid Censoring Scheme, Samia A. Salem, Osama E. Abo-Kasem, Asmaa H. Abdel-Wahed Oct 2022

Analysis Of Two Generalized Exponential Populations Under Joint Type-I Progressive Hybrid Censoring Scheme, Samia A. Salem, Osama E. Abo-Kasem, Asmaa H. Abdel-Wahed

Information Sciences Letters

This paper discussed inference for two generalized exponential using the joint type-I progressively hybrid censoring (JPHC-I) scheme. It assumed that the lifetime distribution of the items from the two populations follow generalized exponential distribution. Based on the JPHC-I scheme, we first consider the maximum likelihood estimators of the unknown parameters along with thier asymptotic confidence intervals. Next, we provide the Bayesian inferences of the unknown parameters under the assumptions of independent gamma priors on the scale parameters using squared error (SE) and linear-exponential (LINEX) loss functions. Markov Chain Monte Carlo (MCMC) techniques is applied to carry out the Bayesian estimation …

Adoption Of Business Model Canvas In Exploring Digital Business Transformation, M. O. Sabri, K. Al-Qawasmi, M. Odeh, M. E. Aydin

Information Sciences Letters

Digital Business Transformation (DBT) values and contributions are still unrecognized by many organizations. Managers face problems in initiating their digital transformation due to the challenges and complexities in the realization of these processes. Business Model Canvas (BMC) – known as a semantically enriched tool for business model analysis and design – is a rather novel approach proposed to solve this problem. It is used to highlight organizations’ capabilities and verify the role of IT systems in organizations. Further empirical investigations are required to identify BMCs role in DBT and specify the main changes caused by IT systems. For this purpose, …
