Pop & Perjury: The Irs Valuation War With The Estate Of Michael Jackson Dec 2022

Pop & Perjury: The Irs Valuation War With The Estate Of Michael Jackson

The University of New Hampshire Law Review

When Michael Jackson died unexpectedly in Los Angeles, California, on June 25, 2009, his career and earnings were nearing an all-time low. Plagued by past sexual abuse allegations, scandals, and questionable health, Michael Jackson’s personal finances were purported to be in complete disarray. However, following his unexpected death, the value of his estate, which was reported to be near to nothing, swelled as the world remembered his beloved contributions to the world and began to purchase accordingly. Sales of Michael Jackson’s music began to soar high. The estate’s value soared even higher as it signed licensing agreements and released new …

Undead Dicta Or Haunted Holdings? A Closer Look At The Zombie Subjective Intent Partnership Formation Cases Dec 2022

Undead Dicta Or Haunted Holdings? A Closer Look At The Zombie Subjective Intent Partnership Formation Cases

The University of New Hampshire Law Review

Undead precedents haunt the partnership formation caselaw. But just how dangerous are they? It depends on what type of zombies they are—walking-dead dicta or haunted holdings. Asking a court to ignore bad dicta is nowhere near as difficult for litigants as asking a court to overrule an entire line of cases.

This article takes a closer look at the undead partnership formation cases that were previously identified in a companion article and concludes that nearly all such cases fall into the less-scary category of undead dicta, rather than truly dangerous category of zombie holdings.

Broken Promises: The Granite State’S Return To The Institutionalization Of Children With Disabilities Dec 2022

Broken Promises: The Granite State’S Return To The Institutionalization Of Children With Disabilities

The University of New Hampshire Law Review

In 1975, the New Hampshire legislature enacted a progressive statute which mandated the Department of Health and Human Services “to establish, maintain, implement and coordinate a comprehensive service delivery system for developmentally disabled persons.” This law was innovative for its time; it decreed that individual service plans (ISPs) be developed for every client in the state’s service delivery system, guaranteed “a right to adequate and humane habilitation and treatment[,]” and contemplated the state’s area agency system as we know it today. The statute was a steppingstone for the 1981 class action lawsuit of Garrity v. Gallen. This was one of …

The Deflection And Heat Transfer Analysis Of Injection Mold Cavity With Sla Cooling Channel Insert, Olumide Temidayo Aladesiun Dec 2022

The Deflection And Heat Transfer Analysis Of Injection Mold Cavity With Sla Cooling Channel Insert, Olumide Temidayo Aladesiun

Theses and Dissertations

Fast cooling in injection molding is the critical in the process economy. Among many different cooling channel designs available, conformal cooling offers the best and the most efficient cooling. However, limited awareness, accessibility, complexity, cost, knowledge, and experience limit the use of conformal cooling channels to be used into the mold in a molding process.

Typically, SLM(Selective Laser Melting) method is used to create cavity inserts with conformal cooling channels, however, due to the difficulties listed above, applications of conformal cooling channels are very limited. For an inexpensive alternative SLA (Stereolithography Apparatus) can print cavity inserts with conformal cooling channels. …

Bobcat Identification, Abundance, And Behavior At Road Mitigation Structures In South Texas, Victoria Hanley Dec 2022

Bobcat Identification, Abundance, And Behavior At Road Mitigation Structures In South Texas, Victoria Hanley

Theses and Dissertations

Highways in South Texas fragment the landscape and result in high road mortality rates for the endangered US ocelot (Leopardus pardalis). In response, the Texas Department of Transportation constructed nine wildlife crossing structures (WCS) on Farm-to-Market (FM) 106 which adjoins Laguna Atascosa National Wildlife Refuge in Cameron County, Texas. With ocelots being rare and elusive, bobcats (Lynx rufus) are often used as a surrogate species to study felid behavior at road mitigation structures in South Texas. Bobcats have unique markings which allow them to be individually identified. Three methods of individual identification of bobcats using camera …

Glitch Estimation And Removal Using Adaptive Spline Fitting And Wavelet Shrinkage On The Gravitational Wave Data, Mohammad Abu Thaher Chowdhury Dec 2022

Glitch Estimation And Removal Using Adaptive Spline Fitting And Wavelet Shrinkage On The Gravitational Wave Data, Mohammad Abu Thaher Chowdhury

Theses and Dissertations

The false alarm rate and reduced sensitivity of searches for astrophysical signals are caused by transient signals of earthly origin, or "glitches," in gravitational wave strain data from groundbased detectors. The greater number of observable astrophysical signals will increase the likelihood of glitch overlaps and exacerbate their negative impact for future detectors with higher sensitivities. The wide morphological diversity and unpredictable waveforms of glitches, and with the vast majority of cases lacking supplemental data present the main obstacles to their mitigation. Thus, nonparametric glitch mitigation techniques are required, which should operate for a wide range of glitches and, in the …

The Role Of Lncrna Uca1 In Colorectal Cancer Progression And Metastasis, Sophia M. Leslie Dec 2022

The Role Of Lncrna Uca1 In Colorectal Cancer Progression And Metastasis, Sophia M. Leslie

Theses and Dissertations

Colorectal cancer (CRC) is the primary cause of cancer-related deaths worldwide, and it is the third most common cancer diagnosed in adults in the United States according to the American Cancer Society. We have identified lncRNA UCA1, a poor prognosis marker in CRC, responsible for increased proliferation and upregulating key genes related to glucose metabolism. Recombinant cell lines were generated to overexpress and knockdown UCA1 to establish the phenotype and to investigate the properties endowed in metastasis. A vital aspect of the metastatic progression is when the cell survives detachment from the extracellular matrix. At 36 hours of anchorage-independent stimulation, …

A Comparative Study Of Instructional Perspectives Among Learning And Development Practitioners, Merzudin Selimovic

Dissertations

The instructional perspectives of learning and development practitioners have a critical impact on their learners. This study aimed to determine if a relationship existed between years of experience of a learning and development practitioner and how they score on the seven factors of Henschke’s (1989) Modified Instructional Perspectives Inventory (MIPI). The MIPI consisted of seven factors: 1) Teacher Empathy with Learners, 2) Teacher Trust of Learners, 3) Planning and Delivery of Instruction, 4) Accommodating Learner Uniqueness, 5) Teacher Insensitivity Toward Learners, 6) Learner-centered Learning Process (Experience-based Learning Techniques), and 7) Teacher-centered Learning Process. The MIPI is a revised version of …

Manipal Journal of Medical Sciences

The existing research on Indian classical music therapy faces several challenges that need attention for the field’s growth and credibility. Most studies rely on anecdotal evidence rather than rigorous scientific methodology, necessitating more controlled trials and longitudinal research. The rich diversity of ragas and talas in Indian classical music poses a challenge in standardizing their therapeutic application. Cultural sensitivity is crucial due to the deeply rooted nature of this therapy in Indian culture, and generalizing findings to diverse populations requires careful consideration. Music therapy is gaining recognition worldwide, with universities offering courses ranging from certificates to doctorates. Music therapy is …

Flood Risk Perceptions And Future Migration Intentions Of Lagos Residents, Susan S. Ekoh, Lemir Teron, Idowu Ajibade, Silje Kristiansen

Geography Faculty Publications and Presentations

Coastal communities across the world face intense and frequent flooding due to the rise in extreme rainfall and storm surges associated with climate change. Adaptation is therefore crucial to manage the growing threat to coastal communities and cities. This case study focuses on Lagos, Nigeria, one of the world’s largest urban centers where rapid urbanization, poor urban planning, degrading infrastructure, and inadequate preparedness compounds flood vulnerability. We situate flood risk perceptions within the context of climate-induced mobilities in Lagos, which no study has done, filling a necessary knowledge gap. Furthermore, we apply a unique approach to flood risk perception and …

Intermediate Algebra Students’ Perspectives Towards Learning Mathematics, And Technology, Caree J. S. Pinder Dec 2022

Intermediate Algebra Students’ Perspectives Towards Learning Mathematics, And Technology, Caree J. S. Pinder

USF Tampa Graduate Theses and Dissertations

Research states that many remedial mathematics learners possess low mathematics academic self-concept, negative attitudes, and high anxiety levels. These aspects can manifest in a lack of confidence, apprehension, reduced engagement, or academic failure (2007; Klinger, 2008; Larkin & Jorgensen, 2016; Parnis & Petocz, 2016;). However, if these learners successfully pass remedial mathematics courses like Intermediate Algebra, they are more likely to persist in mathematics and the university (Benken et al., 2015). Due to students' success in remedial mathematics, persistence in mathematics raises many questions. In many cases, these students have had unpleasant experiences, attitudes, or beliefs about mathematics but were …
