“Faith As A Shield”: Challenging Religious Exemptions To Child Welfare Statutes In Response To Institutional Child Abuse, Shailey Mussey

This Note analyzes the role of religious exemptions in federal and state child welfare statutes in facilitating abuse within the Troubled Teen Industry (TTI), a loosely defined network of residential treatment programs, wilderness camps, and therapeutic boarding schools. Although religious exemptions were originally intended to safeguard religious liberty and parental rights, their statutory design has produced significant regulatory gaps that permit certain faith-affiliated institutions to operate with minimal oversight. By tracing the historical development of these exemptions and examining their contemporary application across multiple jurisdictions, this Note demonstrates how religious status can function as a shield against meaningful accountability. Attachments theories suggest the answer begins in infancy. Originally developed by John Bowlby and later supported by the “Strange Situation” attachment research conducted by Mary Ainsworth, attachment science shows that the quality of early interactions with caregivers influence how children develop trust, seek support, and manage emotions. Through years of empirical research psychologists have identified four main attachment styles, secure, anxious, avoidant, and disorganized, later connected to relationship patterns. Modern research also highlights that attachment patterns are not permanent, supportive experiences later in life can promote growth and change.

Pain is one of the most common reasons that patients seek medical care, and chronic pain is a major health problem. The goal of this project was to address a lack of current, evidence-based knowledge of nurses regarding pain reassessment. The context for this project was a medical-surgical area in a rural hospital. The Doctor of Nursing Practice project attempted to answer the practice focus question on whether education improved knowledge related to improving pain reassessment. Tau accumulates in a group of neurodegenerative diseases known as tauopathies. A prevailing hypothesis has been that Tau degradation is impaired due to an age-related imbalance in the autophagy-lysosome pathway, but whether these defects are a cause or consequence of Tau accumulation remains unclear. Here we show that a disease-causing mutation in the MAPT gene, which encodes Tau, p.R406W, is sufficient to disrupt multiple steps of the autophagy-lysosome pathway in human neurons. Using Airyscan super-resolution imaging, we find that mutant Tau neurons accumulate Tau and phosphorylated Tau in dysfunctional lysosomes, exhibit reduced lysosome motility, impaired fusion of autophagosomes and lysosomes, …

This investigation utilized immunohistochemical analysis to study sympathetic catecholaminergic fibers within supradiaphragmatic and abdominal regions of the right phrenic nerve. The phrenic nerve consists of motor, sensory, and autonomic components and is the primary source of the diaphragm’s somatic motor and sensory innervation. The autonomic component contains sympathetic catecholaminergic fibers that vary by location. Despite extensive research, no clear understanding of the autonomic role of the phrenic nerve has been proposed. Knowledge of phrenic nerve morphology on a gross and histological scale is crucial to understanding its autonomic function and multifaceted impacts on the diaphragm, visceral organs, and mechanisms of …

บทความนี้วิเคราะห์ผลลัพธ์ของนโยบาย “Transforming Rehabilitation” ซึ่งเป็นการปฏิรูปโครงสร้างงานคุมประพฤติในสหราชอาณาจักรโดยให้ภาคเอกชนเข้ามามีส่วนร่วมในการดำเนินงาน ภายใต้ความประสงค์ในการลดอัตราการกระทำผิดซ้ำ เพิ่มประสิทธิภาพในการปฏิบัติงาน และเสริมสร้างนวัตกรรมในการบริหารจัดการผู้กระทำผิด การปฏิรูปนี้ได้มอบหมายหน้าที่โดยให้บริษัทเอกชนที่เป็นผู้รับผิดชอบในการดูแลผู้กระทำผิดที่มีความเสี่ยงต่ำถึงปานกลางผ่านวิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชน (Community Rehabilitation Companies) ในขณะที่หน่วยงานคุมประพฤติแห่งชาติ (National Probation Service) ยังคงรับผิดชอบผู้กระทำผิดที่มีความเสี่ยงสูง การประยุกต์ใช้เครื่องมือทางการเงิน เช่น “ค่าตอบแทนตามการให้บริการ” และ “การจ่ายเงินตามผลลัพธ์” ถูกนำมาใช้เพื่อดึงดูดการลงทุนจากภาคเอกชนและคาดหวังว่าจะเกิดนวัตกรรมด้านเทคโนโลยี จากการศึกษาพบว่าผลการดำเนินงานตามแผนปฏิรูปไม่เป็นไปตามเป้าหมายที่กำหนด ผู้ให้บริการเอกชนไม่สามารถจัดทำบริการเพื่อสนับสนุนการกลับคืนสู่สังคมได้อย่างเพียงพอ ส่งผลให้ผู้กระทำผิดที่ได้รับการแก้ไขฟื้นฟูไม่ได้รับความช่วยเหลือ การให้บริการงานคุมประพฤติขาดความคิดริเริ่มใหม่ และมาตรฐานงานและคุณภาพลดลง ซึ่งสาเหตุหลักเกิดจากการขาดการทดลองนำร่องที่เพียงพอก่อนการขยายผล รวมถึงข้อบกพร่องในกระบวนการประเมินความเสี่ยง ปัญหาทางการเงินทำให้วิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนหลายแห่งล้มละลาย ผลกระทบต่อเสถียรภาพของงานคุมประพฤติและความเชื่อมั่นของประชาชนที่ลดลง จนกลายเป็นปัจจัยให้แนวคิดการลงโทษได้รับความนิยม ขณะที่แนวทางการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนถูกลดบทบาทลง บทความเสนอแนวทางแก้ไขที่สำคัญ ได้แก่ การจำกัดบทบาทของภาคเอกชนให้เป็นเพียงผู้สนับสนุนงานคุมประพฤติ เสริมสร้างความแข็งแกร่งให้กับหน่วยงานคุมประพฤติแห่งชาติในฐานะผู้ให้บริการในการจัดทำงานคุมประพฤติ และการออกแบบเครื่องมือทางการเงินใหม่ที่สร้างแรงจูงใจและส่งเสริมการมีส่วนร่วมของภาคีเครือข่ายและภาคประชาชน นอกจากนี้ บทความยังเสนอแนะให้มีการนำร่องอย่างเป็นระบบเพื่อให้สามารถประเมินความเสี่ยงได้อย่างแม่นยำ และสร้างกลไกการกำกับดูแลที่มีประสิทธิภาพ เพื่อรักษาคุณภาพบริการและสร้างความเชื่อมั่นต่องานคุมประพฤติอย่างยั่งยืน

ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

เสรีภาพในการบันทึกทัศนียภาพ (freedom of panorama) เป็นหลักการที่ถูกพัฒนาขึ้นในลักษณะของการเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ เพื่อทำให้บุคคลสามารถบันทึกภาพอาคารสิ่งปลูกสร้าง ประติมากรรม หรืองานศิลปกรรมอันมีลิขสิทธิ์ที่ตั้งอยู่ถาวรในที่สาธารณะได้โดยไม่ต้องขออนุญาตจากเจ้าของลิขสิทธิ์ หลักการนี้มุ่งที่จะสร้างสมดุลระหว่างสิทธิของเจ้าของผลงานที่ตั้งอยู่ในที่สาธารณะกับประโยชน์ของสาธารณชนและคุณค่าทางศิลปะในทัศนียภาพ แม้เสรีภาพในการบันทึกทัศนียภาพจะได้รับการยอมรับและบัญญัติเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ในกฎหมายหลายประเทศทั่วโลก แต่กลับไม่มีนิยามและขอบเขตที่แน่ชัดและเป็นหนึ่งเดียวกัน ทั้งนี้การกำหนดขอบเขตของเสรีภาพในการบันทึกทัศนียภาพให้กว้างย่อมเป็นการจำกัดสิทธิของเจ้าของลิขสิทธิ์ แต่การให้ขอบเขตของเสรีภาพในการบันทึกทัศนียภาพที่แคบเกินไปก็จะเป็นการจำกัดเสรีภาพของปัจเจกชนและกระทบต่อประโยชน์สาธารณะ บทความวิจัยนี้นำเสนอที่มา หลักการและแนวคิดที่เกี่ยวข้องกับเสรีภาพในการบันทึกทัศนียภาพ โดยศึกษาวิเคราะห์บทบัญญัติข้อยกเว้นการละเมิดลิขสิทธิ์ที่เกี่ยวกับเสรีภาพในการบันทึกทัศนียภาพตามกฎหมายในต่างประเทศจำนวน 20 ประเทศและบทบัญญัติของประเทศไทย บทความวิจัยนี้เสนอบทวิเคราะห์ในประเด็นการกำหนดขอบเขต การปรับใช้และการตีความบทบัญญัติเพื่อให้สอดคล้องกับหลักคิดพื้นฐานของเสรีภาพในการบันทึกทัศนียภาพและหลักการกำหนดข้อยกเว้นการละเมิดลิขสิทธิ์ โดยคำนึงถึงการถ่วงดุลอย่างเหมาะสมระหว่างสิทธิของเจ้าของลิขสิทธิ์กับคุณค่าของเสรีภาพในการบันทึกทัศนียภาพในประเด็นสำคัญ 5 ประการ ได้แก่ การกำหนดประเภทของงานอันมีลิขสิทธิ์ที่อยู่ภายใต้ข้อยกเว้นการละเมิดลิขสิทธิ์ ลักษณะการตั้งอยู่ของงานนั้น ลักษณะการกระทำที่อนุญาตให้กระทำต่องานเหล่านั้น ขอบเขตการนำงานไปใช้ในทางพาณิชย์ และการกำหนดเงื่อนไขอื่นเพิ่มเติม

งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา แนวคิด และทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการของประเทศไทย โดยเปรียบเทียบกับหลักการในอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 (อนุสัญญานิวยอร์ก) กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ (2) ศึกษาและเปรียบเทียบกระบวนการอนุญาโตตุลาการของประเทศไทยกับแนวปฏิบัติสากล (3) วิเคราะห์ปัญหาในการบังคับใช้พระราชบัญญัติอนุญาโตตุลาการ พ.ศ. 2545 ที่เป็นอุปสรรคต่อประสิทธิภาพและความน่าเชื่อถือของกระบวนการอนุญาโตตุลาการในประเทศไทย และ (4) เสนอแนะแนวทางปรับปรุงกฎหมายให้เหมาะสมและทันสมัยยิ่งขึ้น งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยใช้วิธีการศึกษาค้นคว้าเอกสารจากอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ ตลอดจนตำรา บทความวิชาการ คำพิพากษา งานวิจัย และวิทยานิพนธ์ทั้งภาษาไทยและต่างประเทศ โดยมุ่งวิเคราะห์เปรียบเทียบประเด็นสำคัญเพื่อเสนอข้อเสนอแนะในการพัฒนากฎหมายไทย ผลการวิจัยพบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการ เช่น ทฤษฎีอำนาจรัฐ ทฤษฎีสัญญา และทฤษฎีความเป็นเอกเทศ รวมถึงหลักความเป็นอิสระของคู่กรณีและหลักพันธกรณีตามสัญญา ยังไม่ถูกประยุกต์ใช้อย่างเหมาะสมในประเทศไทย ทำให้กระบวนการอนุญาโตตุลาการขาดความยืดหยุ่น (2) ข้อพิพาทที่ไม่อาจเข้าสู่กระบวนการอนุญาโตตุลาการตามมาตรา 40 วรรคสอง (2) (ก) ยังไม่มีการบัญญัติให้ชัดเจน ส่งผลให้เกิดความไม่แน่นอนในการตีความ (3) หลักเกณฑ์การเพิกถอนคำชี้ขาดที่ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชนตามมาตรา 40 วรรคสอง (2) (ข) ยังขาดแนวทางการตีความที่แน่นอน และเปิดช่องให้ใช้ดุลพินิจเกินจำเป็น (4) มาตรการคุ้มครองชั่วคราวตามมาตรา 16 ยังไม่มีประสิทธิภาพเพียงพอ เนื่องจากต้องอาศัยข้อตกลงของคู่กรณีและขาดกลไกรองรับจากศาล และ (5) เมื่อเปรียบเทียบกับกฎหมายของประเทศที่มีกระบวนการอนุญาโตตุลาการที่พัฒนาแล้ว เช่น สหราชอาณาจักร สาธารณรัฐสิงคโปร์ รวมถึงอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ พบว่า ประเทศเหล่านี้มีแนวทางที่ส่งเสริมกระบวนการอย่างมีประสิทธิภาพ ทั้งในด้านบทบาทของศาล การตีความนโยบายสาธารณะ และการบังคับใช้มาตรการคุ้มครองชั่วคราว ซึ่งประเทศไทยควรนำมาเป็นแนวทาง โดยเฉพาะการกำหนดข้อยกเว้นของข้อพิพาทให้ชัดเจน การจำกัดขอบเขตของความสงบเรียบร้อยตามหลักนิติธรรม และการส่งเสริมบทบาทของศาลในการสนับสนุนมาตรการคุ้มครองชั่วคราว เพื่อยกระดับกระบวนการอนุญาโตตุลาการของไทยให้สอดคล้องกับมาตรฐานสากล

In search of the best approach to eradicating homelessness in underdeveloped countries with large populations, we conducted interviews with professionals involved in different models of helping the unhoused. Although it has been established that the Housing First model combined with human services is the best model to end homelessness, the cost of housing might be prohibitive for many national governments. In situations where governments are over-whelmed by the numbers of homeless people, communities and organizations develop specific methods and practices to meet the needs of unhoused individuals.
