Osha’S Covid-19 Vaccine Mandate: Why Justice Gorsuch’S Analysis Of The Mandate As An Elephant In A Mousehole Misses The Mark, Wyatt Rex Allred Jan 2023

Osha’S Covid-19 Vaccine Mandate: Why Justice Gorsuch’S Analysis Of The Mandate As An Elephant In A Mousehole Misses The Mark, Wyatt Rex Allred

BYU Law Review

Administrative law doctrines such as Chevron seek to strike a balance between adequate delegated power and sufficient checks on such power. The major questions doctrine reinforces the latter. Recent decisions finding major questions, however, have shown a departure from textualist principles, which formed the doctrine s foundation. Justice Gorsuch's opinion in NFIB v. OSHA is an example of this desertion of textualist principles and should thus be viewed as an improper application of the major questions doctrine. Rather than remodeling the major questions doctrine, textualist judges should acknowledge that this form of anti-textual analysis is nothing short of a revival …

Resolving Unfairness In A Fair Way: How The Grantor Trust Rules Should Be Reformed, Aaron T. Anderson Jan 2023

Resolving Unfairness In A Fair Way: How The Grantor Trust Rules Should Be Reformed, Aaron T. Anderson

BYU Law Review

Affluent taxpayers often create one or more grantor trusts to achieve significant tax savings. By leveraging mismatches in the rules between the income and estate tax systems, these taxpayers avoid the compressed income tax brackets of trusts while minimizing the property that is included in their estates for estate tax purposes. Some commentators have argued that reform is needed to remove such mismatches. Yet, trusts that rely on the current grantor trust rules abound.

This Note (1) provides a background and history of the rules and use of grantor trusts, (2) argues that harmonizing the estate and income tax systems …

Visual Literacy Of Molecular Biology Revealed Through A Card-Sorting Task, Dina L. Newman, Hannah Spector, Anna Neuenschwander, Anna J. Miller, Lauren Trumpore, Leslie Kate Wright

Articles

Visual literacy, which is the ability to effectively identify, interpret, evaluate, use, and create images and visual media, is an important aspect of science literacy. As molecular processes are not directly observable, researchers and educators rely on visual representations (e.g., drawings) to communicate ideas in biology. How learners interpret and organize those numerous diagrams is related to their underlying knowledge about biology and their skills in visual literacy. Furthermore, it is not always obvious how and why learners interpret diagrams in the way they do (especially if their interpretations are unexpected), as it is not possible to “see” inside the …

New Evidence On Employee Noncompete, No Poach, And No Hire Agreements In The Franchise Sector, Peter Norlander

School of Business: Faculty Publications and Other Works

This paper presents new evidence on anti-competitive practices in the franchise sector. Drawing from a corpus of Franchise Disclosure Documents (FDDs) filed by 3,716 franchise brands in years 2011- 2023 (partial), I report new information on franchise brands’ use of inter-firm non-solicitation (“no poach”) clauses barring recruitment between firms, no hire clauses barring employment, and franchisor requirements that franchisees use employee non-compete clauses barring workers from joining competitors. Regulatory actions that restricted the enforceability of anti-competitive clauses began to appear in FDDs in 2018. While non-solicitation and no hire clauses have declined in use, the use of non-competes remained stable …

Introduction: Millions of Americans infected with the severe acute respiratory syndrome-associated coronavirus-19 (COVID-19) need oncologic surgery. Patients with acute or resolved COVID-19 illness complain of neuropsychiatric symptoms. How surgery affects postoperative neuropsychiatric outcomes such as delirium is unknown. We hypothesize that patients with a history of COVID-19 could have an exaggerated risk of developing postoperative delirium after undergoing major elective oncologic surgery.

Methods: We conducted a retrospective study to determine the association between COVID-19 status and antipsychotic drugs during postsurgical hospitalization as a surrogate of delirium. Secondary outcomes included 30 days of postoperative complications, length of stay, and mortality. Patients …

Urban Resettlement Policies In Cairo: A Case Study Of Manshaiat Nasser And Asmarat City, Roshan Abouzied

Theses and Dissertations

Egypt has a long history of urban development efforts. These efforts have provided substantial solutions in providing the urban population with adequate housing opportunities, especially those living in slum areas. However, these policies have not offered optimal solutions for all residents of informal areas, and recently governments have resorted to evictions and resettlement as one of the main strategies for removing unsafe informal areas. These strategies have had a diversity of consequences on the urban planning of cities like Cairo and repercussions on community dynamics and community social fabric. Accordingly, this thesis demonstrates the impact and reflects the consequences of …

Introduction: Medication noncompliance in the elderly home dwelling adult is a persistent problem resulting in decreased quality of life, hospital readmission within a 30-day period and increased morbidity. Visiting nurses are in a key position to assist the elderly population to employ medication compliance strategies that are tailor-made to fit their individual needs and abilities. The introduction of telehealth technology, while meant to aid elderly home dwelling individuals, may negatively impact the infusion of medication compliance strategies and thus increase medication noncompliance if visiting nurses are not effective in employing this technology.

Aim: The aim of this study is to …

Perceiving Critical Infrastructure With A New Awareness Of Cyber Risk, Duncad Card Jan 2023

Perceiving Critical Infrastructure With A New Awareness Of Cyber Risk, Duncad Card

Canadian Journal of Law and Technology

North America’s critical infrastructure has been the subject of cyber-attack, in various cycles of activity, for many years. In March of 2017, a cyber-attack caused periodic ‘‘blind-spots” for electricity distribution grid operators in the Western US for about 10 dangerous hours. In May of this year, there was panic at the gas pumps across many States in southeastern United States, which has been attributed to a cyber-attack on a major US pipeline that disrupted fuel supplies to the US East coast. US Commerce Secretary Raimondo soon after that attack announced that those sorts of attacks are becoming more frequent and …

Variants of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) have caused successive global waves of infection. These variants, with multiple mutations in the spike protein, are thought to facilitate escape from natural and vaccine-induced immunity and often increase in affinity for ACE2. The latest variant to cause concern is BA.2.75, identified in India where it is now the dominant strain, with evidence of wider dissemination. BA.2.75 is derived from BA.2 and contains four additional mutations in the receptor-binding domain (RBD). Here, we perform an antigenic and biophysical characterization of BA.2.75, revealing an interesting balance between humoral evasion and ACE2 receptor …

Assessing Ecosystem Health Through Contaminants In The Tijuana River National Estuarine Research Reserve, Nancy Torres Jan 2023

Assessing Ecosystem Health Through Contaminants In The Tijuana River National Estuarine Research Reserve, Nancy Torres

Theses

Although the Tijuana River Estuary (TRE) remains the largest, most-intact coastal wetland in Southern California, it has a history of major changes, much of this related to its location immediately north of the US / Mexico Border. One of the primary challenges is cross-border flows from the rapidly growing city of Tijuana, Baja California, Mexico, and the delivery of wastewater, debris, and sediment to sensitive coastal wetland ecosystems. There is a need to more fully investigate these environmental changes to assess the ecosystem health of the Tijuana River Estuary over time, especially related to pollution impacts. This can inform an …
