An increasing number of farms in NH and beyond are incorporating agritourism activities and/or event hosting into their business models. While these can be valuable strategies in terms of community and economic benefits, neighbor/abutter disputes, zoning regulations, and state laws may pose challenges. Part I of this article is a detailed description of the original Gutierrez decision, the dissents as well as the majority opinion. Part II then critically evaluates the majority’s analysis of the application of the instrumental theory to the spousal communications privilege. Part II argues that the majority correctly concluded that the instrumental case for the spousal privilege is weak. The majority rigorously applied the instrumental criteria to the privilege and came to the honest, realistic conclusion that, in most cases, spouses would consult and confide even if there were no spousal privilege. The salinization of freshwaters is a global threat to aquatic biodiversity. We quantified variation in chloride (Cl⁻) tolerance of 19 freshwater zooplankton species in four countries to answer three questions: (1) How much variation in Cl⁻ tolerance is present among populations? (2) What factors predict intraspecific variation in Cl⁻ tolerance? (3) Must we account for intraspecific variation to accurately predict community Cl⁻ tolerance? We conducted field mesocosm experiments at 16 sites and compiled acute LC50s from published laboratory studies. The law is often engaged in prediction. In the calculation of tort damages, for example, a judge will consider what the tort victim’s likely future earnings would have been, but for their particular injury. Similarly, when considering injunctive relief, a judge will assess whether the plaintiff is likely to suffer irreparable harm if a preliminary injunction is not granted. And for the purposes of a child custody evaluation, a judge will consider which parent will provide an environment that is in the best interests of the child.

While the limitations of traditional forensic sciences are generally recognized, the presentation of DNA forensic science statistical testimony has widely evaded criticism. This lack of oversight has allowed four DNA forensic science statistical fallacies to plague the legal system: providing statistics without empirical support, the individualization fallacy, the prosecutor’s fallacy, and the defense attorney’s fallacy. These fallacies pose a significant risk to the preservation of justice, as erroneous DNA forensic science statistical testimony plays a critical role in wrongfully convicting innocent defendants.

Tris(1,3-dichloro-2-propyl) phosphate (TDCPP) is an organophosphate flame retardant. The primary TDCPP metabolite, bis(1,3-dichloro-2-propyl) phosphate (BDCPP), is detectable in the urine of over 90 % of Americans. Epidemiological studies show sex-specific associations between urinary BDCPP levels and metabolic syndrome, which is an established risk factor for type 2 diabetes, heart disease, and stroke. We used a mouse model to determine whether TDCPP exposure disrupts glucose homeostasis. Six-week old male and female C57BL/6J mice were given ad libitum access to diets containing vehicle (0.1 % DMSO) and TDCPP resulting in the following treatment groups: 0 mg/kg/day, 0.02 mg/kg/day, 1 mg/kg/day, or 100 …

Empirical research on the impact of congestion on travel behavior remains limited. This study fills this gap using a comprehensive analytical framework, an improved time-related travel delay measure, structure equation modeling, and the disaggregated household survey data for the Puget Sound Region. The results indicate that travel time delay is associated with fewer household vehicles, fewer vehicle trips, and lower vehicle miles traveled. The findings confirm the intricate impacts of the travel time delay, reinforce the importance of the “D” factors in travel behavior, and point to the need for comprehensive solutions to travel demand management.

There is strong evidence supporting early childhood education (ECE) programmes as an effective way to support children to have the best start in life, especially for the most disadvantaged children. When high‐quality programmes are established – where quality is assured, and barriers to participation eliminated – large positive effects are observed that are sustained into adulthood. Indeed, substantial positive returns on public investment in ECE programmes are reported. When low‐quality programmes are taken to scale in the market, however, smaller effects or no effects are observed. This is attributed to failure to get quality right. And when quality is too …

Saturn’s moon, Titan, has a hydrocarbon-based hydrologic cycle with methane and ethane rainfall. Because of Titan’s low gravity, “floating liquid droplets” (coherent droplets of liquid hydrocarbons that float upon a liquid surface) may form on the surface of Titan’s hydrocarbon lakes and seas during rainfall. Floating liquid droplets, however, have not been investigated in the laboratory under conditions appropriate for the surface of Titan (cryogenic, hydrocarbon, liquids). We conducted a set of experiments to simulate methane and ethane rainfall under Titan surface conditions (89–94 K, 1.5 bar nitrogen atmosphere) and find that floating ethane droplets form in a wide range …

Curcumin Release From Biomaterials For Enhanced Tissue Regeneration Following Injury Or Disease, Adelle E. Hamilton, Ryan J. Gilbert

Chemical and Biochemical Engineering Faculty Research & Creative Works

Curcumin, a bioactive phenol derived from turmeric, is an antioxidant, anti-inflammatory, and antibacterial molecule. Although curcumin exhibits beneficial effects in its innate form, it is highly hydrophobic, which leads to poor water solubility and, consequently, low bioavailability. The lack of bioavailability limits curcumin's effectiveness as a treatment and restricts its use in clinical applications. Furthermore, to achieve beneficial, clinically relevant results, high doses of curcumin are required for systemic administration. Many researchers have utilized biomaterial carriers, including electrospun fibers, nanoparticles, hydrogels, and composite scaffolds, to overcome curcumin's principle therapeutic limitation of low bioavailability. Hispanics/Latinos are the fastest-growing minority group in the United States and are estimated to compose half of the American population by 2060 if growing trends follow current levels. It has been suggested that Latinx/Hispanics perceive and react to adverse experiences with somatization, which is highly comorbid with Post-traumatic Stress Disorder (PTSD) symptoms (van der Kolk, et al 1996). This study surveyed 451 participants from which 88% identified as being Hispanic or Latinas, 2.7% identified as being Black Hispanic/Black Latina, and 9.3% identified as having mixed ethnicities including Hispanic/Latina. Regarding place of birth, 431 respondents (95.6%) identified being born in Continental …

2023 Nebraska Crop Production Budgets Higher Costs And Risks, Glennis Mcmclure

The Nebraska crop budgets are available for the 2023 production season. The 84 budgets indicate cost of production increases. Estimated average economic or total costs per bushel for 2023 corn production are expected to be at least 23% to 25% greater than last year. Soybeans are estimated to be 13% to 19% more in economic costs per bushel, with wheat production costs having jumped over 20% compared to last year and running as high as 63% higher over the last two years combined. Cost scenarios for individual producers can vary based on their timing of input purchases and price variabilities.

John Doe defendants in online copyright disputes can easily preserve their anonymity and operate their infringing enterprises from unknown locations, undeterred by injunctions issued against them directly.
