On January 6, 2021, the world looked on, stunned, as thousands of rioters stormed the U.S. Capitol on live television in support of then-President Donald Trump. In the days and weeks that followed, federal law enforcement scrambled to identify those involved in the attack, in what has become the largest criminal investigation in American history. Whereas even 20 years prior it would have been difficult to identify those involved, as of February 2023, more than 950 people have been identified and charged in relation to the January 6th Capitol attack. Memorizing Trade Secrets, Timothy E. Murphy

University of Richmond Law Review

The earliest trade secret cases recognized that remembered information raised unique issues in trade secret misappropriation claims. However, courts struggled with exactly how to address remembered information, as opposed to information taken in tangible form. The modern trend, according to one case from the Washington Supreme Court, is to ignore the distinction and treat remembered information the same as information taken in tangible form for purposes of trade secret misappropriation claims. However, this case may have prematurely signaled the demise of remembered information’s relevance to a trade secret claim. Since early 2020, life for students has changed tremendously. It has been a time of stress, turmoil, and trauma for students. Researchers from a large Midwestern university wanted to determine how student information use has changed during the COVID-19 pandemic. This paper examines the results of a mixed-methods study undertaken in 2021 using surveys and follow-up focus groups to determine if and how student information use has changed.   1. The timing of avian migration has evolved to exploit critical seasonal resources, yet plasticity within phenological responses may allow adjustments to interannual resource phenology. The diversity of migratory species and changes in underlying resources in response to climate change make it challenging to generalize these relationships.
  2. We use bird banding records during spring and fall migration from across North America to examine macroscale phenological responses to interannual fluctuations in temperature and long-term annual trends in phenology.

Climate change and biological invasions by plant pests (weeds), agriculture and forest insect pests (insects), and microbial pests (plant pathogens) are complex interactive components of global environmental change. The influence of pest distribution and prevalence across landscapes are challenging the conservation and sustainability of natural resources, agricultural production, native biological diversity, and the valuable ecosystem services they provide (Huenneke 1997; Vitousek 1997; Juroszek and von Tiedemann 2013; Ziska and Dukes 2014). This paper explains that when there is great uncertainty about which elements of knowledge must be combined to make an invention, the likelihood of invention increases markedly—by many orders of magnitude—when there are numerous diverse research organizations, rather than just a few. The paper examines the possibility that competition (antitrust) policy toward mergers would be improved if enforcement efforts placed more emphasis on protecting the diversity that is provided by numerous research rivals in a market.

Politics And Eminent Domain: Evidence From The 1879 California Constitution, Mark T. Kanazawa

Department of Economics Working Paper Series

This paper explores the politics of eminent domain, using a specific historical episode: the enactment of the new California constitution in 1879. It presents evidence that the failure of a constitutional provision that would have codified eminent domain powers for water development resulted from a complex interchange of economic interests among farmers, miners, and urban residents. This evidence was manifested in delegate behavior on the floor of the constitutional convention in 1878, including various roll-call votes, which are subjected to an econometric analysis. Climate trends indicate that extreme heat events are becoming more common and more severe over time, requiring improved strategies to communicate heat risk and protective actions. However, there exists a disconnect in heat-related communication from experts, who commonly include heat related jargon (i.e., technical language), to decision makers and the general public. The use of jargon has been shown to reduce meaningful engagement with and understanding of messages written by experts. Translating technical language into comprehensible messages that encourage decision makers to take action has been identified as a priority to enable impact-based decision support. The COVID-19 pandemic impacted societal structures worldwide. In the educational realm, the forced closure, and subsequent reopening of school settings disrupted the personal and professional lives of administrators, teachers, parents, and students. Two groups of Spanish stakeholders affected by the return to face-to-face instruction during the pandemic were the University of Extremadura’s student teachers and their mentors during the practicum, as student teaching is known in Spain.
