In Pursuit Of Balance: Vicarious Liability Doctrine In The United Kingdom And India, M.P. Ram Mohan, Sai Muraidhar K.

Hofstra Labor & Employment Law Journal

The Doctrine of Vicarious Liability is a unique exception to the principle of fault-based liability and holds persons liable for the actions of third parties. The recent verdicts in Wm Morrison Supermarkets v Various Claimants (2020) and Various Claimants v Barclays Bank (2020) by the Supreme Court of UK restricting the scope of vicarious liability through its interpretation of the akin to employment test as well as the close connection test deserves scrutiny. The Supreme Court apart from reaffirming the traditional distinction between independent contractors and employees also has limited the circumstances in which claims of vicarious liability can be …

Sentinel Lymph Node Identification Using Contrast Lymphosonography: A Systematic Review, Priscilla Machado, Ji-Bin Liu, Flemming Forsberg Mar 2023

Sentinel Lymph Node Identification Using Contrast Lymphosonography: A Systematic Review, Priscilla Machado, Ji-Bin Liu, Flemming Forsberg

Department of Radiology Faculty Papers

The sentinel lymph node (SLN) concept hypothesizes that metastatic cancer cells will spread through the lymphatic system to the SLN being the first one in the lymphatic chain to receive the metastatic cells, indicating that if the SLN is free of cancer cells the rest of the lymphatic chain is also without metastatic disease. Diagnostic ultrasound imaging (US) has been used to evaluate lymph nodes (LN) to determine level of suspicion and to guide LN biopsies. However, conventional US cannot be used for lymphatic mapping, which requires administration of a tracer. This has been changed with the use of contrast-enhanced …

Diversity And Disconnection: Does An Online Setting Affect Student’S Understanding Of Privilege, Oppression, And White Guilt?, Shannon Mcqueen Mar 2023

Diversity And Disconnection: Does An Online Setting Affect Student’S Understanding Of Privilege, Oppression, And White Guilt?, Shannon Mcqueen

Political Science Faculty Publications

Should educators teach diversity courses in online formats? Courses covering sexism, racism, ethnocentrism, or homophobia are increasingly part of the curriculum requirements for college students. This study compares student surveys from six sections of the author’s introductory Diversity in Politics course; three of these sections are taught asynchronously online, and three are taught in a face-to-face setting. Results reveal no difference between online and face-to-face students’ understandings of privilege and oppression, sense of belonging, or white guilt. However, although all Republican students increased their understanding of privilege and oppression from this course, Republican students uniquely entered the course with less …

Free Quasitopological Groups, Jeremy Brazas, Sarah Emery Mar 2023

Free Quasitopological Groups, Jeremy Brazas, Sarah Emery

Mathematics Faculty Publications

In this paper, we study the topological structure of a universal construction related to quasitopological groups: the free quasitopological group F-q(X) on a space X. We show that free quasitopological groups may be constructed directly as quotient spaces of free semitopological monoids, which are themselves constructed by iterating product spaces equipped with the "cross topology." Using this explicit description of F-q(X), we show that for any T-1 space X, F-q(X) is the direct limit of closed subspaces F-q(X)(n) of words of length at most n. We also prove that the natural map i(n): (sic)(n)(i=0)(X boolean OR X-1)(circle times i) - …

On Maps With Continuous Path Lifting, Jeremy Brazas, Atish Mitra Mar 2023

On Maps With Continuous Path Lifting, Jeremy Brazas, Atish Mitra

Mathematics Faculty Publications

We study a natural generalization of covering projections defined in terms of unique lifting properties. A map p : E -+ X has the continuous path-covering property if all paths in X lift uniquely and continuously (rel. basepoint) with respect to the compactopen topology. We show that maps with this property are closely related to fibrations with totally path-disconnected fibers and to the natural quotient topology on the homotopy groups. In particular, the class of maps with the continuous path-covering property lies properly between Hurewicz fibrations and Serre fibrations with totally path-disconnected fibers. We extend the usual classification of covering …

How The Covid-19 Pandemic Changed Patterns Of Green Infrastructure Use: A Scoping Review, Amanda Bristowe, Megan Heckert

Geography & Planning Faculty Publications

The use of green infrastructure (GI) has been established as a way to alleviate stress and the COVID-19 pandemic has placed a new emphasis on the importance of GI as both a coping mechanism and a source of recreation. This scoping review seeks to address whether the COVID-19 pandemic affected the use of GI, specifically the ways in which the pandemic altered visitation patterns and the frequency of the use of GI. This review identifies studies that explore the relationship between the COVID-19 pandemic and GI use and assesses whether the pandemic has altered the use of GI, including whether …

Investigating The Diversity Of Wolbachia Across The Spiny Ants (Polyrhachis), Jenna L. Webb, Leland C. Graber, Manuela O. Ramalho, Corrie S. Moreau

Biology Faculty Publications

Among insects, Wolbachia is an exceedingly common bacterial endosymbiont with a range of consequences of infection. Despite the frequency of Wolbachia infection, very little is known about this bacteria's diversity and role within hosts, especially within ant hosts. In this study, we analyze the occurrence and diversity of Wolbachia across the spiny ants (Polyrhachis), a large and geographically diverse genus. Polyrhachis samples from throughout the host genus' phylogenetic and biogeographical range were first screened for single infections of Wolbachia using the wsp gene and Sanger sequencing. The multilocus sequence typing (MLST) scheme was then used on these singly infected samples …

Rethinking The "Phillips Curve" In Nigeria: Assessing The Unemployment-Inflation Nexus In A Non-Linear Framework, Oba Efayema Obukohwo, Hilda Enoh Olele Mar 2023

Rethinking The "Phillips Curve" In Nigeria: Assessing The Unemployment-Inflation Nexus In A Non-Linear Framework, Oba Efayema Obukohwo, Hilda Enoh Olele

Bullion

The need to boost economic growth through policies that will simultaneously enhance employment and price stability cannot be overemphasized for a developing economy like Nigeria. This study thus seeks to ascertain the nexus between unemployment and inflation in Nigeria utilizing unemployment, and other control variables between 1980 and 2020 within a nonlinear framework, the study invalidated the inverse relationship. The study thus proposed that government should formulate and implement policies that will stimulate growth through an unemployment-inflation decelerating trajectory.

The Flag In My Drawer, Patrick Dawson Mar 2023

The Flag In My Drawer, Patrick Dawson

Mercer Law Review

This is my personal “Confederacy essay.” It is about my journey to understanding, and it was a long time coming. I write it for folks like me, namely those who have honestly not thought through this issue all that well. I write it also for my friends and anyone who cares. This essay’s roots are in a past Facebook discussion about the state of America, which I still think is a great nation. A friend of mine, far less convinced than I, told me bluntly to “get your Confederate flag out of the drawer.” I responded, truthfully, that I do …

Multi-Resolution Analysis With Visualization To Determine Network Attack Patterns, Dong Hyun Jeong, Bong Keun Jeong, Soo Yeon Ji Mar 2023

Multi-Resolution Analysis With Visualization To Determine Network Attack Patterns, Dong Hyun Jeong, Bong Keun Jeong, Soo Yeon Ji

Management and Decision Sciences

Analyzing network traffic activities is imperative in network security to detect attack patterns. Due to the complex nature of network traffic event activities caused by continuously changing computing environments and software applications, identifying the patterns is one of the challenging research topics. This study focuses on analyzing the effectiveness of integrating Multi-Resolution Analysis (MRA) and visualization in identifying the attack patterns of network traffic activities. In detail, a Discrete Wavelet Transform (DWT) is utilized to extract features from network traffic data and investigate their capability of identifying attacks. For extracting features, various sliding windows and step sizes are tested. Then, …

Robust Mechanical And Water Responsive Mechanically Adaptive Property Of Physically Cross-Linked Sustainable Nanocellulose Composites, Jinlong Zhang, Qinglin Wu, Bulbul Ahmed, Ioan Negulescu, Rui Zhang

Faculty Publications

The development of wood derived cellulose nanocrystal (CNCs) based sustainable composites is potential to address the plastic pollution issue. However, because of strong hydrogen bonding interactions inside the CNCs, it is still challenging to obtain composites with satisfied comprehensive performance via the incorporation of CNCs into poly (vinyl alcohol) (PVA) matrix directly, so two strategies combined with dopamine modification, base bath solution and ferric (III) ion treatment were reported to tailor the comprehensive performance of PVA/CNC composites. The comparative study indicated that both of physically cross-linked PDA@CNC/PVA and PVA/CNC composites have obvious improvement in term of mechanical and water resistance …

Understanding Environmental Art: A Case Study Of Jason Decaires Taylor's Coral Greenhouse (2019), Laura Dean Hinson Mar 2023

Understanding Environmental Art: A Case Study Of Jason Decaires Taylor's Coral Greenhouse (2019), Laura Dean Hinson

Theses

This thesis highlights the need for a new way to analyze environmental art. In the past, environmental artwork has been discussed in terms of the abstract concepts that drove their creation and the role they played in moving artists outside of the gallery space in the1960s and 70s. However, in recent years environmental artists are increasingly driven by themes of environmental conservation and preservation, using scientific research as the basis of their designs. Because of the shift in focus, developing a new way to discuss environmental art that takes into consideration the influence scientific research has on art production and …

Policing Pregnancy "Crimes", Valena Beety, Jennifer Oliva Mar 2023

Policing Pregnancy "Crimes", Valena Beety, Jennifer Oliva

Articles by Maurer Faculty

The Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization held that there is no right to abortion healthcare under the United States Constitution. This Essay details how states prosecuted pregnant people for pregnancy behaviors and speculative fetal harms prior to the Dobbs decision. In this connection, it also identifies two, related post-Dobbs concerns: (1) that states will ramp up their policing of pregnancy behaviors and (2) that prosecutors will attempt to substantiate these charges by relying on invalid scientific evidence. This Essay examines the faulty forensic science that states have used to support fetal harm allegations and reminds …

Limitations And Exceptions In International Copyright And Related Rights Treaties, Sean Flynn Mar 2023

Limitations And Exceptions In International Copyright And Related Rights Treaties, Sean Flynn

Joint PIJIP/TLS Research Paper Series

Copyright limitations and exceptions have been an integral part of international copyright and related rights treaties since the original text of the Berne Convention in 1886, which protected the ability to adopt exceptions for uses for “educational” and “scientific” uses. Since that instrument, there has been great -- if uneven -- development of norms on limitations and exceptions. Currently, the World Intellectual Property Organization’s Standing Committee on Copyright and Related Rights is considering limitations and exceptions in the draft text for a treaty on broadcast organizations as well as a proposal from the African Group for a work programme on …

Development agendas and plans such as World Intellectual Property Organisation (WIPO) Development Agenda, African Union Agenda 2063, South Africa’s National Development Plan 2030 and Nigeria’s National Development Plan 2021 – 2025, etc. indicate the need for and benefits of research for development. Research as an activity is needed for countries to sharpen their innovative edge and contribute to global scientific and technological advancement. Recent scholarship has highlighted the positive impact on national development of copyright exceptions implementing a right to research in the form of either a complete defence to copyright infringement, or, as user rights. However, the realisation of …
