Transitional Justice, Truth, And Copyright: The Case Of Colombia, Marcela Palacio Puerta Apr 2023

Transitional Justice, Truth, And Copyright: The Case Of Colombia, Marcela Palacio Puerta

Joint PIJIP/TLS Research Paper Series

The impact of copyright on various aspects of human life is becoming increasingly evident. This paper explores, for the first time in the literature, the relationship between copyright and the search for peace, with a focus on the transitional justice process in Colombia. Through a documentary research methodology, the study highlights the challenges posed by copyright laws that lack certainty in the application of exceptions and limitations to the digital world. Such challenges can difficulty a process that is inherently complex and holds great significance. Moreover, these laws also affect access to information, which is crucial in a context where …

Promoting Women's Advancement In The Judiciary In The Midst Of Backlash: A Comparative Analysis Of Representation And Jurisprudence In Key Domestic And International Fora, Shruti Rana Apr 2023

Promoting Women's Advancement In The Judiciary In The Midst Of Backlash: A Comparative Analysis Of Representation And Jurisprudence In Key Domestic And International Fora, Shruti Rana

Faculty Publications

Women's advancement in the judiciary of the United States has been slow and uneven, and has long lagged behind other nations. Parity in representation remains distant, and the gains to date vulnerable to changes in administrations and fluctuating levels of state commitment to gender equality, with the recent global backlash to gender equality and international norms and institutions providing a critical example of this fragility. In this light, this Article argues that gender parity in the judiciary should not be viewed as merely a laudable goal. Rather, representation and parity should be viewed as fundamental state legal obligations under international …

Achieving The Achievable: Realistic Labor Law Reform, Rafael Gely Apr 2023

Achieving The Achievable: Realistic Labor Law Reform, Rafael Gely

Faculty Publications

A common reprise among labor activists and scholars has been that for the fortunes of labor to change, the law must change. Prompted perhaps by a seeming surge in labor movement activity over the past few years, including headline-grabbing strikes and recent union victories at several U.S. Starbucks locations, various labor law activists and scholars have called to seize the moment and proposed the enactment of comprehensive labor law reform. We argue in this Article that broad-scale labor law reform is unlikely to be enacted by the current U.S. Congress or even have all its provisions pass muster when potentially …

The Geography Of Altithermal Subsistence Adaptations On The North American Great Plains, Ryan Breslawski Apr 2023

The Geography Of Altithermal Subsistence Adaptations On The North American Great Plains, Ryan Breslawski

Anthropology Theses and Dissertations

On the Great Plains, the Middle Holocene (8200–5000 yr BP) was a warm period where foraging peoples expanded into new food resources and developed new food processing technologies. It is unclear precisely what drove these cultural changes, and environmental explanations tend to assume that climatically mediated causes occurred along latitudinal gradients, with the southern Plains experiencing severe water shortages and declining abundances of important resources relative to the northern Plains. A decline in one such resource, bison, has been repeatedly proposed as the mechanism that drove the adoption of new resources and technologies, with the most pronounced consequences at southern …

Coyote Occupancy And Movement In Hanover County, Virginia, Richard S. Groover Apr 2023

Coyote Occupancy And Movement In Hanover County, Virginia, Richard S. Groover

Virginia Journal of Science

Although the coyote (Canis latrans) is native to North America, we have limited understanding of its presence in Virginia. Coyote range expansion is linked to anthropogenic factors, including habitat fragmentation and the extirpation of apex predators. Information on coyote adaptations to Virginia habitats is scarce, and eastern coyotes may have unique adaptations for colonizing an area. Anecdotal evidence suggests that coyotes are abundant in Hanover County (north of Richmond, VA), but this has not been confirmed. This study was conducted over an 18-month period with multiple survey sites throughout Hanover County, each equipped with game camera stations and …

In the 2003 Pixar animation Finding Nemo, a clownfish named Marlin is an overprotective father, and for good reason: he has recently gone through the trauma of losing both his wife and all their fertilized eggs save one. Nemo is his only remaining offspring, a son. On Nemo’s first day of school, he gets caught in a fishing net and is taken far away. Marlin spends the rest of the movie looking for Nemo. He gets to know a variety characters in his search, some providing comic relief, some providing leads. But in each interaction Marlin learns a more …

Privacy And Property: Constitutional Concerns Of Dna Dragnet Testing, E. Wyatt Jones Apr 2023

Privacy And Property: Constitutional Concerns Of Dna Dragnet Testing, E. Wyatt Jones

Honors Projects

DNA dragnets have attracted both public and scholarly criticisms that have yet to be resolved by the Courts. This review will introduce a modern understanding of DNA analysis, a complete introduction to past and present Fourth and Fourteenth Amendment jurisprudence, and existing suggestions concerning similar issues in legal scholarship. Considering these contexts, this review concludes that a focus on privacy and property at once, with a particular sensitivity to the inseverable relationship between the two interests, is Constitutionally consistent with precedent and the most workable means of answering the question at hand.

Using Cyclic-Step Chronopotentiometry To Explore Electron Mobility In Dye-Sensitized Solar Cells, Jasmine Hopson, Ian Mcneil Apr 2023

Using Cyclic-Step Chronopotentiometry To Explore Electron Mobility In Dye-Sensitized Solar Cells, Jasmine Hopson, Ian Mcneil

Honors Projects

In this project, we are making dye-sensitized solar cells using titanium dioxide and the dye from raspberries. We are exploring how electrons diffuse through these systems. To do this, we perform cyclic chronopotentiometry where we cycle between periods of applying a voltage to achieve a certain current and periods where the current is stopped. We focus on the time-dependent decay of the voltage when the current is stopped and fit these decays with a bi-exponential model. We compare the results of devices with and without lithium perchlorate in the electrolyte solution since lithium lowers the energies of the acceptor states …

Doctor of Nursing Practice Projects

Purpose/Background

Opioids during surgery have been clinically proven to lengthen the time between intubation and post-op extubation. Increased time to extubation is associated with negative patient outcomes. This scoping review aims to evaluate the use of ketamine with opioid free analgesia (OFA) versus traditional opioid usage and its outcomes on extubation times.

Methods

From September 2021 to November 2021, we conducted a literature search using the University of Tennessee Health Science Center’s (UTHSC) online library. Through the PubMed, CINAHL, Medline, and Cochrane databases, we identified seventy-one articles that matched our criteria. Of those articles, we selected twenty-five to undergo rapid …

A Randomized Waitlist-Controlled Pilot Trial Of Online-Delivered Comprehensive Behavioral Intervention For Tics-Enhanced, Jordan Stiede Apr 2023

A Randomized Waitlist-Controlled Pilot Trial Of Online-Delivered Comprehensive Behavioral Intervention For Tics-Enhanced, Jordan Stiede

Dissertations (1934 -)

Although studies demonstrate that comprehensive behavioral intervention for tics (CBIT) is more effective than nonspecific supportive therapy in reducing tics and related impairment, there is room for improvement, as up to 47% of treatment seeking youth do not show adequate response to treatment. Accordingly, the current randomized, waitlist-controlled pilot trial examined the preliminary efficacy, acceptability, and durability of online-delivered CBIT-Enhanced (CBIT-E), which included the standard CBIT protocol, plus specific and targeted instrumental conditioning procedures focused on directly reinforcing the use of inhibitory competing responses. The present study also explored differences in tic severity outcomes between CBIT-E participants and waitlist control …

Feasibility Of Sewer Overflow Treatment Using Chemical Oxidation After Rapid Solids Removal, Paige Peters Apr 2023

Feasibility Of Sewer Overflow Treatment Using Chemical Oxidation After Rapid Solids Removal, Paige Peters

Dissertations (1934 -)

Sewer overflows discharge 850 billion gallons of untreated sewage into U.S. lakes and rivers every year during high-intensity precipitation events. Common approaches include storage tanks or rapid solids removal followed by chlorine disinfection. These approaches can be capital intensive and only achieve partial treatment. A decentralized, end-of-pipe sewer overflow treatment system would eliminate detrimental overflow effects while handling highly variable flow and pollutant loading. Specifically, the rapid reaction rate of chemical oxidation can achieve soluble organics removal and disinfection of chlorine-resistant pathogens in a small footprint. To address the overflow issue, an advanced high-rate treatment system (AH-RTS) was developed and …

Algorithm-Architecture-Hardware Co-Design In Computing Systems: From Chip Multicore To The Cloud, Wenkai Guan Apr 2023

Algorithm-Architecture-Hardware Co-Design In Computing Systems: From Chip Multicore To The Cloud, Wenkai Guan

Dissertations (1934 -)

The computational demands for training deep learning models doubled every three months recently. However, according to Moore’s Law, the computational power available only doubled every two years. To bridge this demand-supply gap while optimizing energy consumption and carbon emission, through my dissertation, we propose a novel algorithm-architecture-hardware co-design cross-layer approach for computing systems: from chip multicore to the cloud. At the Chip Multicore Level: How can we design high-performance network-on-chip based multiprocessors that are reliable to uncertainty in design parameters? This dissertation answered this question by 1) laying the foundation for uncertainty modeling and robust multi-objective optimization for embedded systems …

Electrocoagulation For Treatment Of Disinfection Byproducts, Organic Matter, And Per-And Polyfluoroalykl Substances., Donald Rockwood Ryan

Dissertations (1934 -)

Technologies are needed to treat contaminants such as disinfection byproducts (DBPs), trace organic compounds (TOrCs), and per- and polyfluoroalkyl substances (PFAS) in water to improve consumer safety and mitigate chronic risk. This dissertation focused on evaluating electrocoagulation (EC) and hydrogen peroxide (H2O2)-enhanced EC (peroxi-electrocoagulation; EC:H2O2) for treatment of these contaminants. The impacts of source water quality (such as natural organic matter [NOM]) on overall performance was assessed and the non-destructive and destructive pathways involved in treatment were evaluated. The first objective focused on EC performance for mitigating the formation of regulated DBPs in water to better substantiate EC’s performance relative …

Memory Acquisition By Brainless Juvenile Terrestrial Planarians (Bipalium Kewense), Christina Chueiri, Christine Gildea Apr 2023

Memory Acquisition By Brainless Juvenile Terrestrial Planarians (Bipalium Kewense), Christina Chueiri, Christine Gildea

Transformations: Presentation Slides

Learning is how organisms build and store memories in their brains to aid them in survival. This process occurs as organisms experience new stimuli. Bipalium kewense, a terrestrial planarian, has a very minimal central nervous system. The nervous system of planarians consists of only two nerve cords and two ganglion which serve as a “brain.” This species reproduces by segmenting a small piece of their posterior end as a fragment, which initially lacks most adult structures. The fragments must regenerate the head, brain, mouth, functioning digestive system, and reproductive organs. To determine where memory is stored in these terrestrial planarians, …

Beyond “Psychic Income”: An Exploration Of Interventions To Address Work-Life Imbalances, Burnout, And Precarity In Contemporary Nonprofit Work, Robbie W. Robichau, Billie Sandberg, Andrew Russo Apr 2023

Beyond “Psychic Income”: An Exploration Of Interventions To Address Work-Life Imbalances, Burnout, And Precarity In Contemporary Nonprofit Work, Robbie W. Robichau, Billie Sandberg, Andrew Russo

Public Administration Faculty Publications and Presentations

Nonprofit scholars and practitioners alike adhere to a long-held assumption that nonprofit work is, and will remain, inherently meaningful work. The long-term marketization of the nonprofit sector coupled with the influence of the COVID-19 pandemic has undercut this narrative. Our research on meaningful nonprofit work indicates that while many nonprofit workers do find their work meaningful, pay, flexibility, and work/life balance are increasingly important to them. This commentary suggests that nonprofit leaders can no longer presume that workers motivated by prosocial values will seek out and stay with nonprofit work, satisfied with the “psychic income” that comes from doing good …
