An Adolescent Concussion Management Toolkit For Occupational Therapists, Coby Yoshimura
An Adolescent Concussion Management Toolkit For Occupational Therapists, Coby Yoshimura
UNLV Theses, Dissertations, Professional Papers, and Capstones
The aim of this project was to demonstrate the role occupational therapists may serve during concussion recovery, by integrating current research and findings into an instructional resource from an occupational therapy (OT) lens. An OT-based toolkit was created to prioritize the identification, assessment, and treatment of two realms of concussion management: functional cognition and vision. The development of a pre and post survey using a modified version of the Generalized Self-Efficacy (GSE) scale was used to determine occupational therapists’ perceived self-efficacy before and after reviewing the created OT-based toolkit. A related samples Wilcoxon signed rank-test was used to analyze pre …
The Importance Of An Educational Occupation-Based Work Program For Young Adults With Intellectual & Developmental Disabilities, Jennifer Zielinski
The Importance Of An Educational Occupation-Based Work Program For Young Adults With Intellectual & Developmental Disabilities, Jennifer Zielinski
UNLV Theses, Dissertations, Professional Papers, and Capstones
Barriers to occupations and transitions to vocational opportunities can be difficult for adolescents and young adults with intellectual and developmental disabilities (I/DD)s to feel confident and pursue job opportunities. Some of the problems stem from the stigma related to the individual’s disability, the contexts surrounding them, and the performance of the work tasks expected. Individuals with I/DDs expressed that not having enough support in the community and the workforce creates significant obstacles to retaining a job. Occupational therapists (OT)s can play a unique role in transition and employment for individuals with an I/DD. With a focus on self-determination and successful …
Analysis And Application Of Finite Element And High-Order Finite Difference Methods For Maxwell’S Equations In Complex Media, Li Zhu
UNLV Theses, Dissertations, Professional Papers, and Capstones
The Perfectly Matched Layer (PML) technique is an effective tool introduced by B´erenger [13] to reduce the unbounded wave propagation problem to a bounded domain problem. This dissertation focuses on two different PML models and their applications to wave propagation problems with Maxwell’s equation in complex media. We investigate these models using two popular numerical methods: the Finite Difference Method (FDM) in Chapters 2 and 3, and the Finite Element Method (FEM) in Chapters 4 and 5.In Chapter 2, we focus on analyzing the stability of a PML developed by B’ecache et al. [10] for simulating wave propagation in the …
Fear Of Recurrence As A Mediator Of Illness Perception And Perceived Stress In Acute Myocardial Infarction Survivors, Sarah E. Zvonar
Fear Of Recurrence As A Mediator Of Illness Perception And Perceived Stress In Acute Myocardial Infarction Survivors, Sarah E. Zvonar
UNLV Theses, Dissertations, Professional Papers, and Capstones
Purpose: The primary objective of this study is to evaluate fear of recurrence as a mediator of illness perception and perceived stress. This research will determine how illness perceptions and fear of recurrence affect perceived stress in the acute myocardial infarction (AMI) population. Other aims will observe how demographics predict patients who may experience increased fear of recurrence and stress in the AMI population, how the variables of fear of recurrence change over time, and if fear of recurrence is still a significant mediator after controlling for depression and anxiety.Rational/ Conceptual Basis/ Background: Acute myocardial infarctions (AMIs) are often accompanied …

Underrepresentation of pregnant populations in randomized controlled trials of lifestyle change interventions is concerning due to high attrition and providers' limited clinical time. The purpose of this evaluative study was to assess intervention uptake of pregnant individuals enrolled in a three-arm feasibility randomized controlled trial, electronic Monitoring Of Mom's Schedule (eMOMSTM), examining lifestyle changes and lactation support alone, and in combination. Measures included: (1) participation and completion rates, and characteristics of intervention completers versus other eligible participants; and (2) provider experiences with screening and enrolling pregnant participants. Pregnant people with a pre-pregnancy body mass index ≥ 25 and < 35 kg/m2 were enrolled into the eMOMSTM trial between September 2019 - December 2020. Of the 44 consented participants, 35 were randomized, at a participation rate of 35%, and 26 completed the intervention, resulting in a completion rate of 74%. Intervention completers were slightly older and entered the study earlier in pregnancy compared to non-completers. Completers were more likely to be first-time mothers, resided in urban areas, had higher educational attainment, and were slightly more racially and ethnically diverse. A majority of providers reported willingness to participate, believed the study aligned with their organization's mission, and were satisfied with using iPads for screening. Lessons learned to guide recruitment success include use of: (1) designated research staff in combination with physician support; and (2) user-friendly technology to help mitigate time burden on physicians and their staff. Future work should focus on successful strategies to recruit/retain pregnant populations in clinical trials.
Development Of A Multifactorial Virtual Fall Prevention Tool For Community Dwelling Older Women, Eduardo Gutierrez, Jacob James Nogra, Carol Sparks, Bradley Voels
Development Of A Multifactorial Virtual Fall Prevention Tool For Community Dwelling Older Women, Eduardo Gutierrez, Jacob James Nogra, Carol Sparks, Bradley Voels
UNLV Theses, Dissertations, Professional Papers, and Capstones
Falls are the leading causes of injury-related death in adults over the age of 65, with women sustaining more than twice the rate of fall-related fractures as men. Reduced access to in-person falls prevention programs during the COVID-19 pandemic created a need for a user-friendly guide to existing online fall prevention resources targeted at this vulnerable population. The first aim of this study was to create and make widely available a website with evidence-based resources that address a range of modifiable fall risk factors, and the second was to test its feasibility in a convenience sample of older women. The …
Development Of A Post-Op Transgender Care Program For Acute Occupational Therapy Practice, Marieliz Llanos
Development Of A Post-Op Transgender Care Program For Acute Occupational Therapy Practice, Marieliz Llanos
UNLV Theses, Dissertations, Professional Papers, and Capstones
Transgender people have experienced adverse health outcomes and barriers to care, ranging from the inability to provide a safe environment for inclusive and equitable care, lack of social support, and limited cultural competency and healthcare provider training. Furthermore, the scarcity of research in transgender care within the field of occupational therapy contributes to the disconnect between the needs of the transgender and gender-diverse (TGD) populations and the lack of preparedness in addressing the occupational performance deficits of transgender clients and individuals undergoing the transitioning process contribute to disparities that are reflected deeply in the experiences of these individuals. In the …

Promoting The Benefits Of An Occupational Therapy Health And Wellness Coaching Program For Adults Living With Chronic Illnesses And Their Self-Management, Natasha Findley
UNLV Theses, Dissertations, Professional Papers, and Capstones
Improved health-related outcomes for individuals 18 years or older living with a chronic condition or multiple chronic conditions can be positively impacted by health and wellness coaching. The primary purpose of this capstone project was to develop a community-based health and wellness coaching program with an occupational therapy-based approach to empower and motivate individuals in discovering their strategies, make healthier choices, and be accountable for their self-management (medication adherence, physical activity, sleep hygiene, healthy eating, stress management, and pain management). According to the American Occupational Therapy Association (2015), occupational therapy focuses on promoting health and wellness by enabling clients to …

The Development Of A Pilot Program Related To The Application Of High-Intensity In Occupational Therapy, Philip Lamoreaux
UNLV Theses, Dissertations, Professional Papers, and Capstones
Among the many diagnoses affecting an individual’s ability to participate in occupation, strokes are among the most common (Tsao et al., 2022). With the decrease in mortality rates by 35.8% due to advancements in medicine (Wolf & Nilsen, 2015), there is a need to remediate, adapt, or modify the life-changing impairments associated with stroke. The most significant evidence for motor learning, which is associated with regaining function, is in relation to high-intensity training in the context of ambulation (Middleton et al., 2015; Moore et al., 2020). By utilizing the neural plastic principles of repetition, salience, task-specificity, and intensity, an individual …
The Importance Of Educating Patients And Staff About Implementing The Neurogenic Bowel Training Program (Nbtp) For Spinal Cord Injury (Sci) In The Acute Care Phase, Silvia Lobaina
UNLV Theses, Dissertations, Professional Papers, and Capstones
According to Borsh et al. (2019), a spinal cord injury (SCI) is damage to a tight bundle of cells and nerves, the spinal cord, that send and receive signals from the brain to and from the rest of the body. A direct injury can cause damage to the spinal cord itself or to the tissues and bones that surround it, which can cause temporary or permanent changes in sensation, movement, strength, and body functions below the injury site (Borsh et al., 2019). Unfortunately, the extent of the disability depends on the severity and location of the SCI; an injury higher …

Etuaptmumk: A Means To Advance Indigenous Economic Development “In A Good Way”, Frankie Young
Etuaptmumk: A Means To Advance Indigenous Economic Development “In A Good Way”, Frankie Young
Dalhousie Law Journal
A reckoning is required on how Eurocentric laws and economic systems are biased toward Western worldviews while not accounting for Indigenous realities, legal orders, or economic perspectives. Most notably, Eurocentric laws have been instrumental in advancing non-Indigenous economic interests to the detriment of Indigenous interests, largely because Indigenous laws have not been respected. The strengthening of certain Eurocentric property and contract laws have limited Indigenous peoples’ legal and economic interests and continues to constrain positive economic outcomes and advancement for Indigenous nations. This article argues that re-centering Indigenous legal traditions is a means to advance Indigenous economic interests. The principle …
Debt As Corporate Governance, Tomer S. Stein
Debt As Corporate Governance, Tomer S. Stein
UC Law Journal
Corporate law is dominated by an equity-only view of corporate governance that centers on management-shareholder dynamics. This Article expands the management-shareholder paradigm by developing a novel integrated theory of corporate governance that fully accounts for the firm’s debt. To that end, the Article carries out a comprehensive analysis of debtholders’ influence on how the firm runs its affairs. This analysis reveals that debt does not merely function as a discipliner. Rather, debt forms an integral part of the ownership and governance structure of the firm through the covenants that debtholders routinely contract for. These covenants create poison pills and other …
The Ethics Of Defense Counsel’S Communications With Absent Class Members Before Class Certification, Candice Enders, Joshua P. Davis
The Ethics Of Defense Counsel’S Communications With Absent Class Members Before Class Certification, Candice Enders, Joshua P. Davis
UC Law Journal
Attention to how courts address the ethics of defense counsel’s communications with absent class members before class certification is valuable for two primary reasons. First, it provides insight into how courts approach ethics in class actions generally. In the class action context, courts tend to pay more attention to the relevant procedural rules—particularly to Federal Rule of Civil Procedure 23—than they do to codes of professional responsibility. Relatedly, they also seek to promote the policy goals that animate Rule 23 rather than to emphasize formalistic distinctions, such as when class counsel begin to represent absent class members or whether class …
Where Neutrality Stops And Reality Begins: Why Considering Identity Is Vital To Lead And Class Counsel Selection, Melissa Mortazavi
Where Neutrality Stops And Reality Begins: Why Considering Identity Is Vital To Lead And Class Counsel Selection, Melissa Mortazavi
UC Law Journal
When courts consider a choice of class or lead counsel in multidistrict litigation (“MDL”) or class action suits, they often follow the idea of a neutral partisan model. Such a model idealizes lawyer conduct as a blank conduit for client interests. In theory, lawyers should be able to bring their legal expertise absent any personal experiences, individualized identity, and morality outside of practice. But the reality is that neither lawyers nor their clients can fully divorce their identities or moral viewpoints from the legal system.
This Essay argues that an identity-blind choice of class or lead counsel, grounded in a …
Class Actions’ Ethical “Kiss”: The Class Action Lawyer’S Client Is The Class, Eli Wald
Class Actions’ Ethical “Kiss”: The Class Action Lawyer’S Client Is The Class, Eli Wald
UC Law Journal
The legal ethics of class actions is a mess, with many lingering, unresolved questions and conflicting answers. The culprit is a fundamental lack of agreement regarding the identity of the client, without which it is impossible to consistently resolve concerns about conflicts of interest and determine the scope of lawyers’ duties of competence and communication to the class, class representative, and class members. This Essay offers a simple solution to this disagreement: the class lawyer represents the class as an entity, not the class representatives and members, who are constituents of the class client. While conceptually simple, treating the class …
Complex Litigation Funding: Ethical Problem Or Ethical Solution?, W. Bradley Wendel, Joshua P. Davis
Complex Litigation Funding: Ethical Problem Or Ethical Solution?, W. Bradley Wendel, Joshua P. Davis
UC Law Journal
Commentators have worried that third-party funding, particularly in complex litigation, may give rise to ethical concerns. In this Essay, we explore an alternative possibility: third-party funding may solve ethical problems rather than cause them.
We explain why third-party funding can comply with the letter and spirit of the relevant ethical rules and why whether it causes or cures ethical problems depends on the setting. We note that if third-party funding agreements are properly structured—protecting, for example, lawyers’ independent judgment—they should not pose ethical problems. On the contrary, in some contexts third-party litigation funding may ameliorate tensions between clients and counsel. …
Local Restrictions On Renewable Energy Siting In The United States, Jesse Honig
Local Restrictions On Renewable Energy Siting In The United States, Jesse Honig
UC Law Journal
Climate change has arrived. The next decade will provide critical opportunities to avoid the most devastating impacts of climate change. The decisions we take over the next ten years will be the difference between moderate levels of warming and warming that will cause catastrophic changes to the planet. To avoid the most devastating impacts of climate change, the United States must rapidly transition the energy sector to almost entirely renewable energy. Notwithstanding the rapid growth of renewable energy over the past decade, the United States must add renewable capacity at an unprecedented rate. To meet this challenge, many states have …

Building A New Bridge: Justin Favela's Puente Nuevo, Kelley Yost
Building A New Bridge: Justin Favela's Puente Nuevo, Kelley Yost
Theses
This thesis analyzes an installation work, Puente Nuevo, created in 2019 by artist Justin Favela at the Amon Carter Museum of American Art. In this large-scale, piñata-like mural, Favela asserts his Latinx identity while questioning cultural stereotypes and viewer expectations with a sense of humor and irony. The unique materiality of Favela’s work, based in the folk art forms of papel picado and cartonería, transforms spaces into immersive environments that are fun and provocative, and capable of housing darker associations as well. He builds layers of meaning into his pieces by revising historic works, such as picturesque landscapes by Casimiro …
Finding The Circle In The Square: A Neoplatonic Interpretation Of Kazimir Malevich’S Black Square, Matthew Madison Rowe
Finding The Circle In The Square: A Neoplatonic Interpretation Of Kazimir Malevich’S Black Square, Matthew Madison Rowe
Theses
This thesis explores the influence of Silver Age philosophers Vladimir Soloviev, Sergei Bulgakov, and Pavel Florensky on Kazimir Malevich’s Black Square. Malevich was among the first to apply Silver Age philosophy to abstract art, fully rejecting all objective representation in art. The thesis argues that Malevich’s Suprematism was the result of the fundamental antimony of the Russian religious worldview, which understands reality as both immanent and transcendent. This understanding of reality was not unique to Russia but was the result of historic influences, including the Neoplatonic and religious-humanist philosophy that was prevalent in Russian intellectual culture during this period. …
A Critical Analysis Of Jeffrey Gibson’S Because Once You Enter My House, It Becomes Our House, A Queer Counter-Monument, Ryan Pagett
Theses
This thesis discusses Indigenous Queer artist Jeffrey Gibson’s active engagement with his queer identity in his work. Using the five aspects of a counter-monument as defined by Stevens, Franck, and Fazakerley’s Counter-monuments: the anti-monumental and the dialogic; using queer as both a form of identification; and using queer as a verbal strategy, this thesis argues that Gibson’s latest work, Because Once You Enter My House, It Becomes Our House is a “queer counter-monument.” Counter-monumentalism was a movement initially developed in Germany post-World War II in opposition to monumentalism as a system of oppression. Countermonumental work disengages from traditional monuments …

TikTok, a video-sharing social media site, has become one of the most popular platforms among digital natives. As a result of evolving globalization trends and unprecedented social changes, this platform has rapidly grown in popularity since its debut in 2016. TikTok has established an ideal setting to boost engagement by fostering a repetitive logic and enabling everyone around the globe to easily create and consume short videos. Although TikTok has capabilities similar to those found on other more established platforms, it has a distinct framework and platform culture refined by its predictive algorithm and user-friendly content interface. For this study, …
