So Far Yet So Close: Comparing Governing Laws In Arbitration Agreements Under English And Chinese Laws, King Fung Tsang, Weijie Lin
So Far Yet So Close: Comparing Governing Laws In Arbitration Agreements Under English And Chinese Laws, King Fung Tsang, Weijie Lin
Vanderbilt Journal of Transnational Law
The governing law of arbitration agreements determines the validity of an arbitration agreement and equally the entire arbitration. However, there is huge disagreement around the world as to the appropriate choice-of-law rules for deciding this governing law, particularly between rules favoring the governing law of the underlying contract (represented by the English approach) and the curial law (represented by the Chinese approach). By comparing the choice-of-law rules of these two jurisdictions, the authors argue that this disagreement is futile and unnecessary because both jurisdictions’ choice-of-law rules are pro-validity in substance and likely lead to the arbitration agreement being upheld. There …

A Private Bargaining And Efficient Breach Approach To The Problem Of Us-China Trade: Bringing A Non-Violation Case In The Wto, Daniel C.K. Chow, Ian M. Sheldon
Vanderbilt Journal of Transnational Law
When Joe Biden defeated Donald Trump to become president of the United States in 2020, many observers hoped that Biden would reset the troubled US-China trade relationship. The Trump administration had abandoned the rules-based approach to international trade of the World Trade Organization (WTO) and adopted a power-based approach instead. Using a power-based approach, the United States imposed or threatened sanctions if China did not dismantle its state-led economy and terminate the use of industrial subsidies to support its domestic industries. The United States also crippled the dispute settlement system of the WTO so that nations could not challenge US …
Two Countries In Crisis: Man Camps And The Nightmare Of Non-Indigenous Criminal Jurisdiction In The United States And Canada, Justin E. Brooks
Two Countries In Crisis: Man Camps And The Nightmare Of Non-Indigenous Criminal Jurisdiction In The United States And Canada, Justin E. Brooks
Vanderbilt Journal of Transnational Law
Thousands of Indigenous women and girls have gone missing or have been found murdered across the United States and Canada; these disappearances and killings are so frequent and widespread that they have become known as the Missing and Murdered Indigenous Women Crisis (MMIW Crisis). Indigenous communities in both countries often lack the jurisdiction to prosecute violent crimes committed by non-Indigenous offenders against Indigenous victims on Indigenous land. Extractive industries—businesses that establish natural resource extraction projects—aggravate the problem by establishing temporary housing for large numbers of non-Indigenous, primarily male workers on or around Indigenous land (“man camps”). Violent crimes against Indigenous …
Developing Mental Health And Wellness Awareness In Schools, Leah Wood
Developing Mental Health And Wellness Awareness In Schools, Leah Wood
Dissertations
The COVID-19 pandemic increased concerns for anxiety and depression in adolescents (Jones et al., 2021). As these concerns increased, students’ coping skills and mental health declined (Meherali et al., 2021). This mixed-methods study based in improvement science sought to develop mental health supports for teachers and students in a secondary setting. A mental health team convened for the purpose of this study completed a root cause analysis for a high school to determine the barriers to mental health supports. We identified the problem and potential barriers preventing proper mental health education and supports for teachers, students, and parents. The analysis …

Crafting Journalism: The Pseudonyms Of American Reform, Sierra Fishman
Crafting Journalism: The Pseudonyms Of American Reform, Sierra Fishman
Capstone Projects and Master's Theses
The late 19th and early 20th centuries in the United States saw the rise of "Stunt Girls" and "Sob Sisters" in journalism. These pioneering women defied traditional societal expectations of housewives and pursued careers in reporting, gaining recognition for their accomplishments through the dangerous nature of their work. While many may know the name Nellie Bly, the pseudonym for Elizabeth Jane Cochrane, other reporters played a vital role in the transformation of journalism, including Caloipe, Nellie Bly, Lola, Annie Laurie, Dorothy Dix, Enid, Eva Gay, Nora Marks, Girl Reporter, Nell Nelson, Grace Ermine, Meb, and Olivia. Your Country Needs You (And Also Your Resources) Britain And Her Colonies During And Shortly After Ww2, Anthony-Noel Cepe
Capstone Projects and Master's Theses
No conflict has shaped the modern world more thoroughly than the Second World War. However, the retelling of this era, whether through mass media or more scholarly works such as books and journal articles, is one seen through a white, Eurocentric lens. This is strange; as the name implies, the Second World War was a truly global conflict, involving not only the major world powers at the time, but also their subjects. Great Britain was no exception; far from the popular image of it standing alone in the face of Nazi tyranny, the island nation drew vast amounts of men …
Increasing Nutrition Education For Collegiate Athletes, Alexandra Diaz
Increasing Nutrition Education For Collegiate Athletes, Alexandra Diaz
Capstone Projects and Master's Theses
When collegiate athletes do not have nutritional education, they do not properly fuel their body for peak performance on the field and in the classroom. This can lead to disordered eating habits, muscle injuries, and mental health issues. When student- athletes have nutritional intervention and education, they can properly fuel their bodies resulting in faster muscle recovery, higher energy levels, as well as higher GPAs. Therefore, I have created a two-hour workshop on nutrition for the members of the CSUMB women’s soccer team.

Non-Destructive Means Of Predicting Masonry Prism Strength Using Ultrasonic Pulse Velocity (Upv), Connor J. Barlow
UNLV Theses, Dissertations, Professional Papers, and Capstones
Current ASTM standards call for grouted masonry prisms to be tested for compressive strength at 28-days to ensure compliance with the structural design. In the event of failing tests, the subject samples may require redesign or reconstruction which can pose problems due to ongoing development around and including the prisms between the time of placement and obtaining test results. The purpose of this research is to determine if the use of ultrasonic pulse velocity (UPV) testing can be utilized to determine a correlation between prism composite strength of the masonry prism with ultrasound readings as to provide preliminary means of …
The Transaction Costs Of Federal Environmental Policy Changes: The Effects Of The Temporary Covid-19 Cwa Rollback On Local Water Systems, Jesse Lee Barnes
The Transaction Costs Of Federal Environmental Policy Changes: The Effects Of The Temporary Covid-19 Cwa Rollback On Local Water Systems, Jesse Lee Barnes
UNLV Theses, Dissertations, Professional Papers, and Capstones
An institutional dilemma exists between the Clean Water Act (CWA) and the Safe Drinking Water Act (SDWA). US surface waters are protected from point-source pollution by the CWA. Community Water Systems (CWSs) that draw from these surface waters for potable purposes are required to treat that water to a level that meets SDWA health standards. Therefore, decreases in CWA regulations could lead to surface water quality declines and, thus, higher SDWA compliance costs for CWSs. This area of inquiry has become increasingly relevant due to Trump-era executive actions to try to decrease the federal government's role in multiple environmental policies, …
Driving And Community Mobility: An Online Educational Program For Generalist Occupational Therapy Practitioners, Gerard Blanco
Driving And Community Mobility: An Online Educational Program For Generalist Occupational Therapy Practitioners, Gerard Blanco
UNLV Theses, Dissertations, Professional Papers, and Capstones
Driving is an important daily activity that often goes unnoticed, yet it enables individuals to engage in crucial tasks such as grocery shopping, going to work, and participating in social activities. Occupational therapy (OT) practitioners must recognize and address the significance of driving in their daily routines to promote clients' independence and fulfillment. However, despite being well-equipped to assist clients with driving-related issues, many practitioners avoid or neglect this area of occupation. A reluctance to addressing driving and community mobility (DCM) can arise from a lack of confidence, available resources, support, or fear of losing a client's trust. These barriers …

Introduction: Technology is embedded in many aspects of healthcare. This is especially true in nursing, where technology is used daily in charting, medication administration, clinical decision-making, healthcare team communication, and information resource utilization. In nursing programs, students are exposed to healthcare technologies and expected to use them once entering the workforce. Healthcare technologies such as electronic health records (EHR), barcode medication administration, medication dispensing machines, and mobile technologies are critical to adopt to leverage their efficiencies and safety mechanisms to provide the best patient care. Despite evidence indicating the benefits of using healthcare technologies, new graduate nurses enter the workforce …
Ga(Y)Zing Backward: Queer Desire In Ovid, Shakespeare, And Scaimma, Falynn Blayre Brickler
Ga(Y)Zing Backward: Queer Desire In Ovid, Shakespeare, And Scaimma, Falynn Blayre Brickler
UNLV Theses, Dissertations, Professional Papers, and Capstones
As Ovidian myth is a central influence on queer stories throughout time, I am interested in how the female/sapphic gaze impacts the retellings of these narratives. In this thesis, I analyze the action of the gaze as an expression of desire and discuss its multiple meanings in both text and performance. Through tracing the gaze within the queer/sapphic narratives of Shakespeare’s Twelfth Night and Sciamma’s Portrait of a Lady on Fire, I show that the gaze is an intersecting act through which non-normative desire is conveyed. In constructing the gaze as an ephemeral action of queer desire in practice, I …

More specifically, the cancerous body and healthy body are contrasted to one another and considered …
Promoting Early Detection In Primary Care: Program Evaluation Of The Dementia Care Aware Program In Orange County, Ennah Cabading
Promoting Early Detection In Primary Care: Program Evaluation Of The Dementia Care Aware Program In Orange County, Ennah Cabading
UNLV Theses, Dissertations, Professional Papers, and Capstones
The aging population is growing quickly, raising concerns about the increasing numbers of those with Alzheimer's disease and related dementias, as age is the common risk factor for acquiring the disease. The increase in the elderly population may influence higher healthcare costs and the need for more healthcare professionals like primary care professionals. However, primary care professionals face challenges meeting this population's demands due to the lack of training, confidence, and understanding of dementia care. A new California initiative called Dementia Care Aware aims to support primary care professionals by offering training, tools, and resources to increase early detection and …
An Immersive Virtual Reality Treatment Learning Module For Unlv Occupational Therapy Students, Paolo Castro
An Immersive Virtual Reality Treatment Learning Module For Unlv Occupational Therapy Students, Paolo Castro
UNLV Theses, Dissertations, Professional Papers, and Capstones
Virtual reality refers to the technology used to create multi-sensory, three-dimensional environments its users can interact with. Occupational therapists may find virtual reality-based therapy appealing as it allows them to access many virtual environments and tasks that would be difficult to recreate in traditional settings. Despite literature suggesting their willingness to use it in practice, there is an evidence-to-practice gap caused by low self-efficacy and knowledge of how to operate and apply it. The author created a learning module for occupational therapy students to see how it affects perceived clinical competency. The results of the learning module showed statistically significant …
Developing A Growth Mindset Among Undergraduate College Students, Monica Ceja Rodriguez
Developing A Growth Mindset Among Undergraduate College Students, Monica Ceja Rodriguez
UNLV Theses, Dissertations, Professional Papers, and Capstones
College is a time of transitional changes that may come with academic challenges for undergraduate college students. Academic challenges, such as failures or setbacks, may also lead to fixed thinking processes, which could also hinder students’ self-efficacy, motivation, and persistence towards accomplishing their academic goals, such as passing classes and graduating college. To help student motivation, growth mindset interventions have been implemented into educational settings and found to be effective in K-12 school settings by influencing students’ beliefs that a challenging task is attainable. For this reason, in this study, I aimed to find if growth mindset interventions would also …

The Lived Experience Of The Dnp-To-Phd Nursing Graduate: Examining The Journey, Bonni S. Cohen
The Lived Experience Of The Dnp-To-Phd Nursing Graduate: Examining The Journey, Bonni S. Cohen
UNLV Theses, Dissertations, Professional Papers, and Capstones
The traditional route of obtaining a Doctor of Philosophy (PhD) in nursing is vertical: a Master of Science in Nursing (MSN), followed by PhD in nursing. An ongoing shortage of PhD- prepared nurses—nurse educators and nurse researchers, in particular, has spurred the creation of more pathways to obtaining a PhD in Nursing. In recent years, there has been a drive to increase the number of nurse scientists with doctoral degrees through innovative pathways. A newer terminal nursing degree, the Doctor of Nursing Practice (DNP), has taken root over the past decade to produce nurse leaders who are experts at translating …
The Response Of Atomic-To-Molecular Hydrogen Transition Points In Photodissociation Regions Due To A Hard X-Ray Spectrum, Gregory Joseph Colarch
The Response Of Atomic-To-Molecular Hydrogen Transition Points In Photodissociation Regions Due To A Hard X-Ray Spectrum, Gregory Joseph Colarch
UNLV Theses, Dissertations, Professional Papers, and Capstones
This dissertation develops a model for the response of the transition points in the density profiles from atomic (H0) to molecular (H2) hydrogen in a photodissociation region (PDR) due to a hard X-ray flux (HXR). A model for a steady-state PDR due to the photodissociation of H2 by the far-ultraviolet (FUV) Lyman-Werner radiation band is presented both analytically and computa- tionally. A steady state X-ray dissociation region (XDR) from an HXR in the 1 - 100 keV energy range is also developed both analytically and computationally. An analytic model is then developed by combining these two different steady state models. …
Addressing Vision Impairments Following Neurological Injuries: A Vision Protocol For Occupational Therapists, Dyrin Cordero
Addressing Vision Impairments Following Neurological Injuries: A Vision Protocol For Occupational Therapists, Dyrin Cordero
UNLV Theses, Dissertations, Professional Papers, and Capstones
Vision impairments have a high prevalence in adults with a stroke or traumatic brain injury (TBI), potentially affecting up to 90% of this population. However, these impairments are often overlooked during the rehabilitation process due to a lack of education and training provided to occupational therapists (OTs). Limited research also contributes to no standardized best practice guidelines for OTs to follow (Aravich & Troxell., 2021). This issue is important to occupational therapy practitioners because vision impairments negatively affect a person's capacity for recovery, quality of life, safety, and mental health (Berger et al., 2016). Occupational therapists aim to utilize holistic …
