Adjudicating 35 U.S.C. § 112(A): The "Person Of Ordinary Skill In The Art" Conundrum And How To Address It, Matthew T. Simmons

A viable alternative for adjudicating issues under 35 U.S.C. § 112(a) of the Patent Act is needed due to the difficulties of trying these issues to a lay jury. Congress agreed when it enacted the America Invents Act (“AIA”), which created alternative proceedings for challenging patent validity post-grant, including post-grant review (“PGR”) and inter partes review (“IPR”). In theory, PGR proceedings permit the Patent Trial and Appeal Board of the United States Patent and Trademark Office to adjudicate whether one or more claims of a patent are valid on § 112 grounds. The Supreme Court’s stance on the death penalty has evolved over time. In Furman v. Georgia, the Court held that the death penalty violated the Eighth Amendment, only to reinstate it in Gregg v. Georgia four years later.  As the Court continued to interpret “evolving standards of decency,” it later categorically barred the execution of defendants with an intellectual disability in Atkins v. Virginia.  To determine if an individual is intellectually disabled, they must demonstrate subaverage adaptive skills that existed before age eighteen.  The Court has also recognized that IQ scores carry a ±5 margin of error and has …

Hybrid bermudagrass (Cynodon dactylon [L.] Pers. × C. transvaalensis Burtt Davy) (HBG) is a water efficient warm-season turfgrass increasingly adopted in cool-season and semi-arid regions due to climate change and the demand for reduced irrigation inputs. However, prolonged winter dormancy limits its visual quality (verdure) and seasonal performance. This thesis evaluated multiple management strategies to modify dormancy dynamics and improve off-season turf quality in a cool-season environment. Field experiments assessed the effects of growth covers, fertilizers, colorants, surfactants, organic acids, and overseeding with cool-season species on HBG dormancy over two seasons. In recent years, many new vehicles equipped with autonomous driving capabilities have been deployed around the world, but they still have a number of failure cases. One proposed solution to improve performance in these scenarios is cooperative perception, a paradigm in which vehicles communicate with other vehicles and nearby sensors to collect additional perception information about the environment. Prior work has demonstrated that cooperative perception can be accomplished with the high accuracy and low latency needed for autonomous driving. Upper extremity (UE) pain affects approximately 30.7% of adults in the United States and is associated with decreased function and participation. Despite evidence supporting non-pharmacological approaches, pharmacological interventions remain commonly used. This capstone project implemented and evaluated an occupation-based educational program to promote non-pharmacological pain management among adults receiving outpatient occupational therapy for UE conditions. This 14-week project included 10 participants and utilized a mixed-methods design with pre-, mid-, and post-surveys. The program consisted of an introduction and three modules addressing therapeutic movement, physical agent modalities, and sensory regulation. Human well-being has been a topic of interest to philosophers at least since the time of Aristotle, and well-being has also been a core concern of social scientists since the birth of the discipline in the late 18th century. Some theories of well-being include economic inequality as a factor, and multiple ways to measure this factor have been developed; as with well-being, there is no single best measure of economic inequality and the choice of which measure to use may be based on both theoretical and practical reasons. Populations’ interactions in contact zones are important for understanding divergence dynamics of closely related taxa. Such interactions may vary from inter-population divergence being reinforced to secondary contact resulting in the creation of a hybrid swarm. The ecology of each lineage, and different factors like behavior and ecological niches, may impact the outcome of such contact. However, there is little current research on how habitat choice at local scales might reflect distinct populations, particularly in cryptic species.
