This qualitative study explored leadership in higher education through the perspectives of six Native American women faculty at a southwest university. The study utilized a Diné informed conceptual framework incorporating the Diné Philosophy of education, the Diné philosophy of life (Są’áh Naagháí Bik'eh Hózhóón - SNBH), and the Diné ceremonial basket. The research examined how Native women faculty perceived leadership, their identity as leaders in higher education, their leadership in the community, and how their background and context influenced their perception of leadership. People who are in love seem to be addicted to their beloved. People who are in love have attentional biases for the beloved and people who are addicted have attentional biases for the substance they are using. This raises the question of how similar craving and attention are for the beloved and an addictive substance. However, there are no studies that directly compared craving and attention to the beloved and addictive stimuli. For nearly four decades, white Evangelical Christians in the United States rallied around politicians who all fit a similar mold. This consistency was flipped on its head in 2016 when Evangelicals poured out in unprecedented levels to support Donald Trump. Despite being inconsistent with the type of candidate they have traditionally voted for, Evangelicals flocked to the polls with 81% of this group supporting Trump for the presidency. Evangelical support for Trump remained over 75% for the duration of his presidency and his reelection campaign in 2020. This shift begs the following research question: How was Donald Trump able to …

An Originalist Approach To Puerto Rico: Arguments Against The Status Quo, Micah Allred

Few originalists have grappled with a fundamental question about Puerto Rico: whether the Constitution permits the United States to hold the island indefinitely as nonstate territory. There are reasons to doubt that it does. The main purpose of the Constitution’s territorial provisions was to allow Congress to transition the then West-ern Territory into states. And, as a structural matter, Congress’s direct authority over Puerto Ricans conflicts with important constitutional principles such as federalism. But for originalists, arguments from purpose and structure are helpful only insofar as they elucidate the original meaning of the Constitution’s text. This Article lays out two …

Capstone Curriculum For University Students With Intellectual Disabilities At Lipscomb University’S Ideal Program, Aubrey J. Barcelo
OTD Capstone Projects
The IDEAL program at Lipscomb University is an inclusive postsecondary education program for young adults with intellectual disabilities. This project was centered around creating a curriculum for the capstone course for fourth year students in the IDEAL program. The capstone course is two semesters of 14-week curriculum aimed at completing an independent/semi-structured needs-based project and experiential learning. The deliverables of the advanced program capstone include a culminating project based on the five components of Person-Centered Planning. The curriculum includes templates and task lists incorporating principles of universal design to facilitate students’ ability to complete the project independently.

This capstone project was completed in collaboration with MOVE Inclusive Dance, a nonprofit, inclusive dance studio specifically serving individuals of all ages with various disabilities. A needs assessment conducted with the staff at MOVE necessitated a cohesive teacher manual, including teacher training protocol, disability index, safety precautions, sample class activities, curriculum guide, and more. The focus of this capstone was to create and distribute a teacher training manual to dance teachers at MOVE Inclusive Dance. The teacher training manual was created using anonymous pre and post test qualitative and quantitative surveys to assess teacher perceptions regarding feelings of confidence and …

People with intellectual and developmental disabilities (IDD) experience significant health and mental health inequities and difficulties accessing care. There are few initiatives that train mental health professionals to care and advocate for the health and mental health care needs of people with intellectual and developmental disabilities.
We developed a Mental Health and Intellectual and Developmental Disabilities Professional Learning Community (PLC) with Clinical Education Teams (CET) training components through The National Center for START (Systemic-Therapeutic-Assessment-Resources-Treatment) Services® to further educate providers in the United States. The lowrider community in Albuquerque creates a space for families and individuals to gather and express themselves within Chicana/o/x culture. Nuevomexicanas have played a significant role in the teaching and preservation of the New Mexican traditions and rituals of lowriding. This research project is a visual and plática-based study. It explores how young Nuevomexicanas express their Chicana identity through la pachuca and chola cultural aesthetics and identity while actively participating in lowrider culture. Tying arrangements, a central concern of antitrust policy since the early days of the Sherman and Clayton Acts, have come into renewed focus with respect to the practices of dominant technology companies. Unfortunately, tying law’s doctrinal structure is a self-contradictory and incoherent wreck. A conventional view holds that this mess is due to errant Supreme Court precedents, never fully corrected, that expressed hostility to tying based on faulty economic understanding. That is only part of the story. Examination of tying law’s origins and development shows that tying doctrine was built on a now-dated paradigm of what constitutes a tying arrangement. …

The current Supreme Court has made clear that history matters. But doing history well is hard. There is thus an allure to old cases because they provide a link to the past that is more accessible for nonhistorian lawyers. This Article warns against that allure by showing how the use of old cases also poses methodological challenges. The Article uses as a case study the emerging doctrine of foreign relations abstention. Before the Supreme Court, advocates argued that this new doctrine is in fact rooted in early admiralty cases. Those advocates did not, however, canvass the early admiralty practice, relying …

Pretrial Commitment And The Fourth Amendment, Laurent Sacharoff

Today, the Fourth Amendment Warrant Clause governs arrest warrants and search warrants only. But in the founding era, the Warrant Clause governed a third type of warrant: the “warrant of commitment.” Judges issued these warrants to jail defendants pending trial. This Article argues that the Fourth Amendment Warrant Clause, with its oath and probable cause standard, should be understood today to apply to this third type of warrant. That means the Warrant Clause would govern any initial appearance where a judge first commits a defendant—a process that currently falls far short of fulfilling its constitutional and historical function. As the urgency of the climate crisis becomes increasingly apparent, many local governments are adopting land use regulations aimed at minimizing greenhouse gas (GHG) emissions. The emerging approaches call for loosening zoning restrictions to unlock greater density and for strict new green building codes. This Article argues that both approaches are appropriate in some places but not in others. Not all density is created equal, and compact multifamily housing at the urban fringe may actually in-crease GHG emissions. Moreover, where density is appropriate, deregulation will not necessarily produce it. And, finally, green building codes will increase housing costs and so …

The concept of rivalry is central to modern accounts of property. When one per-son’s use of a resource is incompatible with another’s, a system of rights to determine its use may be necessary. It is commonly asserted, however, that informational goods like inventions and expressive works are nonrivalrous and that intellectual property rights must therefore be subject to special limitation, if they should even exist at all. This Article examines the idea of rivalry more closely and makes a series of claims about the analysis of rivalrousness for purposes of such arguments. Narratives Of Exile: Themes Of Displacement In Seghers, Duras, And Elio, Erin Consla

This thesis examines identity, memory, and displacement in the exile narratives of Anna Seghers, Marguerite Duras, and María Luisa Elío. I argue that identity post-exile can be conceptualized as a continuous process of becoming, marked by a kaleidoscope of past, present, and future. Several aesthetic maneuvers such as the use of elements of form, memories of childhood, and palimpsest are shared by the chosen narratives, resulting in similar negotiations with identity. Through analysis of the authors' aesthetic focalizations, it becomes clear that their binary subject positions are modulated by the liminality and contradictions inherent in identity creation after exile. A New Lease On Life: The Occupational Impact Of Adaptive Skiing, Caitlin Tetherow, Amy Lyons-Brown, Amy Griswold
Spring 2024 Virtual OTD Capstone Symposium
This research study focuses on understanding the occupational impact of adaptive skiing on well-being and identity to promote lifelong occupational engagement, representation, and inclusion within current ski culture. A mixed-method research study utilized a 25-question online survey and an optional one-time virtual interview. 50 adaptive skiers and/or snowboarders participating in a winter adaptive program between 18-65 years old completed this study. This study found positive evidence supporting outcomes related to physical, emotional, spiritual, and social well-being and positive identity formation from adaptive skiing.

This capstone project explores the impact of aquatics-based occupational therapy on stroke survivors' quality of life. A needs assessment was performed at an outpatient aquatic physical therapy clinic, and an aquatic program was developed based on stroke survivors' unmet physical, social, mental, and occupational needs.

Near hysteria has erupted in the media, state and federal legislatures, community boards, and churches around critical race theory (CRT). Despite the term's history, development, and clearly defined meaning, it has become a catch-all for white America's fears, deflections, and equivocations on race, society, and the law. Christians are no exception. Their critiques routinely claim that CRT is rewriting of American history, that it is anti-democratic, and even heretical.

“Proportionality” is ubiquitous. The idea that punishment should be proportional to crime is familiar in criminal law and has a lengthy history. But that is not the only place where one encounters the concept of proportionality in law and ethics. The idea of proportionality is important also in the self-defense context, where the right to defend oneself with force is limited by the principle of proportionality. Abstract: According to the actual production situation of China's manufacturing industry, a hyperheuristic algorithm based on K-means clustering is proposed for inter-cell scheduling problem of flexible job-shop. K-means clustering is applied to group entities with similar attributes into the corresponding work cluster decision blocks, and the ant colony algorithm is used to select heuristic rules for each decision block. The optimal scheduling solutions are generated by using corresponding heuristic rules for scheduling of entities in each decision block. The ministerial exception is a doctrine born out of the Religion Clauses of the First Amendment that shields many religious institutions’ employment decisions from review. While the ministerial exception does not extend to all employment decisions by, or employees of, religious institutions, it does confer broad—and absolute—protection. While less controversy surrounds whether the Constitution shields religious institutions’ employment decisions to at least some extent, much more debate surrounds the exception’s scope, and perhaps most critically, which employees fall under it. In other words, who is a "minister" for purposes of the ministerial exception?

Neuronal development is a highly regulated mechanism that is central to organismal function in animals. In humans, disruptions to this process can lead to a range of neurodevelopmental phenotypes, including Schizophrenia (SCZ). SCZ has a significant genetic component, whereby an individual with an SCZ affected family member is eight times more likely to develop the disease than someone with no family history of SCZ. By examining a combination of genomic, transcriptomic and epigenomic datasets, large-scale ‘omics’ studies aim to delineate the relationship between genetic variation and abnormal cellular activity in the SCZ brain. OT addresses activities of daily living (, endurance. fine motor coordination. preparation for discharge. and evaluations for patients both pre- and post-LVAD implantation. Self-regulation is essential to elementary students' academic success. Students' ability to manage their behaviors and develop a sense of self-awareness can positively impact their school engagement and performance. School-based occupational therapy practitioners (OTP) can collaborate with teachers and relevant staff to improve classroom behaviors by implementing self-regulation strategies and modifications through the multi-tiered systems of support (MTSS).
