The lowrider community in Albuquerque creates a space for families and individuals to gather and express themselves within Chicana/o/x culture. Nuevomexicanas have played a significant role in the teaching and preservation of the New Mexican traditions and rituals of lowriding. This research project is a visual and plática-based study. It explores how young Nuevomexicanas express their Chicana identity through la pachuca and chola cultural aesthetics and identity while actively participating in lowrider culture. Tying arrangements, a central concern of antitrust policy since the early days of the Sherman and Clayton Acts, have come into renewed focus with respect to the practices of dominant technology companies. Unfortunately, tying law’s doctrinal structure is a self-contradictory and incoherent wreck. A conventional view holds that this mess is due to errant Supreme Court precedents, never fully corrected, that expressed hostility to tying based on faulty economic understanding. That is only part of the story. Examination of tying law’s origins and development shows that tying doctrine was built on a now-dated paradigm of what constitutes a tying arrangement. …

The current Supreme Court has made clear that history matters. But doing history well is hard. There is thus an allure to old cases because they provide a link to the past that is more accessible for nonhistorian lawyers. This Article warns against that allure by showing how the use of old cases also poses methodological challenges. The Article uses as a case study the emerging doctrine of foreign relations abstention. Before the Supreme Court, advocates argued that this new doctrine is in fact rooted in early admiralty cases. Pretrial Commitment And The Fourth Amendment, Laurent Sacharoff

Today, the Fourth Amendment Warrant Clause governs arrest warrants and search warrants only. But in the founding era, the Warrant Clause governed a third type of warrant: the “warrant of commitment.” Judges issued these warrants to jail defendants pending trial. This Article argues that the Fourth Amendment Warrant Clause, with its oath and probable cause standard, should be understood today to apply to this third type of warrant. That means the Warrant Clause would govern any initial appearance where a judge first commits a defendant—a process that currently falls far short of fulfilling its constitutional and historical function. As the urgency of the climate crisis becomes increasingly apparent, many local governments are adopting land use regulations aimed at minimizing greenhouse gas (GHG) emissions. The emerging approaches call for loosening zoning restrictions to unlock greater density and for strict new green building codes. This Article argues that both approaches are appropriate in some places but not in others. Not all density is created equal, and compact multifamily housing at the urban fringe may actually in-crease GHG emissions. Moreover, where density is appropriate, deregulation will not necessarily produce it. And, finally, green building codes will increase housing costs and so …

The concept of rivalry is central to modern accounts of property. When one per-son’s use of a resource is incompatible with another’s, a system of rights to determine its use may be necessary. It is commonly asserted, however, that informational goods like inventions and expressive works are nonrivalrous and that intellectual property rights must therefore be subject to special limitation, if they should even exist at all. This Article examines the idea of rivalry more closely and makes a series of claims about the analysis of rivalrousness for purposes of such arguments. Narratives Of Exile: Themes Of Displacement In Seghers, Duras, And Elio, Erin Consla

This thesis examines identity, memory, and displacement in the exile narratives of Anna Seghers, Marguerite Duras, and María Luisa Elío. I argue that identity post-exile can be conceptualized as a continuous process of becoming, marked by a kaleidoscope of past, present, and future. Several aesthetic maneuvers such as the use of elements of form, memories of childhood, and palimpsest are shared by the chosen narratives, resulting in similar negotiations with identity. Through analysis of the authors' aesthetic focalizations, it becomes clear that their binary subject positions are modulated by the liminality and contradictions inherent in identity creation after exile. A New Lease On Life: The Occupational Impact Of Adaptive Skiing, Caitlin Tetherow, Amy Lyons-Brown, Amy Griswold
Spring 2024 Virtual OTD Capstone Symposium
This research study focuses on understanding the occupational impact of adaptive skiing on well-being and identity to promote lifelong occupational engagement, representation, and inclusion within current ski culture. A mixed-method research study utilized a 25-question online survey and an optional one-time virtual interview. 50 adaptive skiers and/or snowboarders participating in a winter adaptive program between 18-65 years old completed this study. This study found positive evidence supporting outcomes related to physical, emotional, spiritual, and social well-being and positive identity formation from adaptive skiing.

This capstone project explores the impact of aquatics-based occupational therapy on stroke survivors' quality of life. A needs assessment was performed at an outpatient aquatic physical therapy clinic, and an aquatic program was developed based on stroke survivors' unmet physical, social, mental, and occupational needs.

Near hysteria has erupted in the media, state and federal legislatures, community boards, and churches around critical race theory (CRT). Despite the term's history, development, and clearly defined meaning, it has become a catch-all for white America's fears, deflections, and equivocations on race, society, and the law. Christians are no exception. Their critiques routinely claim that CRT is rewriting of American history, that it is anti-democratic, and even heretical.

But that is not the only place where one encounters the concept of proportionality in law and ethics. Abstract: According to the actual production situation of China's manufacturing industry, a hyperheuristic algorithm based on K-means clustering is proposed for inter-cell scheduling problem of flexible job-shop. K-means clustering is applied to group entities with similar attributes into the corresponding work cluster decision blocks, and the ant colony algorithm is used to select heuristic rules for each decision block. The optimal scheduling solutions are generated by using corresponding heuristic rules for scheduling of entities in each decision block. The ministerial exception is a doctrine born out of the Religion Clauses of the First Amendment that shields many religious institutions’ employment decisions from review. While the ministerial exception does not extend to all employment decisions by, or employees of, religious institutions, it does confer broad—and absolute—protection. While less controversy surrounds whether the Constitution shields religious institutions’ employment decisions to at least some extent, much more debate surrounds the exception’s scope, and perhaps most critically, which employees fall under it. In other words, who is a "minister" for purposes of the ministerial exception?

Neuronal development is a highly regulated mechanism that is central to organismal function in animals. In humans, disruptions to this process can lead to a range of neurodevelopmental phenotypes, including Schizophrenia (SCZ). SCZ has a significant genetic component, whereby an individual with an SCZ affected family member is eight times more likely to develop the disease than someone with no family history of SCZ. By examining a combination of genomic, transcriptomic and epigenomic datasets, large-scale ‘omics’ studies aim to delineate the relationship between genetic variation and abnormal cellular activity in the SCZ brain. Patients who are involuntarily committed to the mental health hospital are likely to be exposed to occupational deprivation. Through the induction of occupation-based programming, it is believed that occupational engagement can catalyze recovery and support meaningful participation in daily life, decreasing the prevalence of occupational deprivation. Occupational Therapy's Role In Addressing Health Disparities In Transgender/ Gender Diverse Youth, Samantha Ryan

This study investigated the effectiveness of an educational module in improving occupational therapists' knowledge and skills regarding transgender and gender diverse (TGD) youth. The research builds upon existing literature demonstrating positive outcomes when integrating TGD population needs into healthcare education programs. The study employs a pre-test/post-test design to assess participants' understanding of critical areas, including culturally affirming care, legal and ethical considerations, social determinants of health and health disparities, developmental stages related to gender identity, and safety considerations for TGD youth. Participant< ; who completed the module demonstrated significant improvements in several key areas. They displayed a firmer grasp of culturally affirming care principles and how to 4 implement them in practice. Additionally, their understanding of legal and ethical considerations surrounding TGD healthcare provision deepened. The study also revealed increased knowledge of social determinants of health and the impact of TGD identities on access to equitable healthcare. Participants better understood how developmental stages relate to gender identity and its influence on occupational engagement. Finally, they demonstrated increased knowledge of safety considerations and protective factors for TGD youth in occupational therapy settings. Findings reveal measurable improvements in participants' knowledge and ability to deliver affirming occupational therapy for TGD youth. The results suggest that the educational module promotes culturally competent and ethical care. Furthermore, these findings suggest that integrating TOD-specific education into occupational therapy curricula can significantly enhance practitioners' ability to provide affirming and effective care for TGD youth.

The Barbary Pirates are a fascinating historical phenomenon, but they were also a part of the larger system of early modern Mediterranean captivity. This system, which thrived from the sixteenth to the early nineteenth century, saw Christians and Muslims enslaving and ransoming one another on both sides of the Mediterranean. These ransoms made up the base of the North African ransom economy at the heart of the entire system, and this economic motivator was joined by religious conviction in driving the actors within the captivity complex.
