Democracy, Discourse, And The Artificially Intelligent Corporation, Michael R. Siebecker May 2024

Democracy, Discourse, And The Artificially Intelligent Corporation, Michael R. Siebecker

Sturm College of Law: Faculty Scholarship

Does the ascendance of the artificially intelligent corporation threaten the integrity and legitimacy of democracy? The question seems particularly important as the 2024 presidential election approaches. Hardly a day passes without a new report regarding the disruptive impact of harnessing artificial intelligence (“AI”) technologies. A cascading cadre of academics, business leaders, and politicians warn that unchecked development and dissemination of AI could irreparably damage vital institutions of civil society. Despite the warnings about existential threats AI poses to human agency and democratic processes, reliance on AI technologies proliferates at break-neck speed.

The concern about AI’s destructive impact gets exacerbated by …

Lost Communication: A Generative Criticism Of How Parental Communication Towards Children Affects How Children Communicate With Peers, Gabriel J. Gaus May 2024

Lost Communication: A Generative Criticism Of How Parental Communication Towards Children Affects How Children Communicate With Peers, Gabriel J. Gaus

Masters Theses

This study aimed to determine the effect parental communication towards three characters on the TV show Lost had on how these characters interacted with their peers. The researcher details the history of Lost and other scholarly information that led to this analysis. To determine the effect of parental communication on peer communication, the researcher coded all six seasons of Lost using a generative criticism method. This study showed that the characters Jack, Kate, and John used communication mechanisms displayed by their parents to judge their value and place in peer communications and interactions.

Visitor Use Management: How The Timed Entry Permit Reservation System At Parks And Protected Areas Influence The Perception Of Sustainable Recreation And Impact Visitor Motivations, Cassandra L. Onufrak

Masters Theses

Parks and protected areas across the United States have undergone substantial change in recent years, specifically pertaining to visitation trends and patterns. National parks have endured rapid growth in park visitation and popular attractions within park boundaries now experience a high visitor concentration and traffic. As visitation within national parks increases, there is a high probability that visitor-related impacts, such as vegetation trampling, wildlife disturbance, soil erosion, and intra-visitor conflict, are also likely to increase. Visitors are more likely to feel crowded and rushed, and ultimately label their park experience as low or poor quality. Through the use of Visitor …

Gpatch8 Modulates Mutant Sf3b1 Mis-Splicing And Pathogenicity In Hematologic Malignancies., Salima Benbarche, Jose Mario Bello Pineda, Laura Baquero Galvis, Jeetayu Biswas, Bo Liu, Eric Wang, Qian Zhang, Simon J Hogg, Kadeen Lyttle, Ariana Dahi, Alexander M Lewis, Martina Sarchi, Jahan Rahman, Nina Fox, Yuxi Ai, Sanjoy Mehta, Ralph Garippa, Juliana Ortiz-Pacheco, Zhuoning Li, Mara Monetti, Robert F Stanley, Sergei Doulatov, Robert K Bradley, Omar Abdel-Wahab

Faculty Research 2024

Mutations in the RNA splicing factor gene SF3B1 are common across hematologic and solid cancers and result in widespread alterations in splicing, yet there is currently no therapeutic means to correct this mis-splicing. Here, we utilize synthetic introns uniquely responsive to mutant SF3B1 to identify trans factors required for aberrant mutant SF3B1 splicing activity. This revealed the G-patch domain-containing protein GPATCH8 as required for mutant SF3B1-induced splicing alterations and impaired hematopoiesis. GPATCH8 is involved in quality control of branchpoint selection, interacts with the RNA helicase DHX15, and functionally opposes SURP and G-patch domain containing 1 (SUGP1), a G-patch protein recently …

Re-Instatement Of Pell Grants For Incarcerated Students: Implications For Cs Education, E. Hogan, D. J. Mir, A. Cencini, Keith O'Hara, A. G. S. Raj, W. G. Griswold, L. Porter

Computer Science Faculty Works

The US incarcerates more people, and at a higher rate, than any other country in the world—predominantly low-income people of color. Higher education in prison (HEP) has a powerful impact on justice-impacted people, improving their quality of life during incarceration and reducing their likelihood of returning to prison post-release. HEP nearly disappeared in 1994 after Pell Grant eligibility was eliminated for incarcerated students, which was recently reinstated. More computing educators can reach incarcerated students with digital literacy skills, core computing content, and critical analyses of the impacts of computing on society. CS education researchers can also support the growth of …

Legal Uncertainty In Virtual Worlds And Digital Goods: Do The Same Laws Apply?, Alanna Sadler May 2024

Legal Uncertainty In Virtual Worlds And Digital Goods: Do The Same Laws Apply?, Alanna Sadler

University of Miami Business Law Review

The growth of virtual worlds and digital goods will force US courts to examine whether traditional laws are sufficient to protect consumers. To do so requires judges and legislative officials to possess a deep understanding of concepts that are everchanging. Many aspects of virtual worlds, such as the metaverse(s), are driven by web3 technology, the technology responsible for the NFT and cryptocurrency craze of recent years. It is impossible to ascertain the impact of virtual worlds on daily life, however, companies must nevertheless prepare for the shift toward virtual spaces and digital goods. There is greater skepticism regarding the utility …

Contracting For Social Change, Adam N. Eckart May 2024

Contracting For Social Change, Adam N. Eckart

University of Miami Business Law Review

Throughout history, social change has often been shaped by high profile legislation and through high-stakes litigation. But social change can also be spurred on through private contract, including through the agreements businesses and individuals make with each other every day. Transactional attorneys can promote social change through drafting techniques and choices, including narrative and storytelling techniques, and can use such drafting techniques in order to 1) write better and more complete agreements that are more consistent with business-led social activism already taking place, and 2) influence society by forcing counterparties to evolve on social issues, change industry practice, or foster …

Board Diversity Is Here To Stay: Extrajudicial Avenues, Maryann Lennon May 2024

Board Diversity Is Here To Stay: Extrajudicial Avenues, Maryann Lennon

University of Miami Business Law Review

Board diversity laws have become a focus of corporations, lawmakers, and courts across the country as constitutional challenges to the policies continue to be raised. California is one of the first states to implement statutes relating to board diversity requirements for publicly held corporations within the state. Nasdaq has followed in similar footsteps, implementing new rules that require a certain number of diverse members on boards for companies listed on the exchanges or a statement explaining a lack thereof. Supporters of the board diversity laws may want to lean on arguments made upholding affirmative action policies within the university system. …

The Structure And Control Of Chaos In Theory And Application, Grayson P. Mcdowell May 2024

The Structure And Control Of Chaos In Theory And Application, Grayson P. Mcdowell

Student Scholarship

Chaos theory is the study of systems that evolve in highly irregular ways due to sensitivity to initial conditions. These include but are not limited to certain physical, biological, chemical, and economic systems. In Section I, we offer a protocol that exposes the structure of chaotic trajectories in the logistic map model, a toy model of chaos, and we offer a method for stabilizing chaotic trajectories. Section I finishes with a discussion of potential pathways forward with these methods. In Section II, we look at a concrete chaotic system: the human heart. One hundred nineteen (N=119) students participated in a …

Unraveling The Role Of Lipid Droplets And Perilipin 2 In Bovine Luteal Cells, Michele R. Plewes, Heather A. Talbott, Micah B. Schott, Jennifer R. Wood, Andrea S. Cupp, John S. Davis

Department of Animal Science: Faculty Publications

Steroidogenic tissues contain cytosolic lipid droplets that are important for steroidogenesis. Perilipin 2 (PLIN2), a structural coat protein located on the surface of lipid droplets in mammalian cells, plays a crucial role in regulating lipid droplet formation and contributing to various cellular processes such as lipid storage and energy homeostasis. Herein, we examine the role that PLIN2 plays in regulating progesterone synthesis in the bovine corpus luteum. Utilizing gene array databases and Western blotting, we have delineated the expression pattern of PLIN2 throughout the follicular to luteal transition. Our findings reveal the presence of PLIN2 in both ovarian follicular and …

Two Steps Too Far: New Limitations On The Use Of The Texas Two-Step To Resolve Mass Tort Liability In Bankruptcy, Samuel E. Bartz May 2024

Two Steps Too Far: New Limitations On The Use Of The Texas Two-Step To Resolve Mass Tort Liability In Bankruptcy, Samuel E. Bartz

University of Miami Business Law Review

This paper explores the mechanisms by which companies have utilized corporate restructuring through divisive mergers in conjunction with the available protections and tools of the United States Bankruptcy Code to resolve mass tort liability without placing the entirety of the business under bankruptcy. Popularized in Texas, a divisive merger is a mechanism by which an existing business entity divides itself into two new entities, allocating all pre-existing assets and liabilities to each as they see fit. Although intended to be a means by which to easily sell assets of a business, it has been more popularly used to resolve mass …

Esg Implementation In Emerging & Frontier Markets: Lessons Cultivated From Sri Lanka And Beyond, Ahmed Qaisi May 2024

Esg Implementation In Emerging & Frontier Markets: Lessons Cultivated From Sri Lanka And Beyond, Ahmed Qaisi

University of Miami Business Law Review

Crippling debt accrued within emerging and frontier market nations forces developing governments to enact policies contrary to the well-being of their overall economies. The influence of credit rating agencies as well as organizations like the World Bank and the International Monetary Fund (“IMF”) have handcuffed governments into implementing Environmental, Social, and Governance (“ESG”) policies that are unrealistic and unfeasible and have therefore caused detrimental societal impacts. This note examines how the application of ESG policies and governmental corruption resulted in Sri Lanka’s devastating economic collapse. Also scrutinized are those countries which have taken on debt but have managed well throughout …

Determining The Impact Of Mindfulness Activities To Increase Joy In Work And Decrease Burnout: An Integrative Review, Kimberly Gleason Bogart May 2024

Determining The Impact Of Mindfulness Activities To Increase Joy In Work And Decrease Burnout: An Integrative Review, Kimberly Gleason Bogart

Doctoral Dissertations and Projects

This integrative review aims to evaluate whether mindfulness effectively increases joy in work and decreases nursing burnout. A lack of joy leads to feelings of burnout and negatively affects nurses and their desire to leave the profession. Nursing is often accompanied by intense emotional and physical demands that can lead to job dissatisfaction, anxiety, and stress. Burnout diminishes the quality of care and negatively impacts nurses’ well-being. This integrative review aims to explore mindfulness interventions to increase joy within nursing and potentially alleviate burnout. Drawing upon existing literature, this paper examines various mindfulness interventions and factors contributing to burnout among …

Improved Rational Approximation Of Near-To-Far Propagation Kernels For The Wave Equation, Sampson Owusu May 2024

Improved Rational Approximation Of Near-To-Far Propagation Kernels For The Wave Equation, Sampson Owusu

Mathematics & Statistics ETDs

The 3-space, 1-time dimensional scalar wave equation, or 3+1 wave equation, describes the propagation of scalar or acoustic waves. The unforced homogeneous equation admits a class of outgoing solutions relative to a chosen fixed center, so called “multipole” solutions. This thesis examines near-to-far signal propagation in the context of these multipole solutions. Given a time-series (history of values) for a multipole solution recorded at a radius r1, near- to-far signal propagation recovers the corresponding time-series at larger radius r2 ≫ r1. This propagation takes into account both the appropriate time delay r2 − r1 and corrections to the wave shape. …

Increasing Bacterial Tolerance And Metabolism Of The Biofuel, N-Butanol Using Community-Level Evolution And Functional Genomics, Kayley T. You Mak May 2024

Increasing Bacterial Tolerance And Metabolism Of The Biofuel, N-Butanol Using Community-Level Evolution And Functional Genomics, Kayley T. You Mak

Biology ETDs

Bioremediation capability should be developed along with biofuel technology to mitigate the potential damage of future spills. Biobutanol is being developed since n-butanol is more energy dense and less volatile than ethanol. A bottleneck for industrial production of biobutanol is its toxicity; most microbes cannot survive ~1.5% v/v. Thus, microbial bioremediation of n-butanol would need microbes that can both tolerate and metabolize butanol. We used ecological and evolutionary biology approaches to find bacteria that could tolerate and metabolize butanol. Ecological community-level assays followed by 16S amplicon sequencing were completed to identify butanol-tolerant artificial bacterial communities. Secondly, we looked for bacteria …

The Lopsided Law Of Medical Conscience, Dov Fox May 2024

The Lopsided Law Of Medical Conscience, Dov Fox

The Journal of Contemporary Legal Issues

We’re used to hearing about conscientious refusal: when physicians or pharmacists deny services they deem sinful or wrong, in violation of hospital policies or malpractice laws. Less familiar is conscientious provision: when clinicians supply care that their employer or state restricts. America’s conscience regime often protects refusers categorically: they get conscience without conditions or consequences. But doctors with heartfelt reasons to supply care their institution or government forbids? For them, conscience is no defense.

This radical asymmetry is indefensible and unjust. Both refusers and providers resist workplace rules and legislative directives at odds with their sincere moral convictions. Both sometimes …
