A Social Status Theory Of Defamation Law, Yonathan A. Arbel

Despite deep inequality in social status and social capital in American society, legal scholarship has done relatively little to understand the structures that produce status and maintain its distribution. The Article argues that defamation law plays such a role. The orthodox view is that defamation law's goal is to protect dignity. This view was expressed in a famous Supreme Court holding in 1966, which held that defamation law is necessary to protect "the essential dignity" of "every human being. Caution in reviewing the actions of the legislative and executive branches has been a hallmark of the jurisprudence of Judge J. Harvie Wilkinson III. The Constitution “at most gives judges specific authority to redress violations of specific provisions,” Judge Wilkinson writes in his book Cosmic Constitutional Theory. But even when doing so, “courts must exercise great caution before injecting themselves into the vortex of varied political questions,” for “[i]t is often far preferable to allow the political institutions under our Constitution to struggle among themselves, with each bringing to bear the respective arsenal of powers the Framers accorded them.” …

During the Russian invasion of Ukraine, which started in early 2022, many religious communities in Ukraine turned into social centers, where those affected by the war, mostly internal migrants, could find shelter, food, clothes, medical and psychological aid, help with evacuation and social rehabilitation. The invasion of 2022 aimed at seizing all of Ukraine. The subsequent wave of migrants was defined by the UN as the biggest refugee crisis in the world since WWII. Kahnawa:ke is a First Nations reserve near Montreal in Quebec, Canada, with a rich history of creative expression. This is a Kanienʼkehá꞉ka (Mohawk) community, a part of the Haudenosaunee (Iroquois) Confederacy, a prominent First Peoples group of the Northeast Woodlands. Like many other Indigenous communities, Kahnawa:ke is in the process of revitalizing and renormalizing their culture after centuries of assimilation efforts and pressures to separate them from their traditions. Their creation story, known as the Sky Woman Epoch, is foundational to this culture. While there are a number of creation symbols, this study will focus on the Sky Dome, a …

Studies of lake ice phenology have historically relied on limited in situ data. Relatively few observations exist for ice out and fewer still for ice in, both of which are necessary to determine the temporal extent of ice cover. Satellite data provide an opportunity to better document patterns of ice phenology across landscapes and relate them to the climatological drivers behind changing ice phenology. We developed a model, the Cumulative Sum Method (CSM), that uses daytime and nighttime surface temperature observations from the Moderate Resolution Imaging Spectroradiometer (MODIS) sensor on board the Earth-observing Aqua satellite to approximate ice in (the …

Cyber-physical systems are prevalent in many critical infrastructures and are vulnerable to a variety of attacks from the network. Decentralized control systems are particularly vulnerable since they rely heavily on network communication to achieve their goals. To address network vulnerabilities, we present an event-triggered network connection and communication protocol that minimizes the amount of time agents are connected to the network, reducing the window of opportunity for attacks. This mechanism is a function of only local information and ensures stability for the overall system in attack-free scenarios. "Boycott" -- A Proposed Legal Definition Put To Test, Sharona Aharoni-Goldenberg, Gerry Leisman

The definition of "boycott" attracts controversy in legislation, case law, and dictionaries. This paper questions what the worthy legal definition of "boycott" is. It examines and analyzes various sources on "boycott." We conclude that the most distinctive characteristic of a "boycott" is omissions, such as refusal to provide services. The antithesis of omission is commission. Omissions signify allowing something to happen, whereas commissions signify causing it to happen. Since boycotts concern omissions, they entail less legislative interference with the boycotter's right of autonomy. Yet, the autonomy of the boycotters should be restrained when they coerce the boycott's targets, coerce others …

The pay gap between men and women is typically defined as the ratio of median annual earnings of men and women working full time. The gap is attributable to many pre- and post-labor market factors such as family background, work aspirations, education, experience, ability, hours worked, unionization rates, workplace practices or conditions, technological developments, and even public health developments. Because a large variety of personal and labor market factors contribute to the pay gap, it is highly improbable that the median pay of men and women will ever be the same, any more than pay for younger and older workers. …

Drawing primarily from the internationally recognized human right to a clean, healthy and sustainable environment, ("right to a healthy environment") as well as related international environmental and economic human rights laws, this Article makes three critical moves towards theorizing a gender conscious approach to labor environmentalism. First, this Article demonstrates through four cases studies from Bangladesh, that global and national labor movements can effectively address the root causes of labor rights violations, specifically around health and safety by deploying and mobilizing around the recently passed international right to a healthy environment.
