Asphalt pavements make up a majority of the essential transportation systems in the US. Asphalt mixtures age and degrade over time, reducing the pavement performance. Pavement performance critically depends on the aging of asphalt binder. the aging of asphalt binder during construction is traditionally modeled by rolling thin film oven (RTFO) testing, while aging during service life is modeled by pressure aging vessel (PAV) testing. Comparing these models to the aging of binders in actual pavements is limited because, to be used for current testing, binders must be separated from the pavement's aggregate by solvent extraction. One of the conditions for a detention not to be arbitrary under s. 9 of the Canadian Charter of Rights and Freedom is that it must be authorized by a law that is itself not arbitrary. The Supreme Court’s pronouncements about what makes a law arbitrary have been brief, question begging and, at times, conflicting. This article takes stock and proposes a path forward.

First, it reviews the Supreme Court’s case law with the goal of developing a taxonomy of its various accounts of arbitrary laws. It identifies three: a formal account (with a procedural check), a purpose-sensitive account, and …

The Influence Of The Race Of Defendant And The Race Of Victim On Capital Charging And Sentencing In California, Catherine M. Grosso, Jeffrey A. Fagan, Michael Laurence

The California Racial Justice Act of 2020 recognized racial and ethnic discrimination as a basis for relief in capital cases, expressly permitting several types of statistical evidence to be introduced. This statewide study of the influence of race and ethnicity on the application of capital punishment contributes to this evidence. We draw on data from over 27,000 murder and manslaughter convictions in California state courts between 1978 and 2002. Using multiple methods, we found significant racial and ethnic disparities in charging and sentencing decisions. In July 2019, shortly after Gov. Andrew Cuomo signed the Climate Leadership and Community Protection Act (CLCPA), I wrote in an op-ed, “The champagne corks are still popping. But the realization is dawning that implementing the new law will be really, really hard. The Supreme Court’s recent decision in Andy Warhol Foundation for Visual Arts, Inc. v. Goldsmith is a watershed moment in the story of copyright jurisprudence. At its broadest, the decision articulates a unified vision — one that had been dormant in the lower court fair use jurisprudence — about the role of copyright and the manner in which to make sense of its effort to balance exclusivity with its myriad limitations. In Citizens United v. Federal Election Commission, the Supreme Court invalidated the longstanding ban on the expenditure of corporate funds in federal election campaigns. In so doing, the Court dismissed outright an argument that had long been the foundation for the restriction of corporate money in election campaigns — that, due to the “substantial aggregations of wealth amassed by the special advantages which go with the corporate form[,]” corporate money poses a distinct threat to the integrity of democracy. The GATT security exceptions were practically in hibernation until recently. The recent WTO disputes panel activity concerning such exceptions is characterized by a standard of review that places the accent on ‘when’ action should be taken and not so much on ‘what’ action should be taken. We see two problems with this construction. First, the ‘when’ might be a function of privileged information that those possessing it might be unwilling to divulge in a transparent manner. Second, national security is an amorphous concept, and unless we disaggregate it, it is impossible to pronounce the appropriateness of measures adopted to pursue …

We report an observation of ultrahigh-energy (UHE) gamma rays from the Galactic center (GC) region, using 7 yr of data collected by the High-Altitude Water Cherenkov (HAWC) Observatory. The HAWC data are best described as a point-like source (HAWC J1746-2856) with a power-law spectrum ( d N / d E = ϕ E / 26 TeV γ ), where γ = −2.88 ± 0.15stat − 0.1sys and ϕ = 1.5 x 10−15 (TeV cm2 s)−1 ± 0.3 stat − 0.13 sys + 0.08 sys extending from 6 to 114 TeV. We report the isolation and draft genome sequence of Ruoffia tabacinasalis, a novel member of the bovine nasal microbiota. The genome, which is estimated to be 90.5% complete, is composed of one contig comprising 2,363,349 bp with a GC content of 36.66%.

Two experiments were conducted to assess the efficiency of including the novel protein ingredient Arthrospira platensis or improved soybean meal in a broiler diet. The first experiment aimed to determine the feeding value of soybean meal produced from varieties of soybeans bred for increased amino acid content (SBAA) and improved oil content (SBO) compared to a conventional soybean variety in an ANOVA design fed to Cobb 500 female broilers for 28–42 d. The SBAA and SBO soybeans contained overall higher amino acid content and lower oligosaccharide content compared to the conventional soybean variety in addition to improved oil quality. The …

Heat stress (HS) and water scarcity are significant challenges to sustainable poultry production worldwide. It is, therefore, critical to identify effective strategies to prevent, withstand, or adapt to these challenges. After four generations of divergent selection for water efficiency, the present study was undertaken to determine the effect of HS on meat quality and muscle myopathy incidences in high (HWE)- and low (LWE)-water efficient broilers. Dietary CP reductions in broilers can result in increased FCR when 6 or 7 feed-grade amino acids are allowed to enter formulation, and a partial explanation may be a dietary limitation of His. Histidine requirement data are sparce in the current body of literature, especially beyond 3 wk post-hatch. Therefore, a His dose-response experiment (expressed as a percentage of Lys) was conducted with male Cobb 500 broilers from 15 to 35 d post-hatch. This study investigated the effects of supplemental Gly, Ser, and Arg on growth performance, carcass traits, footpad dermatitis, and litter ammonia emission of broilers fed low-protein diets from 18 to 42 d of age. A total 576 one-day-old female Cobb 500 broilers were divided into 6 dietary treatments: 1) control, high CP (HCP 20%), 2) medium CP (MCP 18%), 3) low CP (LCP 16%), 4) LCP + 0.20% Gly+Ser, 5) LCP + 0.20% Arg, and 6) LCP + 0.20% Gly+Ser + 0.20% Arg. We unravel stationary states in the form of dark soliton stripes, bubbles, and kinks embedded in a two-dimensional droplet-bearing setting emulated by an extended Gross-Pitaevskii approach. The existence of these configurations is corroborated through an effectively reduced potential picture demonstrating their concrete parametric regions of existence. The excitation spectra of such configurations are analyzed within the Bogoliubov-de Gennes framework exposing the destabilization of dark soliton stripes and bubbles, while confirming the stability of droplets, and importantly unveiling spectral stability of the kink against transverse excitations. We have measured multiple differential cross sections for dissociative capture in collisions of 75-keV protons with D2. Data were analyzed for kinetic energy releases (KERs) ranging from 0 to 2 eV, where the dissociation is primarily caused by excitation of the nuclear motion to a vibrational continuum state. Pronounced signatures of two-center interference effects were observed. The data were compared to previously published cross sections for dissociative capture in p+H2 collisions, for which we reported a scattering angle dependent phase shift in the interference term. The D2 data reveal qualitative differences in the interference structure to the H2 case. Some …
