Juror Number Six: Implicit Bias And The Future Of Jury Trials, Dave Mcgowan
Juror Number Six: Implicit Bias And The Future Of Jury Trials, Dave Mcgowan
San Diego Law Review
Implicit bias concepts have been quick to take hold in the law. Their influence may be traced through mandatory continuing education requirements, statutory restrictions on jury selection, jury instructions, and, in two recent rulings from the Washington Supreme Court, judicial limits on juror deliberations and permissible arguments. These limits use implicit bias premises to experiment with altering the balance of interests served by jury trials.
Part II of this Article tells the story of the trial of Tomas Berhe, who was convicted of shooting Everett Williams to death. Mr. Berhe’s case led to an extraordinary event: a live hearing in …

Teacher Experience With Ai In Middle School Education: A Qualitative Research Study, Aimee Lintner
Doctoral Dissertations and Projects
The purpose of the case study was to understand the use of technology, particularly AI, for public middle school teachers in Michigan. The theory that guided this study is Albert Bandura's social cognitive theory. Self-efficacy is relevant in that it relates to self-achievement and the belief in the desired goal —Bandura's view of social cognition keys to self-efficacy, incorporating self-evaluation and focusing on goal orientation. Consistent with the case study, the focus was on teachers' structure for teaching, the potential to use AI in the classroom, and the increased use of technology. The central question is to determine if AI …

Department of Horticulture & Landscape Architecture Faculty Publications
Organic sweetpotato growers have limited effective weed management options, and most rely on in-season between-row cultivation and hand weeding, which are time consuming, are costly, and deteriorate soil quality. Studies were conducted at the Samuel G. Meigs Horticulture Research Farm, Lafayette, IN, and at the Southwest Purdue Agricultural Center, Vincennes, IN, in 2022 and 2023 to determine the effects of in-row plant spacing and cultivar selection on weed suppression and organic sweetpotato yield. The experiment was a split-split plot design, with in-row spacings of 20, 30, and 40 cm as the main plot factor, weeding frequency (critical weed-free period and …

Tackling Selfish Clients In Federated Learning, Andrea Augello, Ashish Gupta, Giuseppe Lo Re, Sajal K. Das
Computer Science Faculty Research & Creative Works
Federated Learning (FL) is a distributed machine learning paradigm facilitating participants to collaboratively train a model without revealing their local data. However, when FL is deployed into the wild, some intelligent clients can deliberately deviate from the standard training process to make the global model inclined toward their local model, thereby prioritizing their local data distribution. We refer to this novel category of misbehaving clients as selfish. in this paper, we propose a Robust aggregation strategy for the FL server to mitigate the effect of Selfishness (in short RFL-Self). RFL-Self incorporates an innovative method to recover (or estimate) the true …

Among all bodies of a fixed volume, the ball has the smallest surface area. Among all ideals in R[x1,..., xn] generated by a fixed number of monomials of degree d, the one with the fewest monomials of degree d + 1 is the lex-ideal. These are two very different sounding facts, but are in fact both examples of isoperimetric problems, which ask: among all objects of a particular size, which has the smallest boundary? In this talk, we’ll focus on the discrete setting, where isoperimetric problems take the form: given a graph G, among all subsets of the vertices of …
The Need For Accurate [And Respectful] Depictions Of Mental Illness In Fiction, Jacequlyn L. Mills
The Need For Accurate [And Respectful] Depictions Of Mental Illness In Fiction, Jacequlyn L. Mills
Masters Theses
This thesis seeks to address the ongoing misrepresentation of mental illness in popular media, specifically within film, television, and literature. The power of the media is instrumental in public perception, and the ongoing negative misinformation and inaccuracy of mental illness those who are affected by it in media is instrumental in spreading harmful stereotypes and stigma. This affects not only the way that the general public views mental illness but also the way those with mental illness view themselves as well as their desire to seek help. I use these forms of media to showcase both the negative and positive …

All Decisions
In this licensee holdover case, the court granted summary judgment dismissing the petition, ruling the respondent is a rent-stabilized tenant under a valid renewal lease, not a licensee. The court found the landlord misdescribed the apartment's regulatory status, violating RPAPL § 741. After the tenant of record died, the landlord issued a renewal lease for the respondent listing both the deceased tenant and the respondent. The court held that the respondent's mother validly accepted the lease on his behalf, making the renewal binding under Rent Stabilization Code § 2523.5(a) and General Obligations Law § 5-703.

374-76 Prospect Place Tenants Assn., Inc. V. City Of New York
All Decisions
The tenant sued the landlord, alleging breach of contract, promissory estoppel, breach of fiduciary duty, and unjust enrichment. The landlord had allegedly promised to convert the building into a low-income cooperative under the TIL program. The court affirmed the denial of the landlord's motion to dismiss, allowing the claims to proceed, as the tenant plausibly alleged a contract, fiduciary relationship, and detrimental reliance on the landlord's promises.
Monfils V. Vista On 5th Corp.
All Decisions
In this illegal lockout case, the court ruled that the tenant retains possession of the premises despite being temporarily transferred to a hospital and rehabilitation facility. The landlord's refusal to readmit the tenant without court approval violated statutory protections under Social Services Law § 461-g. The court found that a resident's discharge from an enriched housing program requires a court proceeding, and self-help measures are unlawful. The tenant met the burden of proving an illegal lockout under RPAPL §713(10), and the case was restored to allow the landlord to address unresolved claims.

Quadrupedal robots are confronted with the intricate challenge of navigating dynamic environments fraught with diverse and unpredictable scenarios. Effectively identifying and responding to obstacles is paramount for ensuring safe and reliable navigation. This paper introduces a pioneering method for 3D object detection, termed viewpoint feature histograms, which leverages the established paradigm of 2D detection in projection. By translating 2D bounding boxes into 3D object proposals, this approach not only enables the reuse of existing 2D detectors but also significantly increases the performance with less computation required, allowing for real-time detection. Our method is versatile, targeting both bird’s eye view objects …
Searching For The Radical Constitution, Robert L. Tsai
Searching For The Radical Constitution, Robert L. Tsai
Faculty Scholarship
Due to its length and richness, The Constitutional Bind could be considered several books in one. It is a socialist critique of American political development that highlights the tradeoffs from incremental rather than transformational progress. It is also a partial intellectual history of radical and alternative constitutional theories marginalized by the set of ideas that came to rule. Finally, the book serves as an urgent plea for fellow citizens to give up the mesmerizing, yet frustratingly confining rhetoric of twentieth-century liberal constitutionalism.
Given Rana’s central objective of investigating the rise of the “creedal” approach to American constitutionalism, I believe it …

The Extent To Which Race, Ptsd Symptoms, And Attitudes Toward Help-Seeking Predict Help-Seeking Intentions/Help-Seeking Behavior Among Veterans, Lenora Elizabeth Rogers
Walden Dissertations and Doctoral Studies
Veterans who are returning to civilian life often experience barriers to seeking mental healthcare. The purpose of this quantitative, non-experimental, correlational study was to determine the extent to which race, PTSD symptoms, and attitudes toward help-seeking (psychological openness, help-seeking propensity, indifference to stigma) predict help-seeking intentions and help-seeking behavior among military veterans. Ajzen’s theory of planned behavior was the basis for this study. A convenience sample of 105 veterans (53 African Americans, 52 Caucasians) were recruited via Alchemer. Standard multiple regression analysis showed that help-seeking propensity was a significant predictor of help-seeking intentions, with higher scores on help-seeking propensity predicting …

The construction sector is essential in the global economy, contributing significantly to economic stability and development. Obtaining of the construction materials has been a severe challenge due to the massive economic crisis that has been witnessed globally. Despite efforts to mitigate the issue, inflation, supply chain disruptions, and a sharp increase in the cost of construction materials are occurring. Projects have been adversely affected by the changes in prices where some have stalled and others failed to meet the set deadlines. These factors are increasing construction problems that have negatively affected the project owners because the cost increase leads to …
Problem Of Rolling Over Of The Stories In Agile It Projects, Ashish Dangwal
Problem Of Rolling Over Of The Stories In Agile It Projects, Ashish Dangwal
Harrisburg University Dissertations and Theses
Agile teams had the problem of rolling over of the stories in the IT projects. The spillover of the stories was happening despite of already having the commitment from the skillful team to finish the work in a Sprint. The reason of inefficiency was lack of Agile best practices like communication, collaboration, trust, teamwork, and self-organization in the Agile teams. Even though the team was skillful, the configuration was not proper. T-shaped team members have generic skill as well as diverse skill set. The T-shaped team members were lacking in the Agile teams and that’s why the spillover was happening. …

Mass Tort Litigation, Chapter 11, And Good Faith: Let Not Perfect Be The Enemy Of Pretty, Pretty Good, Lawrence Ponoroff
Duke Law Journal Online
Soon after enactment of the current Bankruptcy Code, Chapter 11 emerged as the forum of choice for companies seeking to resolve the otherwise intractable problems associated with mass tort liability. In recent years, the enactment of state law divisive merger statutes opened a new era in the evolution of mass tort liability cases. Specifically, companies could create a new entity that would assume responsibility for all outstanding tort claims, thus keeping the parent firm out of bankruptcy entirely. This practice, colloquially referred to as the Texas Two-Step, gained widespread notoriety when Johnson & Johnson placed its new subsidiary, LTL Management, …

Rapidly changing climate is disrupting the High Arctic's water systems. As tracers of hydrological processes, stable water isotopes can be used for high quality monitoring of Arctic waters to better reconstruct past changes and assess future environmental threats. However, logistical challenges typically limit the length and scope of isotopic monitoring in High Arctic landscapes. Here, we present a comprehensive isotopic survey of 535 water samples taken in 2018 and 2019 of the lakes and other surface waters of the periglacial Pituffik Peninsula in far northwest Greenland. The δ18O, δ2H, and deuterium-excess values of these samples, representing 196 unique sites, grant …

BACKGROUND: Biofilm formation in
METHODS: We conducted a literature review analysis of the published articles on the
RESULTS: The results showed that biofilm formation starts as adhesion and progresses through micro-colonies, maturation, and dispersion in a planktonic form. Moreover, specific genes modulate each phase of biofilm formation. Few studies have shown that mechanisms, such as quorum sensing and diffusible signal factors, enhance coordination among bacteria when switching from biofilm to planktonic states. Different protein expressions were also observed between planktonic and biofilm strains, and the biofilm architecture was supported by exopolysaccharides, extracellular DNA, and outer membrane vesicles.
CONCLUSIONS: This infrastructure …
