Chevron Deference Is Dead, Long Live Deference, Jack M. Beermann Nov 2024

Chevron Deference Is Dead, Long Live Deference, Jack M. Beermann

Faculty Scholarship

The demise of Chevron deference standing alone may turn out to be much less important for the future of administrative law and agency regulation than many believe. The Court explicitly approved of deference under the Skidmore factors, which instruct reviewing courts to “resort for guidance, even on legal questions” to “the interpretations and opinions of the relevant agency, made in pursuance of official duty and based upon specialized experience.”8 Further, the Court had already created numerous limitations to the reach of Chevron deference and, as the Court noted, it had not deferred under Chevron in nearly a decade. Chevron deference …

Glucose has long been considered the primary fuel source for the brain. However, glucose levels fluctuate in the brain during sleep or circuit activity, posing major metabolic stress. Here, we demonstrate that the mammalian brain uses pyruvate as a fuel source, and pyruvate can support neuronal viability in the absence of glucose. Nerve terminals are sites of metabolic vulnerability, and we show that mitochondrial pyruvate uptake is a critical step in oxidative ATP production in hippocampal terminals. We find that the mitochondrial pyruvate carrier is post-translationally modified by lysine acetylation, which, in turn, modulates mitochondrial pyruvate uptake. Our data reveal …

Going Against The Family: Perturbation Of A Greenbeard Pathway Leads To Falsebeard Cheating, Peter Lehmann, Mariko Katoh-Kurasawa, Peter Kundert, Gad Shaulsky

Faculty, Staff and Students Publications

Greenbeards facilitate cooperation by encoding a perceptible signal, the ability to detect it, and a tendency to help others that display it. Falsebeards are hypothetical cheaters that display the signal without being altruistic. Despite many examples of greenbeards, evidence for falsebeards is scarce. The Dictyostelium discoideum tgrB1-tgrC1 allorecognition pathway encodes a greenbeard. It allows development, which yields fruiting bodies with altruistic stalks that increase spore dispersal. Here we show that cells lacking rapgapB, a tgrB1-tgrC1 signaling element, cheat by avoiding the stalk fate and generating more spores in chimeras than in pure populations. rapgapB– cells cheat only on …

Genomic instability disorders are characterized by DNA or chromosomal instability, resulting in various clinical manifestations, including developmental anomalies, immunodeficiency, and increased risk of developing cancers beginning in childhood. Many of these genomic instability disorders also present with exquisite sensitivity to anticancer treatments such as ionizing radiation and chemotherapy, which may further increase the risk of second cancers. In July 2023, the American Association for Cancer Research held the second Childhood Cancer Predisposition Workshop, where multidisciplinary international experts discussed, reviewed, and updated recommendations for children with cancer predisposition syndromes. This article discusses childhood cancer risks and surveillance recommendations for the group …

Sample Multiplexing For Retinal Single-Cell Rna Sequencing, Justin Ma, Ting-Kuan Chu, Maria Polo-Prieto, Yong H Park, Yumei Li, Rui Chen, Graeme Mardon, Benjamin J Frankfort, Nicholas M Tran

Faculty, Staff and Students Publications

Rare cell populations can be challenging to characterize using microfluidic single-cell RNA sequencing (scRNA-seq) platforms. Typically, the population of interest must be enriched and pooled from multiple biological specimens for efficient collection. However, these practices preclude the resolution of sample origin together with phenotypic data and are problematic in experiments in which biological or technical variation is expected to be high (e.g., disease models, genetic perturbation screens, or human samples). One solution is sample multiplexing whereby each sample is tagged with a unique sequence barcode that is resolved bioinformatically. We have established a scRNA-seq sample multiplexing pipeline for mouse retinal …

Alternatively Spliced Map4 Isoforms Have Key Roles In Maintaining Microtubule Organization And Skeletal Muscle Function, Lathan Lucas, Larissa Nitschke, Brandon Nguyen, James A Loehr, George G Rodney, Thomas A Cooper

Faculty, Staff and Students Publications

Skeletal muscle cells (myofibers) are elongated non-mitotic, multinucleated syncytia that have adapted a microtubule lattice. Microtubule-associated proteins (MAPs) play roles in regulating microtubule architecture. The most abundant MAP in skeletal muscle is MAP4. MAP4 consists of a ubiquitous MAP4 isoform (uMAP4), expressed in most tissues, and a striated-muscle-specific alternatively spliced isoform (mMAP4) that includes a 3,180-nucleotide exon (exon 8). To determine the role of mMAP4 in skeletal muscle, we generated mice that lack mMAP4 and express only uMAP4 due to genomic deletion of exon 8. We demonstrate that loss of mMAP4 leads to disorganized microtubule architecture and intrinsic loss of …

Evaluating The Effectiveness Of Edge Line Sinusoidal Rumble Strips On Lane Departure Crash Prevention And Injury Severity, Shubhankar Chintamani Shindgikar

USF Tampa Graduate Theses and Dissertations

Lane departure crashes are one of the most prevalent accidents in Florida and the United States. Various forms of rumble strips have been employed to mitigate and decrease these incidents. The Florida Department of Transportation (FDOT) recently adopted a new sinusoidal rumble strip pattern for statewide implementation of audible and vibratory treatment (AVT). Recent research indicates sinusoidal rumble strips are highly effective in alerting drivers audibly and through tactile vibrations, thus aiding lane departure prevention. Moreover, they generate less external noise compared to other rumble strip textures.

However, a systematic assessment of the safety effectiveness of sinusoidal rumble strips in …

Spatiotemporal Dynamics Of Coastal Nekton Metacommunities In The Western Atlantic, Jonathan A. Peake Nov 2024

Spatiotemporal Dynamics Of Coastal Nekton Metacommunities In The Western Atlantic, Jonathan A. Peake

USF Tampa Graduate Theses and Dissertations

The processes of diversification, selection, dispersal, and stochastic drift can combine in many ways to assemble ecological communities. A key focus in ecology is to describe and quantify the relative influences of these processes for different systems and explain the mechanisms by which these processes produce patterns of community structure. To accomplish this goal, ecologists have developed several frameworks that seek to integrate processes that occur locally andregionally. The metacommunity concept treats local communities as pieces of a broader landscape that are connected through dispersal of their constituent organisms. Empirical studies have generally lagged behind the development of metacommunity theory. …

Multi-Sided Information Asymmetry In A Single Contract: Why Revocable Living Trusts Go To Court, James P. Wells Nov 2024

Multi-Sided Information Asymmetry In A Single Contract: Why Revocable Living Trusts Go To Court, James P. Wells

USF Tampa Graduate Theses and Dissertations

Revocable living trust documents (trusts) are among the most important documents created in contemporary estate planning. One of the trust’s objectives is to provide clear guidance to the trustees on how to carry out the grantor's intent. When a trust is contested in court, the objective of the trust has clearly failed. Consequently, understanding why trusts go to court and developing approaches that reduce or eliminate the number of trusts in our courts is an endeavor worthy of research and the primary objective of this research effort.

Ideally, with a clearly stated grantor’s intent and clearly executed interpretation of the …

Using Artificial Intelligence To Adjust Entity Risk Scores Based On Rule Activity, Pramod Joisha, Timothy Peacock

Defensive Publications Series

An entity risk score can be determined based on how an entity interacts with an organization’s computing resources. The entity risk score can be adjusted based on a rule hit score (RHS), which determines how many rules are triggered by the entity’s interactions with the organization’s computing resources. A value of the RHS can be determined using a bipartite graph that includes information for a certain time interval. The RHS value, and how the RHS value change over time, can be used to alter the entity risk score.
