Understanding Music Copyright Through Legal Analysis And Music Theory, Gillian Radcliffe Nov 2024

Understanding Music Copyright Through Legal Analysis And Music Theory, Gillian Radcliffe

Master of Studies in Law Research Papers Repository

This paper focuses on the intersection of law and music. Specifically, the intersection between music copyright law and music theory, and the role of musicologists and music theorists in copyright infringement cases. In particular, the influence they have on court decisions when acting as expert witnesses, or forensic musicologists. Recent decisions regarding copyright infringement in popular music have been strongly influenced by testimony from these forensic musicologists due to the imbalance of musical understanding between the expert and the court.

Forensic musicology is a form of “public music theory,” an approach used by academics in the music theory field when …

Making A Case For Legal Health Advocacy: A Socio-Legal Exploration Of The Law As A Tool For Physician Health Advocacy, Jeanne L. Webber

Master of Studies in Law Research Papers Repository

This paper grapples with the question of whether physicians have a unique moral, ethical or professional responsibility to engage in health advocacy. If so, what are the sources of that obligation, and how is advocacy understood in this context? These questions are addressed through a critical examination of the bio-medical, ethical, and legal literature and medical professional practice standards.

This research explores emergent themes in the literature including how advocacy is conceptualized, the challenges inherent in defining the term, and the consequent difficulty teaching health advocacy in medical education. This paper also examines how the value of advocacy is represented …

Oppositional Communities As Locations Of Grace: Karl Rahner And Postcolonial Theories In Dialogue, Michael J. Liberatore Nov 2024

Oppositional Communities As Locations Of Grace: Karl Rahner And Postcolonial Theories In Dialogue, Michael J. Liberatore

Budhi: A Journal of Ideas and Culture

Discussions amongst theologians about the relationship between faith and culture often operate from an impoverished and presumptive understanding of culture rooted in European modernity, and complicit in the history of colonization and exploitation that emanates from it. Postcolonial theorists interrogate the meaning of culture and its varied manifestations and reveal how power has been used to frame and define cultures with an aim towards coercive manipulation. These critiques create space for oppositional communities to coalesce and resist identity co-optation and oppression. However, the tendency amongst postcolonial theorists toward deconstruction without positing a reconstructed alternative rooted in subjectivity, creates a challenge …

Jose Rizal And The Birth Of The Social Sciences In The Philippines, Resil B. Mojares Nov 2024

Jose Rizal And The Birth Of The Social Sciences In The Philippines, Resil B. Mojares

Budhi: A Journal of Ideas and Culture

The paper narrates jose Rizal’s sojourn in Berlin in 1887 as a defining moment in the emergence of the social sciences as a Filipino discipline. it situates this moment in a much wider history, in which such factors as the expansion of the economy, civil bureaucracy, education, and nationalism gave rise to the first Filipino writings in such fields as history, anthropology, sociology, economics, and political science. in recalling Rizal and his time, the paper argues that there is a longer history of the disciplines in the Philippines than is usually acknowledged.

Buddha-Nature And Personality As The Ground Of Ethics: A Metaethical Dialogue Between DōGen And Berdyaev, Anton Luis Sevilla Nov 2024

Buddha-Nature And Personality As The Ground Of Ethics: A Metaethical Dialogue Between DōGen And Berdyaev, Anton Luis Sevilla

Budhi: A Journal of Ideas and Culture

This paper seeks to contribute to the ongoing Buddhist-Christian dialogue by bringing together the teachings of Zen Master Dōgen and the Russian Christian philosopher Nikolai Berdyaev. This dialogue discusses a metaethical question: What is the foundation of ethical practice? I aim to show that Dōgen’s idea of “buddha-nature” and Berdyaev’s idea of “personality” can be understood as the foundations of ethical practice in ways that are similar and mutually clarifying in their total affirmation of human temporal existence. We begin by discussing the general contours of Dōgen’s practice-realization and Berdyaev’s creative ethics, and then proceed to a comparative examination of …

Rizal And Science: A Struggle For Faith, Reason, And Knowledge, Michael L. Tan Nov 2024

Rizal And Science: A Struggle For Faith, Reason, And Knowledge, Michael L. Tan

Budhi: A Journal of Ideas and Culture

Much of what has been written about Jose Rizal focuses on his political thinking, with side references to his numerous accomplishments in the arts and letters, in science, technology, and medicine. in this essay, i choose to focus on Rizal the scientist, both in the sense of someone searching for knowledge as well as someone employing scientific methods to the study of society. i use Rizal’s writings, including correspondence with family and friends and a former Jesuit mentor, Father Pablo Pastells; his “letter to the Women of Malolos”; his essay “indolence of the Filipinos”; and his novel Noli Me Tangere …
